SUBJECT: Adoption of Supplement No. 33 to the Code of Ordinances

INTRODUCTION
The purpose of this memorandum is to submit to City Council a resolution adopting
Supplement No. 33 to the Code of Ordinances of the City of Dubuque.
DISCUSSION
The attached resolution provides for the adoption of Supplement No. 33 to the City of
Dubuque Code of Ordinances, which codifies Ordinance Nos. 27-19, 32-19, 33-19, 34-
19 and 37-19 through 47-19 as approved by City Council through September 4, 2019.
Supplements to the Code of Ordinances are prepared by Sterling Codifiers, Inc., of
Coeur d'Alene, Idaho.
ACTION STEP
The requested action is for the City Council to pass the resolution adopting Supplement
No. 33 as a part of the Code of Ordinances of the City of Dubuque.

RESOLUTION NO. 378-19
ADOPTING SUPPLEMENT NO. 33 TO THE CODE OF ORDINANCES OF THE CITY
OF DUBUQUE, IOWA
Whereas, under date of August 17, 2009, the City Council, pursuant to Ordinance
No. 43-09, readopted the Code of Ordinances of the City of Dubuque, Iowa in its
entirety; and
Whereas, since August 17, 2009 the City Council of the City of Dubuque, Iowa has
adopted certain ordinances amending the Code of Ordinances and said amendments
have been printed as supplements to the Code of Ordinances; and
Whereas, Section 380.8 of the Code of Iowa provides that supplements, by
resolution, become part of the Code of Ordinances.
Whereas, Code Supplements are prepared by the Sterling Codifiers, Inc., and filed in
the Office of the City Clerk of the City of Dubuque, Iowa.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Supplement No. 33 to the City of Dubuque Code of Ordinances,
which codifies Ordinance Nos. 27-19, 32-19, 33-19, 34-19 and 37-19 through 47-19 as
approved by City Council through September 4, 2019 is hereby adopted and becomes
part of the Code of Ordinances of the City of Dubuque, Iowa.

nel, accounting, budgetary, and procurement policies of the

A. Composition: The commission comprises nine (9) residents of the �
City, appointed by the City Council. ,j

B. Age Requirement: Residents must be eighteen (18) years of age or I;i

C. Qualifications: ;
1. Four (4) members must be residents of census tracts and block '�?
groups where at least fifty one percent (51%) of the residents are I�
low/moderate income persons as determined by the United States I�
Department of Commerce, Bureau of the Census. �

2. Four (4) members must be resider�ts of the cornrnunity at-large. � i

3. One member must be appointed by and from the mernbership of ,�
the Housing Commission, with approval from the City Council. (Ord. �k,�

2-5C-6: OATH: Each person, upon appointment or reappointment to �
the commission, must execute an oath of office at the first �
meeting of the commission following the appointment or reappointment or at !
the City Clerk's Office any time prior to the first meeting of the commission.

2-5C-7: TERMS: The term of office for Commissioners is three (3)
years or until such Commissioner's successor is appointed
and qualified, provided, however, that the term of the cross-representative
appointee from the City of Dubuque Housing Commission must coincide

E. Minutes: A copy of the minutes of all regular and special meetings of �
the commission must be filed with the Ci#y Council within ten (10) �

F. Quorum: Five (5) Commissioners constitute a quorum for the trans-
action of business. The affirmative vote of a majority of the Com-
missioners present and voting is necessary for the adoption of any

tion, provided that they may receive reimbursement for neces- i
sary travel and other expenses while on official commission business within �

I. To support, upon request, the efforts of the City Council and other �
City commissions in the assessment of the general development ��'

2-5C-14: GRIEVANCE PROCEDURE; REVIEW STANDARDS; iI
APPEAL PROCESS: The grievance procedure for the CDBG �'

program is as follows:

A. Any aggrieved person may file a grievance with the City Manager. '�

B. Grievances must contain a concise statement of the grievance and li
an explanation of the action desired. i

C. The City Manager must forward the grievance to the commission ;;;
within seven (7) business days of its receipt. ,I

D. The commission, within fifteen (15) working days of the receipt of the �
grievance, must set a time for a hearing. The complainant must be I
notified in writing of the time and place of the hearing. If a grievance �
is resolved prior to the date of the hearing, the aggrieved party must I'.
request in writing that the grievance be withdrawn. p

E. The commission must conduct a hearing to review the grievance. �'
The grievant may appear in person, by agent, or by attorney. All �
persons wishing to appear before the commission have an opportu- ��:
nity to be heard regarding the grievance. Minutes must be kept of �
the proceedings of the hearing. i

