J. Nagle, and, WHEREAS, it is deemed advisable to reconvey by Quit Claim Deed said real estate to said J. J. Nagle upon payment to said City of Dubuque of the sum of $580.21; NOW THEREFORE: Be it Resolved by the City Council of the City of Dubuque: That, upon the payment of said sum by said J. J. Thompson requesting that the attached bill of H. B. McCarten, plumber, in the sum of $85.57 be paid by the City as said bill was incurred for the relaying of his sewer connection at his home at 1645 South Grandview Avenue, said sewer having been laid by the City from main sewer to curb line when street was improved and was laid with not enough fall for proper drain- age, presented and read. Resolution No. 9 -32 RESOLUTION FOR TEMPORARY TRANSFER Whereas, there is now in the hands of the treasurer the sum of $15,771.65, credited to the Firemen's Pension Fund, and Whereas, there is now in the hands of the treasurer the sum of $3.95, credited to the Policemen's Pension Fund, and Whereas, it is desired to transfer $2,500.00 from the Firemen's Pen- sion Fund to the Policemen's Pen- sion Fund, for the following rea- sons: Several policemen have been re- tired and placed upon the pension roll during the last ten months which action was not anticipated at the time the levy was made for the Police Pension Fund, thereby caus- ing a shortage to exist in said Po- lice Pension Fund. There will re- main sufficient funds in the Fire- men's Pension Fund to take care of the pensions to be paid from said fund during the balance of this fis- cal year. The requested transfer will be repaid to the Firemen's Pen- sion Fund in 1932. This transfer will not effect the provisions of the Elliott Tax Redemption Law. Whereas, proper arrangement have been made for the return of this money, same to be returned within one year from date of trans- fer, and Whereas, there is sufficient money in the Firemen's Pension Fund to meet all demands thereon, until said money can be returned, and Whereas, all laws relating to mu- nicipalities have been complied with, Now Therefore, be it resolved by the City Council of the City of Du- buque of Dubuque County, Iowa, sub- ject to the approval of the Director of the Budget, that said sum of $2,500.00 be, and the same is hereby ordered transferred from the Fire- men's Pension Fund to the Police Pension Fund and the City Clerk (secretarial officer) is directed to correct his books accordingly and to notify the treasurer of this transfer, accompanying the notification with a copy of this resolution and the rec- ord of its adoption. 22 The vote thereon being as fol- lows: Ayes— Regular Session, February 1, 1932 ED. Resolution No. 10 -32 RESOLUTION FOR TEMPORARY TRANSFER Whereas, there is now in the hands of the treasurer the sum of $45,038.14, credited to the General Fund, and Whereas, there is now in the hands of the treasurer the sum of $00.00, credited to the Dock Oper- ating Fund, and Whereas, it is desired to trans- fer $975.00 from the General Fund to the Dock Operating Fund, for the following reasons: In anticipation of the construction of proposed public docks, engineer- ing services were needed by the Dock Board to prepare plans and specifications therefor, to make sur- veys and to do general engineering work in connection therewith. The salary of the Engineer engaged to do such work was expected to be paid from a proposed bond issue which was expected to be made be- fore the end of the present fiscal year. Due to delays and unexpected opposition to said bond issue said funds are not available and there exists a deficit in the Dock Operat- ing Fund in the sum above stated. This transfer will be repaid to the General Fund in 1932, from the Dock Operating Fund. This transfer will not effect the provisions of the Fl- liott Tax Reduction law. Whereas, proper arrangement have been made for the return of this money, same to be returned within one year from date of trans- fer, and Whereas, there is sufficient money in the General Fund to meet all de- mands thereon, until said money can be returned, and Whereas, all laws relating to mu- nicipalities have been compiled with, Now Therefore, be it resolved by the City Council of the City of Du- buque of Dubuque County, Iowa, sub- ject to the approval of the Director of the Budget, that the said sum of $975.00 be, and the same is hereby ordered transferred from the Gen- eral Fund to the Dock operating Fund and the .City Clerk (secretarial officer) is directed to correct his books acordingly and to notify the treasurer of this transfer, accom- panying the notification with a copy of this resolution and the record of its adoption. To the Honorable Mayor and City Council, Dubuque, Iowa. Gentlemen: Mr. John Ramsey of 408 Klingen- berg Terrace made request at this office today that he be granted an extension of time for payment on the new sanitary sewer recently con- structed in Klingenberg Terrace to his lots 4 and 5. Mr. Ramsey ad- vises that the amount of his assess- ment for this sewer is $91.89. Mr. Ramsey