Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the purpose or
acting upon such business as may
properly come before the meeting.
Petition of Mrs. A. J. Vogler et al
requesting an extension of time be
granted for the construction of a
sidewalk in front of and abutting
Lot 569 Ham's Addition, said lot be-
ing located on Decatur Street be -,
tween Lincoln Avenue and Prescott
Street, presented and read.
Councilman Schuckert moved to
refer the petition to the City Coun-

requesting the City Council to cause

the Interstate Power Company to
remove their transmission pole lo-
cated about 30 feet north of Thir-
teenth Street in the Alley between
Iowa Street and Central Avenue
from its present location and place
said pole back up against the prop-
erty line in order to clear conges-
tion in the alley, presented and read.
Councilman McEvoy moved to re-
fer the petition to the City Council.
Seconded by Councilman Schuckert.

June 21, 1932.,
To the Honorable Mayor and City
Council,
Dubuque, Iowa.
Gentlemen: This is to confirm
your decision reached with the of-
ficials of the Interstate Power Com-
pany, namely Messrs. Maddock and
Smith, that an Ordinance be drawn
by the City Solicitor authorizing the
substitution of buses for street cars,
authorizing the rerouting of trans-
portation facilities, authorizing the
reservation of bus stops on Main
Street from 2nd to 12th and also on
8th Street near Main Street, author-
izing the Interstate Power Company
to remove their rails and ties and
other track facilities in asphalt and
brick streets within a five year per-
iod, the work to be done on an av-
erage yearly basis. Further, that
so long as the Interstate Power Com-
pany's rails and ties are installed
in the present paving, that the Inter-
state Power Company shall be re-
quired to protect and maintain the
Surface of the street for the entire
width of their right -of -way. It was
also determined that the Interstate
Power Company should, as quickly
as possible after the discontinuance
of street cars, remove switches and
frogs at such places as may be re-
quired in the City by the City Coun-
cil; that they remove the railroad
crossing on Rhomberg Avenue, thus
permitting the C. G. W. Railroad
Company to install a rail crossing
as promised the City and that at
street intersections and other de-
pressions and obstructions caused
by the present track in certain
streets, that repairs be made of a
teniporary measure at least to facil-
itate the easy movement of auto-
mobile traffic over said depressions.
It is specifically understood that
the Interstate Power Company shall
make immediate repairs to such
right -of -ways in present City streets
as are dangerous.
Regarding the poles and trolley
wires and other overhead electrical
equipthent necessary for street car
operation and not needed for bus
transportation system, it was agreed
that the Interstate Power Company
should remove all trolleys and sur-
plus poles except those that at this
time may be required by the City
for the use and operation of Police
and Fire signal system, such poles
to be determined by the City Elec-
trician and the Interstate Power
Company.

Gentlemen: This is to advise you
of your decision reached July 1st in
coimection with the recommendation
of the City Managei of June `27t1i
concerning the offer of the Harris
Trust & Savings Bank of Chicago
to sell to the City of Dubuque cer-
tain Ditbuque securities for the pur-
pose of investing the present cash
in the City General Sinking Fund.
Your decision was that the City
Manager be authorized to purchase
$90,000 of the 4 /g% Sewer Bonds,
being a portion of the $90,000 issue
that was recently awarded to the
Harris Trust & Savings Bank for re-
lief program last winter. The ma-
turities and prices of these specific
bonds authorized to be purchased
are as follows: —

$10,000— December 1, 1941 — $102.70
25,000 — December 1, 1942— 102.93
5,000 -- December 1, 1943— 103.15
It is understood that all these
bonds bear 1 /4% commission less
than the prices above stated.
This is also further to confirm
your decision that the Harris Trust
& Savings Bank be notified of your
decision to purchase these securities.

tion of a six, (6) inch vitrified tile
sewer in and along the alley between
Lincoln Avenue and Rhopberg
Avenue from the manhole 200 feet
south of Shiras Street to a point
about 25 feet north of Shiras Street,
Thos. Flynn Coal Company, contract-
ors, has been completed.
I further certify that this work
has been done in accordance with
the plans and specifications and stip-
ulations of the contract and I would
therefore recommend its acceptance
by the Council.

