Whereas, said sealed proposals were opened and read on the 26th day of October, 1995 end it has been determined that the bid of Portzen Construction, Inc. of Dubuque, Iowa in the amount of $48,560,73 was the lowest bid for the furnishings of all labor and materials and performing the work es provided for in the plans and specifications. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the contract for the above improvement be awarded, subject to the concurrence of the Iowa Department of Transportation, to Portzen Construction, Inc. and the Manager be and is hereby directed to execute a contract on behalf of the City of Dubuque for the complete performance of the work. Service People Integrity Responsibility innovation Teamwork UPPER MAIN URBAN REVITALIZATION PLAN October 1995 1.0 Introduction The following describes certain provisions of the Iowa Urban Revitalization Act and proposes the creation and designation of an Upper Main Urban Revitalization Area. The State of Iowa, under Iowa Code Chapter 404, allows cities to designate areas as urban revitalization districts. Under this Act, improvements to qualified areas may receive a total or partial exemption from property taxes for a specified number of years. The exemptions are intended to stimulate private investment by reducing tax increases related to property improvements. Once an area is deemed to meet the requirements established in Chapter 404, a plan must be established which identifies the area boundaries, property owners, existing conditions, proposed plans and the basic abatement provisions for the revitalization area. 2.0 The Area 2.1 Location Addendum Map 1 identifies the location of the proposed district. As indicated on the map this area is generally bounded by 14th Street on the north, Central Avenue on the east, 10th Street on the south and the alleyway between Locust Street and Main Street on the west. The boundaries of the proposed area are as follows: Beginning at the alley between Locust and Main on 10th Street, extending north along said alleyway to 13th Street, east along 13th Street to Main Street, north on Main Street to 14th Street, east on 14th Street to Iowa Street, south on Iowa Street to 13th Street, east on 13th Street to Central Avenue, south on Central Avenue to 1 lth Street, west on 11th Street to the alleyway between Iowa Street and Main Street, south along this alleyway to 10th Street, west on 10th Street to the point of origination. 2.2 Zoning The area is divided into three (3) zoning districts as depicted on Addendum Map 2. The northerly area from Main Street to Iowa Street and 13th Street to 14th Street has been zoned as OS (office/service) and OR (office/residential). The remaining portion of the proposed district is zoned as C-4 (commercial). 2.3 Existing and Proposed Land Use Addendum Map 3 identifies the primary land use for the entire proposed Upper Main Urban Revitalization Area. The predominant use of the area is a mix of residential and commercial, which constitutes 32.14% and 42.86% of the total parcels respectively. The proposed land Upper Main Urban Revitalization Plan cont - Page 2 use includes the expansion and adaptive reuse of commercial buildings into single-family attached and multi -family residential dwellings in the parcels located at 243 and 247 W. 1 lth Street, 1131 Main Street (Twin Sisters Subdivision) and at 1100, 1110, 1120, 1130, 1140 and 1150 Main Street. 2.4 Assessed Valuations and Owners of Record The existing assessed valuation of the real estate in the proposed area, listing land and building values separately, is included as Addendum #4. This addendum also contains a list of the names and addresses of the owners of record of real estate within the area. 2.5 City Services The city is currently undergoing a downtown circulation study that encompasses this area. This comprehensive study will review and address traffic patterns, parking and urban design issues. There are no current plans to expand existing city services in this area as it is already fully served by infrastructure and publicly provided services. 3.0 Relocation No relocation should occur due to the rehabilitation of the remaining vacant space on the parcels identified for expansion under existing and proposed land use. Should a relocation occur in the district due to action on the part of a property owner to qualify for the benefits under this Plan, the property owner causing a qualified tenant to be displaced shall pay all of the relocation costs of the tenant as a condition for receiving a tax -exemption under Iowa Code Section 404.3. This provision shall not apply to property owners who do not seek tax abatement. 4.0 Qualification of Area In July 1995 a building condition survey was conducted by the Planning Services Department in order to determine the boundaries for the urban revitalization area and the criteria to be used by the City Council to make a finding. Land use information concerning existing uses, building ages and building conditions was collected in order to document the conditions of deterioration that presently exist. 