The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report, and related materials are attached for your
review.
Discussion
James Steiner, Vice President of Finance and Auxiliary Services for the University of
Dubuque, spoke in favor of the request, noting that the Wellness Center will be for
students only and that it is for initial consultation. He discussed the need for a wellness
center that can assist students both mentally and physically.
Staff reviewed the staff report, noting that the University of Dubuque is asking to rezone
a property into and amend its Institutional District to accommodate the Wellness Center.
Staff explained the project location relative to existing campus buildings. Staff said that
the project would include the construction of an 11-stall parking lot with access on
Grace Street.
There was one public comment. A neighboring property owner had concerns with traffic
and screening of the property. In addition, two property owners in the vicinity submitted
letters. One letter stated concerns with reduction in the property tax base due to the
property being owned by a tax-exempted entity and the other letter noted concerns with
privacy, noise and stormwater drainage.
The Zoning Advisory Commission discussed the proposal and noted the proposed
parking lot was in a good location being away from the nearby residences and that the
Wellness Center would be a great addition to the University's campus.

Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request. �

would have a home look to it, including a front porch. An eleven (11) stall parking lot will be part of the �
plan and will be located on the West side, away from, and hidden from the neighbor to the East. !
WELCOME CENTER ADDITION TO MYERS BUILDING and SOUTH QUAD IMPROVEMENTS
The proposed project involves construction of an addition to the UD Myers Building that will be used for
a welcoming center, with class rooms, a student center and a small lecture hall. Other project
improvements will provide sidewalks and outdoor spaces for students between the Heritage Center and
the Myers Building. It will also be home to the new University of Dubuque bell tower. The project will
include redesign the Heritage Center outdoor patio in the southeast corner of the building.

SUBJECT: Rezone property at 1998 Grace Street from R-1 Single-Family Residential
to ID Institutional District and to amend the University of Dubuque's
Institutional District to allow a Student Wellness Clinic

INTRODUCTION
The University of Dubuque has submitted an application to rezone the property located
at 1998 Grace Street from R-1 Single-Family Residential to ID Institutional District. The
University of Dubuque is doing this to facilitate the construction of a new student
wellness clinic utilizing the properties at 1998 Grace Street and 2018 Grace Street. The
University of Dubuque owns both properties.
DISCUSSION
The Institutional District within the city of Dubuque is primarily applied to our local
colleges, seminaries, and hospitals. The Institutional District is a type of Planned Unit
Development that, because of the unique nature of these campuses, has specific
regulations guiding the continued growth and development of these institutions. There
are two reasons to amend an Institutional District. The first, the property is currently not
zoned for an Institutional District; and second, that a significant on-campus project is
proposed.
The current application for the Student Wellness Center encompasses both types of
requests. The University seeks to put a student wellness clinic at 1998 and 2018 Grace
Street. This property is located across the street from Severance Hall and Atchison
Hall.
The proposed student clinic will include the construction of a parking lot with access
directly to Grace Street. The project includes an 11-stall parking lot to be located on the
west side of the clinic, away from the neighboring property owner to the east.
Attached to this memo is a copy of the conceptual layout for the project, as well as
elevations of the proposed clinic building, and a Google street-level view of the existing
property.

Planning staff has reviewed the proposed project with other City Departments, and have
received no concerns regarding the proposed changes from the standpoint of serving it
with water and sewer services and fire protection. The proposed student wellness
clinic, if approved, will be required to go through the City's standard development review
process prior to the issuance of building permits.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the information in
this memorandum and the attached documents and make a recommendation to the City
Council on the requested rezoning to Institutional District of 1998 Grace Street, and an
amendment to the University of Dubuque Institutional District for the construction of a
student wellness clinic.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY PROVIDING FOR THE REZONING
OF PROPERTY AT 1998 GRACE STREET FROM R-1 SINGLE-FAMILY RESIDENTIAL
TO ID INSTITUTIONAL DISTRICT AND APPROVAL OF AN AMENDED CAMPUS
DEVELOPMENT PLAN FOR THE UNIVERSITY OF DUBUQUE TO ALLOW THE
CONSTRUCTION OF A STUDENT WELLNESS CLINIC
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, be amended by providing for the rezoning of property at 1998
Grace Street from R-1 Single -Family Residential to ID Institutional District and approval
of an amended campus development plan for the University of Dubuque ID Institutional
District, a copy of which is on file with the City of Dubuque Planning Services
Department.
Section 2. Institutional District Regulations.
A. Use Regulations
The following regulations shall apply to all uses made of land in the
above-described ID Institutional District:
1. Principal permitted uses shall be limited to:
a. Offices for administrative personnel or other institutional
employees and affiliates.
b. Churches, libraries, and museums.

