Meeting called by order of Mayor
Kane and Councilman Thompson.
Mayor Kane read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of adopting
revised resolutions approving con-
tracts between the City of Dubuque,
Iowa, and the Government of the
United States on the following pub-
lic improvements: Roosevelt Street
from Rhomberg Avenue to north
line of Lot 6 Peil's Sub., Main Street
and South Main Street from Charter
Street to West Seventeenth Street,
West Seventeenth Street from Cen-
tral Avenue to Locust Street and
Boulevard Lights on Main Street
from Jones Street to West Thir-
teenth Street and acting on any oth-
er business as may properly come
before a regular meeting of the City
Council.
Resolution No. 124-33
Resolution of City Council of City
of Dubuque approving the contract
between the City of Dubuque, Iowa,
and the Government of the United
States, said contract being hereto
attached and made a part hereof and
designated, "Grant Agreement," dat-
ed as of October 23, 1933, between
the City of Dubuque, State of Iowa,
(herein called the "City "), and the
United States of America, (herein
called the "Government "), and auth-
orizing the execution and delivery
thereof to the Federal Emergency
Administration of Public Works.
WHEREAS, an application for a
Federal Grant of thirty per cent of
the actual cost of labor and mater-
ials to be employed in the construc-
tion of a public improvement desig-
nated and described as the repav-
ing with concrete of Roosevelt
Street from Rhomberg Avenue to
the north line of Lot 6 Peil's Sub-
division has been made to the Fed-
eral Emergency Administration of
Public Works and said application
has been approved; and
WHEREAS, said Grant Agreement
provides that it shall be approved
by the Governing Body of the City
and that proper officers thereof be
authorized to execute the same on
behalf of said City and deliver three
executed copies thereof to the Fed-
eral Emergency Administration of

BE IT FURTHER RESOLVED
that this Resolution shall supercede
Resolution No. 114 -33, heretofore
adopted by the City Council of Du-
buque, Iowa, on the 23rd day of
October, 1933, and the execution of
the contract in triplicate by the
Mayor and City Clerk, pursuant to
said Resolution, be and the same
is hereby confirmed and ratified.
This Resolution being deemed ur-
gent and of immediate necessity, in
the preservation of public peace,
health and safety, shall be in force
and effect immediately upon its pass-
age and approval by the City Coun-
cil.

Resolution No. 128 -33
CITY COUNCIL OF CITY OF
DUBUQUE, IOWA
WHEREAS, in connection with the
requested 30% Grant and 70% Loan
for a new modern outdoor swimming
pool at Dubuque, Iowa, from the
Federal Government, the approval
of the site, to be at the southeast
corner of Railroad Street and Route
No. 61 on city owned property plan-
ned to be used for future industrial
use, was included in two (2) Reso-
lutions adopted by the Council of
the City of Dubuque, Iowa, viz: —
Resolution 113, passed and adopt-
ed October 23, 1933, authorizing the
application to be made for the Grant
and Loan; and
Resolution 104, passed and adopt-
ed October 23, 1933, endorsing the
project; and
WHEREAS, since the adoption of
the above mentioned two Resolu-
tions, approving the site at Railroad
Street and Route No. 61, a plan has
been developed to secure a site of
believed far greater advantage, viz.
in, or adjacent to, the present Grand-
view Avenue Tourist Park; and
WHEREAS, the revised site in,
or adjacent to, the Grandview Aven-
ue Tourist Park, has the recom-
mendation of the Dubuque Planning
and Zoning Commission and the Du-
buque Playground and Recreation
Commission; and
WHEREAS, the benefits of the
last selected site appear more ad-
vantageous to the City Council of
Dubuque, Iowa: Now, Therefore,
BE IT RESOLVED by the City
Council of Dubuque, Iowa, that the
actions of endorsing the project and
authorizing the application, so far as
the site is concerned, for the new
outdoor swimming pool at the south-
east corner of Railroad Street and
Route No. 61, on city owned pro-
perty, by Resolutions No. 104 and
No. 113, respectively, both passed
October 23, 1933, be rescinded and
modified and that the City Council
of Dubuque, Iowa, does hereby en-
dorse and authorize said application
from the Federal Government on the
basis of the site for the new pool to
be located either on a part of the
present Grandview Avenue Tourist
Park, or on new property, easterly
of and adjacent to the present Grand-
view Avenue Tourist Park.

