Property between Windsor Avenue and Sheridan Road DATE: August 27, 2019 In response to a request from Padre Pio Health Care Center Inc. to vacate a public utility easement across a portion of Lot 1-1-3 of Stone Hill Community Subdivision #1 between Windsor Avenue and Sheridan Road, City Engineer Gus Psihoyos states that the utility easement was dedicated to the public for public utility purposes. The easement was never used by the City or any public utility company and is vacant. Engineering Department staff has reviewed this request and determined that the existing public utility easement is not needed for City utilities. All public utility easement owners have consented to the request for vacation of the easement area. City Engineer Gus Psihoyos recommends City Council approval of a resolution vacating all interest in a public utility easement located on Lot 1-1-3 of Stone Hill Community Subdivision #1. Property between Windsor Avenue and Sheridan Road DATE: August 22, 2019 INTRODUCTION This is in response to a request from Padre Pio Health Care Center Inc. requesting the vacating of a public utility easement across a portion of Lot 1-1-3 of Stone Hill Community Subdivision # 1, between Windsor Avenue and Sheridan Road, in the City of Dubuque, lowa. BACKGROUND Padre Pio Health Care Center Inc. owns the property legally described as Lot 1-1-3 of Stone Hill Community Subdivision # 1 between Windsor and Sheridan. A public utility easement (10' wide) was platted over a portion of Lot 1-1-3 of Stone Hill Community Subdivision # 1 according to the Survey Plat for the same recorded as Instrument Number 3173-79, in the office of the Dubuque County Recorder. This utility easement was dedicated to the public for public utility purposes. The easement as shown on the attached exhibit was never used by the City or any public utility company and is vacant. The owner is planning to make property improvements in the area of the easement. DISCUSSION The owner is planning to construct a building addition to the existing maintenance building which is located south of the Assisi Village building and north of the Stonehill Care Center building on the Stonehill Campus. The proposed location of the maintenance building addition lies over the existing public utility easement on the lot. The property owner is petitioning to vacate a portion of the public utility easement across the lot in order to facilitate the construction of the proposed improvements. The easement area as shown on the attached exhibit was never used by the City or any public utility company and is vacant. Engineering Department staff has reviewed this request and has determined that the existing public utility easement is not needed for City utilities. All public utility easement owners have consented to the request for the vacation of the easement area. Theref�re, �#af� is recc�mmend�ng vacation of the public ufility easement area across Lot 1-1-3 of Stone Hill Community Subdivision # 1 as indicated on the attached Exhibit.
