Public Works Director Mike Koch is recommending that the May 7th public hearing
related to the Residential Parking Permit District for Senior High School include an
option that was not originally part of the petitions. Under this option, Auburn Street and
Green Street would not be considered for inclusion in a parking permit district because
they do not meet the 80% parking rate requirement. The district would then potentially
include Grandview (between Avoca and Auburn), Algona (between Grandview and
Dexter), and Rosedale (from Avoca to the St. Anthony's property). Acknowledging that
Avoca Street is currently experiencing some level of parking problems, that would also
be included in consideration for the parking permit district.
He further recommends that the parking restriction only apply between the hours of 7:00
a.m. and 2:30 p.m., except Saturdays, Sundays and holidays. These time periods are
less restrictive than the current parking district that exist around Senior, as well as what
was requested in the petitions. However, it appears that the petitioners would agree to
this modification.
These changes would not be an amendment to the existing parking district, but would
require the creation of a new parking district because the restrictions would be different
that the existing District C.

BACKGROUND
The first RPPD in the Senior High School area was approved in 1995. In
order to mitigate the loss of the curbside parking, other parking restrictions
were removed from parts of Grandview and West Locust adjacent to the
Senior High School property. These changes actually more than offset the
number of spaces that were lost to the RPPD.
On January 18, 2001, City staff met with several representatives of the
school district in regard to the three petitions. They are concurrently looking
for remedies to offset the loss of these curb spaces from the adjacent City
streets; however, vacant property is lacking for the construction of additional
parking lots at Senior, nor are there budgeted funds available at this time for
this purpose.
DISCUSSION
Since the first two petitions were received, residents in an adjacent area also
filed a third petition. The first petition included the two properties on the
south side of Grandview Avenue east of Avoea Street. The second petition
included properties on both sides of Rosedale Street west of Avoca to the
St. Anthony's School property. These petitioners asked to be added to the
existing Parking Permit District C that was established on February 6, 1995.
The third petition includes the remainder of the south side of Grandview from
Avoca to Auburn Street; Auburn Street from Grandview to Dexter Street;
Algona Street, from Grandview to Dexter Street; Green Street, from Algona
to Avoca; and Avoca from Green to Rosedale. (See Exhibit A.)
During our meeting with school representatives, it was pointed out that the
original two petitions, if added to the existing District C would restrict
parking between the hours of 7:30 a.m. and 10 p.m. daily except Sunday
and holidays. The School then asked if the time restriction for the new
petitions could be modified· City staff has since spoken the original
petitioners, who indicated that they would be in agreement of a less
restrictive time period. The third petition asked for a restriction between the
hours of 7 a.m. and 2 p.m. daily except Saturdays, Sundays, and holidays·
This time period is also agreeable to the first two sets of petitioners. If all
parties would agree, all three petitions would be combined into one separate
Residential Parking Permit District E.
Each of the petitions contained sufficient signatures representing at least 60
percent of the residents of the dwelling units in the proposed areas. Having
met this requirement, City staff, as is required by City ordinance, conducted
a parking study of the areas as identified in the petitions. Taken as a whole,
the entire district would not meet the requirement that "at least 80 percent
of the curbside parking spaces in the proposed parking permit district were
utilized during peak periods"· However, if taken in blocks, certain areas
would meet or exceed the requirement.
The sections of Grandview between Avoca and Auburn, Algona between
Grandview and Dexter, and Rosedale from Avoca to the St. Anthony's
property all meet the requirements. Auburn, Green, and Avoca Streets did
not meet the minimum utilization requirements. (See Exhibit B.) Senior High
School students already use to some extent Avoca from Rosedale to Green
for parking.
Some of the options to consider are as follows:
If the three petitions are treated as one, they do not meet the required
80 percent (80%) vehicle usage; and, therefore, the petition should be
denied.
The second alternative would be to approve the first and second
petitions, to include Rosedale, and a small portion of North Grandview.
This should not have a significant impact on Senior High School
because these areas already have two-hour maximum parking, which
should not currently be used by students at Senior High School
because of this two-hour restriction. (See Exhibit C.)
3. If, however, the streets included in the petition which meet the
parking criteria are treated separately, North Grandview, Algona, and
Rosedale meet the 80 percent (80%) requirement, and could be
included in the RPPD. (See Exhibit D.)
4. Another option, while not petitioned for, would be to include Avoca
Street to Option 3, realizing that more Senior High students would
move onto Avoca Street if Option Number 3 would be selected. (See
Exhibit E.)
RECOMMENDATION
I would recommend Option 4, since it includes those streets that meet the
80 percent (80%) parking rate, denies those streets that do not meet the
requirements, yet includes Avoca Street, which is currently experiencing
some level of parking problem from the Senior students.
I would also recommend that all three petitions prohibit parking between the
hours of 7 a.m. and 2:30 p.m. daily except Saturdays, Sundays, and
holidays. These time periods are less restrictive than the current RPPD
district around Senior, as well as the first and second petitions. All of the
petitioners, however, agree with these time restrictions. A new parking
district would need to be created since the time restrictions vary from the
existing District C.
ACTION TO BE TAKEN
I would recommend that the Council consider the various alternatives and
provide input to staff for the preparation of an ordinance and a public hearing
on May 7.

