Alcohol License Applications TO: Michael C. Van Milligen, City Manager FROM: Kevin S. Firnstahl, City Clerk DATE: September 25, 2019 SUBJECT: Request for Special City Council Meeting to Approve a Special Event Liquor License PURPOSE The purpose of this memo is to request a special session of the City Council to approve a special event liquor license for Squirrelly Merlies, LLC and the expedition of liquor licenses for two additional business. BACKGROUND Squirrelly Merlies, LLC submitted a liquor license application for a special event to be held on Saturday, September 28 at McGrath Dubuque Harley-Davidson, 145 N. Crescent Ridge. At the September 16, 2019 City Council meeting, the City Council approved the application as a sole proprietorship under the name of Harry Maglaris pending the completion of all proper documentation. However, the Dram insurance company will not approve an application submitted under personal name. Mr. Maglaris then submitted a new application to the Iowa Alcoholic Beverages Division under the name of Squirrelly Merlies, LLC to coincide with the Dram insurance. The City requires City Council approval. DISCUSSION If the special meeting is approved by the Mayor with a quorum of Council Members, I respectfully request including two additional applications currently scheduled for the October 7 City Council meeting.Expediting approval of these two additional licenses will help these businesses proceed in a timelier manner. EZ Stop II, 700 Rhomberg Avenue This property was recently sold to Nkole (Mary) and Augustine Kabongo. The closing took place on September 24. By including the application for EZ Stop II on this resolution, they can begin selling alcohol at their new store a few days earlier. th Driftless Catering, LLC 168 E. 10 Street The annuallicense was approved by the City Council on August 19pending completion of all required documentation. Expecting to be open by October 1,the owners booked a special event for October 3. The inspection process has taken longer than anticipated and cannot be completed by October 3. Driftless Catering, LLC has applied for a five- day, special event liquor license from the Iowa ABD and has received a 60-day temporary use permit from the Building Services Department. This allows Driftless Catering, LLC to honor their commitment to the special event host while fulfilling the necessary requirements to pass inspections required for its annual liquor license. RECOMMENDATION I respectfully request approval of a special event liquor license application for Squirrelly Merlies, LLC. It is further recommended that the annual liquor license for EZ Stop II and the five-day special event liquor license for Driftless Catering, LLC also be approved on the same resolution. /ksf RESOLUTION NO. 343-19 APPROVING APPLICATIONS FOR BEER, LIQUOR, AND/OR WINE PERMITS, AS REQUIRED BY CITY OF DUBUQUE CODE OF ORDINANCES TITLE 4 BUSINESS AND LICENSE REGULATIONS, CHAPTER 2 LIQUOR CONTROL, ARTICLE B LIQUOR, BEER AND WINE LICENSES AND PERMITS Whereas, applications for Beer, Liquor, and or Wine Permits have been submitted and filed with the City Council for approval and the same have been examined and approved; and Whereas, the premises to be occupied by such applicants were inspected and found to comply with the Ordinances of the City and the applicants have filed the proper fees and bonds and otherwise complied with the requirements of the Code of Ordinances. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Clerk is hereby authorized and directed to cause to be issued the noted permit types to the following applicants pending submission of the locally required documentation: New EZ Stop II 700 Rhomberg Ave. Class E Liquor, Class C Beer, Class B Wine (Sunday) Special Events Squirrelly Merlies, LLC 145 N.
