The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting the current configuration of these lots makes
them all unsellable. The applicant explained that there are buildings that encroach over the
property line, and by reducing the lots from three to two, would remove the building
encroachments and make both lots sellable.
Staff reviewed the staff report, noting the location and that a substandard lot (Lot 2) would be
created. Staff stated that even though Lot 2 will have less frontage and lot area required by the
R-1 Single-Family Residential zoning district, both lots would be sellable, and since both lots are
already developed, it would not impact adjacent properties.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request, waiving the lot frontage and lot area requirements for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Maple Leaf Addition No. 4 re-subdivides two existing
parcels to address a long-standing building encroachment between the properties. The
parcels are located at 627 and 647 Louella Lane on the north side of Dubuque.
DISCUSSION
The Plat of Survey of Maple Leaf Addition No. 4 resubdivides three lots into two new
lots to address a long-standing building encroachment between the properties. The
submitted Plat of Survey is being reviewed by the Zoning Advisory Commission as Lot 2
of the Plat will not have the 50 feet of lot frontage and 5,000 square feet of lot area as
required in the R-1 Single-Family Residential zoning district.
The Plat of Survey includes the location of the existing two homes on the parcels and
places a new lot line between the parcels that provides a 7-foot side yard setback for
each building. The existing lot line is platted through the home at 627 Louella Lane. An
encroachment such as this over a property line makes it more difficult to sell either
property as many banks will be hesitant to issue a mortgage with such an
encroachment.
Planning staff does not object to the proposed new lot configuration, even though Lot 2
will have less frontage and lot area as required by the R-1 District, as it will actually
increase the value of each of the properties involved. The two homes have been
existing for many years and the change in the lot size and lot frontage will not impact
adjacent properties.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the information in
this memorandum and make a recommendation to approve the Plat of Survey Maple
Leaf Addition No. 4, waiving lot frontage and lot area for Lot 2 as shown on the
submitted Plat of Survey.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF MAPLE LEAF ADDITION NO.
4 IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of Maple Leaf
Addition No. 4 in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 28.17 feet of frontage and 3.275 square feet of
lot area for Lot 2 on a public or approved private street, where 50 feet of street frontage
and 5,000 square feet of lot area is required by Section 11-14 of Title 16 of the City of
Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 28.17 feet of frontage on a public street or
an approved private street, and 3,275 square feet of lot area for Lot 2.
Section 2. That the Plat of Survey of Maple Leaf Addition No. 4 is hereby approved, and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said Plat of Survey.