4.1 Historic Significance The area is dominated by historic buildings and street patterns which predate the automobile. Building ages in the area range from 1870 to 1968 with an overwhelming majority (92%) falling into the 1870 - 1930 era. A portion of the proposed area falls within the boundaries of the Jackson Park Historic District. Upper Main Urban Revitalization Plan cont - Page 3 4.2 Deterioration Major structural components were considered in rating building conditions. These components were ranked as either good or fair under the following criteria: Good: The building appeared to be structurally sound and free of major defects. Ongoing maintenance such as window repair, re -pointing and painting was evident. Of the structures reviewed 68% qualified under this category. Fair: The building has been the victim of deferred maintenance. As a result such conditions as wood or mortar decay, window repair, roof repair and tuckpointing needs exist. The correction of these conditions may require complete replacement and may constitute a hardship or lack of feasibility on the part of the property owner, thus retarding the provision of housing accommodations, or constitute an economic or social liability. Of the structures reviewed, 32% qualified for this category. In addition, obsolescence is evidenced in a majority of the buildings in the proposed area. These buildings require major rehabilitation for adaptive reuse as residential and commercial structures for the district. The current lack of investment in the buildings for these purposes is evidenced by the number of vacancies that exist in the area. Addendum #5 identifies total vacancies for the area broken down into primary land use (first floor) and secondary land use (upper floors) both of which have a vacancy of 23%. This is above the 10 - 15% acceptable level for similar districts. Given these conditions the area meets the statutory requirements for both a historic and deteriorated area as defined in Iowa Code Section 404.1. 5.0 Revitalization Program 5.1 Tax Exemption a) All residential property, assessed either as residential or commercial, in the revitalization area shall be eligible for tax abatement. b) The abatement incentive is intended to bring back to useful purpose the vacant or underutilized buildings which exist in the revitalization area. Tax abatement shall be available only for the rehabilitation of existing structures in the revitalization area, not for the new construction of additions or separate buildings. c) The tax abatement schedule shall offer the same exemption opportunity as is available in other residential Urban Revitalization Districts so designated in the City of Dubuque. Therefore, a ten-year 100% exemption on the actual value added by the improvements as provided in Iowa Code Section 404.3 (4) shall be established as part of this Plan. Upper Main Urban Revitalization Plan cont - Page 4 d) The percent increase in value shall also reflect the standard used in other residential urban revitalization districts in the city. The actual value of the building(s) to which improvements have been made must have increased the assessed value by at least fifteen percent before an abatement is applied. Each year that an application is made for tax abatement, the assessed value must have increased in that year by at least fifteen percent. e) The proposed area shall remain as a revitalization area for a period of 25 years commencing upon the adoption of the ordinance approving this revitalization area by the City Council. 5.2 Availability of Funding There are at present four active programs which may provide a source of funding for residential and commercial improvements to the area: Community Development Block Grant Funds, HOME funds and two loan programs through Dubuque Main Street, Ltd. 6.0 Conclusion The proposed urban revitalization district will assist the rehabilitation efforts of several vacant, deteriorating properties by providing needed housing units for the citizens of Dubuque and the surrounding area. After the ten-year abatement period lapses on these projects, the full assessed value of the rehabilitation property will go on the tax rolls to the benefit of the entire community. C u `"e, Community and Economic Development Director SUBJECT: Establishing an Upper Main Urban Revitalization District Introduction This memorandum transmits an ordinance establishing an Upper Main Urban Revitalization District for City Council review and approval at a public hearing set for October 2, 1995. The Plan for that district is attached hereto. Background This urban revitalization plan will allow property tax abatement for new improvements to residential property in this district. Several property owners requested the revitalization area designation to assist in the feasibility