Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report, and related materials are attached for your
review.
Discussion
The applicant, Dan Kennedy of the Dubuque Sports Enterprises, LLC, spoke in favor of
the request. He said that he would like to split his property in an effort to facilitate the
sale of the Dubuque Sports Complex. He said he would also like to remove the wooded
area that would not be part of the sale.
Staff reviewed the staff report, noting that the subject property is the Dubuque Sports
Complex, which is located in the county at the end of Nightengale Lane. He said that
the applicant would like to consolidate three lots into two lots. He noted that Lot 1 does
not have frontage on a platted or private street and the majority of lot is Iocated in the
floodplain. He said Lot 2 would contain the ball fields, buildings and parking lot. He
explained the Commission is reviewing the plat because Lot 1 does not have street
frontage.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving lot frontage requirement for Lot 1 Dubuque
Sports Complex.

INTRODUCTION
The submitted Final Plat of Dubuque Sports Complex resubdivides 36.12 acres from %
three lots to two lots. The property is located in Dubuque County at the end Nightingale
Lane, and is commonly referred to as the Dubuque Sports Complex. The submitted
Final Plat is being jointly reviewed by both the City and County of Dubuque as it is
within two miles of the city of Dubuque corporate limits.
DISCUSSION
The submitted Final Plat of Dubuque Sports Complex resubdivides the existing three
parcels into two lots to facilitate a future sale of the property. The property is located at
the end of Nightingale Lane, which is a private roadway that has an existing 100-foot
wide driveway easement. The submitted Final Plat plats a 66-foot wide access
easement through Lot 2 to serve Lot 1.
The majority of both Lot 1 and Lot 2 of the submitted plat lie within the 100-year flood
plain of the South Fork of the Catfish Creek. A substantial portion of the property lies
within the floodway of the South Fork of the Catfish Creek, which will significantly impact
the ability to further develop the parcel.
Staff has no objection to the submitted Final Plat and waiving the lot frontage
requirement for Lot 1 of the Dubuque Sports Complex.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the information
and provide a recommendation on the submitted Final Plat of the Dubuque Sports
Complex in Dubuque County, lowa.

The City Council will consider your request to plat property located at the Dubuque
Sports Complex at a public meeting on Monday, April 15, 2019, at 6:00 p.m. in the City

RESOLUTION NO. 136-19
A RESOLUTION APPROVING THE FINAL PLAT OF DUBUQUE SPORTS COMPLEX
IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk the Final Plat of Dubuque Sports
Complex in Dubuque County, Iowa; and
Whereas, said Final Plat provides 0 feet of frontage for Lot 1 on a public or approved
private street, where 50 feet of street frontage is required by Section 11-14 of Title 15 of
the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of lot frontage on a public or an
approved private street for Lot 1.
Section 2. That the Final Plat Final Plat of Dubuque Sports Complex is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the approval
of the City of Dubuque, Iowa upon said Final Plat.
