of $50,000.00 Sewer Bonds, providing
for the levy of taxes to pay the same

tofore enacted governing this subject

Gentlemen:
The petition of F. J. Sauer in re-
gard to the construction of a sani-
tary sewer on Strauss and Hedley
Streets was presented to Council
August 22 complaining of the long
lateral being constructed to his
house.
On recommendation of the City
Engineer Council approved the plan
of assessing Mr. Sauer only for the
lateral on the basis of being the aver-
age length of the lateral on said
sewer. The balance of the cost of
this lateral will be assessed with the
main sewer.

Cary and Mrs. Caroline Nelson which
was presented to council August 22
praying that the city find some room
suitable and acceptable to the Ladies
of the Grand Army of the Republic
to hold ritualistic meetings and carry

Dubuque, Iowa.
Gentlemen:
At an informal meeting held Aug.
29, the City ,Council acting on re-
quest of Mrs. A. J. Vogler asking for
an extension of time to construct a
sidewalk on Decatur Street along
Lot 569 at Ham's Addition granted
said request.
The request of Mr. Kohlman on
the north side of Ascension Street,
west of Lincoln, and Mr. James Ku-
low for a sidewalk on Decatur Street
across said Decatur Street from Mrs.
Vogler's lot were also considered by
the City Council and the request of
both parties were granted, that the
sidewalks should not be constructed
this fall.

Gentlemen:
At the meeting of August 15 Mrs.
James Benda appeared before coun-
cil requesting reconsideration toward
relief in the payment of taxes on
lots in the East Dubuque Addition
formerly owned by the mother of
Regular Session, September 6th, 1932
on relief work was considered by the
City Council August 29.
It was believed that the council
chamber was not suitable for this
purpose and, due to the fact that so
many civic and city meetings were
being held in the council chamber,
that it would be unwise to start the
procedure of using the council cham-
ber for meetings of this nature.
Council discussed the possibility of
securing for this organization room
in the former Masonic Temple now
under control of the Library Board.
Accordingly, the request was de-
nied with regret.

Mrs. James Benda which have now
come into the possesion of Mrs.
Benda.
The applicant stated that taxes
had accumulated since the year 1924
upon proper suspension by the City
Council from year to year. She stated
that council had considered this
question and had denied her petition
and that she asks for reconsidera-
tion.
Accordingly, at the meeting of
City Council held August 29, the
question was again discussed. The
decision at this meeting was that
council can not grant relief by way
of cancellation for any of the defer-
red taxes which now extend over a
period of eight years.
Accordingly, the request was de-
nied.

At the meeting of August. 22 a
communication of the City Manager
was presented to council stating that
the Interstate Power Company de-
sired to increase the parking space
reserved for busses from fifty feet
to sixty feet at the following two
locations:
1. North side of 8th Street, east
of Main and along Stampfer's store
side.
2. East side of Main Street, south
of 8th Street and in front of Kresge's
5 and 10 cent store.
This question was considered at
an informal meeting of council held
August 29. Due to the fact that so
many objections have recently arisen
from the fifty foot bus reservations,
it was decided by council that the re-
quest on the north side of 8th Street,
east of Main Street and along Stamp -
fer's store side be granted and the
request on the east side of Main
Street, south of 8th Street and in
front of Kresge's 5 and 10 cent store
he denied.

of M. A. Owsley to purchase one -half
of Lot 2 of industrial tract E, front-
ing on Locust Street and facing
Charter Street was discussed.
It was determined that it would be
unwise to sell a small portion of this
industrtial land for an oil station.
Accordingly the request was de-
nied.

This is to advise that the City
Council of Dubuque, at an informal
meeting held August 29, considered
the claim of Mrs: Elizabeth Grabow
for injuries by reason of falling on
an icy walk at St. Columbkille's
Church.
This claim was presented by her
husband June 8, 1932. On recom-
mendation of the City Solicitor the
petition was denied.

It was agreed that if the billboard
be located at least thirty -five feet
fro'' the curb that the construction
would not be detrimental to the ap-
pearance of the land.