of renovating residential units in this area. Assessed values are frozen and new increases to that base value would be abated for a period of 10 years. The abatement only applies to the rehabilitation of existing buildings, not new construction. The terms of the abatement are the same as are available in other City urban revitalization districts. Improvements must increase the assessed value by at least fifteen percent before an abatement is applied. The Plan will remain in effect for twenty-five years as renovation is expected to take place over a long period of time. As required by law, property owners and residents have been notified of the public hearing (public notice attached) 30 days prior to the public hearing. While not required, notification was also given to the Dubuque Community School District, NICC, the County Board of Supervisors and East Central Intergovernmental Association. Notice was also published in the Telegraph Herald. To date, no public comments have been received about the proposed Plan. On September 20, 1995, the Long Range Planning Commission reviewed the Plan for consistency with the comprehensive plans for the City. The Commission's comments are being forwarded to the City Council. Recommendation Staff recommends the adoption of the attached ordinance establishing the Upper Main Urban Revitalization District in order to provide an investment incentive to property owners in the district and to stimulate the reuse of older, deteriorating buildings adjacent to the Central Business District. The creation of additional affordable and market -rate housing units and the eventual payment of full property taxes to the taxing body make this designation an important incentive tool benefitting the City and the community at large. Action Step The Action Step is for the City Council to hold a public hearing on October 2, 1995 on the proposed designation of the Upper Main Urban Revitalization District and adopt the attached ordinance. attachments UPPER MAIN URBAN REVITALIZATION PLAN October 1995 1.0 Introduction The following describes certain provisions of the Iowa Urban Revitalization Act and proposes the creation and designation of an Upper Main Urban Revitalization Area. The State of Iowa, under Iowa Code Chapter 404, allows cities to designate areas as urban revitalization districts. Under this Act, improvements to qualified areas may receive a total or partial exemption from property taxes for a specified number of years. The exemptions are intended to stimulate private investment by reducing tax increases related to property improvements. Once an area is deemed to meet the requirements established in Chapter 404, a plan must be established which identifies the area boundaries, property owners, existing conditions, proposed plans and the basic abatement provisions for the revitalization area. 2.0 The Area 2.1 Location Addendum Map 1 identifies the location of the proposed district. As indicated on the map this area is generally bounded by 14th Street on the north, Central Avenue on the east, 10th Street on the south and the alleyway between Locust Street and Main Street on the west. The boundaries of the proposed area are as follows: Beginning at the alley between Locust and Main on 10th Street, extending north along said alleyway to 13th Street, east along 13th Street to Main Street, north on Main Street to 14th Street, east on 14th Street to Iowa Street, south on Iowa Street to 13th Street, east on 13th Street to Central Avenue, south on Central Avenue to 1 lth Street, west on l lth Street to the alleyway between Iowa Street and Main Street, south along this alleyway to 10th Street, west on 10th Street to the point of origination. 2.2 Zoning The area is divided into three (3) zoning districts as depicted on Addendum Map 2. The northerly area from Main Street to Iowa Street and 13th Street to 14th Street has been zoned as OS (office/service) and OR (office/residential). The remaining portion of the proposed district is zoned as C-4 (commercial). 2.3 Existing and Proposed Land Use Addendum Map 3 identifies the primary land use for the entire proposed Upper Main Urban Revitalization Area. The predominant use of the area is a mix of residential and office/ commercial, which constitutes 29% and 45% of the total parcels respectively. The proposed Upper Main Urban Revitalization Plan con't - Page 2 land use includes the expansion and adaptive reuse of commercial buildings into single- family attached and multi -family residential dwellings in the parcels located at 243 and 247 W. 1 lth Street, 1131 Main Street (Twin Sisters Subdivision) and at 1100, 1110, 1120, 1130, 1140 and 1150 Main Street. 