c. Classrooms, laboratories, lecture halls, and similar places of
institutional assembly.
d. Off-street parking and loading.
e. Recreational or athletic facilities for the primary use and
benefit of institutional residents or affiliates.
f. Single-family, two-family or multi -family dwellings for the
housing of institutional residents or affiliates.
2. Accessory Uses. The following uses shall be permitted as
accessory uses in the above-described ID Institutional District.
a. Located entirely within a principal building, bookstores, or
bars seating not more than seventy-five (75) persons at one
time and located not closer than two hundred feet (200')
from the nearest Residential or Office Residential District.
b. All uses customarily incidental to the principal permitted
uses in conjunction with which such accessory uses
operated or maintained, but not to include commercial use
outside the principal building.
3. No conditional uses shall be allowed.
B. Lot and Bulk Regulations
Development of land in the ID Institutional District shall be regulated as
follows:
The proposed Student Wellness Clinic shall be constructed in
substantial conformance with the amended campus development plan,
a copy of which is on file with the City of Dubuque Planning Services
Department.
C. Performance Standards
The development and maintenance of uses in this ID Institutional
District shall be established in conformance with Section 5-22 of the
Unified Development Code and the following standards:
1. The storm water control shall be designed and built in accordance
with City Regulations subject to review and approval by the City of
Dubuque Engineering Department.
2. That appropriate erosion and sediment control will be installed
prior to commencement of any land disturbing activity related to
University of Dubuque — Student Wellness Center

the subject project, including all required state and city permits
related to erosion control.
3. New outdoor lighting shall utilize 72 -degree cut-off luminaries.
4. Landscaping shall be provided in compliance with Article 13 of the
Unified Development Code.
5. All utilities, including telephone and cable television, shall be
installed underground.
6. Final site plans shall be submitted in accordance with Articles 12
and 13 of the Unified Development Code.
D. Parking Requirements
The off-street parking requirements for the principal permitted uses for
the herein described ID Institutional District shall be regulated as
follows.
1) Any significant expansion or reduction in the number of off-street
parking spaces must be reviewed by Planning Services staff for
compliance with the adopted Institutional District regulations.
E. Sign Regulations
The sign regulations shall be the same as that which are allowed in the
ID Institutional District as established in Article 15 of the Unified
Development Code.
F. Additional Standards
That all previously approved campus development plans are hereby
amended to allow for the attached campus development plan.
G. Transfer of Ownership
Transfer of ownership of property in this ID Institutional District requires
rezoning of the property to an appropriate zoning district.
H. Modifications

RE 1998 and 2120 Grace St.
I assume the UD already owns the properties in question for rezoning. My concern is the continued reduction of
property taxes once the UD or any other institution of higher learning purchases a previously zoned residential property,
that the city property tax base is reduced, and the remaining tax payers have to pickup the balance, that balance was
previously paid by residential homeowners. It appears that the UD has had substantial monetary donations over a 15
year period of time, evidenced by the continuous building. and expansion.
It does not seem out of the question that volunteering to support our community and the city through a contribution to
the tax base is unreasonable. It would indicate the UD is acting in good faith, in support of the city; I have read where
other higher learning institutions have made such donations, in the past to help support the city.
As I know that I have no leverage in the rezoning, I wanted to send my thoughts on the tax issue.

Subject: Rezone property at 1998 Grace Street
Regarding the rezoning of property located at 1998 Grace Street from family residential to an institutional district, I have
four concerns. My southern property line will butt up against the proposed wellness center. I am very concerned about
our privacy, noise and rain drainage.
1. Wellness Center. What is the primary purpose of the Wellness Center? Will its activities be used for socialization
outdoors?
2. Privacy. Will the business of the proposed wellness center impact my residential privacy at my home? How will the
wellness center separate it's privacy from our privacy?
3. Noise. Will the activities of the proposed wellness center increase the overall noise levels as compared to our current
residental home. I enjoy the use of our back yard for family and friend activities. We especially enjoy quiet uninterrupted
sleep at night.
4. Rain drainage. Will the structure of the proposed weliness center be built to avoid rain and snow drainage on the
residential homes south of the proposed wellness center?
These major concerns should be addressed and reviewed as part of the proposed rezone before a decision is
rendered. The University of Dubuque is a great school of education. I have no problem with the rezone if they
communicate with the residents directly over our concerns for privacy, noise, and property drainage.
Thank you to the Zoning Advisory Commission forvoicing my concerns.
