SUBJECT: Adoption of Supplement No. 32 to the Code of Ordinances

INTRODUCTION
The purpose of this memorandum is to submit to City Council a resolution adopting
Supplement No. 32 to the Code of Ordinances of the City of Dubuque.
DISCUSSION
The attached resolution provides for the adoption of Supplement No. 32 to the City of
Dubuque Code of Ordinances, which codifies Ordinance Nos. 2-19, 9-19, 11-19
through 17-19, 22-19 and 23-19 as adopted by City Council through May 6, 2019.
Supplements to the Code of Ordinances are prepared by Sterling Codifiers, Inc., of
Coeur d'Alene, Idaho.
ACTION STEP
The requested action is for the City Council to pass the resolution adopting Supplement
No. 32 as a part of the Code of Ordinances of the City of Dubuque.

RESOLUTION NO. 245-19
ADOPTING SUPPLEMENT NO. 32 TO THE CODE OF ORDINANCES OF THE CITY
OF DUBUQUE, IOWA
Whereas, under date of August 17, 2009, the City Council, pursuant to Ordinance
No. 43-09, readopted the Code of Ordinances of the City of Dubuque, Iowa in its
entirety; and
Whereas, since August 17, 2009 the City Council of the City of Dubuque, Iowa has
adopted certain ordinances amending the Code of Ordinances and said amendments
have been printed as supplements to the Code of Ordinances; and
Whereas, Section 380.8 of the Code of Iowa provides that supplements, by
resolution, become part of the Code of Ordinances.
Whereas, Code Supplements are prepared by the Sterling Codifiers, Inc., and filed in
the Office of the City Clerk of the City of Dubuque, Iowa.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Supplement No. 32 to the City of Dubuque Code of Ordinances,
which codifies Ordinance. Nos. 2-19, 9-19, 11-19 through 17-19, 22-19 and 23-19 is
hereby adopted and becomes part of the Code of Ordinances of the City of Dubuque,
Iowa.

A. Central Market Area: The property of the City adjacent to the City �'�
Hall, together with such parts of the streets and sidewalks located �'

within the area bounded by the south side of Tenth Street, the north �I
side of Thirteenth Street, the west side of Central Avenue and the !,
east side of Main Street, and such distances on lowa Street between f
Thirteenth and Fourteenth Streets on both sides thereof as may be �
necessary for three (3) standard auto parking stalls, will constitute ;a

� B. Other Areas: Other areas will be delineated as farmers' markets and �
� a map of such areas will be filed with the Offices of the City �
Manager, the City Clerk, the Health Services Department, and the �
Planning Services Department if the applications for such markets �
and subsequently the markets themselves comply with the rules and
regulations for a farmers' market set forth in the City's farmers'
market permit application, this Code, and any other applicable local,

4-4-2: FARMERS' MARKET; DISPLAY OF MERCHANDISE: The t ,
Central Market and any other designated farmers' markets ;;
that obtain and comply with the City's farmers' market permit application will !I
be a "farmers' market" as provided for in the lowa Administrative Code and
will be subject to the rules relating thereto. Inspections may be conducted
by the City Manager who is under contract with the State Department of
Inspections and Appeals. Subject to such regulation and the limitations and
prohibitions set forth hereinafter, any person, firm or corporation may
display, offer for sale or sell on the streets or sidewalks of the Central
Market or another farmers' market, flowers, plants, arts, crafts or food items I;
which have been raised, produced, procured or crafted by the local vendor I
and which are displayed and sold at a stalf for which a permit has been � j
issued as provided for in this chapter. (Ord. 13-19, 3-4-2019) ;

4-4-3: MARKET STALLS ESTABLISHED; ISSUANCE OF PER-
MITS: '
A. Spaces For Stalls Established; Fees: The City Manager is authorized �'
to establish spaces for stalls in the Central Market or other desig- �
nated farmers' markets as may be necessary and to issue permits ;�
for the use of such stalls. The fees for such permits shall be estab-
lished by the City Manager.

