E. Landlord To Let Clean Units: No landlord shall permit occupancy of any vacant dwelling unit or
rooming unit unless it is substantially clean, sanitary and ft for human occupancy.
F. Common Areas Maintenance: Every landlord of a dwelling containing two (2) or more dwelling uniL
or more than one (1) rooming unit shall be responsible for maintaining, in a safe and sanitary
condition, the shared public areas of the dwelling and premises thereof, unless there is a written
agreement between the landlord and occupant to the contrary.

rooming unit to exceed the number of persons allowed under this and other applicable codes,
including the Building and Fire Codes.

/10-2F-13: OCCUPANT RESPONSIBILITIES FOR MAINTENANCE AND OCCUPANCY
OF RENTAL DWELLING UNITS:
A. Occupant Responsible For Sanitary Condition: Every occupant of a rental dwelling unit shall
maintain the dwelling unit or rooming unit in a clean, safe and sanitary condition.
/ 1. Every floor and floor covering shall be kept substantially clean and sanitary.
2. Every wall and ceiling shall be kept substantially dean and free of dirt or greasy film.
3. No dwelling or the premises thereof shall be used substantially for the storage or handling of
garbage.
4. No dwelling or the premises thereof shall be used for the storage or handling of dangerous or
hazardous materials beyond typical household use.
5. No occupant of a rental dwelling unit shall deliberately or negligently destroy, deface, damage,
impair or remove any part or portion of the premises or knowingly permit any other occupant or
person to do so without consent of the landlord.
B. Supplied Facilities; Smoke Detection: The landlord shall have installed 'batteries for all required
smoke detectors at the time a new occupant moves into a dwelling unit. Subsequent replacement
of batteries required to operate smoke detection equipment shall be the responsibility of occupant •
unless otherwise arranged or agreed upon by the respective occupant and landlord. Occupants of
a rental dwelling unit shall notify the landlord if they become aware that the smoke detection
equipment is not operating properly_ Occupants shall not cause a smoke detector to be removed.

2. If the complaint is not remedied to the tenants satiefeetton within seven (7) business days, the

complaint is founded, the Code official shall schedule an inspection. lf the owner or landlord
refuses entry, the Code official may seek a warrant as stated in subsection B of this section.
3, if violations are found, the owner or landlord shall have fifteen (15) calendar days to remedy the
violations. A fee equal to the cost of a second or subsequent reinspection shall be charged to
the owner or landlord and paid no more than thirty (30) days after the inspection; however, if
further reinspections are needed to ensure compliance, the requisite fee shall be paid prior to
any reinspections.
4. The owner or landlord shall not pursue an action for eviction, nor shall the owner or landlord
cause any service, facility, equipment or utility required by this Code to be removed, shut off, or
discontinued because of, or in retaliation for, filing a complaint under this subsection.

J. Notice Of Violations: Whenever the Code official determines that a violation of the Housing Code
exists, the Code official shall inform the owner or landlord of the violation(s).
1. Right To Appeal: The Code official 5hal} notify the owner or landlord of their right to appeal, and
shall provide an appeal application form upon request.
2. Staying Of Order Under Appeal: Except for emergency orders to vacate made according to the
requirements of this Code, enforcement of any notice and order of the Code official shall be
placed on hold until a determination-is-neaele by the Housing Advisory and Appeals Board.

K. Placarding Procedures For Unfit Properties Or Rental Dwellings Without Rental Dwelling Permit:
\ny dwelling, dwelling unit or rooming unit which is found to be so damaged, decayed, dilapidated,
unsanitary, unsafe or vermin infested that it creates a serious hazard to the health or safety of the
occupants or of the public, or is a rental dwelling unit that has not been issued a rental dwelling
permit shall be determined to be unfit for human habitation and shall be so designated and
placarded
1. Placarded Dwellings To Be Vacated: Any dwelling, dwelling unit, rooming unit or any portion
thereof, placarded in accordance with this article by the Code official, shall be vacated
immediately or as ordered by the Code official,
