Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing that Lot 1 included their
townhouses and Lot 2 includes a retaining wall that will be dedicated to the
homeowners' association for maintenance.
Staff reviewed the staff report, noting that the Zoning Advisory Commission is reviewing
the lot split as it does not have any frontage. Staff noted that Lot 2 is labeled non-
buildable, includes the retaining wall, and will be deeded to the homeowners'
association for maintenance.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it to be appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Plat of Survey of Lot 1 and Lot 2 of Cedar Lake — East Thirteenth Addition,
subject to waiving the lot frontage requirement for Lot 2. j
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Lot 1 and Lot 2 of Cedar Lake — East Thirteenth
Addition subdivides 13,828 square feet of property to facilitate the transfer of Lot 2 to
the homeowners' association for Cedar Lake Subdivision.
DISCUSSION
The submitted Plat of Survey splits off a portion of an existing lot in Cedar Lake
Subdivision to facilitate its transfer to the homeowners' association. The property is
labeled as non-buildable and is located at the end of North Cedar Court. The property
consists of a retaining wall that supports adjacent property within the Cedar Lake
Subdivision.
North Cedar Court is a private street within the Cedar Lake Subdivision and is privately
maintained by the homeowners' association. The proposed lot split will not adversely
impact the access to the adjacent parcel or any of the surrounding parcels, and will not
negatively impact surrounding properties.
RECOMMENDATION
Planning staff recommends that the submitted Plat of Survey of Lot 1 and Lot 2 of
Cedar Lake — East Thirteenth Addition be approved subject to waiving the lot frontage
requirement for Lot 2.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 AND LOT 2 OF
CEDAR LAKE -EAST THIRTEENTH ADDITION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of SuNey of Lot 1 and Lot 2 of
Cedar Lake -East Thirteenth Addition in the City of Dubuque, Iowa; and
Whereas, said Plat of SuNey provides 0 feet of frontage for Lot 2 on a public or
approved private street, where street frontage is required by Sec;;tion 11-14 of Title 16 of
the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of SuNey has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Plat of SuNey has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 2.
Section 2. That the Plat of Survey of Lot 1 and Lot 2 of Cedar Lake -East Thirteenth
Addition is hereby approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey.
