Regular Session, April 4, 1932.
Council met at 7:45 P. M.
Present —Mayor Meuser, Council-
men Andelfinger, Jansen, McEvoy,
Schuckert, City Manager Evans.
Mayor Meuser stated that this
meeting is the regular monthly
meeting of the Council and also the
first meeting of the fiscal year for
the transaction of such business as
may properly come before the meet-
ing.
Mayor Meuser administered the
oath of office to the newly elected
members, Martin B. Andelfinger,
Mark R. Kane and Ardenal Thomp-
son whereupon the old councilmen,
Mayor Meuser and Councilman Jan-
sen retired and the new Council
went into session.
Councilman McEvoy moved that
Councilman Andelfinger be appoint-
ed as Mayor for the ensuing year.
Seconded by Councilman Thompson.
Carried by the following vote:
Yeas — Councilmen Kane, McEvoy,
Schuckert, Thompson.
Nays —None.
Councilman Andelfinger not vot-
ing.
Mayor Andelfinger then took the
Mayor's chair.
Resolution No. 18 -32
Be it resolved by the Council of
the City of Dubuque:
That the following officers be ap-
pointed to serve during the fiscal
year, 1932, at the pleasure of the
Council and be paid the salary pro-
vided for in the Budget adopted by
this Council on March 29, 1932: ex-
cept the Police Court Judge whose
salary shall be $1,500.00.

With reference to the Playground
Superintendent who has the title in
the Budget of "Recreation Director,"
I beg to advise you that this 'appoint-
ment is made by the Playground
Commission who fixes his salary and
term of employment. I have ap-
proved such appointment and con-
firmed the same and am submitting
his name herewith as an appointee
of my department. He will have
charge of playgrounds and all re-
creational facilities of the City under
my direction and control.
All other employees of depart-
ments at present engaged therein
have been employed by me and will
continue therein at my pleasure and
be paid the wages and salaries pro-
vided for in said Budget.

Mr. R. M. Evans, City Manager, and
City Council, Dubuque, Iowa.
Gentlemen: Approximately twenty -
five cases of Small Pox have been
reported in the city recently and it
is the opinion of the Health Depart-
ment that a great many more cases
will occur unless it is possible to
protect school children by means of
Regular Session, April 4th, 1932

vaccination. Quarantine measures
are far from 100% effective because
many cases cannot be recognized
early.
The Public Health Committee of
the Dubuque County Medical Society
have given me their assurance that
the members of the Medical Profes-
sion will volunteer their services to
immunize all of the children in the
schools who are unable otherwise to
pay for such vaccination. At the
present time there are 1,110 children
alone on the Milk Fund, and it is
estimated that at least 2,000 children
need to be vaccinated.
I would suggest that your honor-
able body appropriate sufficient
funds to vaccinate these children
against Small Pox.
It will also be necessary to pro-
cure the services of an additional
School Nurse for a short time. Such
a person is now available and was
formerly engaged in school nursing
work.

An Ordinance vacating that por-
tion of Delhi Street lying northerly
of the North line of Lot Two (2) of
One (1) of Two (2) of One (1) of
Boxleiter's Subdivision of One (1) of
Caroline Boxleiter's Sub. of Mineral
Lot 160, as shown upon the plat pre-
pared by W. H. Cullen, of the Sub-
division of said described real estate,
and granting and conveying said va-
cated portion of said street to James
J. King for valuable consideration.
Whereas, the traveled portion of
Delhi Street adjacent to Lot 2 of 1
of 2 of 1 of Boxleiter's Subdivision of
1 of Caroline Boxleiter's Sub. of M.
L. 160 was narrowed and relocated
many years ago, thereby leaving an
unused portion thereof immediately

Gentlemen: The request of Mr.
Anthony Puccio of 29 Keokuk Street,
Dubuque, dated April 1st, and pre-
sented to Council April 4th, was re-
ferred to the writer for investigation
as to the reason why the applicant
should be granted a free license to
peddle ice cream. Please be advised
that I have interviewed Mr. Puccio
and wish to advise as follows:
He is a man of about 50 years of
age; has lived in Dubuque for 24
years; he is not a citizen and can-
not read. In 1927, while working as
a molder for McDonald's, he was
stricken with blood poisoning. His
left hand and wrist were badly crip-
pled by operations to save the man's
life and today this left arm is prac-
tically useless.
The applicant has had a free lic-
ense for the past three years to sell
ice cream. He has a wife and 10
children to support. The applicant

has equipment necessary to sell this
ice cream and it is the writer's be-
lief that at present he can find no
other means of livelihood. Accord-
ingly, I would respectfully recom-
mend the granting of the license,