Mayor Kane stated that this is
the regular monthly meeting of the
City Council for the transaction of
any such business as may properly
come before a Regular Meeting of
the City Council. •
Communication of T. F. McCoy
advising that he has discontinued his
confectionery and restaurant busi-
ness at 801 Iowa Street as of No-
vember 1st, 1933, and requesting that
he be released from the bond cov-
ering his Class "B" beer permit at
said address and that it is under-
stood that he is entitled to use the
beer permit any time during the life
of said permit, presented and read.
Councilman Schuckert moved that
the communication be received and

that a storm sewer be constructed

struction in this location at this
particular time, the decision of the
Council was that until such time
as money could be provided for this
construction, that the storm sewer
ditch, which is badly filled and
averts the water over the entire

and the earth be filled up along
both sides of the trench to prevent
immediate flooding.

Gentlemen: On Saturday after-
noon, November 4th, four members
of the City Council viewed White
Street at the Page Hotel and the
Coca -Cola Company north of East
Fourth Street. These two locations
have been a source of flooding con-
dition twice within the last eighteen
months.
Consideration was given toward
the erection, by the City, of area-
ways around the present windows
and openings into the basements of
these two buildings. Due to the
fact that the sidewalk and curb had
been lowered recently at the new
construction on said White Street
and that there already exist in the
block between 4th and 5th Streets,
on the west side of White Street,
many other steps and areaways pro-
jecting into the sidewalk space, it
was the decision of City Council
that authority be granted at once
to construct such necessary area-
ways to prevent future flooding of
the Coca -Cola Company cellar and
the Page Hotel cellar, conditioned

on the construction of the areaways
being built as close to the property
lines as possible.

Gentlemen:
The City Council viewed the loca-
tion at the northeast corner of Wind-
sor Avenue and Ries Street of a two -
story frame building that is physic-
ally beyond rental or livable use.
This building is a hazard to adjoin-
ing property and is a hazard to per-
sons walking on the sidewalk on
Wes Street inasmuch as a portion of
the front entrance extends out over
the sidewalk. Complaints have been
filed with the City for years in this
connection and reports from the Fire
Chief, Sanitary Inspector and Build-
ing Inspector condemn any future
use of this building.
Accordingly, the decision of the
City Council upon viewing the same
November 4th, was that steps be im-
mediately taken to have the building
condemned and removed. The mat-
ter was referred to the City Solic-
itor to prepare the necessary pro-
cedure.

Nowata Street between West 14th
Street and Julien Avenue.
On November 4th Council viewed
this street and found that not a
single light existed on this rather
long section of Nowata Street and
approved the installation of a new
street light in the middle of the
block at the existing angle. Ac-
cordingly, the City Manager recom-
mends a 400 C. P. overhead street
light at this angle location.

present 600 C. P. lamp at the first
pole on Glen Oak Street north of
Julien Avenue; to install a new 100
C. P. lamp at the northwest corner
of the present dark intersection of
Glen Oak and Julien and to install
a new 250 C. P. lamp on Glen Oak
at the second pole north of Julien.
This change in location and number
of lamps will benefit the angle in
Glen Oak and the intersection of
Glen Oak and Julien.

