There is hereby created the Cable Television Commission. ;�
2-11-2: Purpose:
The purpose of the commission is: !
A. To develop, in respect to community programming and cable regulation, policies that '�,�

1. The use and protection of equipment and facilities; �
2. All training programs; .

5. The resolution of subscriber complaints which could not be resolved satisfactorily by

B. To develop policies and procedures regarding the public community programming I�
channels that will promote its nondiscriminatory, first come, first served and equitable use �
in conformity with all applicable regulations and requirements and limit such use to �j
residents of Dubuque and their own productions. �

C. To encourage interest in and development of decidedly local community programming. �

D. To encourage cooperation and cordial relations between community programmers, �
cable subscribers, and the local cable manager and the local cable manager's staff. '

E. To identify and support organizations interested in the channels reserved for public,
education, and government programming.

F. To advise the following: '
1. The city manager or the city manager's designee (collectively "the city manager") on �
matters relating to community programming and the regulation of the cable system; �
2. The city council on expenditure of any funds designated by a franchise for PEG �
equipment and facilities; and �
3. The city council on any matter relating to the cable franchise or system.

G. To promuigate and administer through the city manager all policies, rules, and
procedures relating to community programming.
H. To keep abreast of developments in cable technologies, services, and programming
and to become competent in cable regulation, finances, and standards of operation. ;�

I. To act through the city manager as the local regulatory agent of the cable franchise and ;�
to monitor the operation of the cable system. ;1
J. To consult with the local cable manager on the best updating of the cable system, j
services, and programming and to advise the city council on expending the updating �

K. To evaluate its own proceedings and actions and all community programming and '�

L. To provide any cable user in the city of Dubuque the opportunity to voice a complaint ';I
regarding the user's cable service. �I�

2-11-3: Internal Organization and Rules: '�i
The commission may adopt rules and regulations to govern its organizational procedures as i1
may be necessary and which are not in conflict with this Code of Ordinances or fihe lowa ;�
Code. ;

2-11-4: Procedures for Operation:
All administrative, personnel, accounting, budgetary, and procurement policies of the city '
govern the commission in all its operations. �;,

2-11-5: Membership: !I
A. The commission comprises seven (7) residents of the city, appointed by the city ;I�
council. '
i
B. Residents must be eighteen (18) years of age or older. �
�
C. Special Qualifications. In its appointments, the city council will endeavor to achieve a I�
broad representation of the community and public interests which can take advantage of
dedicated channels to benefit the residents of the City of Dubuque and to develop a
commission versed and competent in telecommunication administration, finances, and
regulation. The city council will attempt to give preference to applicants who are actively �,
interested in promoting community cable programming who possess, or are willing to
acquire, video production background, and who will relate to the spectrum of
informational and cultural needs of cable viewers of the City of Dubuque and applicants
who possess professional or experiential backgrounds in law, finances, administration,
public relations, or telecommunication technologies.
2-11-6: Oath:
Each person, upon appointment or reappointment to the commission, must execute an oath
of office at the first meeting of the commission following the appointment or reappointment or
at the city clerk's office any time prior to the first meeting of the commission.

2-11-7: Terms:
The term of office for commissioners is three (3) years or until such commissioner's
successor is appointed and qualified. �

2-11-8: Vacancies: �
Vacancies must be filled in the same manner as original appointments. ;,
2-11-9: Officers/Organization: � �
The commissioners must choose annually a chairperson and vice-chairperson, each to serve ''
a term of one (1) year. The chairperson must appoint a secretary, who need not be a member �,l
of the commission. The commissioners must fill a vacancy among its officers for the !{
remainder of the officer's unexpired term. ��

2-11-10: MEETINGS: � �
A. Regular Meetings. The commission must meet not less than once each quarter. i�',

B. Special Meetings. Special meetings may be called by the chairperson or at the written 'i
request of a majority of the commissioners.

