paving of this portion of Main Street
be awarded to the K -M Supply Com-
pany of Dubuque as their bid was
the lowest bid received and is on
the basis of reinforced concrete
paving.
For your information, the K -AI
Supply Company bid was signed by
Mr. R. J. Mulgrew of Dubuque,
Iowa, and the other member of the
K -M Supply Company is Mr. F. J.
Kennedy of Dubuque, Iowa. Mr. R. J.
Mulgrew states that he has been in
the general contracting business for
21 years. His principal paving work
has been on state highway projects
in Iowa, Illinois, Minnesota and Mis-
souri. Mr. Mulgrew has a superin-
tendent who has had 25 years of ex-
perience in highway and city paving.
His company owns and has at hand
a Koehring concrete mixer of S -bag
capacity and the same company has
also all necessary rollers and other
equipment that may be required on
said paving project.

Gentlemen:
Attached is an invoice from John
Roidl of 1905 Catherine Street, dated
October 4th, in the sum of $3.45.
This invoice is for damage done to
four windows at Mr. Roidl's home
Friday, September 29th, because of
blasting by the City in connection
with the widening of the roadway
on Catherine Street north of Angella
Street.
Immediately following the damage
to the windows, Mr. Roidl came up
to our foreman, Frank King, who
went down to his yard and saw the
broken glass lying on the window
sills and the yard immediately adja-
cent thereto. On October 2nd Mr.
Roidl came to my office advising of
these broken windows and demand-
ing that the City immediately repair
the same. He claimed that the cold
weather was interfering with the
use of the room in which the win-
dows were broken.
He presented the price of $2.15 for
the glass and agreed to have the
glass installed for $.80. He also
claimed two additional windows
were cracked and for which he
wants the sum of $.25 per window.
I present this information as a
claim from Mr. Roidl and recom-
mend the payment of the same.

At the October 2nd Council meet-
ing a petition from Dolor Meehan of
279 Valley Street requesting that he
be permitted to establish a news
stand at the northeast corner of 8th
and Locust Streets for operation on
Sundays only, was referred to the
City Manager.
Please be advised that I have dis-
cussed this question with the young
man, Dolor Meehan, who is 15 years
of age. He is apparently a bright
and energetic boy and desires to
place a small table or box at the
north curb line of 8th Street at the
east line of Peryon's Drug Store.
I have discussed this question with
Mr. Peryon, the druggist, and Mr.
Peryon has no objections to offer.
Papers will be sold from approxi-
mately 6:00 A. M. to 12 o'clock noon
on Sundays only.
The father of this boy works at
Carr, Ryder & Adams Company and
the young man says that he has
been selling papers for one year and
his family needs the additional rev-

Gentlemen:
Attached is an invoice from the
Dubuque Foundry for one new single
standard boulevard light post, total
$49.50, and also another invoice from
Geo. Kennelly for labor installing
said lamp post, together with ma-
terials, totalling $45.25. These two
invoices are in connection with the
former boulevard light standard on
the west side of Central Avenue
near the division line of the Stan-
dard Oil Company gas station at
Kauffmann Avenue and the Iowa
Dairy Company plant. This light was
knocked down September 10, 1933,
by F. Crim of 851 Kauffmann Ave-
nue. Mr. Crim had secured gasoline
from the Standard Oil Station at
Central Avenue and Kauffmann and
when he was ready to start, cranked
his car, which happened to be in
gear. The car had stood on the pri-
vate property of the Standard Oil
Company. In going forward, the car
hit the light standard on the west
side of Ceneral Avenue, above des-
cribed, and completely demolished
the same.
Prior to this accident, this post
had been struck at least twice in
the last year or so and had been in
a dangerous location in its original
position. Just a few days prior to
this accident, the Standard Oil Com-
pany officials made request to move
the post several feet toward the
north to locate the same in a new
parking area that would not be dis-
turbed by entrance to either their
station or the Iowa Dairy Company.
Permission was granted to move
this wiring and set the new post
providing the Standard Oil Company
stood the entire expense. After the
accident, the Standard Oil Company
did install a new base at the new
location, but the above mentioned
two invoices include additional labor
and materials necessary to furnish
the new post and equipment neces-
sary thereto.
On September 11th Mr. Crim ap-
peared at my office and stated that
he had been driving a Maxwell car
with Iowa license No. 31- 876 that
he had no insurance and no money
and did not know how he could pay
for the damage done to the light.
I present this information to Coun-
cil for decision upon the recommen-
dation of the City Solicitor.