You are hereby notified and there
is hereby called a special meeting
of the City Council of the City of
Dubuque, to be held in the Council
Chamber in the City Hall at 7:30
o'clock P. M. on Monday, November
13, 1933. At this meeting there will
be considered for final adoption an
Ordinance entitled "Ordinance No.
11 -33. An Ordinance providing for
the issuance of $16,000.00 Sewer
Bonds, providing for the levy of tax-
es to pay the same and declaring
an emergency," which ordinance has
been on file with the City Clerk
for public inspection since the 6th
day of November, 1933. At this
meeting there will also be introduced
a Resolution entitled, "Resolution
directing the advertisement and sale
of $16,000.00 Sewer Bonds, which
resolution will have the considera-
tion of the Council at that time.
Any other and further business that
may properly come before a regular
meeting of said Council will be con-
sidered at this meeting.

AN ORDINANCE providing for the is-
suance of $16,000 Sewer Bonds, pro -
giding, for the levy of taxes to, pay tt,q
same and declaring an emergency.
WHEREAS, the City of Dubuque, in
the County of Dubuque, and State, of
Iowa, heretofore, pursuant to and in
strict compliance with all lbws, applidr-
able, lawfully ordered and provided for
Winding and constructing'seivers in and.
for said City at a cost of not less than,

WHEREAS, it, is necessary and ad
visable that provisions be made for the
issuance of bonds of said City in the
sum '' of ' $16,000' to defray the cost of
building and constructing said sewers;
and.
WHEREAS, notice and, hearing on
the initiation of proceedings, for the is-
suance of said bonds has heretofore
been given in manner and form, re-
quired, by Section 363 of the Code of
Iowa and, no petition not protest has
been filed;
NOW, THEREFORE, Be it Ordained
by the City Council of the City of ,Du-
buque, as follows:
Section 1. That pursuant to and as
authorized by Section' 6125 of the Code
of Iowa, there shall by and there is
hereby ordered issued, the negotiable
Sewer Bonds of said City of , Dubuque
in the principal amount of $16,000; said
bonds to be 16 in number, dated Decem-
ber 1, 1933, bearing interest, at the rate
of Four and One -half per. cent (4rFz 't)
per ahnum, from the date of said bonds
until paid, payable Jprie 1, 1934, anq
semi - annually thereafter on the first
days of Deceber. and June in, each
y gr: that said 'bonds `be signed by, the
Mayor and attested by the City Clers
and the. seal of said. City attached, and
be registered as to issuance. by the City,
Treasurer and a. certificafe,of such reg-
istrption endorsed thereon; 'That, in-

coupons: thereto attached; and, maturing
on the several days when, such inter•

For • the year 1934, a tax suffic-
ient to produce the sum of $720 to
reimburse eurren' funds for ad-
vancements to pay interest June 1,
1934 and December 1, 1934.
For each of the years 1935 to 1943,
both inclusive, a tax sufficient to
produce the sum of $720 each year'
for interest.
For the year 1944, a tax sufficient
to produce the sum of $5,720 for
principal and interest.
For tha year 1945, a tax sufficient
to produce the sum of $5,495 for'
principal and interest.
For the year 1946, a tax sufficient
to produce the sum of $6,270 for

Said taxes when collected shall be
converted into a special fund for the

SECTION SIX. That the principal
or interest 'corning due at any time
when: there aye insufficient funds on
hand' to pay the same,. be promptly
paid, when due from current funds en

