The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
Phil Jensen, attorney representing Ace Construction, spoke in favor of the request, noting that
his client has cleaned up the property and is intending on constructing a contractor shop and
yard on the site.
Staff reviewed the staff report, noting the lot location, nearby utilities, and access issues. Staff
explained that the property is restricted in size and has limited access.
There was one public comment. A resident, who lives directly across the train tracks from the
subject property, had concerns about debris being burned, smoke, storm water drainage and
noise.
The Zoning Advisory Commission discussed easements and access to the lot, compared the
uses permitted in the C-2 and C-3 General Commercial zoning districts and screening
requirements for contractor shops.
Recommendation
By a vote of 4 to 3, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The property was originally subdivided circa 1930 as part of the
Hamm's Addition. Subsequently, housing was built on the adjacent properties and
realignment of the railroad in the 1960s severed the subject property from the original
subdivision leaving it remnant parcel. The property has been used for storage in the
past and is currently vacant.
Physical Characteristics: The subject property is a relatively level 5,000 square foot
triangle with 185 feet of adjacency along a platted but unimproved public alley and 195
feet of adjacency with the lowa Chicago and Eastern Railroad Corporation (ICE) right-
of-way on the south side of the lot. The property does not enjoy adjacency with a public
or private street and appears to take access across an abutting private lot, a platted but
unimproved alley and the ICE right-of-way.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
infill and mixed-use development and recommend buffering non-compatible uses from
each other. The City's 2030 Future Land Use Plan identifies this area as commercial.
Impact of Request on:
Utilities: City water is available along the north side of the subject property and City
sanitary sewer is available along the south side of the property.
Traffic Patterns/Counts: There are no traffic counts available for Hawthorne Street
where the subject lot takes access. �

Public Services: Existing public seroices are adequate to seroe the site.
Environment: Staff does not anticipate any adverse impact to the environment as
the lot is very restricted due to its shape. Any development of the lot will have to
comply with current City standards regarding erosion and storm water
management.
Adjacent Properties: Development of the subject property due to its size and ,
location should have little impact on the neighborhood. ',

Neighborhood Shopping Center district to C-3 General Commercial district to permit '
development of a contractor's shop. The subject property is a relatively level 5,000
square foot triangle with 185 feet of adjacency along a platted but unimproved public
alley and 195 feet of adjacency with the lowa Chicago and Eastern Railroad
Corporation (ICE) right-of-way on the south side of the lot. The property does not enjoy

The property is bordered by commercial and industrial zoning and by and mixed-use
development, including restaurants, contractors shop, single-family residential
development and railroad right-of-way. The lot is triangular and development of the
property due to its size and location should limit its impact on the surrounding
properties.
The C-2 district permits 20 relatively low-intensity commercial uses; whereas, the C-3
district permits 53 more high-intensity commercial uses such as bars, drive-in/carry-out
restaurants and vehicle service or repair that are not permitted by right in the C-2
district. Access to the site is problematic and any future development of the lot will have
to be reviewed by the City's Development Review Committee to insure compliant
access and all other appropriate codes and ordinances.

the Zoning Ordinance regarding granting a rezoning

AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF ORDINANCES,
UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER DESCRIBED
PROPERTY LOCATED AT 2325 GARFIELD AVENUE FROM C-2 NEIGHBORHOOD
SHOPPING CENTER DISTRICT TO C-3 GENERAL COMMERCIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter described
property from C-2 Neighborhood Shopping Center District to C-3 General Commercial
"District, to wit:
Northwest part of Lots 193, 194, 195 and 196 Hams Addition, and to the
centerline of the adjoining public right-of-way, all in the city of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
by law.