says that he is 73 years old a former farmer and labor- er at Farley & Loetscher Manufac- turing Co., and that he has been out of work for a number of months and cannot possibly make the 10% pay- ment or any payment whatsoever by February 11th, the last date for the 10% arrangement. Gentlemen: In connection with the letter ad- dressed to the City Council from Mr. P. S. Fawkes, dated January 29, 1932, concerning a sanitary sewer lateral stoppage on Hill Street, which letter was referred to the City Manager for investigation and report at the meeting of February 1st, please be advised as follows: When Mr. Fawkes advised the City of the trouble, our City sewer men rodded and drew a 6 -inch sewer knife through the main sewer on Hill street in front of his connection. The City sewer men believed that no trouble existed in the main sewer. Mr. Fawkes states that nothing was found wrong with the main sewer. The bill that Mr. Fawkes paid to Nesler & Buechel, amounting to $29.50, includes the time spent in trying to rod the sewer lateral from the house to the main and certain time spent in digging up the laity sewer lateral in the parking be- tween the sidewalk and curb and also for the permit , and the work necessary to dig up the sewer lateral connection at the main near the cen- ter of Hill Street. Mr. Nesler, the plumber, and our sewer foreman, Mr. Sullivan, both state that the trouble with this sewer lateral was that roots had grown at the top of the City sewer at the exact point of connection with the Fawkes lateral and had clogged the lateral connection, although no obstructions were in existence in the main. The roots !apparently had grown at the particular hole cut in the City main sewer where the lat- eral was inserted. Another similar case a few days later occurred at the J. E. Snyder home at 180 Hill Street, which is the house immediately south of Mr. Fawkes' home. The main sewer was not stopped at this location, but the Snyder lateral sewer become clogged in a similar way. Mr. Sullivan was able to rod this sewer from the eel- 28 Special Session, February 23, 1932 lar out into the main and release the roots, although at the Fawkes' home, due to the type of construction, rods could not be inserted into the lateral into the cellar. It would seem in both cases, and particularly in the Fawkes case, that the fault was not with the City sewer. However, when Nesler & Buechel had opened the street in front of the Fawkes connection, our Sewer Department installed a man- hole at this point, which includes not only the Fawkes lateral, but also that of Mr. Czizek's residence. The reason for building this manhole was due to the fact that the old manhole at Langworthy Avenue and Hill Street was constructed in such a way that it was impossible to rod the Hill Street sewer flowing from Langworthy Avenue to the south. In other words, this manhole invert is for the sewer flowing toward the north and the sewer toward the south is about 4 feet above the in- vert. At the position of this upper pipe this manhole is so narrow that it was impossible to insert the rods in a successful manner toward the south. Inasmulch as this manhole was built at the Fawkes connection, it Would possibly have cost the City $10.00 to dig down such a depth as was done by the plumbers. The writer would therefore suggest that possibly a $10.00 allowance could be made to Mr. Fawkes in this excava- tion procedure. Yours very truly. R. M. EVANS, City Manager. Verbal report of City Manager Evans presented on petition of Gen- eral Fitzhugh Lee Auxiliary No. 1, United Spanish War Veterans re- questing permission to hold tag day for relief and patriotic purposes, A 30 Special Session, February 23, 1932 May 14th., 1932, which was referred to my office to secure their last year report of receipts and disbursements stated that he had received their re- port which shows receipts and dis- bursements as folows: Total amount collected $195.89; Credits for 1931: To relief fund $26.49, to flowers for sick and dead $16.20, to department relief fund for Christmas cheer $5.00, to milk fund $5.00, balance helped to defray part of the expense of drill team at the Department Convention in Burlington, Iowa, in June, 1931. Councilman Andelfiinger stated that the petition as presented re- quested permission to hold a tag day for relief and patriotic purposes and that the report as submitted for the past year shows a total of $195.89 collected and of this sum the amount of $26.49 was turned into the Reief Fund and the greater portion of the balance was used to defray expenses of drill team to attend convention at Burlington, Iowa. The report there- by showing that the funds were not used for relief and patriotic purposes and further stated that the United Spanish War Veterans do not sanc- tion the holding of tag days for such purposes. Councilman Andelfinger moved that the request of the General Fitz- hugh Lee Auxiliary No. 1, United Spanish War Veterans to hold a tag day on May 14th., 1932, be not granted.