Be it resolved by the Council of
the City of Dubuque, that the Treas-
urer of said City be and he is here
by directed to invest Forty Thou-
sand Dollars, ($40,000) of the funds
in his hands which are being accum-
ulated as a sinking fund for the pay-
ment of general obligation bonds of
the City of Dubuque in municipal
bonds which constitute a general ob-
ligation of the municipality issuing
the same, preferably such bonds as
have been heretofore issued by the
City of Dubuque itself.

Ordinance No. 15 -32
An ordinance authorizing Interstate
Power Company, its successors
and assigns, to substitute motor
bus transportation for street rail-
way transportation in the City of
Dubuque;fixing a time for the re-
moval of rails, ties, poles, and ap-
purtenances from the streets and
the restoration of streets; desig-
nating motor bus routes; prescrib-
ing the places for loading and dis-
charging of passengers; imposing
conditions upon the rights granteh
by this ordinance; providing for
the continuance in effect of all the
provisions of the franchise ordin-
ance of said Interstate Power Com-
pany not inconsistent herewith;
and requiring an acceptance of the
provisions hereof.
WHEREAS, Interstate Power Com-
pany, as the successors to Dubuque
Electric Company, operates a street
railway system in, along and upon
the streets of the City of Dubuque
by virtue of a franchise ordinance
adopted and approved by the elect-
ors of said City on March 27, 1922;
and,
WHEREAS, section 11 of said or-
dinance provides: "that said Com-
pany shall not abandon any of its
lines or any part thereof nor fail
to operate said lines in accordance
with this franchise except by writ-
ten consent of the City Council;
and,
WHEREAS, said section further
provides as follows: "it is specific-
ally provided and agreed that no
thing herein contained shall be con-
strued to prevent the Company from
substituting some other modern sys-
tem of transportation for the present
street railway transportation sys-
tem if, during the period of this fran-
chise, such proposed substituted sys-
tem shall be approved by the City
Council of the City of Dubuque ";
and,
WHEREAS, the City Council of
the City of Dubuque is convinced
that the substitution of motor bus
transportation for street railway
transportation meets with the ap-
proval of the general public and will
promote the best interests of said
City and its inhabitants and that
authority has been granted to it by
the terms of said franchise ordin-
ance to authorize the abandonment
of the street railway system and the
substitution of motor bus transpor-
tation therefor during the life of said
franchise; and,
WHEREAS, it is deemed neces-
sary and advisable by this Council.
to exercise due care to safeguard
ties and other equipment appurten-
ant to the operation of the street
railway system is being undertaken,
said Company, its successors or as-
signs, shall assume all responsibil-
ity for damages to persons or prop-
erty which may arise on account of
any negligence in the performance
of such work and shall hold the City
of Dubuque harmless from such
damages.
Par. 252. Repairs of Right of Way.
Section 6. That the provisions of
said Section 6 of the franchise ordi-
nance relating to repairs on the
space occupied as right of way un-
der said ordinance shall continue in
effect as long as the rails and ties,
or either one, remain in the streets,
provided, however, that such Com-
pany, its successors or assigns, shall
not be required to repair its right of
way from which rails have been re-
moved but ties have been allowed
to remain where laid on and encased
in concrete when defects arise there-
in from causes proven to be extran-
eous to street railway facilities in
the streets; that is to say, that said
Company, its successors and assigns,
shall keep the space occupied by its
right of way in good repair at all
times and the City Council shall
have the right to determine the nec-
essity for repairs and the materials
with which such repairs shall be
made, and should said Company, its
successors or assigns, refuse or neg-
lect to make such repairs for which
it is herein chargeable, after a writ-
ten notice of said Council to make
repairs within a reasonable time,
said Council shall have the right to
cause said repairs to be made and
charge the expense thereof to said
Company, its successors and assigns.
Par. 253. Operation of Buses. Sec-
tion 7. That the provisions of Sec-
tion 7 of said franchise ordinance,
relating to the operation of street-
cars, shall be applicable to the oper-
ation of buses, that is to say, that
such buses shall be of modern pat-
tern and construction, suitable for
safety, convenience and comfort of
the passengers, properly equipped
and heated. All buses shall come to
a full stop before crossing railroad
tracks and shall not proceed furth-
er until it has been ascertained that
no train is approaching.
In the operation of buses all traf-
fic rules of the City of Dubuque, now
in effect or hereafter enacted, shall
be observed, reserving in the City
Council the right to enact reason-
able rules and regulations relative
to the matters contained within this
section.
Par. 254. Fares. Section 8. That
all of the provisions of sections 8
and 9 of said franchise ordinance
Special Session, July 12th, 1932
relating to fares shall apply to the
operation of buses and no part of
said sections 8 and 9 shall be con-
strued as being amended, modified,
altered or repealed hereby.
Par. 255. Service. Section 9. That
all of the provisions of section 10 of
said franchise ordinance relating to
service and controversies, shall ap-
ply to the operation of buses and no
part of said section 10 shall be con-
strued as being amended, modified,
altered or repealed herby.
Par. 256. Forfeiture. Section 10.
That all the provisions of section 12
of said franchise ordinance relating
to the forfeiture of franchise, shall
continue in effect and apply to bus
operation and no part of said sec-
tion 12 shall be construed as being
amended, modified, altered or re-
pealed hereby.
Par. 257. Bus Stops. Section 11
Unless otherwise determined by the
City Council in the interest of pub-
lic safety and convenience, buses, in
loading and unloading passengers,
shall draw up to the curb and stop

