Van Milligen, City Ma�a t`jr �' �� FROM: Gus Psihoyos, City Engineer .,.,��.,, ��-.,_.._-_�;=:'� SUBJECT: South Fork of the Catfish Creek Sanitary Interceptor Sewer Stream Bank Emergency Repair Project Accept Public Improvement Contract DATE: May 14, 2019 INTRODUCTION The enclosed resolution provides for the acceptance of the public improvement construction contract for the emergency stream bank repairs to a segment of the South Fork of the Catfish Creek which was in close proximity to the existing South Fork of the Catfish Creek sanitary interceptor sewer. BACKGROUND The City was working on a project to repair and stabilize a segment of the stream bank along the South Fork of the Catfish Creek, located just upstream of the North Cascade bridge crossing. The segment of stream bank is approximately 300 feet in length and had experienced significant erosion and stream embankment loss over the past several years. The City has an existing 18-inch sanitary interceptor sewer that runs along the South Fork of the Catfish Creek. Stream bank erosion had gradually been encroaching towards the alignment of the sanitary interceptor sewer. In January 2019, the Engineering Department took drone aerial photos of the stream bank erosion location to assist with the development of repair and stabilization plans. In reviewing the aerial photos, the erosion and stream embankment loss had increased significantly and was now extremely close to the existing sanitary interceptor sewer. Due to the recent observed stream bank encroachment on the existing South Fork of the Catfish Creek near the City's sanitary interceptor sewer, emergency repairs were required to repair and stabilize this segment of the stream bank to prevent impacts to the sanitary interceptor sewer. On February 4, 2019, based on City staff recommendation, the City Council authorized per Resolution 40-19 that an emergency repair project be initiated pursuant to State of lowa Code, 384.103 Emergency Repairs, so that the necessary stream bank repair and stabilization could be made to protect the existing sanitary interceptor sewer. DISCUSSION The Catfish Creek Sanitary Interceptor Sewer - Stream Bank Emergency Repair Project was completed by Legacy Corporation of East Moline, IL, in the final contract amount of $80,774.17, which is a 19.6% decrease from the original contract amount of $100,485.00. Wher th� project was initially bid, it vvas anticipated that there would be sufFicient suitable fill material onsite that could be used to restore and stabilization the stream bank. However, upon starting the repair project, fhe onsite soiis were not suitable and thus the City was required to purchase embankment fill material from the nearby River City quarry at a cost of $9,255.24. The material purchase was a direct cost to the City and was not included in the contractor's contract. RECOMMENDATION I recommend that the City Council accept the public improvements and authorize the payment of the contract amount of $80,774.17 to Legacy Corporation of East Moline, IL, for the Catfish Creek Sanitary Interceptor Sewer - Stream Bank Emergency Repair Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Catfish Creek Stream Bank Repair - Steger Tjarks CIP appropriations for the contract amount of $80,774.17 less any retained percentage provided for therein as provided in Iowa Code. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $4,038.71 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
