Hi Charlie,
Please see below for a response I received yesterday from the city manager's office and health department. I
hope this is resolved quickly to your satisfaction. They did say the dog owners would at least be cited for lack
of licenses, and Alex needed to file her written statement as a next step if she hasn't already. Sounds like
animal control has been in contact with Alex since you and I spoke.
There is also a recap of our vicious dog ordinance below.

I contacted Public Health Specialist Mary Rose Corrigan and she provided the following information,
including the answers in red:

Dog vs dog attacks are not uncommon, unfortunately. Dogs can often show aggression towards other dogs,
but not be aggressive towards a person. Just because a dog attacks one certain dog, doesn’t mean they will
attack other dogs. The dogs that attacked are not licensed. Citations will be issued for failure to license.

Sunday afternoon there was an incident at 2875 Argle street, where two neighbor dogs charged a cocker
spaniel pet and caused some injuries. it took "5 grown men" to subdue the dogs (who did not have collars on).
Police responded and did a report- see attached.
The dog will be fine but the family is shaken up and was disappointed in the response of animal control. The
father was visiting his daugher, Alex, who owns the home and dog, so called me on her behalf.
A police report was filed and an officer returned to take photos of the injuries after visiting the vet. Alex, the
owner of the cocker spaniel, was told by animal control that they were busy and suggested they keep their
dog tethered, in its own yard, and carry mace. (the dog was tethered in its own yard and supposedly
approached and attacked by the neighbor dogs.) They were a bit riled up that they were given that advice and
"put off" as low priority since it was not a human who was bitten and animal control "was pretty busy". I
asked AC officer Jenny Cook about this incident this morning (via email) since Randy Gehl had forwarded me
a Facebook post about the incident. Jenny stated Alex- dog owner, called her before she had a chance to
call her after receiving the report. Jenny won’t be on duty until Wed afternoon so I will ask her about the
phone conversation.
I'm sure they are and I hope making one full time helps. I imagine making both full time would really help.
1) I'm sure it is in the que to be investigated, but wanted to bring it to your attention. According to Alex and
another neighbor the dogs have done similar things before, but not as severe. These were never reported to
Animal control the family is considering coming before the next city council meeting. I told them I would see
what we could do by then. They want the dog owners investigated and to pay for the $300+ vet bills
eventually. Jenny asked Alex to provide her with a written statement about the incident and that if she
would testify in court, MIs could be written for “dog running loose”. We have not received a statement
yet. McKinzie is currently on duty and will follow up with Alex
2) My understanding is that dog on dog attacks do not currently count toward the "Strike 3" vicious dog
ordinance. Not necessarily, it depends on the situation and the history of the animal. Can you confirm this
is the case? If so I'd like to propose an amendment to the ordinance that includes injured pets as a result of an
unprovoked attack. The Vicious definition in the code is: 7-6 F-2 A. Basis For Declaration: The City Manager
may find and declare an animal vicious based upon the following:
1. When the animal has attacked or bitten any person on more than one (1) occasion without provocation or
when an attack or bite results in serious bodily injury.
HOWEVER, the incident and the animal history may affect whether a dog is declared “Potentially
Vicious” Sec 7-6E-1: A "potentially vicious dog" is a dog that:

A. When unprovoked, on two (2) separate occasions, has engaged in any behavior that has required a
defensive action by any person to prevent bodily injury when the person and dog were off of the
property of the owner or keeper of the dog;
B. When unprovoked, has attacked or bitten a person;
C. When unprovoked, has inflicted a serious injury or caused the death of a domestic animal, either on
public or private property other than the property of the owner or keeper; or
D. When unprovoked, chases or approaches a person or domestic animal upon the streets, sidewalks, or
any public or private property other than the property of the owner or keeper, in a menacing fashion or
apparent attitude of attack. (Ord. 76-08, 11-3-2008)

On 06/01/2019 at approximately 1544 hours I, Officer Salazar, responded to 2875 Argyle St reference a dog bite.
Upon arrival, I spoke with Alexandra Grace Hunter DOB: of 2875 Argyle St Dubuque, IA 52001. Hunter
owns a soon to be 2 year old white and tan female Cocker Spaniel named Pearl. Hunter was outside her residence
with Pearl who was leashed to the house when two dogs came out from the residence of 2843 Argyle St. The two
dogs are named Duke and Daisy. Duke is a 3 year old brown male Pitbull. Daisy is a 2 year old white and black half
Husky and half female Pitbull.
I spoke with the owner of Duke and Daisy, Daniel De Henson DOB: 06/17/83 of 2843 Argyle St Dubuque, IA 52001.
Henson advised the door to outside was left open too long resulting in the dogs to get out and bite Pearl. Duke did not
have his collar nor leash on. Daisy had her collar but no leash.
Both Duke and Daisy were observed attacking Pearl by Hunter and her boyfriend, Mathias Oniel Goodale DOB:
of 2875 Argyle St Dubuque, IA 52001. I also spoke with two other witnesses, Marylin Katherine Kennedy
DOB: of 727 Goethe St Dubuque, IA 52001 and Mary Kay Markus DOB: of 735 Goethe St
Dubuque, IA 52001. Kennedy and Markus stated they were on the porch of 735 Goethe St when they observed Pearl
who was on a leash being attacked by two dogs.
Henson could not confirm if his dogs are up to date with their shots but stated they have a Vet appointment at Trivet
in Farley this Friday, 06107/19.
Pearl was treated by her Vet at Colonial Ter. Email to Animal Control was sent in reference to this case. Photos were
taken of Pearls injuries.