Par. 258. Routes. Section 12. In
consideration of the permission to
abandon the railway system and sub-
stitute therefore motor bus transpor-
tation, and in order to provide great-
er facilities to the public, without
interfering with or nullifying rail-
way routes as existing when the
franchise ordinance was adopted, it
is provided that the routes to be
traversed by said motor bus trans-
portation system shall be as fol-

are guaranteed to it by the terms
of said franchise ordinance to the
end that such rights will not be
prejudiced or destroyed by the aban-
donment of the street railway sys-
tem and the substitution of motor
.bus transportation therefor; and,
WHEREAS, all provisions of the
franchise ordinance, not necessarily
inconsistent with the clause therein
authorizing the substitution of mo-
tor bus transportation for the street
railway system and the abandonment
of said street railway system, must
be continued in effect and performed
by said Interstate Power Company,
its successors and assigns, for the
remaining period of said franchise.
Now, therefore;
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DU-
BUQUE:
Par. 246. Abandonment and Sub-
stitution. Section 1. That the In-
terstate Power Company, its succes-
sors and assigns, be and it is hereby
authorized to abandon its existing
street railway system and substitute
therefore a modern motor bus trans-
portation system.
Par. 247 Immediate Removal of
Poles, Wires, Switches, Passing
Tracks, etc . Section 2. That upon
the discontinuance of street railway
operation said Interstate Power Com-
pany, its successors and assigns
shall begin at once and complete, at
its own expense, the removal from
City streets of all trolley poles, guy
poles and other poles no longer nec-
essary for street car operation, ex-
cept such of these poles as may be
required by the City for its alarm
signal system. It shall also remove
all trolley wires, span wires and
other useless overhead equipment.
It shall also remove all rails and
wooden ties, (unless said wooden
ties are laid on and encased in con-
crete), and switch fixtures at exist-
ing passing tracks (except the pass-
ing tracks on Central Avenue and
West Locust Street) and rails and
ties at railroad crossings. It shall
remove rails and the rods (no ties
installed) at the curved branch -off
at the northwest corner of Main and
West Eighth Streets. It shall also
remove tracks and wooden ties in
brick paving on Central Avenue in
front of present street car barn as
quickly as the sale of present street
cars can be made and said cars re-
moved from car barn; however, said
Central Avenue car barn tracks
shall be completely torn out and
new concrete paving constructed to
replace the existing brick paving on
Central Avenue at this location not
later than July 1st, 1933.
Par. 248. Removal of Other
Tracks. Section 2 -A. Rails, wood-
en ties (unless said wooden ties are
laid on and encased in concrete)
and other track facililities now lo-
cated in asphalt and brick pavements
shall be removed by said Interstate
Power Company, its successors and
assigns, at its expense, within five
years from the 1st day of June, 1933.
Such work shall be distributed pro-
portionately over such five year per-
iod, the right being expressly re-
served to the City Council of the
City of Dubuque to designate the
streets from which such equipment
shall be removed in each year. Rails