Miss Mary Bolton, representative
of the Volunteers of America, ad-
dressed the Council requesting per-
mission to hold a tag day on Septem-
ber 17th, 1932. Miss Bolton was ad-
vised that the Council would take
this matter under consideration and
she would be advised of the decision
of the City Council.
Mr. Al. Smith, Superintendent of
the Interstate Power Company, ad-
dressed the Council relative to the
City Council granting the prayer of
the petition of the Interstate Power
Company requesting permission to
discontinue the operation of the
Seminary Hill bus from the inter-
section of the paved and unpaved
section of Seminary Street westerly
over the County Highway to Asbury
Road, thence northerly over the
County Highway to St. Joseph's
Sanitarium and return southerly ov-
er Asbury Road to the intersection
of Asbury Road to St. Ambrose
Street and in lieu of this change
they wish to continue the operation
of the Seminary bus from Seminary
Street over St. Ambrose Street to
the intersection of the Asbury Road
and Asbury Street, and thence along
Asbury Street to Delhi Street, etc.,
to the downtown section.
Councilman Schuckert moved that
the prayer of the petition, be granted
and that a new re- routing of the
Seminary Hill bus be allowed over
St. Ambrose Street. Seconded by
Councilman Thompson. Carried by

Mr. Grommerisch addressed the
Council relative to the valuation as
placed for taxation purposes on his
property located on Alpine Street
and requesting the City Council to
lower the valuation. Mr. Grommer-
isch was advised that the Council
had no jurisdiction in the matter.

the City Manager be authorized to
investigate and install, if found nec-
essary, street lights on Glen Oak
Street between West 3rd Street and
Wes 5th Street and also at the inter-
section of Hennepin Street and
Windsor Avenue. Seconded by Coun-
cilman Schuckert. Carried by the
following vote:

Gentlemen: In connection with
the authority granted by City Coun-
cil for the receipt of bids for the
sale of $50,000 storm sewer bonds of
this City, said bids to be received
at 10:00 A. M. Monday, September
19th, please be advised as follows:
Up until 10 o'clock Monday, Sep-
tember 19th, there was on file with
the City Clerk one sealed bid. On
opening the same, we found that
Halsey, Stuart & Co. of 201 So. La

Salle Street, Chicago, enclosed a for-
mal written offer for the purchase
of $50,000 storm sewer bonds on the
basis of 4 interest and a prem-
ium of $90.00. A certified check for
$1,500.00 was enclosed with the bid.
No other sealed bids were received.
After the opening of the only seal-
ed bid presented and proceeding to
the oral offers for sale of said secur-
ities, White- Phillips & Co. of Daven-
port and National City Co. of Chi-
cago, after presenting certified
checks each in the sum of $1,500.00,
bid orally up until the sum of $110.00
as finally bid by the National City
Co., represented by Mr. J. W. Winall
of Dubuque in person.
In accordance therewith I would
respectfully advise you that the Na-
tional City Co., located at 120 So.
LaSalle Street, Chicago, were the
highest bidders for said issue of
storm sewer bonds on the basis of
414 interest and a premium of
$110.00. A written offer in duplicate
is herewith attached to this report
upon which has been attached their
offer at the rate of 4%% interest
and $110.00 premium.
Another bidder who submitted a
certified check for $1,500.00, but who
did not bid orally was the firm of
Glaspell, Vieth & Duncan of Daven-
port. After the reading of the first
and only written bid, they withdrew
and asked the return of their check.

Bonds and approving and author-
izing the agreement of such sale
and award.
Whereas, notice of sale of Fifty
Thousand Dollars ($50,000) Sewer
Bonds of the City of Dubuque, Du-
buque County, Iowa, has heretofore
been given in strict compliance with
the provisions of Chapter 63 of the
Code of Iowa, 1927, by publication of
notice for two or more successive
weeks in one of the official news-
papers of Dubuque County; and
Whereas, all sealed bids have
been received and placed on file, af-
ter which open bids were called for
and received as follows: National
City Company, Chicago, Ill., par and
accrued interest and premium of
$110.00 White - Phillips Company, Da-
venport, Ia., par and accrued inter-
est and premium of $105.00, and
thereafter such sealed bids were
opened, the substance of the best
sealed bid being as follows: Halsey.
Stuart & Co., Chicago, I11., par and
accrued interest and premium of
$90.00.
Now, therefore, Be It Resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That upon being ad-
vised in the premises it is hereby
determined that the bid of National
City Company, Chicago, Ill., for the
purchase of Fifty Thousand Dollars
($50,000) Sewer Bonds, as adver-
tised, bearing interest at the rate of
four and one - quarter per cent
(41/4%) per annum, is the highest
and best bid received and that said
bonds be and the same are hereby
awarded to said National City Com-
pany, Chicago, Ill.
Section 2. That the form of agree-
ment of sale of said bonds to Na-
tional City Company, Chicago, 111.,
be and the same is hereby approved
and the Mayor, City Clerk and City
Treasurer are hereby authorized to
execute said agreement for and on
behalf of the City of Dubuque, Iowa,
and to affix the corporate seal of
said City thereto.
Section 3. That all resolutions or
parts of resolutions in conflict here-
with be and the same are hereby
repealed.

BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DU-
BUQUE:
Par. 269, Section 1. License Re-
quired. No person, firm or corpora-
tion, operating as a peddler, shall
sell or offer for sale melons, fruits
or vegetables upon or along the
streets, alleys or public places of
the City of Dubuque unless a license
shall have been issued to such per-
son, firm or corporation in the man-
ner herein provided. Provided, how-
ever, that this provision shall not
apply to anyone who raises or pro-
duces such commodities or sells or
distributes them as the agent or ser-
vant of such producers. Before this
exception shall apply, the person
claiming to be a producer, or his
agent or servant, shall file with the
City Manager a statement under
oath to the effect that he is such
producer or agent or servant.
Par. 270, Section 2. Term Defined.
The term "operating as a peddler"
shall mean anyone who sells or offers
to sell such commodities at whole-
sale or retail from a truck, wagon or
other vehicle propelled or driven
along and upon the streets, alleys or
public places, or from house to house,
store to store, or place to place and
shall include all itinerant vendors of
such commodities engaged in busi-
ness for themselves, selling by sam-
ple or by taking orders for imme-
diate or future delivery.
Par. 271, Section 3. Inspection. It
shall be the duty of the Food Com-
missioner and Market Master to exer-
cise supervision and control over the
business of selling the commodities
above referred to and to that end
they may, at any time, make an in-
spection of the commodities offered
for sale and condemn the same when-
ever they are found to be unfit for
human consumption.
Par. 272, Section 4. Licenses
Issued. Licenses shall be issued by
the City Manager after an applica-
tion therefor has been filed with him.
Provided, however, that such Mana-
ger may refuse a license in any case
where the applicant is not of good
moral character, free from disease,
or trustworthy in his business deal-
ings or, for any other reason that
satisfies the Manager that the inter-
ests of the people would be best pro-
tected by withholding a license from
the applicant.
Par. 273, Section 5. Fees. As a
condition to the issuance of a license,
the following license fees shall be
paid, depending upon the length of
time that such license is to be issued,
to -wit: for one day - $10.00; for one
week— $25.00; for one month —
$50.00; and for one year — $75.00.
The license shall indicate thereon
the name of the licensee and the
period for which it is issued. Licen-
ses shall not be transferable and no
refund shall be granted when a
license has actually been used for a
lesser period than that for which it
has been issued. -
Par. 274, Section 6. Penalty. Any
person, firm or corporation, engaging
in the business aforesaid without a
license shall be deemed guilty of a
misdemeanor and upon conviction,
shall be fined not less than $10.00
nor more than $100.00 and impri-
soned until such fine and costs are
paid, not to exceed thirty days in
jail.
Par. 275, Section 7. Repeal. All
ordinances or parts of ordinances
inconsistent or in conflict with any
of the provisions of this ordinance
are hereby repealed.
Par. 276, Section 8. Validity. In
the event that any part, section or
paragraph of this ordinance is held
to be invalid, such invalidity shall
not effect any other part, section or
paragraph of the same.
Par. 277, Section 9. Publication.
This ordinance, being deemed urgent
and for the preservation of the
health, peace and general prosperity
of the City of Dubuque and its inha-
bitants, shall be in force and effect
from and after its final passage and
adoption by the City Council and
publication as provided by law.

