Gentlemen:
At the Council meeting of May
15th a letter was presented from the
writer to Council in connection with
the request of Mr. Charles Joseph
Healey for a cancellation of water
and sewer assessments on a portion
,June 5th, 1933 127
of Lot 245, Central Avenue. The
original letter is attached hereto.
The writer was instructed to as-
certain if said property had been sold
at tax sale. This is to advise that
according to Mr. Puls' investigation,
no tax sale has been made to date.
For your information, the status of
the taxes and special assessments up
to May 17, 1933 is as follows:
Regular 1932 tax — $49.42. Unpaid,
but can still be paid at face up to
July 1, 1933.
The paving assessment was origin-
ally $96.96 against said lot. Two
payments have been made to date,
one to County Treasurer and 0116 to
the City Treasurer, but the third
payment of $13.68, due March 31,
1933, has not yet been reported paid.
Regarding the sewer and water
connections to said portion of Lot
245, no payments have been made
on the same. The original $67.22
has been increased up to May 17th
by an additional $11.24.
The paving, sewer and water as-
sessments on this portion of Lot 245
were all made out in the name of
Mr. Charles J. Healey and not the
Mettel Land Company. Notices con-
cerning said assessments were sent
to Mr. Healey.

WHEREAS, a sanitary sewer has
been so constructed by the City of
Dubuque in Thomas and Farley
Streets that connection therewith
can be made from Lot Number Forty -
five (No. 45), Althauser Subdivision,
Ben L. Ernst, owner, but said lot has
not been assessed for the cost of con-
structing said sewer and said Ben L.
Ernst is now desirous of connecting
said lot with said sewer; and,
WHEREAS, it has been deter-
mined that a fair and equitable as-
sessment for said sewer against said
lot is Seventy Dollars and ninety
cents, ($70.90); NOW, THEREFORE
Be it Resolved by the City Council
of the -City of Dubuque,
That said Ben L. Ernst be and he
is hereby granted permission to con-
nect said Lot No. 45 Althauser Sub-
division with said sanitary sewer
upon payment to the City of Du-
buque of the sum of Seventy Dollars
and ninety cents, ($70.90), said pay-
ments to be made as follows:
$5.00 at the time this Resolution
is accepted by him and. approx-
imately $5.00 a month thereafter
until the whole amount is paid.
Be it Further Resolved that this
Resolution become effective after
passage and approval by the City
Council and when the provisions
thereof are accepted by said Ben L.
Ernst, said acceptance being en-
dorsed hereon.

gentlemen: In connection with the
request of the Continental Oil Corn-.
parry, dated June 5th and presented
to City Council on the same date,
requesting to eliminate the curbing
at the northwest corner of Locust
and West 5th Streets, please be ad-
vised, that the City Council, on the
afternoon of June 6th, viewed this
location and the decision, was as
follows:
Due to the fact that the, removal
of the curb at this intersection of the,
sidewalk on the west side of Locust
Street and the north side of West
5th, Street would permit cars to cut
around, this corner in such a way
as to endanger pedestrians, and in
view of the fact that an entrance to
the filling station at the intersection
of the two sidewalks on 5th and Lo-
cust Streets would prevent pedes-
trian s from waiting at this intersec-
tion for traffic to clear, prior to
crossing the street, the Council ruled
that they could not grant the
request.
They did approve, to a modified
degree, the original drawing desig-
nated B- 1867A -13A which shows a
curb at the intersection of the two
sidewalks, but Council consented to
the - increasing of the said radius. up
to a minimum of 20 feet. This will
not interfere with the, full 6 -foot side -
walk projection at the intersection
and will, provide a safe waiting place
for pedestrians standing at the, in-
tersection, while cars are passing.

dents on Booth Street, near Martha,
requesting that storm sewer facil-
ities be provided on Booth Street
from near Martha Street to West
West 14th Street was viewed and
considered by the Council on the
ground June 6th.
The decision, of Council was that
this is a necessary feature to pre-
vent the continuous washing of
Booth Street and Martha Street near
Booth and an effort should be made
to secure Federal aid on this pro-
ject.