and ties now placed in existing con-
crete streets shall be permitted to
remain until such time as danger
to vehicular traffic shall require re-
moval of the same and this removal
shall be performed at the expense
of the Interstate Power Company,
its successors and assigns.
Par. 249. Removal by City. Sec-
tion 3. Should said Company, its
successors and assigns, fail or refuse
to remove its poles, wires, rails, ties
and other equipment, appurtenant to
the operation of its street railway
system in the manner and at the
times provided for in sections 2 and
2A hereof, the City of Dubuque shall
remove or cause the same to be re-
moved and charge the cost thereof
to said Company, its successors and
assigns, including the cost of the
replacement of the streets from
which such equipment has been re-
moved.
Par. 250. Replacement of Streets.
Section 4. Whenever and as poles,
rails and ties are removed from the
streets and sidewalks, said Company,
its successors and assigns, shall re-
store the surface of the streets and
sidewalks to as good condition as
they were before such equipment
was removed, the restoration of such
streets and sidewalks to be made
of such materials as conform to the
existing right of way, and sidewalks,
or its equal, and all work shall be
done under the supervision of the
Manager and Engineer and subject
to their approval and at the expense
of said Company, its successors or
assigns. Failure or neglect to re-
store such streets and sidewalks, as
herein provided, shall authorize the
City of Dubuque to perform such
work and charge the expense there-
of to said Company, its successors
or assigns.
Par. 251. Liability of Company.
Section 5. During the time or times
the removal of poles, wires, rails,
Jones and Main Street; thence on
Main Street to West 13th Street;
thence on West 13th Street to Cen-
tral Avenue; thence on Central

The foregoing routes shall be
maintained and serviced by motor
bus transportation for the remaining
period of the franchise of said Com-
pany, its successors and assigns, ex-
cept that modifications and addi-
tions thereto may be made as the
demands and convenience of the
public may make the same neces-
sary or advisable.
Par. 259. Omnibus Provision. Sec-
tion 13. Nothing herein contained
shall be construed to extend the
term of the franchise ordinance of
said Company, its successors or as-
signs, and no provision or provis-
ions of said ordinance, whether the
same be referred to herein or not,
unless such provision or provisions
are inherently inconsistent with the
operation of motor bus transporta-
tion, shall be construed as amended,
modified, altered or repealed and all
reciprocal rights and obligations ex-
isting under said ordinance shall
_continue in force and effect just as
much as if this ordinance had not
been adopted.
Par. 260. Acceptance. Section 14.
This ordinance shall be in force and
effect ten days from and after its
final passage, adoption and approval
by the City Council of the City of
Dubuque, the acceptance of its
terms by the Interstate Power Com-
pany, its successors or assigns, in
writing, and the publication of the
same in the manner provided by
law.

Which certain Ordinance was
passed by the City Council upon
first and second readings on the 5th
day of July, 1932, and passed, ad-
opted and approved upon final read-
ing on the 12th day of July, 1932,
therafter to be published in the
manner provided by law.