vided shall have been collected:
SECTION SEVEN. That a certified

sary for the immediate preservation of

Resolution directing the advertise-

Whereas, it is necessary and for
the best interests of said City that
$16,000 Sewer Bonds contemplated
to be issued by the City of Dubuque,
Dubuque County, Iowa, be offered for
sale at this time: Now, Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque, Iowa, as
follows:
Section 1. That sewer bonds in
the amount of Sixteen Thousand
Dollars ($16,000) as proposed to be
issued and as referred to in the pre-
amble of the resolution, dated De-
cember 1, 1933, be offered for sale
pursuant to published advertise-
ment.
Section 2. That the City Clerk be
and he is hereby authorized and di-
rected to publish notice of the sale
of said bonds for two or more suc-
cessive weeks in the Telegraph -
Herald and Times - Journal, an official
newspaper of Dubuque County, print-
ed and published in the City of Du-
buque, Iowa, such notice to state
that bids will be received and act-
ed upon by this Council at a meet-
ing to be held at 7:30 o'clock P. M.
on December 4, 1933, and such no-
tice to be in substantially the fol-
lowing form:
NOTICE OF SALE OF BONDS.
Sealed bids will be received at the
office of the City Clerk in the City
Hall, Dubuque, Iowa, until 10 o'clock
A. M., December 4th, 1933, for
$16,000 Sewer Bonds of the City of
Dubuque, Iowa, at which time they
will be referred to the City Council
of said City at its meeting to be
then held in the Council Chamber of
said City Hall, and after the receipt
of which open bids will be received
and the bonds will then be sold to
the highest bidder for cash. Said
bonds will be dated December 1,
1933, and mature $5,000 on December
1, 1945; $5,000 on December 1, 1946;
and $6,000 011 December 1, 1947.
Both principal and interest are to
be payable at the office of the City
Treasurer, Dubuque, Iowa. All bids
shall specify the rate of interest,
and all other things being equal, the
bid of par and accrued interest or
better for the lowest interest rate
will be given preference. The suc-
cessful bidder must pay the cost of
printing the bonds.
These bonds are to be issued for
the purpose of defraying the cost of
building and constructing sewers
and will constitute general obliga-
tions of said City. The City will fur-
nish the approving opinion of
Messrs. Chapman and Cutler, law-
yers, Chicago, Illinois, and all bids
must be so conditioned. Bidders
mut furnish certified check for $750
as guarantee of good faith, this
amount to be forfeited by the suc-
cessful bidder should he fail to take
up and pay for the bonds when
ready. The right is reserved to re-
ject any or all bids.

ing the sufficiency of the petitions

cil requesting that the City Council
call a Special Election of the voters
of the city of Dubuque, Iowa, as re-
quired by law, to vote upon the fol-
lowing proposition: "Shall the City
of Dubuque, Iowa, abandon its or-
ganization under Chapter 328 of the
Code of 1927 and become a Special
Charter City under the laws of the
State of Iowa," and acting on any
other business as may properly come

