is the regular monthly meeting of
the City Council for the transaction
of such business as may properly
come before the meeting.

levy of special assessment and in-
tention of the City Council to issue
bonds for the improving of Kleine
Street from the south property line
of Kaufman Avenue to the north
property line of Klingenberg Terrace,
presented and read.
Councilman Schuckert moved to
receive and file the proof of publi-

WHEREAS, the contract hereto-
fore entered into by the City of
Dubuque for the improving of Kleine
Street hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $1297.73.
AND WHEREAS, public notice as
provided by law„ has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and determined:
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque that to provide for
the cost of improving Kleine Street
from the south property line of
Kaufmann Avenue to the north
property line of Klingenberg Ter-
race there be issued improvement
bonds to the amount of $1297.73.
Said bonds shall be issued under
the provisions of Chapter 311 of
the Code of Iowa, 1927, which bear
date as of the 3rd day of November,
1932; shall be in denominations of
$100.00 except that there shall be
one bond to the amount of $97.73.
They shall be numbered from 3279
to 3291 inclusive and shall be di-
vided into ten series of which the
bonds numbered 3279 and 3280 shall
constitute the first series and shall
be payable the 1st day of April, A.
D. 1933, the bonds numbered 3281
and 3282 shall constitute the second
series and shall be payable the lst
day of April, A. D. 1934, the bonds
numbered 3283 and 3284 shall con-
stitute the third series and shall be
payable the 1st day of April, A. D.
1935, the bond numbered 3285 shall
constitute the fourth series and
shall be payable the 1st day of April,
A. D. 1936, the bond numbered 3286
shall constitute the fifth series and
shall be payable the 1st day of
April, A. D. 1937, the bond number-
ed 3287 shall constitute the, sixth
series and shall be payable the lst
day of April, A. D. 1938, the bond

seventh series and shall be payable

Said bonds shall bear interest at
the rate of five per cent per annum
which interest shall be payable
semi - annually, in accordance with
the terms of the coupons thereto
attached; and said bonds shall be
payable out of the proceeds of the
special assessment levied for said
improvement.
Both principal and interest shall
he payable at the office of the City
Treasurer in the City of Dubuque.

ments, with interest on all defer-
red payments at the rate of five per
cent per annum, and this bond is
payable only out of the money de-
rived from the collection of said
special tax, and said money can .be
used for no other purpose. And it
is hereby certified and recited that
all the acts and conditions and
things required to be done preced-
ent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness Whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by
its Mayor and countersigned by its

that the Mayor and City Clerk be
and they are hereby instructed to
cause said bonds to be prepared and
when so prepared to execute said
bonds, and that the City Clerk be
and he is hereby instructed to reg-
ister said bonds in a book to be
kept by him for that purpose and to
then deliver them to the City Treas-
urer who will also register them in
a book to be kept by him for that
purpose.

kept in a special fund to be known

Gentlemen: The question of the
Dubuque Auto Clubs "No Parking"
signs in front of their bus terminal
on Locust Street between 8th and
9th was again presented to City
Council who viewed the ground on
October 7th.
Since the meeting of October 3rd,
at which time the signs were order-
ed removed, the Dubuque Auto Club
had presented a bond protecting the
City in regard to public liability for
said signs in the sum of $5,000 and
$10,000.
It was explained to officials of the
Dubuque Auto Club that Council was
without power to grant such signs
and that since the same were dan-
gerous, the Dubuque Auto Club
agreed to have the signs removed
from the sidewalk and, at their own
expense, erect the four signs on the
outside wall of the front line of the
building.

Gentlemen: The request of Mr.
Rhoads of the Dubuque and Sioux
City Railroad Company toward the
vacation of Main Street south of
Railroad Street was further discuss-
ed by Council October 7th. The
ground was viewed by Cuoncil and
it was found that approximately 670
feet existed along the center line of
Main Street south, of Railroad
Street. This street is 64 feet wide
which would give an area of approx-
imately 43,000 sq. ft. The City Man-
ager was instructed to call Mr. W.
A. Smith, attorney for said railroad,
and advise him of the area..
Council determined that the land
was not to be vacated by means of
a donation, but that it was either to
be sold or used for the possible erec-
tion of a new siding for industrial
fill along Locust Street.

Gentlemen: The matter of grad-
ing the alley north of 14th Street
and west of Atlantic Street to Fill -
more Street, which had been pre-
sented to Council September 19th,
was viewed by Council October 7th.
In the meantime a paving petition
for said alley between 14th and Fill -
more Streets had been presented to
Mr. Herman Lott. The City Man-
ager was instructed to interview Mr.
Lott regarding the paving petition,
which was done October 8th. Mr.
Lott advises that the property own-
ers cannot see their way toward
paving this year.
The City Manager was further in-
structed to make the alley usable by
relieving the drainage conditions in
the alley in the rear of Mr. Lott's
garage and by filling the ruts on the
north end of alley and adding a few
cinders to the muddy places near
14th Street.

The decision on this question was
that no bus zone should be marked
on the west side of the street in
front of Mr. Ketoff's store as it was
agreed by Council and Mr. Ketoff
that this would interfere with busi-
ww ness of the petitioner.

Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting upon such business that may
properly come before the meeting.
Councilman Thompson moved that
the matter of ordering Frank A.
Gierens to vacate and remove his
building from Kimball Street be re-
ferred to the City Manager for in-
vestigation and report. Seconded by
Councilman Schuckert. Carried by
the following vote:

Quinn, with attached bill to the
amount of $15.29, for damages sus-

dered drawn on the City Treasurer

instead to the Upper Mississippi
Waterway Association, presented
and read. City Manager Evans rec-
ommending that the request of the
Upper Mississippi Waterway Assoc-
iation be granted and the appropria-
tion of $100.00, as set out in the
budget for membership dues; be or-
dered paid to the Upper Mississippi
Waterway Association.

the recommendation of the City
Manager be approved and the ap-
propriation of $100.00 as set out in
the budget be made payable to the
Upper Mississippi Waterway Assoc-
