The application, staff report and related materials are attached for your review. Discussion The applicanYs attorney, Davin Curtiss, spoke in favor of the request, reviewing the mix of uses in the neighborhood, and that the area to be rezoned is only the existing storage garages. He explained the property has a 10-unit residential building on it, and is located across from Conlon Construction, a dental office, and Glenview Motel on Rockdale Road. He said the rezoning entails a small portion of 1091 Rockdale Road. He referred to a map and explained that only a portion around an existing garage will be rezoned to C-3. He said the intent will be to allow the detached garages to be rented out for storage. He said the remaining property will not change and would continue to be operated as a 10-unit residential property. Staff reviewed the staff report, surrounding zoning and land use and previous use of the site. Staff reviewed the site plan review process, noting that the applicant was informed of the restriction that storage garages were only available to tenants. Staff reviewed the allowed uses in the C-3 District and area proposed to be rezoned. i There were several public comments from neighbors regarding concerns that the i change in zoning will have a negative impact on property values, is not consistent with I surrounding zoning and development pattern, and opposition to non-residents using the garages for storage. The Zoning Advisory Commission discussed the request, reviewing C-3 uses and limited nature of requested area to be rezoned. Commissioners felt that it represents a I spot zone when the majority of the area is zoned for residential use. Planning staff believe the structure was originally built as a road side motel when Rockdale Road was part of the route for U.S. Highway 61. Physical Characteristics: The subject property has frontage on Rockdale Road and generally drains to the southeast. Future Land Use Map: Multi-family. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Traffic Patterns/Counts: Based on 2013 IDOT counts, Rockdale Road carries 4,900 average daily trips. Public Services: Existing public services are adequate to serve the property. Environment: Staff does not anticipate any adverse impact to the environment as the structure is already built. The rezoning of the parcel to C-3 to allow self-storage units should have little impact on adjacent properties. CIP Investments: None proposed. Staff Analysis: The applicant is requesting to rezone a portion of the parcel at 1091 I Rockdale Road from R-4 Multi-Family Residential District to C-3 General Commercial ', District. The applicant is seeking only the rezoning of the existing storage buildings i behind his existing apartment building at the same address. ' The applicant constructed the new storage buildings in 2017 for the purpose of providing storage space for tenants of the adjacent apartment building. City staff was alerted to the fact that the units were being used for storage by people other than the tenants of the apartment building which is not an allowed accessory use to the apartment building, and contacted the property owner. The property owner is requesting the C-3 General Commercial District be applied only to the storage buildings to allow the renting out the units to the general public. As part of the site plan review process prior to construction of these units, a site plan approval letter was issued and signed by the property owner, and as part of that, the regulation was included in the approval letter that the individual garage units were restricted to personal storage by tenants of the apartment units at 1091 Rockdale Road. Planning staff has attached to this staff report a copy of the C-3 District regulations that includes a list of allowed uses and setbacks. Planning staff recommends the Zoning Advisory Commission review the criteria established in Section 9-5 of the Unified Development Code regarding property reclassification applications. I however, would like to express my concern about having this property zoned C-3. Christopher Lange knew he did not have the proper zoning to build a storage unit to lease out, yet he still went ahead and built it anyway, leased out the unit(s) and now because he got caught wants to get the proper zoning. I am sure this may happen more often than I am aware of, but to me, he knew what he built was not zoned correctly and tried to get away with it. I do not think this is how we should be running our city. Also, he never got a fine or penalty but as a tax payer, the City had to send someone out to inspect after getting a complaint and again Christopher Lange paid none of that expense. Also, on Sunday, April 29th, I had a lady come to my door and tell me she wanted to talk about the zoning on this property. I told her I already called the City and found out Christopher knew before he built the units they could not be leased out and he built it any way. She said I was wrong and was given the wrong information,, she was very rude and said, Christopher is only trying to get it re -zoned so his brother can store one car there. I doubt this is the case. currently rent a storage unit in Dubuque and I find there is a lot of garbage and things left behind, not by me but other renters. My property is behind these units and I do not need to have garbage blowing into my backyard as I take great pride in my home and property. I am against this being re- zoned. And if it is re -zoned, maybe having a fence put up to block things from blowing into my yard. Also, he could put anything commercial on this property if it is re -zoned and that concerns me and the affect that could have on my property value. Today he may say it is for these storage units but who is to stop him for adding something else. 1 Thank you for your time, and please vote no as the zoning committee did to re -zone the area he is looking to re -zone.