2.4 Assessed Valuations and Owners of Record The existing assessed valuation of the real estate in the proposed area, listing land and building values separately, is included as Addendum #4. This addendum also contains a list of the names and addresses of the owners of record of real estate within the area. 2.5 City Services The city is currently undergoing a downtown circulation study that encompasses this area. This comprehensive study will review and address traffic patterns, parking and urban design issues. There are no current plans to expand existing city services in this area as it is already fully served by infrastructure and publicly provided services. 3.0 Relocation No relocation should occur due to the rehabilitation of the remaining vacant space on the parcels identified for expansion under existing and proposed land use. Should a relocation occur in the district due to action on the part of a property owner to qualify for the benefits under this Plan, the property owner causing a qualified tenant to be displaced shall pay all of the relocation costs of the tenant as a condition for receiving a tax -exemption under Iowa Code Section 404.3. This provision shall not apply to property owners who do not seek tax abatement. 4.0 Qualification of Area In July, 1995, a building condition survey was conducted by the Planning Services Department in order to determine the boundaries for the urban revitalization area and the criteria to be used by the City Council to make a finding. Land use information concerning existing uses, building ages and building conditions was collected in order to document the conditions of deterioration that presently exist. 4.1 Historic Significance The area is dominated by historic buildings and street patterns which predate the automobile. Building ages in the area range from 1870 to 1968 with an overwhelming majority (89%) falling into the 1870 - 1930 era. A portion of the proposed area falls within the boundaries of the Jackson Park Historic District. Upper Main Urban Revitalization Plan cont - Page 3 4.2 DeteriorationIi Major exterior structural components were considered in rating building conditions. These components were ranked as either good or fair under the following criteria: Good: The building appeared to be structurally sound and free of major defects. Ongoing maintenance such as window repair, re -pointing and painting was evident. Of the structures reviewed 82% qualified under this category. Fair: The building has been the victim of deferred maintenance. As a result such conditions as wood or mortar decay, window repair, roof repair and tuckpointing needs exist. The correction of these conditions may require complete replacement and may constitute a hardship or lack of feasibility on the part of the property owner, thus retarding the provision of housing accommodations, or constitute an economic or social liability. Of the structures reviewed, 18% qualified for this category. In addition, obsolescence is evidenced in a majority of the buildings in the proposed area. These buildings require major rehabilitation for adaptive reuse as residential and commercial structures for the district. The survey indicated 45 vacant residential units of 145 known residential units. This is a 31% vacancy rate. Additional upper floor vacancies could also be utilized for additional residential use. Given these conditions, the area meets the statutory requirements for both a historic and deteriorated area as defined in Iowa Code Section 404.1. 5.0 Revitalization Program 5.1 Tax Exemption a) All residential property, assessed either as residential or commercial, in the revitalization area shall be eligible for tax abatement. b) The abatement incentive is intended to bring back to useful purpose the vacant or underutilized buildings which exist in the revitalization area. Tax abatement shall be available only for the rehabilitation of existing structures in the revitalization area, not for the new construction of additions or separate buildings. c) The tax abatement schedule shall offer the same exemption opportunity as is available in other residential Urban Revitalization Districts so designated in the City of Dubuque. Therefore, a ten-year 100% exemption on the actual value added by the improvements as provided in Iowa Code Section 404.3 (4) shall be established as part of this Plan. Upper Main Urban Revitalization Plan cont - Page 4 d) The percent increase in value shall also reflect the standard used in other residential urban revitalization districts in the city. The actual value of the building(s) to which improvements have been made must have increased the assessed value by at least fifteen percent before an abatement is applied. Dear Mayor and City Council Members: The Long Range Planning Commission, at its September 20, 1996 meeting, reviewed the proposal for designation of the Upper Main Urban Revitalization District. By City code, the LRPC is to review any new or amended urban renewal plan amendments for consistency with the Comprehensive Plan of the city. By unanimous vote, the Commission recommends approval of the designation of the Upper Main Urban Revitalization District as consistent with the Comprehensive Plan.