C. Open Meetings. All meetings must be called and held in conformance with the lowa
Open Meetings Law. �
�
D. Attendance.
1. In the event a commissioner has been absent for three (3) or more consecutive '

meetings of the commission, without being excused by the chairperson, such absence ��'
will be grounds for the commission to recommend to the city council that the position
be declared vacant and a replacement appointed. I;

2. Attendance must be entered upon the minutes of all meetings. ;
E. Minutes. A copy of the minutes of all regular and special meetings of the commission i;
must be filed with the city council within ten (10) working days after each meeting, or by '

the next regularly scheduled city council meeting, whichever is later. ,I

F. Quorum. Four (4) commissioners constitute a quorum for the transaction of business. �
. The affirmative vote of a majority of the commissioners present and voting is necessary �
for the adoption of any motion or resolution. `
2-11-11: Compensation: - ;
Commissioners serve without compensation, provided that they may receive reimbursement
for necessary travel and other expenses while on official commission business within the
limits established in the city administrative policies and budget. �
2-11-12: Removal: �
Except as provided in 2-11-10(D)(1), the city council may remove any commissioner for good °
cause. �

2-11-13: Powers: �
The commission has the following powers, duties, and responsibilities:
A. To assure that cable channels, equipment, and resources dedicated and reserved for ,J
community programming are used effectively, efficiently, and economically to afford the
community and individuals of the City of Dubuque the opportunity to express opinions 1
and provide information to cable users, and that such programming is characterized by �
appropriateness, quality, and continuity; and '

B. To assure full compliance with any franchises authorizing cable or video service in the '
City of Dubuque, that the franchises be interpreted and applied to the benefit of the City
and its residents, that quality and updated services be delivered throughout the City, and ��
that the public interest be protected in all matters related to the cable services delivery I

2-5C-1: COMMISSION CREATED; COMPOSITION:
A. Creation: There is hereby created a community development advisory commission
whose primary purpose shall be to provide for citizen participation in the
development and evaluation of the city of Dubuque's community development block '
grant (CDBG) program.
B. Membership: The commission shall comprise nine (9) members; four (4) members
shall be residents of census tracts and block groups where at least fifty one percent
(51%) of the residents are low/moderate income persons as determined by the '�;
United States department of commerce, bureau of the census; four (4) members ;
shall be residents of the community at Iarge; and one memb�r shall be that member
of the housing corr�mission designated by the housing commission. (2007 Code .�
§ 15-46)
2-5C-2: TERM; FILLING OF VACANCIES; COIViPENSATION:

A: Term: The term of office for a commissian member shall be three (3) years. !�

B. Removal Of Memk�er� A commission member may be removed a# any time with or �i
without cause by a vote of two-thirds (2/3) of all members of the city council.
�
C. Filling Vacancies: A vacancy occurring on the commission caused by resignation or �
otherwise shall be filled by appointment of the city council for the remairader of the �
unexpired term.
�
D. Compensation: Members of th� commission shall serve without cornpensation ?
except for actual expenses, which shall be subject to approval by th� �it�r �aunciL �

2-5C-3: ORCANIZATION:
The commission shaBl choo�e annually, at its firsfi regular meeting of the fiscal year, one
of its rnembers to ac�t as chairperson, and another of its members to act as vice
chairperson, to perform all of the duties of the chairpersan during the chairperson's
absence or disability. The commission shall adopt such rules and regulatior�s governing
its,Urganization and proce�ures as it may be deemed necessary, consistent with the
following:
A. Meetings: The commis5ion shall meet as necessary to fulfill the purposes for which �
the commission �✓as created.
B. /�tt�ndar�ce Of Merreb�rs: Members of the commission shall attend at least two-�hirds
(2/3) ofi�II regularly scheduled meetings within any consecutive twelve (12) month
period. If�ny mer��ber fails to attend such prescribed number of ineetings, such

failure shall constitute grounds for the commission to recommend to the city council �
that said member be replaced. Attendance of all members shall be entered in the �
minutes. �
C. Minutes Filed With Clerk: The commission shall file with the city clerk a copy of the �
minutes of each regular and special meeting of the commission within ten (10) ;i

2-5C-4: GENERAL DUTIES AND RESPONSI�ILITIES: �I�

A. To conduct public hearings in accordance with the minimum standards established in ��
the CDBG program's citizen participation plan to ensure meaningful citizen input in �
the planning, implementation and assessment of the city's CDBG program; �
�. To rovide for and encoura e the artici ation of low and moderate income persons �

who reside in designated areas of slum and blight a,nd residents of lo�nr and ,
moderate income neighborhoods, as defined by the city council, in the planning, y
implementation and assessment of the CDBG program; �

C. To identify community development needs, particularly the needs of persons of low '�

D. To serve in an advisory role upon the request of the city council in policy decisions i,�
regarding funding priorities and program developmenfi and implementation; �

E. To monitor and evaluate program acfiivities to advise whether identified corr�munity '�
development objectives have been met; �

F. To undertake public information efforts to educate the citizenry of the availability of �
CDBG funded programs and to provide for a greater understanding of the city's �
community development efforts, �

G. To assist in the preparation of the statement of community development objectives
and projected us� of funds, amendments thereto and required reports including, but
not limited to, the annual grantee performance report (GPR) and the annual
comprehensive housing assistance strategy (CHAS);
H. To serve in an advisory role to the city manager in the review of complaints and
grievances received in accordance with the procedures established in section 2-5G
5 of this article; and
�
I. To support, upon request, the efforts of the city council and other city
commissions in the assessment of the general development needs of the
community. (2007 Code § 15-49)
2-5C-5: GRIEVANCE PI�OCEDURE; REVIEW STANDARDS; APPEAL PROCESS:
i�
The grievance procedure for the community development block grant program shall be ;�
as follows: �
A. Right To File: Any aggrieved person may file a grievance with the city manager.
�
I
B. Contents: Grievances shall contain a concise statement of the grievance and an
explanation of the action desired.
�
C. Forwarding To Commission: The city manager shall forward the grievance to the
commission within seven (7) working days of its receipt. �
D. Setting Date For Hearing; Notice To Complainant: The cornmission shall, within
fifteen (15) working days of the receipt of the grievance, set a time for a hearing. The
complainant shall be notified in writing of the time.and place of the hearing. !f a I,
grievance is resolved prior to the date of the hearing, the aggrieved party shall 'i,
request in writing that the grievance be withdrawn. 'I
E. Hearin Procedure: The ��
g commission shall conduct a hearing to revrew the grievance. �
The grievant rriay appear in person, by agent, or by attorney. All persons wishing to I�
appear b�fore the commission shall have an opportunity to be heard regarding the i�
grievance. Minutes shall be kept of the proceedings of the hearing. ,�

F. Recommendations Of Commission: The commission shall forward its ��
recommendation, in writing, to the city manager within ten (10) working days �
following the hearing. �
G. Action By City Manager: The city manager shall receive and review the j
recornmendation of the commission and shall respond to the grievant with.in ten (10) '�
working days of the receipt of the recommendation. The commission shall be ��
advised of the action of the city manager.
H. Compliance With Federal Regulations: The recommendations of the commission
shall comply with the regulations established by the U.S. department of housing and �
urban development for the community development block grant program under title I
of the housing and community development act of 1974, as amended, and this code.
I. Appeal To Council By Grievant: If the grievant is unsatisfied with the response of the
city manager, an appeal may be made filed with the city clerk. The appeal shall be
forwarded by the city clerk to the city council. The city council may, at its discretion,
hold a hearing to consider the concerns of the grievant.
J. Council Action; Appeal To HUD: Upon review of the appeal, the city council shall: 1)
accept the response of the city manager; 2) modify the response of the city
manager; or 3) return the grievance to the city manager for further review. If the
outcome of such appeal is unsatisfactory, the complainant may file a written appeal
with the U.S. department of housing and urban development (HUD). (2007 Code
§ 15-50)
2-5C-6: PROCEDURES FOR OPERATIONS:

people in our community who might not always feel like they
have a voice.
Describe your experience �As a team member at the Dubuque Rescue Mission, I am �
working in diverse knowledgeable about the issues and problems that the less
environments: fortunate in our community face every day, and I think this
would help me excel as part of the Commission. Many people
in our community struggle, in many ways: low paying jobs, the
lack of affordable housing, among other issues. With my
passion for helping people, I can help the Homeless Advisory
Commission thrive to make Dubuque an even better place to
live, work and play!
Describe your experience From my experience since 2012, I feel that people in our
engaging other community community WANT to make a difference, they want to make
members to gather their their voices heard, but they might now always know the best
input and opinions: way to be heard. I enjoy talking to citizens in our community, in
person, while also using social media to get input about
Dubuque. I can help citizens become engaged and involved,
and in the process, more people can make a positive impact!

Message: Thanks to the inspiring advice of Mayor Buol in August 2012, I served on the Human Rights Commission for 4 years. I am
now applying for a role with the Community Development Advisory Commission, because I feel like my involvement within the
community, especially the Dubuque Rescue Mission in the past 4 years, would bring a new perspective and possibly new ideas to the
commission.
I will be an active member to the commission. Even though I will be traveling this summer, Alexis Steger has informed me that I can
still participate in meetings via cell phone.