In connection with the matter
which was referred to the City Man-
ager with power, namely the invest-
igation and authorization of two new
Special Session, September 20th, 1932
street lights, one at Hennepin and
Windsor Avenue and one on Glen
Oak near West Third Street, please
be advised that I have investigated
both conditions, together with Mr.
Gorr of the Interstate Power Com-
pany, and authorization has been
made this day to install one new 250
c.p. light, costing $38.00 per year,
at the southeast corner of Hennepin
and Windsor Avenue.
On Glen Oak Street it has been
determined that the logical place
for the proposed new light is at the
intersection of Glen Oak and the
alley first north of West Third Street
approximately 200 feet north of the
intersection of West Third and Glen
Oak. The size of this lamp author-
ized is 250 c.p. and the cost $38.00
per year.

Gentlemen:
At the Council meeting of July
5, 1932, the petition of the Genz
Stores, et al, praying that the pre-
sent pole owned by the Interstate
Power Company on the alley between
Iowa and Central Avenue, said pole
being north approximately 75 feet
from 13th Street, be moved as close
to the property line as possible in
order to clear the present obstructed
condition of the alley, was referred
to City Council. This matter was
discussed informally by Council at
an informal session about three
weeks ago.
This is to advise that the Inter-
state Power .Company today have
agreed to replace the present weak
pole by a new pole, moving the same
as close as possible to. the rear of
the present garage occupied by the
Schrup Motor Company and change
the location of said pole to a posi-
tion about 8 feet south and opposite
a place without windows at the
Schrup Motor Company's garage.
The condition that the City Man-
ager formerly discussed with Coun-
cil was that the Schrup Motor Com-
pany would be compelled to change
their service from the pole to the
building, but upon investigation, it
was found not necessary to do so.
This change of location of the pole

is acceptable to Mr. Schrup. Accord-
ingly, I believe that a new location
will be much more satisfactory to
the users of this alley.

and award of $50,000 Sewer Bonds
and approving and authorizing the
agreement of such sale and award.
WHEREAS, notice of sale of Fifty
Thousand Dollars, ($50,000) Sewer
Bonds of the City of Dubuque, Du-
buque County, Iowa, has heretofore
been given in strict compliance with
the provisions of Chapter 63 of the
Code of Iowa, 1927, by publication of
notice for two or more successive

weeks in one of the official news-
papers of Dubuque County; and
WHEREAS, all sealed bids have
been received and placed on file,
after which open bids were called
for and received as follows: National
City Company, Chicago, I11., par and
accrued interest and premium of
$110.00: White - Phillips Company,
Davenport, Ia., par and accrued inter-
est and premium of $105.00 and there-
after such sealed bids were opened,
the substance of the best sealed bid
being as follows: Halsey, Stuart &
Co., Chicago, Ill., par and accrued
interest and premium of $90.00.
NOW, THEREFORE, Be It Re-
solved by the City Council of the
City of Dubuque, Iowa, as follows:
Section 1. That upon being ad-
vised in the premises it is hereby
determined that the bid of National
City Company, Chicago, Ill., for the
purchase of Fifty Thousand Dollars,
($50,000) Sewer Bonds, as adver-
tised, bearing interest at the rate of
four and one - quarter per cent (4 %)
per annum, is the highest and best
bid received and that said bonds be
and the same are hereby awarded to
said National City Company, Chi

Section 2. That the form of agree-
ment of sale of said bonds to Na-
tional City Company, Chicago, Ill., be
and the same is hereby approved,
and .the Mayor, City ,Clerk and City
Treasurer are hereby authorized to
execute said agreement for and on

