Council met at 7:35 P. M.

Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.
Councilman Schuckert moved to
suspend the rules for the purpose of
allowing any one present in the
Council Chamber, who wishes to do
so, to address the Council. Second-
ed by Councilman McEvoy. Carried
by the following vote:

Messrs. Stampfer and Gonner ad-
dressed the Council requesting that
the City Council rescind their prev-
ious action in discontinuing the
sprinkler alarm service at the Ninth
Street Fire Engine House, the same
to become effective July 1st, 1933.
Councilman McEvoy moved to re-
fer this matter to the City Council
for further consideration. Seconded
by Councilman Thompson. Carried
by the following vote:

Mr. John Chalmers, Chairman of
the Aviation Committee of the
Chamber of Commerce, addressed

communicate with the Senator and
Representatives of Dubuque County
notifying them that the City Council
of the City of Dubuque approves the
passage of legislation for the control
of telephone rates and service. Sec-

in connection with the letter ad-
dressed to Council by the writer
February 3rd pertaining to the de-
sire of Mr. Wm. Glab' of Morrison
Bros. that Council fill the vacancy
existing in the office of Inspector of
Boilers, as authorized on March 20,
1926, by resolution of Council, that
at a special meeting of Council held
Thursday, February 23rd, the name
of Mr. James Lonergan was suggest-
ed by the Council and unanimously
approved as Boiler Inspector.
For your information, Mr. Loner -
gan was interviewed this morning
and he advises that he shall pro-
ceed at once to secure the test from.
the A. S. M. E. Society and will
attempt, at the earliest possible
time, to secure the official rating
from this organization as is required
by the resolution.

to the error by the City of Dubuque
paying for bonds of employees with
the exception of the City Treasurer.
The decision in the 1931 -32 budget
was that all bonds, except the Treas-
urer's bond, were to be paid by the
individual.
The bond of Mr. Bartels is up for
renewal and the rate has been in-
creased from $4.00 to $5.00 per thou-
sand. We ask your consideration
toward the reduction of this bond
to $1,000 similar to the present
amount of the Electrical Inspector,
the Secretary to the City Manager,
Plumbing Inspector, the Market Mas-
ter, City Clerk, City Solicitor and
others.

Gentlemen: This is to confirm
your decision made at a special
meeting of City Council held at 2:30
Friday, March 3rd, 1933, in connec-
tion with furnishing tools, materials
and workmen's compensation for the
men to be furnished by the local
County Work Relief Committee for
emergency work within the City of
Dubuque.
It was explained that the State of
Iowa has made application for and
had been granted $45,000,000 from
the R. F. C. Funds for work relief;
that the Supervisors of Dubuque
County had made application for and
had been granted $59,500 for labor
to be expended to April 30, 1933
within Dubuque County.
Honorable Governor Herring has
appointed the following men, as the
personnel of the Dubuque County
Work Relief Committee: —
Chairman —Paul Naumann.
Supervisors Chas. Datisman, and
W. J. Malloy, and Chas. Landon and
Wm. Clemens.
Upon organization of the local
committee, the City of Dubuque was
asked to furnish suitable work, pro-
vide supervision and timekeeping for
the labor and provide all necessary
materials, supplies, tools, equipment
and possibly workmen's compensa-
tion in order to provide work for
the local unemployed. The local
committee shall select the labor and
payment for all labor shall be han-
dled through the local committee, by
warrants from Federal Funds.
After discussion and consideration
the City Council voted to accept the
proposition of the Dubuque County
Work Relief Committee and the City
Council authorized the purchase of
necessary tools, at lowest possible
prices, and authorized the payment
by the City of workmen's compensa-
tion, conditioned upon the decision
of the Attorney General whose opin-

ion is pending. The following gen-
eral projects were tentatively ap-
proved by the City Council for re-
lief work and the same are to be
submitted to the Dubuque County
Work Relief Committee: -
1. Relaying and repairing sunken
gutters on Roosevelt and other
streets.
2. Grading Stoltz St., Eleanor St.,
etc.
3. Cleaning debris, dirt, leaves, etc.
macadam and dirt streets.
4. Quarry rock, crush and haul to
muddy streets and alleys.
5. Cover r e c e n t l y constructed
storm sewers, as Hawthorne St.,
Shiras Ave., Southern Ave., etc.
6. Straighten, widen, deepen open
channels from storm sewers on
14th, Garfield, Bee Branch, etc.,
toward the river.
7. Remove the tree stumps now
existing in city parkings be-
tween curb and sidewalk.
8. Straighten leaning curbs in
many unpaved streets.
9. Build wall and riprap present.
stone and rock on south side of
Ice Harbor.
10. Clean up along River Front,
shot - tower, River Park and
stream banks.
11. Reditch, gutter and slope dirt
and macadam streets and alleys.
12. Leveling of Playgrounds.
13. Improvement and grading at
Bathing Beach; change location
of discharge of Peosta Slough
at low water stage.
14. Leveling of Dumping Grounds.
15. Removal of weeds, grass and
trash in streets.
16. Cleaning sewers and catch bas-
ins.
17. Painting hand rails on city
steps.
18. Repairs to brick sections of
street from curb to curb on 1st.