INTRODUCTION
This is in response to two petitions to remove a Two-Hour Parking Time Zone and to
amend the existing Residential Parking-Permit District (RPPD) in the Senior High School
area.
BACKGROUND
In October, 1985, the City Council adopted an ordinance allowing the designation of
certain streets as Residential Parking Permit Districts. The purpose of such a district
was to reduce traffic congestion resulting from the use of parking within residential
districts by persons not residing within the district, to protect the residents of these
districts from an unreasonable burden in gaining access to their residences, to preserve
the character of such districts as residential districts, and other various purposes. The
ordinance provides for such a designation only after a petition of residents representing
60 percent (60%) of the dwelling units in the proposed area is received, a parking
study is conducted by the City Engineering Division and a public hearing is held by the
City Council.
To be eligible for such a district, there must be at least 80 percent (80%) of the
curbside parking utilized during peak periods, and must have at least 25 percent (25%)
of such utilization by non-residents of the area. Under such a designation, no one can
park curbside within the district during the restricted hours without a residential or
guest parking permit issued by the City.
DISCUSSION
On July 7, 2000, a petition containing sufficient signatures was received from
residents on the south'side of Grandview Avenue east of Avoca Street requesting that
· this area be included in the existing adjacent Residential Parking Permit District C. This
area is currently designated as a Two-Hour Parking Time Zone. The residents would
like the Two-Hour F~arking Time Zone removed, but believe that if that were done, the
students would totally be utilizing these spaces during school hours. Therefore, they
are requesting the RPPD designation where the Two-HoUr Parking Time Zone currently
exists.
A Two-Hour Parking restriction also extends immediately west on the south side of
Rosedale from Avoca Street to the alley east of St. Ambrose Street. When the July 7
petition was received, Engineering contacted a resident of this section of Rosedale to
see if there would be any interest among the neighbors to extend the RPPD further and
to repeal the Two-Hour Parking Time Zone for this area as well. It should be noted
that currently there are no parking restrictions on the north side of Rosedale between
Avoca and the St. Anthony's School property.
In response to the City's inquiry, a petition containing sufficient signatures has since
been received from residents representing 60 percent (60%) of the dwelling units on
both sides of Rosedale Street from Avoca Street to the alley west of Avoca. Copies of
both petitions are attached.
Although the current Ordinance requires that staff conduct a parking study to
determine parking usage in the affecte~l area, this was not possible due to the existing
Two-Hour Parking Zone, It is clear that should the Two-Hour Parking Time Zone be
removed that parking would relocate to this area and the 80 percent (80%) parking
usage criteria would subsequently be met.
RECOMMENDATION
I would recommend approval of the petitions, and would recommend that the south
side of North Grandview Avenue from the east property line of 1961 North Grandview
to Avoca Street and the south side of Rosedale Street from Avoca Street to the alley
east of St. Ambrose Street be removed from the ordinance for Two-Hour Time Zones.
In addition, I would recommend that the following areas be included in the existing
Residential Parking Permit District C: the south side of North Grandview Avenue from
Avoca Street to the east property line of 1961 North Grandview Avenue; the south
side of Rosedale Street from Avoca Street to the alley east of St. Ambrose Street; and
the north side of Rosedale Street from Avoca Street to the west property line of 2095
Rosedale Street. The district parking regulations would be from 7:30 a.m. to 10 p.m.
daily, except Sundays and holidays.
I would further recommend that the City Council set a public hearing on the
designation of portions of North Grandview Avenue and Rosedale Street as a
Residential Parking Permit District between, the hours of 7:30 a.m. and 10:00 p.m.
daily, except Sundays and holidays. After the public hearing, the City Council may
reject the petition, adopt an ordinance designating the proposed area as a Residential
Parking Permit District, or adopt an ordinance modifying the proposed district. The
City Council may also adopt alternate hours other than 7:30 a.m. to 10:00 p.m.
parking restriction.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution setting a public hearing
on December 4 on the proposed Residential Parking Permit District on portions of
North Grandview Avenue and Rosedale Street.