and to affix the corporate seal of said

AN ORDINANCE amending ordi-
nance No. 17 -32 entitled, "An Ordi-
nance providing for the issuance of
$50,000 Sewer Bonds, providing for
the levy of taxes to pay the same and
declaring an emergency," so as to
reduce the interest rate and effect a
reduction in the amount of annual
taxes thereby provided for, and de-
claring an emergency.
WHEREAS, under date of August
29, 1932, this City Council of the City
of Dubuque, Dubuque County, Iowa,
enacted an ordinance entitled, "An
ordinance providing for the issuance
of $50,000 Sewer Bonds, providing for
the levy of taxes to pay the same
and declaring an emergency," and
WHEREAS, it is deemed advisable
and for the best interests of said
City that the bonds thereby author-
ized be issued bearing interest at the
rate of Four and One - quarter Per
Cent (4 %) per annum, instead of
Four and one half per cent (4% %)
per annum; now, therefore,
BE IT ORDAINED by the City
Council of the City of Dubuque as
follows:
Section 1. That Section 1 of the
ordinance referred to in the pre-
amble hereof be and the same is
hereby amended to read as follows:
Section 1. That pursuant to and
as authorized by Section 6125 of the
Code of Iowa, there shall be and
there is hereby ordered issued the
negotiable Sewer Bonds of said, City
of Dubuque in the principal amount
of $50,000; said bonds to be 50 in
number, dated September 1, 1932;
bearing interest at the rate of Four
and One - quarter Per Cent (4 %)
per annum, from the date of said
bonds until paid, payable March 1,
1933, and semiannually thereafter on
the First days of September and
March in each year; that said bonds
be signed by the Mayor and attested
by the City Clerk and the seal of said
City attached, and be registered as
to issuance by the City Treasurer
and a certificate of such registration
endorsed thereon; that interest on
said bonds be evidenced by coupons
thereto attached and maturing on
the several days when such interest
matures, which coupons shall be exe-
cuted with the facsimile signatures
of said officials, and said Mayor and
City Clerk, by the execution of said
bonds, shall adopt as and for their
proper signatures, their respective
facsimile signatures appearing on
said coupons; and that both principal
and interest be payable in lawful
money of the United States of Amer-
ica, at the office of the City Trea-
surer in and of the City of Dubuque,
Iowa; that said bonds be of the de-
nomination of $1,000 each, be num-
bered consecutively from 1 to 50,
both numbers included, become due
and •payable in their numerical order •
as follows: $15,000 on September 1
of each of the years 1937 to 1939 in-

"Section 5. That for the purpose
of providing for the levy and collec-
tion of a direct annual tax sufficient
to pay the interest on said bonds as
it falls due, and also to pay and dis-
charge the principal thereof at ma-
turity, there be and there is hereby
levied upon all the taxable property
in said City in each of the years
while said bonds or any of them are
outstanding, a tax sufficient for that
purpose, and in furtherance of this
provision but not in limitation there-
of that there be and there is here-
by levied on all the taxable property
in said City the following direct
annual tax, to -wit:
For the year 1933, a tax sufficient
to produce the sum of $4,250 being
$2,125 to reimburse current funds for
advancements to pay interest due
during the year 1933, and $2,125 for
interest:
For each of the years 1934 and
1935 a tax sufficient to produce the
sum of $2,125 each year for interest;
For the year 1936 a tax sufficient
to produce the sum of $17,125 for
principal and interest;
For the year 1937 a tax sufficient
to produce the sum of $16,488 for
principal and interest;
For the year 1938 a tax sufficient
to produce the sum of $15,850 for
principal and interest;
For the year 1939 a tax sufficient
to produce the sum of $5,213 for
principal and interest.
"Said taxes when collected shall
be converted into a special fund for

the payment of principal and inter-
est of the bonds hereby authorized
and no other purpose whatsoever."
Section 3. That a certified copy of
this amendatory ordinance be filed
with the County Auditor of Dubuque
County, and that said Auditor be and
is hereby instructed in and for each
of the years 1933 to 1939 inclusive to
levy and assess the amount of annual
taxes as hereinbefore set out, in lieu
of the amounts as provided by the
original ordinance hereby amended,
and a certified copy of which was
filed in his office on September 9,
1932.
Section 4. That all ordinances and
resolutions and parts thereof, in so
far as same may be in conflict here-
with, be and the same are hereby
repealed, and that the ordinance
hereby amended, as amended, be and
the same is hereby in all respects
ratified and confirmed.
Section 5. That it is hereby found
and declared that an emergency
exists and that it is necessary for
the immediate preservation of the
public peace, health and safety that
this ordinance become effective upon
its passage, approval and publication,
and it is so ordered.

Gentlemen: Attention was called
to the fact that very inadequate
street lighting exists on Rhomberg
Avenue at Fengler, Dock and Farra-
gut intersections. No lights exist
at either of the three above men-
tioned intersections. The distance
from Farley to Ann is 800 feet, Na-
tional to Dock 800 feet and Haw-
thorne to Farragut 920 feet.
It is felt that a light should be
installed at Fengler, Dock and Far-
ragut Streets on Rhomberg Avenue
at once due to the fact that this is
a main highway and the intersec-
tions are particularly dark because
of heavy tree conditions. Accord-
ingly, I would recommend that au-
thority be granted for a 400 C. P.
light at each of these three inter-
sections.
