The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant, Steve Knepper, spoke in favor of the request. He reviewed his proposal
noting the condition of the building when he purchased it and that he is asking for the
proper zoning for a four-plex.
Staff Member Wally Wernimont reviewed the staff report, noting its current configuration
as a four-plex and that it was converted illegally sometime after 1996. He stated that R-
3 zoning allows for up to six units. He also noted that the property is compliant with off-
street parking. He explained that all property owners within 200 feet were notified of the
rezoning request. He concluded by noting that the request would be an expansion of an
existing R-3 zoning district.
There were no public comments.
The Zoning Advisory Commission discussed the request reviewing the current
configuration of the building and the history of zoning in the neighborhood.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The property is part of the Kelly's Subdivision. On July 5, 1996 a
foundation permit was issued for a future duplex. Only September 17, 1996, a permit
was issued to erect a duplex on the foundation. On June 3, 1999, a permit was issued
to erect a 20' x 32' detached garage.
Physical Characteristics: The subject property is an approximate 8,272 sq. ft. lot with
approximate dimensions of 47 feet wide by 176 feet deep. There is a two-story, side-
gable, framed duplex (built 1996), a two-car garage (built 1999), a paved driveway with
access off of the alley and a paved off-street parking pad with access from W. 8ih Street
located on site. The property is bordered by a single-family residence at 745 W.B�n
Street to the east, W.8'h Street to the south, a single-family residence at 769 W. g�n
Street to the west and an alley to the north. The property is accessed from both W.B�n
Street and a rear alley. There is a sidewalk located across the front of the property.
Concurrence with 2017 Imagine Dubuque Comprehensive Plan: The
Comprehensive Plan encourages:
1) A mix of housing affordable for all segments of Dubuque's population throughout
the community, including options for those who might be saving for their first home.
2) New multi-family development in proximity to jobs to minimize transportation costs.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.

Traffic Patterns/Counts: There are no traffic counts available for W.8�h Street or in
close proximity to the subject property. Staff anticipates that rezoning this property
will generate little additional traffic.
Public Services: Existing public services are adequate to serve the property.
Environment: Staff does not anticipate any adverse impact to the environment with
the conversion from a duplex to a four-plex as the site is fully developed and the
building is not proposed to be expanded.
Adjacent Properties: The subject property is bordered by single-family residences.
Rezoning the property to R-3 to accommodate the conversion of the building from a
duplex to a four-plex may slightly increase the amount of activity and traffic over
and above that which would be typical of a duplex. The off-street parking
requirement for a four-plex is 6 paved off-street parking spaces. The property has
the required amount of paved off-street parking spaces.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone a duplex from R-2A Alternate -
Two-Family Residential to R-3 Moderate Density Multi-Family Residential. This is
an expansion of an existing R-3 Moderate Density Multi-Family Residential zoning
district. The rezoning, if approved, will allow the conversion from a duplex to a four-
plex.
The R-3 Moderate Density Multi -Family Residential District allows residential
dwellings ranging from single-family detached dwellings up to a six unit multi -family
buildings. These dwelling units can be in the form of townhouses, condominiums or
apartments. Attached to this staff report is a copy of the R-3 District standards that
list the allowed uses and the bulk regulations. Required off-street parking is 1.5
spaces per dwelling unit for multi -family dwellings, or 2 spaces per dwelling for
single-family residential. The R-3 District requires that there be a minimum of 2,000
square foot of lot area for each unit.
If approved, the property would be incompliance with the required amount of lot
area and off-street parking for the proposed four-plex.
Staff recommends the Commission review Article 9.5 of the Unified Development Code
regarding property reclassification.

ORDINANCE NO. 48-19
AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 757 W. 8th STREEST FROM R -2A ALTERNATE
TWO-FAMILY RESIDENTIAL DISTRICT TO R-3 MODERATE DENSITY MULTI -FAMILY
RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter—described property
from R -2A Alternate Two -Family Residential District to R-3 Moderate Density Multi -Family
Residential District, to wit:
W 4T S 175'6" - Lot 29 Kelly's Sub, and to the centerline of the adjoining public
right-of-way, all in the City of Dubuque, Iowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication as provided by
law.