Whereas, the City of Dubuque, pursuant to Section 32-383 of the Code of
Ordinances, has received a petition containing sufficient signatures that an area described
as follows be included in Residential Parking Permit District "C":
North Grandview Avenue, south side, from Avoca Street to the east property line of

Whereas, Section 32-381 through 32-393 of the Code of Ordinances of the City of
Dubuque, Iowa, empower the City Council to establish a Residential Parking Permit District
upon receipt of a valid petition and finding of certain conditions; and
Whereas, a valid petition has been received to amend Residential Parking Permit
District "C" consisting of the south side of North Grandview Avenue, from Avoca Street to
the east property line of 1961 North Grandview Avenue; the south side of Rosedale, from
Avoca Street to the alley east of St. Ambrose Street; and the north side of Rosedale Street,
from Avoca Street to the west property line of 2095 Rosedale Street.
Whereas, the City Manager has (~aused a parking study of the above identified area
to be conducted, and which study has established that the area meets the criteria
established in Section 32-383 of the Code of Ordinances of the City of Dubuque, Iowa; and
Whereas, the City Manager, based upon the petition and the result of the parking
study, recommends to-the City Council that the area be designated as a Residential
Parking Permit District during the hours of 7:30 a.m. to 10:00 p.m. daily, except Sundays
and holidays; and
Whereas, the City Council pursuant to public notice published on the

the intent and purposes of Section 32-381 through 32-393 of the Code of Ordinances of

Residential Parking Permit District during the hours of 7:30 a.m. to 10:00 p.m. daily, except

Section 3. That-the recommendation of the City Manager based upon the petition

the hours of 7:30 a.m. to 10:00 p.m. daily, except Sundays and holidays, is hereby
approved and accepted.

Section 5. That the Code of Ordinances of the City of Dubuque, Iowa, be amended
by adding North Grandview Avenue, Clarke Drive, Sunnyview Drive, Ungs Street, Hoyt
Street; and Rosedale Street to Subsection (a) of Section 32-395 thereof as follows:
"Sec. 32-395. Residential Parkinq Permit District "C".
(a)
The following described area constitutes a Residential Parking Permit District
designated as Residential Parking Permit District "C":
North Grandview Avenue, west side, from Rosedale Street to the nor[h
property line of 2165 North Grandview Avenue, east side, from Clarke Drive
to the north property line of 2280 North Grandview Avenue, south side, from
Avoca Street to the east property line of 1961 North Grandview Avenue;
Clarke Drive from the east property line of 1687 Clarke Drive to St. Ambrose
Street; Sunnyview Drive, from North Grandview Avenue to St. Ambrose
Street; Ungs Street, south side; Hoyt' Street; Rosedale Street, south side,
from Avoca Street to the alley east of St. Ambrose Street; and Rosedale
Street, north side, from Avoca Street to the west property line of 2095
Rosedale Street.
Section 6. That the City Clerk is hereby directed to mail to every dwelling unit within
the designated district the documents prescribed by Section 32-385 of the Code of
Ordinances of the City of Dubuque, Iowa.
