The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Benjamin Beard, Straka Johnson Architects and Gretchen Brown, Stonehill Care Center
spoke in favor of the request. They reviewed that the proposal consists of a three-story
addition of ground, first, and second floor housing for assisted living, with a raised
walkway to connect the two buildings. i
Staff reviewed the staff report, noting the project relative to existing campus buildings �
and existing streets. Staff reviewed that the campus is currently zoned both Institutional
and Planned Unit Development. Since the proposed addition to the Assisi Village
building would be built within a portion of each zoning district, it was appropriate to
consolidate into a single PUD. Staff noted a small R-1 parcel also would be part of the
PUD consolidation.
There were no public comments made at the meeting.
Commissioners asked about parking impacts of the proposal. Staff noted most residents
won't drive and that parking removed for the new addition would be replaced in part by
two new garages.
The Zoning Advisory Commission discussed the proposal and felt that it was
appropriate.

Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
A super majority vote is needed for the City Council to deny or amend the
Commissioner's recommendation.

INTRODUCTION
The proposed amendment to the Padre Pio Health Center Institutional District and the
Assisi Village Planned Unit Development facilitates a proposed building addition to the
south side of the existing Assisi Village apartment building and two new garage
buildings. This request also consolidates the three existing zoning districts into one
Planned Unit Development District with a Planned Residential designation.
DISCUSSION
The requested amendment combines the ID Institutional District for the Padre Pio
Health Center, the Planned Unit Development designation for the Assisi Village, and
rezones a small R-1 parcel adjacent to Sheridan Road that is near the new access road
constructed from the Padre Pio Health Center to Sheridan Road.
The Padre Pio Health Center was first established as an Institutional District in 1995.
The Assisi Village project was zoned as a Planned Unit Development District as the
Stonehill Care Center in 1997. The two facilities are both owned by Padre Pio Health
Care Center Inc., and with the proposal to add an addition to the south side of the
existing Assisi Village apartment building which crosses the zoning boundary between
the Planned Unit Development and the Institutional District, Planning staff felt it was
appropriate at this time to combine the two zoning districts into one Planned Unit
Development zoning with the Planned Residential designation.
Within the city of Dubuque, most senior residential facilities are zoned Planned Unit
Development with a Planned Residential designation. At the time of the initial rezoning
of the Stonehill Care Center to Institutional District, Planning staff noted that it could
actually be zoned either institutional district or planned residential.
The proposed addition on the south side of the existing Assisi Village apartment building
is comprised of three stories that accommodate assisted living memory care on the
ground floor and assisted living on the first floor. The second floor will have a chapel
and related support services.
In addition to the proposed building expansion, two garage structures will be built to the
west. These structures will replace the existing garage that will be demolished as part of
the proposed project.
Provided the proposed changes to the Padre Pio Health Center and Assisi Village
property are approved, the proposed building addition and garages will be reviewed
through the Development Review Team, which coordinates the review of new
developments for compliance with applicable city codes and regulations.
RECOMMENDATION
Planning Services staff recommends that the Zoning Advisory Commission review
Section 5-24.5 Plan Approval Standards of the Unified Development Code and make a
recommendation to the City Council.

ORDINANCE NO. 36-19
AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, RESCINDING ORDINANCES 66-
95, 25-97, 45-11 AND 36-16 APPROVING AN AMENDED CONCEPTUAL
DEVELOPMENT PLAN FOR THE PADRE PIO HEALTH CARE CENTER AND ASSISI
VILLAGE, REZONE THE EXISTING INSTITUTIONAL DISTRICT TO PLANNED UNIT
DEVELOPMENT, AND REZONE PROPERTY ALONG SHERIDAN ROAD FROM R-1
TO PLANNED UNIT DEVELOPMENT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances Unified
Development Code is hereby amended by rescinding Ordinances No. 66-95, 25-97, 45-
11 and 36-16, and adopting a revised campus development plan for the Padre Pio
Health Care Center and Assisi Village, and rezone the existing Institutional District to
Planned Unit Development, and rezone property along Sheridan Road from R-1 to
Planned Unit Development, to wit:
Lot 1 Padre Pio Subdivision No. 1, and to the centerline of the adjoining public
right-of-way, all in the City of Dubuque, Iowa.
Section 2. That in order to accomplish the purposes of this Planned Unit
Development District, the above-described property is subject to the following conditions
and restrictions:
A. Use Regulations
The following regulations shall apply to all uses made of land in the above-
described Planned Residential District:
1. Principal permitted uses shall be limited to the following:
a. Nursing or convalescent homes.
b. Residential care facilities.
c. Multi -family dwellings limited to 53 congregate apartments and 25
cottages for independent living.
d. Offices for administrative personnel or other employees and
affiliates.
e. Off-street parking and loading.
2. Conditional use shall be regulated by Section 5-22.2 of the Unified
Development Code.
3. Accessory uses shall be regulated by Section 5-22.3 of the Unified
Development Code.
B. Lot and Bulk Regulations
Development of land in the Planned Residential District shall be regulated as
follows:
1. That all previously -approved campus development plans are hereby
amended to allow for the attached development plan.
C. Site Development Standards
The site development standards for this Planned Residential District shall be
established as follows:
1. That the proposed access road from Sheridan Road shall be located in
substantial conformance with the conceptual development plan.
2. The 24 -foot wide private roadway serving the Assisi Village development
shall have no on -street parking allowed.
3. Off-street parking for the Assisi Village development shall be .5 space per
congregate apartment unit and 2 spaces per cottage dwelling.
4. Sidewalks shall be provided within the Assisi Village development as
depicted in the approved conceptual plan.
5. Site plans shall be submitted in compliance with Section 12 Site Plans of
the Unified Development Code.
6. New outdoor lighting shall comply with Section 13-3.1 Site Lighting of the
Unified Development Code.
7. That storm water from new facilities shall comply with Section 13-3.3
Storm Water Management of the Unified Development Code.
8. Landscaping and screening requirements shall be established in
accordance with the requirements of Section 13-4.4 of the Unified
Development Code.
9. Trash enclosures shall comply with Section 13-4.9 Exterior Trash
Collection Areas of the Unified Development Code.
D. Sign Regulations
1. The sign regulations for the Padre Pio Health Center shall be in
accordance with the ID District in Section 15-11.13 of the Unified
Development Code of the City of Dubuque, Iowa.
2. The sign regulations for the Assisi Village Development shall be in
accordance with the R-4 Multi -Family Residential District in Section 15-
11.1 of the Unified Development Code.
E. Parking Standards
The off-street parking requirement for the principal permitted uses for the
herein described Planned Residential District shall be regulated as follows:
1. That new off-street parking spaces shall be designed and constructed in
compliance with Section 13-3.5 Parking Lot Layout of the Unified
Development Code.
2. Any significant expansion or reduction in the number of off-street parking
spaces must be reviewed by Planning Services staff for compliance with
the adopted Padre Pio Health Center/Assisi Village Planned Residential
District.
F. Ordinance History
1. 66-95: Rezoned Stonehill Care Center property from R-4 Multi -Family
Residential District to ID Institutional District.
2. 25-97: Amended existing Planned Unit Development District to allow the
development of the Assisi Village.

G Transfer of Ownership
Transfer of ownership or lease of property in this Planned Residential District
shall include the transfer or lease agreement, the provision that the purchaser
or leasee acknowledges awareness of the conditionals authorizing the
establishment of this district.
H. Modifications
Any modifications of this Ordinance must be approved by the City council in
accordance with zoning reclassification proceedings of Section 9-5 of the
Unified Development Code.
Section 3. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 4. This Ordinance shall take effect immediately upon publication, as