At an informal meeting held No-
vember 20th the decision was

Resolution No. 133 -33
WHEREAS, on the 6th day of No-
vember, 1933, there was filed in the
office of the City Clerk of Dubuque,
Iowa, a communication signed by
Arnold Utzig, as Chairman of the
Taxpayers Committee, and having
attached thereto two hundred and
seventy -two (272) petitions address-
ed to the Mayor and City Council
of the City of Dubuque and purport-
ing to be signed by 6,184 electors
of said City, requesting therein that
the following proposition be submit-
ted to the electors of said City at a
special election to be called there-
for, to -wit:
"Shall the City of Dubuque aban-
don its organization under Chap-
ter 328 of the Code and become
a Special Charter City under the
laws of the State of Iowa ? ";
and,
WHEREAS, at a meeting of the
City Council held on the 6th day of
November, 1933, upon motion duly
passed, said petitions were received
and referred to said Council for can-
vass; and,
WHEREAS, a canvass of said peti-
tions by the Council revealed the fol-
lowing facts:
1. There are three sets of peti-
tions, one set having been signed in
1933, a second set having been
signed in 1927, and third set pur-
ported to have been signed in 1933
but containing evidence therein of
having been signed at a much earlier
date.
2. 2,828 names are contained with-
in the petitions signed in 1933 of
persons who are registered at the
given address.
3. 1,844 names are contained with-
in the petitions signed in 1933 of
persons who are not registered at
the given address.
4. 114 names are contained with-
in the petitions signed in 1933 by
persons who signed such petitions
more than once.
5. 36 names are contained with-
in the petitions signed in 1933 of per-
sons who were dead at the time that
the petitions were filed.
6. 7 names are contained within
the petitions signed in 1933 of per-
sons who were not electors at the
time that the petitions were filed.
7. 308 signatures upon the peti-
tions of 1933 which have been signed
by one other than the elector whose
name it purports to be.
8. 215 names are contained with-
in the petitions signed in 1927 of
persons who are registered at the
given address.
9. 495 names are contained with-
in the petitions signed in 1927 of
persons who are not registered at
the given address.
10. 139 names are contained with-
in the petitions signed in 1927 of
persons who signed such petitions
more than once.
11. 12 names are contained with-
in the petitions signed in 1927 of
persons who were dead at the time
that the petitions were filed.
12. One name is contained with-
in the petitions signed in 1927 of
a person who was not an elector at
the time that the petitions were
filed.
13. 27 signatures appear upon the
petitions of 1927 which were signed
by one other than the electors whose
name it purports to be.
14. 155 names appear upon peti-
tions purported to be signed in 1933
but such petitions are questionable
because it is known that at least
five of such persons died several
years before 1933 and it has been
found that, upon such petitions there
are:
a -61 names of persons who are
registered at given address.
b -64 names of persons who are
not registered at the given ad-
dress.
c -24 names of persons who
signed more than once.
d —One name where the signa-
ture was made by one other
than the person whose name
it purports to be.
e -5 names of persons who were
deceased at the time the peti-
tions were filed, and also at
the time they purport to have
been signed.
15. All signatures to the petitions
were secured prior to July, 1933,
the effective date of the present
law; and,
WHEREAS, after eliminating all
duplications of signatures, persons
deceased when the petitions were
filed, persons who were not electors
at the time the petitions were filed,
signatures affixed to the petitions by
others than the persons whose names
they purport to be, as contained
within the petitions of 1933, this
Council has concluded and finds that
the following signatures should be
counted upon such petitions of 1933:
a -2,828 names of persons who
signed the petitions and are
registered at the given ad-
dress.
b -1,844 names of persons who
signed the petitions and are
not registered at the given
address; and,
WHEREAS, after eliminating all
duplications of signatures, persons

filed, persons who were not electors
at the time the petitions were filed,
signatures affixed to the petitions by
others than the persons whose
names they purport to be, as con-
tained within the petitions of 1927,
this Council has concluded and finds

a -215 names of persons who are
registered at the given ad-
dress.
b -495 names of persons who are
not registered at the given
address; and,
WHEREAS, after eliminating all
duplications of signaturs, persons de-
ceased when the petitions were filed,
persons who were not electors at
the time that the petitions were filed,
signatures affixed to the petitions by
others than the persons whose names
they purport to be, this Council has
concluded and finds the following
signatures purported to be signed
in 1933 but which are questionable
because of existing evidence that
they were signed at an earlier date:
a -61 names of persons who are
registered at the given ad-
dress.
b -64 names of persons who are
not registered at the given
address; and,
WHEREAS, it has been deter-
mined that by adding together all
signatures appearing upon the vari-
ous petitions in the manner above
stated that 5,507 electors have signed
such petitions; and,
WHEREAS, the law, as it has ex-
isted since July, 1933, fixing the
number of electors necessary for a
petition of this kind, provides that
the petition should contain the sig-
natures of electors of the City of
Dubuque equal in number to twen-
ty -five per cent of the votes cast
in said City for all the candidates
for Governor at the last preceeding
general election; and,
WHEREAS, at the last preceeding
general election there were cast in
the City of Dubuque for all candi-
dates for Governor, 16,737 votes:
NOW, THEREFORE:
BE IT RESOLVED AND DETER-
MINED BY THE COUNCIL OF
THE CITY OF DUBUQUE:
That the form of the proposition
requested by the petitions to be sub-
mitted to the electors at a special
election is legal and that such peti-
tions are sufficient for such purpose
and, therefore, the Mayor of this
City be and he is hereby directed
to issue a proclamation for a special
election to be held on the 5th day
of January, 1934 at which election
there shall be submitted to the elec-
tors the following proposition:
"Shall the City of Dubuque aban-
don its organization under Chap-
ter 328 of the Code and become
a Special Charter City under the
laws of the State of Iowa ?"