second readings October 9th, 1933,

Ordinance No. 10 -33
An ordinance regulating the erec-
tion, maintenance and operation of
pens, buildings, yards, sheds and en-
closures, wherein live stock is col-
lected, kept or fed for commercial
purposes; prescribing sanitary rules
and regulations therefor, and declar-
ing the violation hereof a nuisance
and providing for the abatement
thereof.
Be it Ordained by the City Council
of the City of Dubuque:
Par. 402. Section 1. No person,
firm or corporation shall keep or
maintain within the corporate limits
of the City of Dubuque any pens,
buildings, yards, sheds or enclosures
wherein any cattle, sheep or swine
are collected, kept or fed for com-
mercial purposes unless such pens,
buildings, yards, sheds or enclosures
are erected, constructed and main-
tained as hereinafter provided.
Par. 403. Section 2. All such
pens, buildings, yards, sheds or en-
closures shall be erected and main-
tained with floors constructed of
concrete at least four (4) inches
thick with a smoothly trowled wear-
ing surface.
Par. 404. Section 3. All such con-
crete floors shall be constructed so
as to drain to a catch basin or
basins connected with the sanitary
sewage system of the City of Du-
buque, or in the event no such sew-
age system is in proximity to such
premises such catch basin or basins
shall be connected with or drain into
a cesspool approved by the Plumbing
Inspector of said City. Such cess-
pool shall be cleaned and disinfect-
ed as often as necessary to main-
tain the same in a sanitary condition
and so that it will not emit noxious
odors.
Par. 405. Section 4. All such pens,
buildings, yards, sheds and enclos-
ures shall be connected with the
city water system or other pressure
water system, and when in use shall
be flushed and cleansed with water
by use of a hose connected with
said water system at least once daily
except in freezing weather and shall
be kept thoroughly clean and free
ft om filth and noxious odors at all
times.
Par. 406. Section 5. Every such
pen, building, yard, shed, or enclos-
ure shall have erected and main-
tained in connection therewith a
water -tight covered container for re-
ceiving and hauling manure, litter
and refuse accumulating on said
premises between times of its re-
moval therefrom and all such man-
ure, litter and refuse shall be gath-
ered daily when such pens, buildings,
sheds, yards and enclosures are in
use and shall be placed in such con-
tainers. The contents of such con-
tainers shall be removed and hauled
away from the premises at least
every second day.
Par. 407. Section 6. The keeping
of cattle, sheep or swine in any pen,
buildings, yard, shed or enclosure
within the corporate limits of the
City of Dubuque in violation of the
provisions of this ordinance shall
constitute a nuisance and the same
may be restrained and abated as by
law provided.
Par. 408. Section 7. This ordin-
ance being deemed urgent and in
the interest of the preservation of
the public health, safety and com-
fort of the inhabitants of the City
of Dubuque shall be in force and ef-
fect from and after its final passage
and adoption by the City Council
and publication as provided by law.

ly's proposition to the City dated
September 14th, which was accepted
by Council September 18th, that the
work has been reinstated and, in
certain cases, new equipment in-
stalled to complete satisfaction of
the Electrical Department.
We have a check at hand for the
amount of the contract, namely
$1,540.00, from the National Reserve
Insurance Company.
There is one point in question,
however, on this proposition, namely
that five days after the contract
was drawn and presented to the
City, or on September 19th, a sec-
tional wire that had been knocked
down by the storm was stolen. The
theft was discovered by Mr. Ken-
nelly and reported to the Police De-
partment and the Police have been
unable thus far to identify the thief
and secure the return of the stolen
wire. In order to secure the lights
for the park, the Power Company
furnished wire necessary to replace
the stolen section. We have a bill
from them totaling $29.12 for wire
and materials only.
At a conference held this morn-
ing with Mr. Portenier, adjuster for
the insurance company, Mr. Kennel-
ly and Mr. Otto Bethke, the question
remains unsettled as to who shall
assume the cost of $29.12 for the
stolen wire and materials. The in-
surance policy did not cover any
theft, yet it is my contention that
had the wind storm not knocked the
wire down, it is quite likely that the
wire would not have been stolen.
Mr. Kennelly's contract in the last
item covers the complete replace-
ment of destroyed wires. According-
ly, he has agreed to assume an ad-
ditional $13.63 for labor performed
by the Interstate Power Company in
repleacing this stolen section of
wire.
In conclusion, I wish to advise
that the $29.12, the cost of the re-
placed wire that was stolen, is the
point in question.

