City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Millwork District Parking Lot #2 Project, as completed by Drew Cook & Sons
Excavating, Co., Inc., in the final contract amount of$427,307.86, which is a 14°k
increase of the base bid amount of$375,885.50. The increase is due to additional
quantities as follows:
1) New conduit and related excavation for future smart meters and electric
vehicle charging station - $18,854.00
2) Unforeseen removal of old foundations and cisterns - $13,600.00
3) Additional curb and gutter, additional pavement removal and replacement,
and additional stone and brick required - $18,968.36.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Millwork District Parking Lot #2
INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for
Millwork District Parking Lot#2 Project.
BACKGROUND
In 2010, Gronen Properties, Wilmac Property Co and Warehouse Trust provided a letter
to the City requesting public development of 470 off-street parking spaces to assist with
attraction of commercial and residential tenants in the newly developed district. The 11t"
& Elm St surFace parking lot will bring the total number of City-owned parking spaces in
the Historic Millwork District to 509 spaces.
The City purchased the property, between 11t" and 12th streets and adjacent to Elm
Street from Stackis, LLC for $500,000. The City also issued two contracts for the
deconstruction of the existing structure for a total amount of$151,700.
DISCUSSION
The Millwork District Parking Lot #2 Project was completed by Drew Cook & Sons
Excavating, Co., Inc. in the final contract amount of $427,307.86. This is a 14%
increase of the base bid amount of$375,885.50. The increase is due to additional
quantities including:
1) New conduit and related excavation for future smart meters and electric vehicle
charging station. $18,854.00
2) Unforeseen removal of old foundations and cisterns. $13,600.00
3) Additional curb and gutter, additional pavement removal and replacement, and
additional stone and brick required. $18,968.36.
The FY18 Capital Improvement Budget included $828,376 to continue the development
of public parking within the Historic Millwork District. These funds were carried over into
the FY19 budget. The project constructed an 81 stall parking lot with concrete pavement
and permeable pavers. Improvements to the storm sewer, site lighting and conduit for
electricity and communications were also installed. Landscaping will be included in a
� future project and will be similar to that of the Intermodal facility landscaping.

RECOMMENDATION
The City Council is requested to adopt the attached resolution to accept the
improvements and to authorize the payment of the contract amount of $427,307.86 to
Drew Cook & Sons Excavating, Co., Inc. Millwork District Parking Lot #2 Project.

RESOLUTION NO. 183-19
ACCEPTING THE MILLWORK DISTRICT PARKING LOT #2 AND AUTHORIZING
THE FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Millwork District Parking Lot #2
(the Project) has been completed by the Contractor, Drew Cook & Sons Excavating,
Co., Inc. of Dubuque, IA (Contractor), and the City Engineer has examined the work and
signed a certificate stating that the Project has been completed according to the terms
of the Public Improvement Contract and that the City Engineer recommends that the
Project be accepted; and
WHEREAS, the final contract amount for the Project is $427,307.86;
WHEREAS, the Contractor has previously been paid $418,762.22, leaving a balance
of $8,545.64; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Millwork District Parking Improvements CIP appropriations for the contract amount of
$427,307.86 less any retained percentage provided for therein as provided in Iowa
Code.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $8,545.64 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