� F. The commission must forward its recommendation, in writing, to the ,

LISHED: There is hereby established a Residential Parking
Permit Program. The procedure for being designated a Residential Parking
Permit District shall be as follows:
A. Petition:
1. Required: In order to be considered for a Residential Parking Per-
mit District designation, a group of residents must submit a petition

to the City Manager containing the signature of an adult member of
at least sixty percent (60%) of the dwelling units in the residential ��
area. Petitions shall only be considered for areas which contain at ;
least four (4) adjacent block faces or fifty (50) curb parking spaces. �
The boundaries of and the streets within the proposed permit parking ,�
district shall be clearly identified on each page of the petition. The i�
petition shall also state clearly that, if the district is approved that �
participation in the program is mandatory, only those vehicles with a �
permit shall be permitted to park in the Residential Parking Permit
District between seven o'clock (7:00) A.M. and five thirty o'clock
(5:30) P.M. daily, or such other hours as may be requested by the j ;
petition and approved by the City Council, except Sundays and � i
holidays, and an annual fee will be charged for a parking permit for �,
each vehicle. The necessary petition can be obtained from the Office
of the City Clerk. A cover letter explaining the reasons for the �
request and a map showing the boundaries of the proposed parking i
permit district shall accompany the petition. ��j

2. Exception: A petition may be considered for an area which con- I
tains less than four (4) adjacent block faces or fifty (50) curb parking ;;
spaces if there are extenuating conditions that render such require- !��
ment unreasonable. Upon the recommendation of the City Manager, �i
such requirement may be waived by the City Council if it finds that l
the proposed Residential District is isolated or separated from other �� �
residential areas by topographical features or by cornrnerciai area.

The City Council shall not grant such a waiver, however, if it deter- ��
mines that the only basis for granting such a waiver is the conven- 'I�
ience of the residents or if it determines that the waiver is being �
requested by the petitioners to prevent opposition to establishing a
district. All other requirements of this division must be established. i

3. Consideration: A petition for creation of a Residential Parking ��
Permit District in an area may only be submitted for consideration �
once per quarter. N

B. Parking Study: Upon receipt of a valid petition, the City Manager � �
shail cause a parking sivay ot Yne area identitiea in tne petition to be �
conducted. A Residential Parking Permit District may be established �
only if the results of the study demonstrate that the following
criterions are satisfied during peak periods:
1. At least seventy percent (70%) of the curbside parking spaces in
the proposed parking permit district were utilized during peak �
periods. For purposes of this criterion, a legal curbside parking
space shall be twenty three (23) linear feet.

� 2. At least twenty five percent (25%) of the curbside parking spaces
in the proposed parking district were utilized by nonresident parkers. '
For purposes of this criterion, the latest available motor vehicle �
registration information shall be used.

3. The parking study will be completed within thirty (30) days of ;
receipt of the petition, except in specific circumstances deemed !
necessary by the City Engineer. �l

4. No more than four (4) site visits will be completed as part of a �
parking study, except in specific circumstances deemed necessary �
� by the City Engineer. �

5. In order to receive a recommendation to the City Council for j�
crea�ion of a Residential Parking Perrnit District the conditions in '�
subsections B1 and B2 of this section must be met a minimum of ;;
one time during the site visits. ��

C. Parking Study Report And Recommendation: Upon completion of the °
parking study, if the conditions of subsection B of this section are �C,
established, the City Manager shall make a report and recomrraenda- ;I
tion to the City Council, based upon the petition and results of the ;i
survey, on whether or not to designate the proposed parking district �
( or a portion thereof as a Residential Parking Permit District and the ;�
hours such res�rictic�ns are to be in effieci. �fhe recor�rnendatio� shall �
take the following into account:
1. The effect on the safety of the residents of the proposed Residen- �
tial Parking Permit District from intensive parking by nonresidents; �
2. The di#ficulty nr inability of residents of the proposed Residential �
Parking Permit District to obtain adequate curbside parking adjacent �
to or near their residences because of widespread use of available �
curbside parking spaces by nonresident motorists; '
� 3. The likelihood of alleviating, by use of the Residential Parking
I�
� Permit Program, any problem of nonavailability of residential parking �
spaces; and
4. The desire of the residents in the proposed residential parking
permit area for the institution of a Residential Parking Permit District
and the willingness of those residents to bear the cost incidental to
the administration of the Residential Parking Permit Program.

D. Public Hearing: Upon receipt of the report and recommendation from �` I,
the City Manager, the City Council shall set a public hearing on the
petition. Upon completion of the public hearing, the City Council may
reject the petition or adopt an ordinance designating the permit area ;�
as a Residential Parking Permit District and the hours such parking ''I�
restrictions are to be in effect. :

1. Amendments to the existing districts for expansion or reduction of '1
the district must be requested by submitting to the City Manager a 'i�

The owner of a nonresidential building in a parking permit district r
which was formerly a residential building may apply for residential '
parking permits as provided herein. The number of permits which '
may be issued for such nonresidential building shall be limited to the �
number of permits that would have been available when the building �

B. The residential parking permit shall be permanently affixed to the ;j
inside bottom left corner of the front windshield. Guest permits shall '�
be prominently displayed. Vehicles not equipped with a front wind- �
shield shall permanently affix the permit in a prominent location. � :�

C. No residential parking permit shall be issued for a vehicle whose ;I
owner or principal operator is not a resident in the designated Resi- �
dential Parl�ing Permit District. �

D. The applicant for, and holder of, the residential parking permit shall !�
be the owner or principal operator of the vehicle receiving the park- �
ing permit. �

E. The users of guest permits shall be for the primary purpose of visit- �i
ing the principal permit holder's residence and must be at the prem- ;I
ises while the guest permit is being utilized. �

A. The residential parking permit shall be renewed annually during the i
month of August and expires on August 31 of each year. �!

mit application, the holder shall receive a new parking permit valid �

9-14-321.728: RESPONSIBILITY OF PERMIT HOLDER: ;;

A. The holder of a residential parking permit or guest parking permit �
�' shall be permitted to stand or park a motor vehicle operated by such �I�
holder in the designated Residential Parking Permit District during '

such time as the parking of such vehicles therein is permitted. While 'I
such vehicle for which a residential parking permit has been issued �
is so parked, or a vehicle displaying a visitor peri�it, such perrlit '
shall be displayed as prescribed in this division.
B. A residential parking permit or guest parking permit does not guaran- I�,�
tee or reserve to the holder a parking space within the designated ';
permit parking district. A parking permit does not authorize the �,
standing or parking of any vehicle in such places and during such ��
times as the stopping, standing, or parking of vehicles is prohibited '�
,
or set aside for specific types of vehicles and does not excuse the ;;
� violation of any traffic regulation in the Residential Parking District. ';

C. Whenever the holder of a residential or guest parking permit, or the ;
vehicle for which the parking permit was issued, no longer fulfills one N
or more of the applicable provisions of this division controlling !�
issuance, renewal, or transfer of parking permits, the holder shall so ',�

(d) Maintenance. All electrical systems and equipment, both �
existing and new, and all parts thereof shall be maintained in u
a proper operating condition in accordance with the original �i

design and in a safe and hazard-free condition. Any devices ;;
or safeguards which are required by this code shall be main- j��
tained in conformance with this code. The owner or desig- �
nated agent shall be responsible for the maintenance of the �
electrical system. To determine compliance with this subseo- i

The details of any action granting approval of an alternate shall be
recorded and entered in the files of the code enforcement agency. �

80-6. Modifications. Whenever there are practical difficulties involved '�
in carrying out the provisions of this code, the building official may ��
grant modifications for individual cases, provided it is found that a ',;
special individual reason makes the strict letter of this code impracti- ;�
cal and the modification is in conformity with the intent and purpose
of this code, and that such modification does not lessen health, life, #
and fire safety requirements. The details of actions granting modifi- � i

cations shall be recorded and entered in the files of the code �

80-7. Tests. Whenever there is insufficient evidence of compliance �!

with any of the provisions of this code or evidence that materials or �

state of lowa class "A" or "B" master or journeyman electrical
license.

(c) Exempt Systems And Utilities. An electrical permit shall ;

(1) Electrical wiring, devices, appliances, apparatus, or
equipment operation at less than twenty-five (25) volts and i
not capable of supplying more than fifty (50) watts of energy. j

(2) Low energy power, control, and signal circuits of �
classes II and III as defined in this code. i

(3) A permit shall not be required for the installation,
alteration, or repair of electrical wiring, apparatus, or equip-
ment for the generation, transmission, distribution, or meter-
ing of electrical energy, or in the operation of signals or the �
transmission of intelligence by a public or private utility in the
exercise of its function as a serving utility. i
Exemption from the permit requirements of this code shall not
be deemed to grant authorization for any work to be done in
violation of the provisions of this code or any other laws or
ordinances of this jurisdiction. �

82-2. Permit Process.
(a) Application For Permit. The applicant for an electrical
permit must be one of the following:
(1) The homeowner as defined elsewhere in this ordi- a
nance; or,

master electrical licensee and affiliated with an electrical `,!
contracting firm or business that is also licensed by and '�
registered with the state of lowa.

(b) Application. To obtain a permit, the applicant shall first file �
an application therefor in writing on a form furnished by the :

(2) Describe the land on which the proposed work is to �

sets with each application for a permit. The building official '
may require plans, computations, and specifications to be
prepared and designed by an engineer or architect licensed
by the state of lowa to practice as such.
EXCEPTION: The building official may waive the submission
of plans, calculations, etc., if it is found that the nature of the �

(a) Issuance. The application, plans, specifications, and other j
data filed by an applicant for permit shall be reviewed by the �
building official. Such plans may be reviewed by other depart-
ments of this jurisdiction to verify compliance with any appli-
cable laws under their jurisdiction. If the building official finds ; ;

writing or stamped "APPROVED". Such approved plans and
specifications shall not be changed, modified, or altered �"
without authorization from the building official and all work
shall be done in accordance with the approved plans. l

The building official may issue a permit for the construction of
part of an electrical system before the entire plans and
specifications for the whole system have been submitted or
approved, provided adequate information and detailed state-
ments have been filed complying with all pertinent require-
ments of this code. The holder of such permit shall

� 83-10. Suspension Of Permit Privilege For Multiple Violations. Where
a licensed electrical contractor is found doing electrical work without
an electrical permit on three (3) separate occasions in one (1) year, �
a hearing shall be held by the building official at which time the
permit privileges of said electrical contractor may be suspended for a
period of time not to exceed one (1) year. The members of the '�
Dubuque electrical code board as established by article 81-3 shall be
present at such hearings and shall act as advisors to the building
official in determining what course of action should be taken.