site selected for said swimming pool,
namely, at the southeast corner of
Railroad Street and U. S. Highway
No. 61, and
Whereas, it is deemed advisable
by the Council to surrender the use
of this present city owned property
at the above mentioned location to
the Playground and Recreation Com-
mission for use of a swimming pool.
Whereas, it is deemed advisable
by the City Council of Dubuque,
Iowa, to 'authorize the application for
30% grant for labor and material and
a loan for the balance of the estim-
ated total cost of sixty thousand dol-
lars ($60,000.00) for said swimming
pool from the Federal Government,

Whereas, it is deemed necessary
by the City Council to secure for the
citizens of this municipality a mod-
ern and protected place for swim-
ming.

Whereas, the application prepared
by the Dock Commission of the City
of Dubuque, dated May 25, 1933, and
approved by the City Council, to
the R. F. C. for a loan of $150,000.00
for the purpose of securing neces-
sary land, constructing a coal and
ore terminal and buying equipment
for said operation has not yet been
approved by the R. F. C.; and
Whereas, it is believed by the City
Council of Dubuque that a possible
grant of 30% for labor and material
for the construction of this terminal
can now be secured from the Fed-
eral Government; and
Whereas, the construction of locks
and dams in the Mississippi River
is now assured as the date has been
set for receipt of bids for the two
dams above and below Dubuque;
now therefore
Be It Resolved by the City Coun-
cil of Dubuque that the contem-
plated plan of the Dubuque Dock
Commission to ask for a grant of
30% for labor and material and a
loan of the balance of a total esti-
mate of $150,000.00 be approved and
that the Dock Commission be urged
to make speedy action toward their

Whereas, it is proposed by this
Council to pave Main Street from
Charter Street to West Seventeenth
Street and it is deemed necessary
and advisable to enlarge and recon-
struct the existing storm sewer in
said street prior to said paving
work, and also to reconstruct the
storm sewer in West Eighth Street
from Bluff Street easterly to Main
Street and also to reconstruct cer-
tain sections of the storm sewer in
Rhomberg Avenue; and
Whereas, an application has been
made to the Federal Government for
a grant of thirty per cent of the
cost of labor and materials to be
used and employed in the construc-
tion of said sewers, which applica-
tion has been approved and the City
of Dubuque has been advised that
such funds are available for said
project, and
Whereas, said improvements are
necessary in order to avoid serious
damage and loss to valuable prop-
erty; and
Whereas, the construction of said
improvements at this time will tend
to relieve the unemployment situa-
tion now existing in this City; and,
Whereas, in order to finance the
portion of the cost of said improve-
ments which it to be borne by said
City, it is necessary to cause to be
issued and sold sewer bonds in a
sum aggregating Sixteen Thousand
Dollars. Now, Therefore:
Be It Resolved by the City Colin
cil of the City of Dubuque:
That storm sewers be and the
same are hereby ordered construct-
ed and put in place in Main Street,
West Eighth Street and Rhomberg
Avenue, according to the plans and
specifications heretofore prepared
and approved by this Council and
that the cost thereof be paid as fol-
lows: (A) Thirty per cent of cost
of labor and materials from United
States Government grant, and (B)
the remaining portion to be from
proceeds of sewer bonds to be is-
sued and sold by said City, and that
all necessary and pertinent proceed-
ings for the issuance of such bonds
in the sum of Sixteen Thousand Dol-
lars be taken, passed and adopted
by this Council.
This Resolution being deemed ur-
gent and of immediate necessity, in
the preservation of public peace,
health and safety, shall be in force
and effect immediately upon its pas-
sage and approval by the City