B. Use Of Metered Parking Spaces: When a permit holder uses a � �
metered parking space on days other than authorized by the holder's �
permit, the permit holder shall comply with the parking meter require-
ments of this Code. (Ord. 13-19, 3-4-2019)

A. When stalls in the Central Market have been established by the City �
Manager and signs are erected giving notice #hereof, no person shall
park a vehicle in such stall between the hours of six o'clock (6:00) �
A.M. and twelve o'clock (12:00) noon on Saturdays in the months of � j
May through October unless the vehicle has on display a permit as �
described in this chapter.
B. When stalls in other designated, permitted farmers' markets have
- been established by the City Manager and signs are erected giving
notice thereof, no person shall park a vehicle in such stall between

acceptable sanitation and to protect the public health, safety and welfare. �

regulate the sidewalk and street traffic in the area of the I
Central Market or other designated farmers' markets as may be necessary �j

4-4-9: INSPECTION; CONFISCATION OF FOOD UNFIT FOR u
� CONSUMPTION: All food or food products displayed, sold or �
offered for sale at the Central Market and other designated farmers'
markets shall be subject to inspection by the City Manager. If any food or
food product is found to be unfit for human consumption, the City Manager
shall confiscate and destroy the food, and the person displaying, offering for
sale or selling such food shall be guilty of a misdemeanor. (Ord. 13-19,

license must be filed with the City Clerk on a form provided by I
the City Clerk. The application must be signed by the applicant and must !!

address, if any, and physical description.
r B. The applicant's employer or sponsor, if any, and the employer or �',
`� sponsor's address and telephone number, the nature of the appli- '';�
cant's business, and the last three (3) places of such business. j

C. If the applicant is a corporation, the corporation address and the ;:,
names and addresses of the officers thereof. If the applicant is a �'.

firm, partnership, or association, the firm, partnership, or asso- ;j
ciation's address and the names and addresses of all the members ��
thereof. If the applicant is a corporation, the application must state �!'
whether or not the applicant is an lowa corporation or a foreign ��;
corporation, and if a foreign corporation, whether or not such corpo- i
ration is autharized to do business in lowa. �

water service that is disconnected by the City for a meter not in ser- ; ,
vice. When a tenant account is subject to disconnection due to delin- ; j

C. Estimated Billings: For all meters in service, bills will be issued I

A. Application For Temporary Water Service; Deposit: When a tempo- `i
rary water service is desired for construction work, application shall i
be made to the City Manager. A deposit equal to the actual cost of 1
the meter and fittings shall be paid in advance. The applicant shall �
guarantee payment of such water service charges and return said li,
meter in good condition. j

B. Installation Of Meter: The applicant shall thereupon install a suitable
meter, furnished by the City, and shall pay for all water furnished in
accordance with the then prevailing water rates including minirnum ;
monthly charges. ,
C. Payment Of Charge When Installation Of Meter Impractical: If it is
the opinion of the City Manager that placement of a meter is imprac- ��
tical, then the deposit for meter and fittings shall not be required, but
a charge, as determined by the City Manager, after official publica- ''
tion, shall be made, but under no circumstances shall water be used '
for sprinkling lawns, wetting dovvn yards or compacting of soil unless '�
a meter has been installed on the service, or arrangements have
been made for such usage.
D. Water Rate For Various Other Purposes: The rate for water charged ;
for other purposes not mentioned herein, such as for circuses, � �;
carnivals, fairs, skating rinks, swimming pools, tank wagons and j
filling cisterns will be made by the City Manager when application is ,

necessary and conducive to the protection of the public ii
< health, safety, welfare and convenience of the City to levy and collect just ��
` and equitable charges, rates or rentals upon all lots, parcels of real estate I��
and buildings that are connected directly or indirectly with the sanitary ��
sewage system of the City, the proceeds of such charges or rentals so '

B. Monthly Billing: All accounts shall be billed monthly. The payment of C
bills is subject to the terms of section 13-1 C-4 of this title. �
C. Unpaid Billing For Class I Premises: The collection of solid waste
provided Class I premises and the maintenance of the availability of , '.
such service, whether or not such service is used regularly or not at '� �i
all by the owner of such Class I premises, is hereby declared a '
benefit to said premises at least equal to the monthly charges speci- f
fied, and in case of failure to pay the monthly charge when billed as '�,
heretofore provided, then the monthly charge shall become a lien ;
against the property benefited or served and shall be collected in the '

D. Certify Delinquenfi Accounts To County Treasurer: It is the duty of ',
the Finance Director-City Treasurer to certify the actual rates and '
fees plus the costs of administration to the County Treasurer as '
provided in section 13-1 C-4 of this title and all such costs will
constitute a lien against said property and be collected with and in �' j