Gentlemen:
In connection with the request of
the Dubuque Dock Commission to
City Council July 5th that the City
join with them in the cost of ex-
tending two concrete runways from
the eastern edge of the present con-
crete drive at the steamboat landing
at the Mississippi River, which ques-
tion was referred to the City Man-
ager for investigation and report,
please be advised that we herewith
submit a sketch showing the exist-
ing concrete structure, the water's
edge and the proposed two exten-
sions This question has been dis-
cussed with individual members of
the Dock Commission and is as they
desire the same.
One new concrete strip will be 12
feet wide by 25 feet long, the other
will be 8 feet wide by 12 feet long.
At the basis of $10.00 per cu. yd. it
is estimated that $100.00 will com-
plete the construction of these two
pavement slabs which will be a
minimum of 8 inches thick and shall
be dowled to the present existing
rock base.
Inasmuch as the Dock Commis-
sion receives all the revenues from
wharfs and docks in the City, it is
felt that the Dock Commission
should stand the full expense of this
improvement. However, due to the
fact that revenue from river facil-
ities has been so limited this Sum-
mer and that the Dock Commission
has an obligation of $975.00 to re-
pay to the City for money loaned
them last year, it is suggested that
the City join on a 50% basis for the
cost of this construction on the con-
dition that if the Dock Commission
can, at the end of the fiscal period,
pay the 50% more or less, as esti-
mated as the City's share, that they
will then assume the entire cost of
the construction.
It is felt that the two concrete
slabs are needed as the existing
condition of the rock base is very
rough and dangerous both to pedes-
trian travel coming from steamboats
and the hardship to local coal deal-
ers and grocery dealers toward fur-
nishing of fuel and supplies to the
boats as they land here.

Whereas, vast amounts of public
funds belonging to the State of Iowa
and the various political subdivi-
sions thereof, including counties,
cities, towns and school districts,
are deposited in closed banks within
said State and that great distress
and suffering is resulting thereby;
and,
Whereas, the funds in the State
Sinking Fund are inadequate to re-
pay to such public corporations the
sums represented by such deposits
in such closed banks; and,
Whereas, the Congress of the
United States has adopted a relief
measure which, among other things,
provides for the establishment of a
Three Hundred Million Dollar
($300,000,000) Reconstruction Fin-
ance Corporation Fund which is
available for loans to states to re-
lieve distress; and,
Whereas, the Council of the City
of Dubuque deems it necessary and
advisable that the State of Iowa,
acting by and through its Chief
Executive Officer, the Honorable
Governor of Iowa, take immediate
action to secure a loan from the Re-
construction Finance Corporation
for the purpose of creating a fund
for the repayment to public corpor-
ations of funds deposited in closed
banks in the State of Iowa; Now,
Therefore,
Be it Resolved by the City Coun-
cil of the City of Dubuque:
That the Honorable Governor of
the State of Iowa be and he is here-
by requested to take immediate ac-
tion looking toward the securing of
a loan from the Reconstruction Fin-
ance Corporation in the sum of

issue.
It is understood that Kaufmann
Avenue, Hempstead and Lowell
Streets and Marshall Street from
Rhomberg to Lincoln and Rush
Street be considered among the
most urgent storm sewers to be
constructed under this issue.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: This is to advise that
at the informal meeting held follow-
ing the special meeting July 12th
the request of the occupants of the
R'oshek Building, dated June 24th,
was referred to the City Council for
investigation concerning the ques-
tion of extending the parking limits
on the south side of 7th Street be-
tween Locust and the alley between
Main and Locust.
Council did consider this question
and reached the decision that, due
to the fact that the Washington
Park availed the residents and rent-
ers of property in this vicinity ade-
quate space, and since other re-
quests for parking conditions would
undoubtdly arise if this change were
made, that they could not change
the ordinance and grant the request.
Accordingly, the request was denied.