Resolution to fix a date of meet-
ing at which it is proposed to take
action for the issuance of $16,000
Sewer Bonds.
Whereas, the City of Dubuque, in
the County of Dubuque and State of
Iowa has heretofore ordered and
provided for building and construct-
ing certain sewers in and for said
City, the cost thereof to the amount
of $16,000 to be borne by said City;
and,
Whereas, it is deemed for the best
interest of said City that the cost
to be so paid be realized at this
time and that the sewer bonds of
said City be issued therefor, but it
is first necessary to give notice of
a hearing as required by Section 363
of the Code of Iowa: Now, There-
fore:
Be It Resolved by the City Coun-
cil of the City of Dubuque as
follows:
Section 1. That this City Council
meet at the Council Chamber in the
City Hall within the City of Du-
buque on the 6th day of November,
1933, at 7:30 o'clock P. M., at which
time and place proceedings will be
instituted and action taken for the

issuance of $16,000 Sewer Bonds, for
the purpose of defraying the cost to
that amount of building and con-
structing sewers in and for said
City.
Section 2. The City Clerk is here-
by directed to give notice of pro-
posed action for the issuance of said
bonds setting forth the amount and
purpose thereof, the time when and
place where said meeting will be
held, by publication at least once
for 'at least ten days before said
meeting, in the Telegraph - Herald
and Times - Journal, the official news-
paper of said City and which has a
general circulation within said City.
Said notice shall be in substantially
the following form:
"The City Council of the City of
Dubuque, Iowa, will meet on the 6th
day of November, 1933, at the Coun-
cil Chamber in the City Hall, Du-
buque, Iowa, at 7:30 o'clock P. M.,
for the purpose of instituting pro-
ceedings and taking action for the
issuance of $16,000 Sewer Bonds of
said City for the purpose of defray-
ing the cost to that amount of build-
ing and constructing sewers in and
for said City.
At any time before the date of
said meeting five or more taxpayers
may file a petition in the office of
the City Clerk, setting forth their
objections thereto.

posed to take action for the issu-
ance of such bonds, the date of said
meeting being fixed as of November
6th, 1933, at 7:30 o'clock P. M.; and,
Whereas, at said meeting of No-
vember 6th, 1933, unless objections
are filed by taxpayers before that
date, against the issuance of said
bonds, appropriate proceedings will
be adopted and an ordinance en-
titled, "An ordinance providing for
the issuance of •$16,000 Sewer Bonds,
providing for the levy of taxes to
pay the same and declaring an em-
ergency," will be introduced; and,

vide for the issuance of said bonds

Resolution of City Council of City
of Dubuque approving the contract
between the City of Dubuque, Iowa,
and the Government of the United
States, said contract being hereto
attached and made a part hereof and
designated "Grant Agreement," dat-
ed as of October 30, 1933, between
the City of Dubuque, State of Iowa,
(herein called the "City "), and the
United States of America, (herein
called the "Government "), and auth-
orizing the execution and delivery
thereof to the Federal Emergency
Administration of Public Works.
Whereas, an application for a Fed-
eral Grant of thirty per cent of the
actual cost of labor and materials
to be employed in the construction
of a public improvement designated
and described as the construction of
a system of street lights on Main
Street from Jones Street to West
Thirteenth Street, of the City, (con-
sisting of 81 double -light metal light
standards with necessary appurten-
ances), has been made to the Fed-
eral Emergency Administration of
Public Works and said application
has been approved; and
Whereas, said Grant Agreement
provides that it shall be approved
by the Governing Body of the City
and that proper officers thereof be
authorized to execute the same on
behalf of said City and deliver three
executed copies thereof to the Fed-
eral Emergency Administration of
Public Works, together with certified
abstracts from the minutes of the
meeting of said Governing Body of
said City showing all proceedings
taken incident to such authorization,
including a certified copy of this
Resolution: Now, Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque: That the
Grant Agreement hereto attached
and made a part hereof, designated
"Grant Agreement," dated as of Oc-
tober 30th, 1933, between the City
of Dubuque, State of Iowa, (herein