been tentatively approved by the City Council as its budget
for the fiscal year ending March 31, 1934 This budget will
be considered for final adoption by the City Council at a
special meeting to be held in the Council Chamber at the

to this Board of Health that small-
pox, in epidemic form, is prevalent
within said City and, therefor, this
Board deems it dangerous to the
public health to permit children who
cannot show satisfactory evidence of
vaccination within the past seven
years to attend public, private or
parochial schools while the emerg-
ency caused by such epidemic ex-
ists, Now, Therefore:
Be It Resolved by the Board of
Health of the City of Dubuque, that
no child shall be permitted to at-
tend a public, private or parochial
school in this city unless such child
can show satisfactory evidence of
having been vaccinated against
smallpox within the past seven
years, this restriction, however, to
be in force only during the time of
the existence of the present emerg-
ency caused by an epidemic of
smallpox.
Be It Further Resolved that the
Chairman of this Board, after this
Resolution has been approved by
the Council of said City, be and he
is directed to cause to be published
in the official newspaper of the City
of Dubuque a public Proclamation
setting forth therein the promulga -,
tion of the regulation, as set forth
herein.
Be It Further Resolved that the
regulation provided for in this Reso-
lution shall become effective ten
days after the publication of the
Proclamation herein provided for
and the principal, teachers and
those in charge of public, private or
parochial schools shall receive a no-
tice thereof, and thereafter it shall
be their duty to exclude such chil-
dren from such schools.
Be It Further Resolved that a
violation of this regulation shall
subject the offender to punishment
as provided for by the Ordinances
of the City of Dubuque.
Be It Further Resolved that the
Health Director be and he is hereby
instructed to advise this Board as
soon as the emergency has passed
and, thereupon, this regulation shall
become null and void.

Resolution No. 3 -33.
Whereas, the City Manager has
caused to be prepared a budget of
estimated receipts and expenditures
for the fiscal year 1933, and the
same has been tentatively submitted
to this Council as a basis for the
preparation of the Annual Budget
required by law to be prepared by
the Council; and,
Whereas, this Council has exam-
ined such budget and from the infor-
mation therein contained has pre-
pared its budget on the basis of
estimates of the expenditures of the
several departments of the City of
Dubuque, showing therein the pur-
poses for which the estimated in-
come from tax levies and miscel-
laneous receipts will be used, so
that said budget will show all of the
proposed expenditures for the ensu-
ing year. Now, therefore,
Be it Resolved by the Council of the
City of Dubuque:
That the Manager's budget be and
the same is hereby tentatively ap-
proved and the same is adopted as
its budget for the ensuing year, 1933.
Be it further resolved, that the
Clerk be and he is hereby directed
to cause said budget to be published
in the official newspaper of this city
at least once, said publication to be
made at least two weeks in advance
of the date set herein for final hear-
ing thereon and adoption thereof.
Be it further resolved, that this
Council meet on the 22nd day of
March, 1933, at 7:30 o'clock P. M.,
in the Council Chamber at the City
Hall, for the purpose of conducting
a hearing upon the Manager's bud-
get and the Council's budget, at
which time any tax payer of the
City will be given full opportunity
to be heard upon any objections or
protests made thereto, or to any
item or items thereof or to any omis-
sion therefrom, and after all parties
have been heard, said budget will be
amended or adopted, as prepared.

year from April 1st, 1933, to March

business that may properly come be-
fore a regular meeting of the City
Council.

Whereas, the Board of Health of
the -City of Dubuque has adopted a
resolution containing a regulation to

The following budget of expenditures for the fiscal year
April 1, 1933 to March 31, 1934, on the basis of expenses for
the several departments of the City of Dubuque, Iowa, has
been prepared by the City Manager and such budget has
been tentatively approved by the City Council as its budget
for the fiscal year ending March 31, 1934 This budget will
be considered for final adoption by the City Council at a
special meeting to be held in the Council Chamber at the
City Hall on the 22nd day of March, 1933, at 7:30 o'clock
P. M. Any taxpayer objecting thereto or protesting to the

WHEREAS, a budget of proposed
expenditures for the fiscal year 1983
has been duly prepared by the City
Manager, published as required by
law and submitted to this Council
for approval, and,
Whereas, the Council has prepared
its budget of proposed expenditures
for the fiscal year 1933 and published
the same as provided by law, and
an opportunity has been offered all
who might wish to file objections
or protests to the same and the time
for final action thereon having been
fixed as the 22nd. day of March,
1933, and,
Whereas, any and all objections
thereto have been duly considered
by this Council and to any item
therein and no changes have been
proposed or made in said budget
and this being the day for final con-
sideration thereof:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque, that said budget of proposed

at his own expense, this is to advise
that the City Council ordered the
same to be viewed by the Council,
which view was held about 4:30 P.
M., March 15th.
The original idea of Mr. Roth's
was to reduce the intersection to
such an extent that the sidewalk
would have to be built upon private
property. The City Council decided,
'after viewing the ground, that they
did not approve of the diversion of
the sidewalk and felt that the two
outside lines of the present side-
walks should intersect, with ample
room for pedestrians to wait at this
intersection for passing automobile
traffic. Accordingly, the decision w'as
to refer the question to the City
Engineer, with authority that pos-
sibly a 15 -foot radius could be in-
stalled which would still permit the
sidewalk to be erected on the two
intersecting streets; further, that
permission was granted to install
the runways from the curb to the
property little 'on both RhombeYg
Avenue and Humboldt Street, with
the condition that excessive grades
across the sidewalk would not be
permitted.

Gentlemen: This is a record of a
special meeting of City Council call-
ed for Thursday evening, March 9th,
at 7:30, by the Mayor. The meeting
was attended by all Councilmen.
The Mayor discussed the question
of the possibility of securing the up-
per and lower parts of Ham's Island.
Consideration was given to a propo-
sition submitted to the Council by
Mr. John G. Chalmers Sr. in regard
to the securing of the Papin tract,
by deed, consisting of 82 acres, more
or less, and the Mayor explained
that the Interstate Power Company
might issue a long term lease to the
City for possibly as low a price as
the yearly taxes on said property.
Plans were discussed as to securing
from the Lacy Estate additional
property south of the Papin tract for
necessary airport runways.
On motion by Councilman Mc-
Evoy, seconded by Councilman
Thompson, a committee was named,
including Mayor Andelfinger, City
Solicitor Czizek and Mr. John, G.
Chalmers, chairman of the Dubuque
Chamber of Commerce Aviation
Committee, to try to make arrange-
ments and 'submit to Council at a
later date, for the tentative accept-
ance of agreements to secure certain
portion of Ham's Island conditioned
on the securing of • the War Depart-
ment's activity in filling certain low
portions of said island by pumping.

Since that date, through the fact
that the lots were partially owned
by persons residing in California, it
was impossible to secure a deed
until last week. The City now has
the deed and the same is being re-
corded and the writer requests auth-
ority to make sale of this property
on the conditions set out in the min-
utes of March 2nd, namely for
$300.00.
For your information, Lot 19 is 50
feet wide, with a depth across the
major portion of same of approxim-
ately 70 feet. Lot 18 is a 50 foot
wide lot, having a depth of about
206 feet. Both lots are on a rock
cliff, the grade of which starts on
the property line at the sidewalk
and the cut necessary at the rear of
the house, similar to one built on
Lot 17 immediately east thereof,
would probably be 8 feet
The total cost in which the City
is involved on said lots is $728.73.
The purpose of this letter is to
again secure authority on the condi-
tion that the deed was not secured
for approximately two years from
date of previous authority.

Gentlemen: Information has been
presented by Mr. A.' H. Hoefer of
Glen Oak Street and also Mr. C. E.
Rhoades of the Dubuque Auto Club
advising of the inadequate lighting
facilities at the diagonal intersec-
tion of Julien Avenue and Glen Oak
Street. At this particular intersec-
tion there is no street light at pres-
ent. On parallel streets, including
Wood, Mt. Pleasant and Booth
Streets, there is one street light be-
tween Julien Avenue and West 14th
Street, while on Glen Oak there are
two street lights between West 14th
Street and Julien Avenue.
It is the writer's recommendation
that the present street light about
200 feet north from Julien Avenue
on Glen Oak Street be moved to the
intersection of Julien Avenue and
Glen Oak and that the present light
on Glen Oak Street about 300 to 400
feet south of West 14th Street be
moved from one to two poles closer
to Julien Avenue to more nearly the.
position of the curve or bend in said
street.

tion 2. That for the purpose of con-
venience the fund which is made up
from money received from the Con-
solidated Tax Levy, moneys and
credits and miscellaneous receipts
shall be designated and known as
"General Fund."
Par. 296. SURPLUS. Section 3.
That any surplus remaining above
these appropriations shall be and
the same are hereby set apart to
be appropriated as contingencies
arise or may be applied upon such
municipal improvements as the
Council may determine upon. Any
surplus remaining in any fund at the
close of the fiscal year 1932, except
such as have been levied for special
purposes shall be transferred into
and become a part of the General
Fund.
Par. 297. DISTRIBUTION. Sec-
tion 4. That the distribution and
division of the above appropriations
shall be made in accordance with
the budget of the City Council ad-
opted on March 22, 1933, which bud-
get is made a part of the ordinance
by reference thereto and shall be
considered in connection with the
expenditures of said appropriations.
Par. 298. EMERGENCY CLAUSE.
Section 5. This ordinance in the in-
terest of the preservation of public
peace, health, safety and the gen-
eral welfare of the City of Dubuque
and the inhabitants thereof, being
deemed urgent and of immediate
necessity shall be in force and ef-
fect from and after its final passage,
adoption and approval by the City

Arthur M. Meyers for damages
caused to his premises due to the
backing up of the sanitary sewer at
