A request has been received from Steeple Square LLC (SS Event Center, LLC) to
vacate the public alley between Jackson and White from 15�h to 16�h Streets, as part of
the redevelopment of the entire block including building upgrades and parking and
circulation improvements. City Engineer Gus Psihoyos recommends City Council
approval to vacate City Lot 484-A and dispose of the lot to SS Event Center LLC.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is in response to a request from SS Event Center, LLC for the vacating of the
Public Alley between Jackson and White from 15t'' to 16t" Streets, as part of the
redevelopment of the entire block including building upgrades and parking and
circulation improvements.
BACKGROUND
Steeple Square LLC (SS Event Center LLC) is in the process of redeveloping the entire
block including building upgrades and parking and circulation improvements. In order to
protect the City's existing sanitary sewer main and to accommodate the proposed
development of the block, the City and Steeple Square LLC have entered into an
agreement by which the City will vacate its existing alley right-of-way between Jackson
and White from 15th to 16th Streets to Steeple Square LLC. Steeple Square LLC will
provide financial assistance in the lining of the existing sanitary sewer and
reconstruction r�f one manhole in order t� �rolong the life of the sewer main. A copy of
the Agreement is attached to this memo. The proposed redevelopment improvements
are located on the City alley right-of-way between 15t" and 16th Street. City staff is
recommending the vacation of the alley right-of-way for the developer to construct the
improvements on their own property.
DISCUSSION
In this area of the original City of Dubuque the adjacent property owners own to the
centerline of the street or alleys and the City holds only a right-of-way easement. In
April of 2019, SS Event Center LLC, Opening Doors, and Jackson Street School
dedicated, in fee, the entire alley right-of-way along their property frontages to the City.
The City has agreed to vacate the entire alley area back to SS Event Center LLC.
Opening Do�rs and Jacksnn Str�et School have consented to the v�c�tion of the entire
alley tn SS Event Center. The owners have already dedicafied a utilifiy �asement in the
area propc�sed t� be vacated fc�r sanitary sewer and electric ufiilifiies.
ThP alley right of w�y �rea to be v�cafiPd to SS Ev�nt CentPr LLC has k�een platfieci and
� copy of thP recorded plat is attached. The platting of the right of way area has k�Pen
coordinat�d with the owners of the property. City Lot 484-A will be vacated to SS Event
Cenfi�r LLC to fa�ilitat� the construcfiion of the proposed block redevelopment
improvemenfis. A public he�ring for the disposal o�' the City's inter�est in the alley right-
of-way will take place in later in May of this year.
RECOMMENDATION
I am recommending the vacating and disposal of City Lot 484-A, in the City ofi Dubuque,
lowa.

FROM E. SIXTEENTH ST. TO E. FIFTEENTH ST., DESCRIBED AS CITY LOT 484-A,
IN THE CITY OF DUBUQUE, IOWA
Whereas, SS Event Center, LLC has requested the vacating of the Alley between
Jackson St. and White St., from E. Sixteenth St. to E. Fifteenth St.; and
Whereas, there has been presented to the City Council of the City of Dubuque, Iowa,
a plat dated February 5, 2019, prepared by Buesing and Associates, Inc., describing the
proposed vacated alley right of way, in the City of Dubuque, Iowa; and
Whereas, pursuant to resolution and published notice of time and place of hearing,
published in the Telegraph Herald, a newspaper of general circulation published in the
City of Dubuque, Iowa on the 10th day of May 2019, the City Council of the City of
Dubuque, Iowa met on the 20th day of May, 2019, at 6:00 p.m. in the Historic Federal
Building Council Chambers (second floor), 350 West 6th Street, Dubuque, Dubuque
County, Iowa to consider the request to vacate; and
Whereas, the City Council of the City of Dubuque, Iowa overruled any and ail
objections, oral or written to the request to vacate; and
Whereas, the City Council of the City of Dubuque, Iowa, has determined that the
proposed vacated Alley between Jackson St. and White St., from E. Sixteenth St. to E.
Fifteenth St., described as City Lot 484-A, in the City of Dubuque, Iowa, should be
approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the real estate described as City Lot 484-A, in the City of Dubuque,
Iowa, be and the same is hereby vacated.

City of Dubuque, Iowa on the 10th day of May, 2019, the City Council of the City of
Dubuque, Iowa met on the 20th day of May, 2019, at 6:00 p.m. in the Historic Federal

County, Iowa to consider the proposal for the sale of real estate described as:

and the City Clerk be and is hereby authorized and directed to deliver said deed of
conveyance to SS Event Center, LLC.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

Whereas, there has been presented to the City Council of the City of Dubuque, lowa,
a vacation plat dated February 5, 2019 prepared by Buesing and Associates, Inc.,
showing the Alley between Jackson St. and White St., from E. Sixteenth St. to E.
Fifteenth St., described as City Lot 484-A, in the City of Dubuque, lowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the vacation plat dated February 5, 2019 prepared by the Buesing
and Associates, Inc., relative to the real estate hereinabove described be and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby authorized
and directed to execute said plat for and on behalf of the City of Dubuque, lowa.

RESOLUTION DISPOSING OF CITY INTEREST IN CITY LOT 484-A, IN THE CITY
OF DUBUQUE, IOWA
Whereas, pursuant to resolution and published notice of time and place of hearing,
published in the Telegraph Herald, a newspaper of general circulation published in the
City of Dubuque, Iowa on the 10th day of May, 2019, the City Council of the City of
Dubuque, Iowa met on the 20th day of May, 2019, at 6:00 p.m. in the Historic Federal
Building Council Chambers (second floor), 350 West 6th Street, Dubuque, Dubuque
County, Iowa to consider the proposal for the sale of real estate described as:
City Lot 484-A, in the City of Dubuque, Iowa
;and
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the conveyance of City of Dubuque real property described as City
Lot 484-A, in the City of Dubuque, Iowa, to SS Event Center, LLC be and the same is
hereby approved. Conveyance shall be by Quit Claim Deed.
Section 2. That the Mayor be authorized and directed to execute a Quit Claim Deed,
and the City Clerk be and is hereby authorized and directed to deliver said deed of
conveyance to SS Event Center, LLC.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

proposed vacated alley right of way, in the City of Dubuque, Iowa; and