The applicant, Mr. Gust Hadji-
nickolas, has had World War service,
having been discharged from army
June 2, 1919. He is a citizen with
full papers received August 21, 1918,
and registered No. 1,036,974. Appli-
cant has lived in Dubuque for about
10 years. Until about two years ago
he worked for the Illinois Central
Railroad Company, but lost his posi-
tion due to a bad rupture. Applicant
is still ruptured and is not able to
perform hard labor. He has a de-
pendent wife and five children under
14 years of age.
It is recommended that he be
again granted a license for one year
without cost.

walk on College Street in front of

of Mineral Lot 159 has been inves-
tigated by the City Engineer and the
writer.
These walks were constructed in
1929 by a local contractor after ad-
vertising for bids. Three slabs are
cracked in the sidewalk today. It is
felt that it is not absolutely neces-
sary to replace these slabs at this
time as they are not uneven or dan-
gerous. The maintenance bond has
expired after two years from date of
completion.
Mr. Acker requests a reduction in
the amount of assessment for this
work. If the City is responsible for
this, the same could probably be re-
placed for $7.50. We do not recom-
mend at this time that the City make
any adjustment in the assessment.

Gentlemen: The petition of James
E. Allen requesting a refund of $1.00
on a dog tax has been investigated
and we find that license No. 50 is-
sued in 1931 was writen to Mr.
James E. Allen and he advised us
later that the dog was kept entirely
out of the City of Dubuque. Accord-
ingly, instructions have been given
to the City Treasurer to refund by
check $1.00 to Mr. Allen at Box 123,
Route No. 1, Dubuque, Iowa.

Gentlemen: At the meeting of
March 4th there was referred to the
City Engineer and the City Manager
the petition of H. Gronan Est. re-
garding a special assessment against
Lot 39, Marsh's Addition, on North
Main Street for investigation and
report.
Please be advised that this par-
ticular assessment totals $41.01, vas
levied on September 11, 1929, and in-
cludes a charge for a sanitary sewer
connection from the main to the
curb amounting to $16.00 and for
water connection to the same lot
amounting to $25.01. The protest on
the assessment is due to the fact
that the sanitary sewer has never
been used inasmuch as the present
home at or near the front of the lot
is of old construction and the level
of said house is considerably below
the grade of the street and the sewer
lateral would not serve the cellar in
the present position. The sewer is
sufficient for any modern home that
in the future might be built on said
lot.
The water service has never been
used because of the fact that the
family are provided with a well on
the lot and have never availed them-
selves of the city water.
No previous protests were made
on this assessment and your com-
mittee does not see any reason why
an adjustment should be made at
this time as the facilities are there
for use if desired under proper
conditions.

Gentlemen: On March 7th there
was presented to City Council a let-
ter signed by John Willy and four
other names requesting an extension
of the street lighting system on
Kaufmann Avenue from the end of
the present system to the City Line.
The petition was signed by Mr.
Willy at 1333 Kaufmann Avenue and
F. M. Mathis, 1725 Kaufman Avenue.
The other three names on the peti-
tion we are not able to locate as resi-
dents of this street.
For your information, the most
westwardly light on Kaufmann Ave-
nue is at or near the entrance to the
high level Water Works station.
From there to the city line, or the
west end of said street, it would be
necessary to install at least four
lights of rather strong candle power
to serve this territory. In this dis-
tance there are but two homes;
there are no sidewalks on either side
of the street. From the Water Works
light back to Kleine Street the lights
on Kaufmann Avenue are very poor-
ly arranged and some time at least
three additional lights should be in-
stalled. Inasmuch as our appropria-
tions are not sufficient for a number
of light changes at this time, it is
recommended that this matter be
deferred until such time as Kauf-
mann Avenue can be rebuilt.

Gentlemen: On April 4th there
was referred to the City Manager a
petition of the Izaak Walton League
of America from the La Crosse,
Wisconsin, chapter praying that the
City of Dubuque pass a certain reso-
lution toward the change in the
plans of dams for the Upper Missis-
sippi River in order to protect the
refuge for fish at or in the vicinity
of Winneshiek.
The writer has conferred with
local representatives of the Izaak
Walton League in Dubuque and it is
felt that this movement is in direct
opposition with the industrial de-
velopment of Dubuque waterways.
Accordingly, I would recommend
that the resolution be not adopted.