A. Separation Of Yard Waste: Yard waste shall be separated by the
owner of a premises from all other solid waste. I
B. Composting: An owner may compost such person's own yard waste I
and food scraps on such person's own premises, provided the same
is stored in such a manner as to not create a fire, health or safety
hazard. � I
C. Collection Schedule For Yard Waste: Yard waste that has not been
composted shall be collected by the City not more than once each
week according to the collection schedule established by the City �
Manager.
D. Preparation Of Waste: Containerized yard waste collected by the I
City shall be placed in degradable paper bags with an affixed single �I

1. Causes: The City Manager may, for good cause, suspend or I,
revoke a rental license for a rental unit, and in the case of a multi- ;'.
family dwelling, suspend the license as to one or more rental units I
for a period not to exceed one year for any of the following:
a. Conviction, judgment, plea of guilty, or finding of guilt of the
licensee for violation of any provision of the Property Maintenance
Code;
b. Misrepresentation by the licensee of any material fact in the [
application for a rental license; i

c. Refusal by the licensee to permit inspection of the licensed
rental unit(s) by authorized City personnel;
d. Nonpayment of the fee for renewal of the rental license; I

e. Failure to attend the Successful Rental Property Management '

f. Failure to perform a required criminal background cheek on an �
applicant for tenancy after July 1, 2011; or
g. Failure of a priority category to comply with an inspection �� �
schedule or pay inspection fees. Tenants will be relocated from the �
rental unit at the priority category's expense. �
2. Opportunity To Appeal: Prior to any suspension or revocation �
under this subsection, the City Manager must give notice in writing to
the property owner, manager, or licensed real estate professional
and provide for an opportunity to appeal. ;

A. The Zoning Advisory Commission shall choose annually, at its first ` �

regular meeting of the fiscal year, one of its members to act as
Chairperson, and another of its members to act as Vice Chairperson, I
to perform all of the duties of the Chairperson during the Chair-
person's absence or disability. The commission shall adopt such i
rules and regulations governing its operation and procedure as may ;

B. Meetings of the Zoning Advisory Commission shall be held the first
Wednesday of the month or at the call of the Chairperson and at
such other times as the commission may determine. ,

(12) month period. If any member fails to attend such prescribed

16-9-5: ZONING RECLASSIFICATION: '

A. The City Council finds that the reclassification of property is a kj
sensitive and important legislative function which, in the interest of 'i
maintaining uniform zoning policies and the integrity ofi the compre-
hensive plan, should only be exercised sparingly and under proper
conditions. For this reason, and because the original zoning district 'I
- boundaries under this title are presumed to be correct and appro- �
,L priate, it shall hereafter be the policy of the City to reclassify ';
` property only where a clear showing has been made that the original ;;
classification was a mistake or that circumstances and conditions
affecting the property in question have so rnaterially changed so as '�
to demand reclassification in the public interest.

B. The reclassification procedures outlined herein should not be
confused with, or used in place of, the amendment process or the ��
variance process. Thus, the Council intends that reclassification of il
property should not be entertained where: 1) an alleged hardship
peculiar to the property is claimed, which is more properly the ,�
subject of a variance request; or 2) it is alleged that the provisions �
; themselves as applied to similar properties are unreasonable, which '
� is more properly the subject of a text amendment proposal. In all `
cases, the burden shall be upon the person(s) seeking reclassifica- �
tion to demonstrate that the requested reclassification is more appro- �
priate than the present classification, in light of the characteristics of �
the property and the public welfare. ��

C. Furthermore, it is contemplated under this title that the Long Range �

protest against the reclassification request which is filed with the City '�
Clerk and signed by the owners of twenty percent (20%) or more of
the area of the lots included in the request, or by the owners of
twenty percent (20%) or more of the property which is located within
two hundred feet (200') of the exterior boundaries of the property
being considered for reclassification, such request shall not be
enacted except by the favorable vote of at least three-fourths (3/4) of !
the Council. Property owned by the City or located in the public right- ,I
of-way shall not be considered in the above calculation of twenty

City Council may not give final approval to any zoning reclassifica- G
tion (rezoning) request for property in the Southwest Arterial Corridor 'i'

delineated on drawings on file in the City Clerk's Office, from the I;�
effective date of July 1, 2016, except where a vested right to the