Street be extended northwardly by
various alleys and highways to
Brunswick Street and that both Mar-
quette and Brunswick Streets be
graded.
Council viewed this location and
considered the requests on June 6th.
Due to the very rough topography,
especially on Brunswick Street, and
the rock cliff condition, it was
deemed impossible to consider this
construction at this time. Accord-
ingly, the ,petition was denied.

Gentlemen: On May 31st Mr. B.
G. Pierce, through Mr. W. F. Coop-
er of Dubuque, made application for
a continuance of a permit granted
in 1932 to again conduct a roller
skating rink on the .open lot at the
southeast corn er of Third and Lo-
cust Streets.
This matter was presented to
Council June 5th, was viewed by the
Council June 6th, and in connection
with the protest filed against said
roller skating rink, as well as those
in favor of same at this location,
Council deemed it necessary to de-
ny the petition. Accordingly, action
was taken to not permit this skating
rink to operate at this location at
this time.

Gentlemen: On May 2nd a peti-
tion signed by Irma W. Wallis, J. A.
Wallis and John A. Henschel was
presented to the City Council "re-
questing that Dillon Street be
graded and covered with cinders
from Grandview to the alley between
State Street and South Hill Street,
also that the alley between South
Hill Street and State Street, at the
north end of Dillon Street be graded.
This request was viewed by the
City Council June 6th and due to
the excessive amount of fill that
would be necessary, the decision "of
Council was that the work could not
be undertaken at this time.
In order to provide an entrance
to the home of Mr. J. A. Henschel
on Dillon Street, it was deemed ad-
visable to shape up the alley at the
south end of this property leading
from State Street and to grade
slightly said alley at the north end
of the same so that a continuous
alley would be provided, preventing
the necessity of a turn thoroughfare.

Gentlemen: On a tour of the City
June 6th, City Council were shown
a condition that exists at the rear
of Mrs. Brede's Lot No. 4 at Vernon
and Mt. Pleasant Streets. Complaint
has been filed by Mrs. Brede against
the City due to the fact that in 1932
the alley east of Lots 4, 5 and 6 had
been graded at the request of own-
ers of Lots 13 and 14. Since the
alley had been graded, the garage
on the rear of Lot 4, belonging to
Mrs. Brede, which has no footings
underneath the walls, has shown
signs of failure. The garage was
built too high in regard to the grade
of Vernon Street and said alley
leading south from Vernon Street at
the rear of Lots 4, 5 and 6.
The decision of Council was that
the City was not to blame for the
condition of the garage due to the
fact that the grade of Vernon Street
and the approach of the alley off
Vernon Street had been established
and the garage had not been prop-
erly constructed in regard to the
street and alley grades.

ORDINANCE NO 9, -33.
An ordinance amending an ordinance
entitled "Ordinance No. 15, —32. An
ordinance authorizing Interstate Power
Company, its successors and assigns,
to substitute motor bus transportation
for street railway transportation in the
City of Dubuque; fixing a time for the
removal of rails, ties, poles, and appur-
tenances from the streets and t he
restoration of streets; designating mo-
tor bus routes; prescribing the places
for loading and discharging of passen-
gers; imposing conditions upon the
rights granted by this ordinance; pro-
viding for the continuance in effect of
all of the provisions of the franchise
ordinance of said Interstate Power
Company not inconsistent herewith;
and requiring an acceptance of the pro-
visions hereof," as amended by Ordi-
nance No. 20, —32, by repealing that
portion of paragraph 258, section 12,
Route 7, and enacting a substitute in
lieu thereof.
Be it Ordained by the City Council
of the City of Dubuque:
Par. 400. Section 1. That that por-
tion of Paragraph 258, section 12, desig-
nated Route 7 of an ordinance entitled,
"Ordinance No. 15, —32. An ordinance
authorizing Interstate Power Company,
its successors and assigns, to substi-
tute motor bus transportation for street
railway transportation in the City of
Dubuque; fixing a time for the removal
of rails, ties, poles, and appurtenances
from the streets and the restoration of
streets; designating motor bus routes;
prescribing the places for loading and
discharging of passengers; imposing
conditions upon the rights granted by
this ordinance; providing for the con-
tinuance in effect of all of the pro-
visions of the franchise ordinance of
said Interstate Power Company not in-
consistent herewith; and requiring . an
acceptance of the provisions hereof",
as amended by Ordinance No. 20, —39,
be and the same is hereby repealed and
that in lieu thereof, said Route 7 of
said ordinance shall be described as
follows:
"Route 7. Linwood, Mt. Carmel and
Cleveland Avenue route; commencing
at Davis street and Windsor avenue;
thence on Davis street to Sheridan
street; thence on Sheridan street to
Edith street; thence on Edith street
to Burden avenue; thence on Burden