Gentlemen: On March 16th there
was addressed to the City Council
a petition asking for a new fire
alarm box to be located at or near
24th and Washington Streets. This
natter was referred to the Manager
Special Session, April 26th, 1932

March 18th for investigation and
report.
Please be advised that there is
located at present Box No. 36 at the
southeast corner of 24th and Central
Avenue and Box No. 62 at the north-
west corner of 24th and Windsor
Avenue. The proposed box would be
in direct line between these two ex-
isting stations on 24th Street and
would be approximately 750 feet
from the Central Avenue location of
which one block to the north would
represent the space along the south
side of Comiskey Field.
It is suggested that until such
time as the City can install a num-
ber of needed boxes, and as this par-
ticular location is no more hazard-
ous than a great many others in the
City, that action be deferred on the
installation at this time.

March 18th the City Manager was
instructed to investigate the request
for the installation of a fire alarm
box at or near the Mt. Pleasant
Home on Mt. Pleasant Street.
Please be advised that there is no
box in this district north of Julien
Avenue and the Mt. Pleasant Home
and the surrounding territory is fair-
ly well built up and entitled to fire
alarm service in the writer's opinion.
An estimate for the materials on
this installation includes the follow-
ing:
1 Box $137.50
Wire and other pole fixtures 62.50
$200.00
The 'above estimate is in addition
to the regular salary time of the fire
alarm employees for erection. It is
planned that this box could be in-
stalled in between other jobs of the
department.

April 18, 1932.

Gentlemen: Mr. John Wersinger
of 2656 Central Avenue was granted
a permit at the Council meeting of
October 19, 1931, to peddle fruit and
vegetables without payment of the
usual fee. Shortly after this grant
the applicant was injured on a farm
outside of the city. His injury con-
sisted of a skull fracture near the
left temple.
Mr. Wersinger now advises that he
desires a permit for one year with-
out fee to sell fruit and vegetables
in this city. He has a wife and four
children; has had World War ser-
vice, with seven months of over -sea
duty. He says that previously he de-
sired the permit to make a liveli-
hood, but now under doctor's in-
structions, it will be necessary for
him to do only light work on ac-
count of the injury to his head.

Whereas, in the year 1910, an ex-
change of real estate was author-
ized between Frances A. Minard and
Walter C. Minard and the City of
Dubuque whereby it was proposed
to transfer to the City of Dubuque
a portion of Lot One (1) of Lots
Ten (10) and Eleven (11) in Finley
Home Addition to said City in ex-
change for a portion of the alley
abutting upon said lots in order to
change the location of said alley;
and,
Whereas, a plat was prepared
making provision for such change
and exchange of properties and in
accordance therewith the City of
Dubuque acquired a portion of said
Lot One (1) of Lots Ten (10) and
Eleven (11) from the owners there-
of but said City failed to convey to
said grantors the portion of the alley
indicated upon the plat as Lot "A ";
and,
Whereas, Minnie Sommerfeld is
now the owners of said Lot "A" but
the records do not disclose any

An Ordinance granting the Chi-
cago, Milwaukee, St. Paul & Pacific
Railroad Company the right to levy
and construct a sidetrack across the
Alley first East of Garfield Avenue
commencing at a point on the East
side of said Alley opposite the south
line of Lot 128, Ham's .Addition to
the City of Dubuque, thence running
northerly at an angle to a point
about thirty -five feet north of the
south line of Lot 129, Ham's Addi-
tion, as shown upon the blue print
hereto attached, presented and read.
Councilman Schuckert moved that
this be considered the first reading
of the ordinance. Seconded by Coun-
cilman McEvoy. Carried by the fol-

An Ordinance restricting the max-
imum weight and length of trailers
and semi - trailers operated upon the
streets of the City of Dubuque; pro-
hibiting the use upon said streets of
trailers and semi - trailers exceeding
such restricted weight and length
limitations; repealing said ordin-
ances or parts of ordinances in con-
flict herewith; declaring an emerg-
ency to exist; and providing pen-
alties for the violation here, present-
ed. Representative of Yellow Truck
Co. of Madison, Wis., Mr. Creswick
and Mr. Dewey Waller addressed the
Council asking to have action de-
ferred on this ordinance. Attorney
Frank O'Connor and Mr. Hayes ad-
dressed the Council relative to the
adoption of the ordinance.
Councilman Thompson moved to
defer action on the ordinance till the
meeting of May 2nd, 1932. Seconded
by Councilman McEvoy. Carried by
the following vote:

Councilman Thompson moved that
St. Mary's Orphanage be granted
permission to connect a six -inch
sewer line with the existing eight -
inch sewer line now installed on
their property, this eight -inch sewer
now being connected with the City
sewer at the City Limits on Davis
Street. Seconded by Councilman Mc-
Evoy. Carried by the following vote:
