Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting he would like to split the lot to facilitate
building of a residence.
Staff reviewed the staff report, noting that the proposed lot split is to facilitate the construction of
a single-family home on a family farm. The lot is located in the County and within two miles of
the city of Dubuque corporate limits. Staff noted that Lot 1 does not have frontage on a platted
or private street. Staff said the lot would be accessed by the existing 33-foot wide access and
utility easement.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request, waiving the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey subdivides off a one-acre parcel from an existing 40-acre
parcel to create an additional building lot. The property is located in Dubuque County
just north of John F. Kennedy Road on Schlitzer Lane. The submitted Plat of Survey is
being jointly reviewed by both the City and County of Dubuque as it is within two miles
of the city of Dubuque corporate limits.
DISCUSSION
The submitted Plat of Survey subdivides off a one-acre parcel within an existing 40-acre
parcel for an additional building lot. The Plat is being reviewed by the Zoning Advisory
Commission as the resulting Lot 1 does not have frontage on a public or private street.
Access to the property will be by way of an access and utility easement 33-foot wide
designated as Schlitzer Lane. By County standards, two lots can be served by an
access easement. Once a third lot is created, the access easement must be improved
to a 66-foot right-of-way easement for public access. The quarter section to the east is
owned by the same property owner, so the additional 33 feet necessary can be added
on either side of the existing Schlitzer Lane.
The submitted Plat of Survey is in all other respects in compliance with the City of
Dubuque's subdivision regulations contained in the Unified Development Code.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Plat
of Survey and recommend approval as submitted, waiving the lot frontage requirement
for Lot 1.

Whereas, there has been filed with the City Clerk a Plat of Survey Lot 1 in the Northeast
Quarter of the Northwest Quarter of Section 9, T89N, R2E of the 5th P.M., Dubuque
County, Iowa, located at 16766 Schlitzer Lane; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where 50 feet of street frontage is required by Section 11-14(B) in
accordance of Title 16 of the City of Dubuque Code of Ordinances; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 1.
Section 2. That the Plat of Survey Lot 1 in the Northeast Quarter of the Northwest
Quarter of Section 9, T89N, R2E of the 5th P.M., is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Plat of Survey.