Know all men by these presents:
That in consideration of $1.00 in
hand paid by the City of Dubuque,
Iowa, a municipal corporation, the
receipt whereof is hereby acknowl-
edged, the undersigned beiug the
owner of Lot 1 of 1 of 1 of Waller's
Subdivision at the northeast corner
of West Fifth and Delhi Streets in
the City of Dubuque, hereby grants
and conveys to said City of Dubuque,
a perpetual right of easement, in,
over and across said southwest cor-
ner of said Lot 1 of 1 of 1 of Wall -
er's Subdivision, described as a tri-
angle 7 feet along Delhi Street and
7 feet along West Fifth Street, for
the purpose of providing a proper
sidewalk of approximately 5 ft. in
width at the intersection of West
Fifth and Delhi Streets. This Grant
of Easement shall be binding upon
the undersigned, his heirs, executors,
administrators, purchasers and as-
signs forever.

Be it resolved by the City Council
of the City of Dubuque that the fol-
lowing, having complied with the
provisions of law relating to the sale
of cigarettes within the City of Du-
buque, be granted a permit to sell
that the money collected from the
citizens of Dubuque would be used
in the State of Iowa, but not neces-
sarily in the City of Dubuque and
the Council felt that local relief and
charitable organizations were better
able to take care of local conditions.
Accordingly, the petition was denied.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: Attached is a request
of Mr. M. C. Mai of 438 Main Street,
the operator of the former Bruns-
wick Billiard Parlor, which was pre-
sented to Council May 26, 1933, and
referred to the City Manager for fur-
ther investigation.
Mr. Mai's plea is that on April 10,
1933, he applied for and was issued
a license for five pool and billiard
tables, totaling $25.00. The license
fee was paid on date of issuance of
license. At the time of request for
license, Mr. Mai discussed with Miss
Demkier a possibility of refund on
said billiard table license in case of
change of occupation on said prem-
ises. In his letter to Council, Mr. Mai
stated that "no doubt a refund would
be made upon application." In our
conversation today, I find that he
was not guaranteed by this office a
refund, but that the thought that
possibly he might receive a refund
arose in his mind after having seen
refunds made on cigarette licenses
and other City licenses.
Following the approval of the beer
act, Mr. Mai was one of the first
petitioners for a Class B permit. He
was granted and paid for beer per-
mit No. 13 issued April 25, 1933, as
well as $10.00 for a restaurant li-
cense on the same date, totaling
$110.00. Immediately on granting of
his beer permit, he started to aban-
don the pool and billiard tables and

operated said five tables approxim-
ately four weeks from April 1, 1933.
At the date of issuance of license
No. 28 for these five tables, the old
Ordinance No. 61, dated January 3,
1920, was apparently in effect. There
is no mention in this ordinance of
any refund being permitted or not
permitted. In Ordinance No. 3, pass-
ed April 10, 1933, Section. 306 reads
as follows:
"No Refund. Section 8. Except as
may be provided by law, no refund
shall be allowed upon any license
which is actually used for a lesser
period than that prescribed in the
license."
According to the new Ordinance,
finally adopted April 18, 1933, being
designated Ordinance No. 4, the sec-
tion devoted to billiard and pool
halls has no mention of any refund
being permitted or not permitted.
Other sections of this same Ordin-
ance have conditions upon which a
refund cannot be granted.
This request for a refund 011 the
time basis of 11 -12 of the year for
the non -use of said five billiard and
pool tables may be in conflict with
the above noted Section 306. How-
ever, it would seem to the writer
that Mr. Mai complied with the Or-
dinance of the City of Dubuque even
with knowledge that the possibility
might exist that within a month he
would not use these same tables. It
is the writer's belief that if any legal
way exists to make this partial re-
fund, that it should be done.
