Council met at 7:30 P. M.
Present —Mayor Andelfinger, Coun-
cilmen Kane, McEvoy, Schuckert,
Thompson, City Manager Evans.
Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.
Councilman Schuckert moved that
W. 11. Cullen be appointed as City
Clerk Pro Tem of the meeting. Sec-
onded by Councilman Kane. Carried
by the following vote:

men Kane, McEvoy, Schuckert and
Thompson.

ance of Public Improvement Bonds.)

Resolution No. 117 -32
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a six (6) foot
concrete sidewalk hereinafter de-
scribed, has been completed and said
improvement has been accepted by
the City Council of said City and
the City Engineer has computed the
cost and expense thereof to be
$201.74.
And whereas, public notice as pro-

vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of the construction of a six (6) inch
concrete sidewalk six (6) feet wide
along the east side of Locust Street
abutting City Lots 87 and 88 and the
north 20 foot 2 inches of 86 and
along the south side of West Third
Street from Locust Street to the
alley between Main and Locust
Streets abutting City Lot 88, there
be issued improvement bonds to the
amount of $201.74. Said bonds shall
be issued under the provisions of
Chapter 311 of the Code of Iowa,
1927, which bear date as of the 5th
day of January, 1933, shall be in de-
nominations of $100.00 except that
there shall be one bond to the
amount of $101.74. They shall be
numbered from 3315 to 3316 inclu-
sive and shall be divided into two
series of which the bond numbered
3315 shall constitute the first series
and shall be payable the 1st day of
April, A. D. 1933, the bond numbered
3316 shall constitute the second ser-
ies and shall be payable the 1st day
of April, A. D. 1934.
Said bonds shall bear interest at
the rate of five per bent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement.
Both principal and interest shall
be payable at the office of the City
Treasurer in the City of Dubuque.
Said bonds shall be substantially in
the following form:

IMPROVEMENT BOND
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
193 ; or any time before that date
at the option of the City, the sum
of One Hundred Dollars ($100.00)
with interest thereon at the rate of
five percent per annum, payable on
the presentation and surrender of
the interest coupons hereto attached,
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
any by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 5th day of December, 1932. This
bond is one of a series of 2 bonds,
1 for $100.00 numbered 3315, and one
for $101.74 numbered 3316, all of
like tenor and date, and issued for
the purpose of the construction of
a six (6) inch concrete sidewalk
six (6) feet wide along the east side
of Locust Street abutting City Lots
87 and 88 and the north 20 foot 3
inches of 86 and along the south side
of West Third Street from Locust
Street to the alley between Main
and Locust Street abutting City Lot
86, and described in said resolution;
which cost is assessable to and lev-
ied along said improvement, and is
made by law a lien on all abutting
or adjacent property, and payable
in ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used for no other pur-
pose. And it is hereby certified and
recited that all the acts and condi-
tions and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Dubuque
are hereby irrevocably pledged.
In witness whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 5th day of December, 1932,
and has authorized the use of their
fac - simile signature to the interest
coupons hereto attachd.

to the City Treasurer who will also
register them in a book to be kept
by him for that purpose.
Be it further resolved, that the
City Treasurer be and he is hereby
instructed to sell said bonds in the
manner provided by law, the pro-
ceeds of said sale to be kept in a
special fund to be known as Improve-
ment Fund.
Be it further resolved, that the
interest coupons attached to the
bonds be signed with the fac- simile
signature of the Mayor and counter-

Be it further resolved, that as fast
as funds allow, beginning with the
second year after the payment of
interest due, these bonds shall be

Now, Therefore, Be It Resolved by
the City Council of the City of Du-

Communication of The League of
Iowa Municipalities, with resolution
attached, requesting the City Coun-
cil of the City of Dubuque to em-
ploy Frank G. Pierce, Secretary of
the League, to report to the City of
Dubuque on all matters before the
legislature in which the City of Du-
buque will be interested, presented
and read.

Petition of Henry Valentine mak-
ing claim in the amount of $9.20 for
damages sustained to his automobile
due to accident caused by cave in

claim be allowed and a warrant in
the sum of $9.20 ordered drawn on
the City Treasurer as settlement in
full of the claim. Seconded by Coun-

Ordinance No. 22 -32
An ordinance amending an ordin-
ance entitled, "Ordinance No. 2 -30.
An ordinance regulating the use of
motor and other vehicles upon the
streets of the City of Dubuque; de-
signating the provisions hereof as the
Traffic Code of the City of Dubuque;
repealing all ordinances heretofore
enacted governing this subject and
all ordinances or parts of ordinances
inconsistent herewith; and provid-
ing a penalty for violation hereof,"
by repealing Subdivision "A" of Rule
56, paragraph 89, section 3 and en-
acting a substitute thereof, and by
adding to said Rule 56, additional
provisions designating as boulevards
Central Avenue from the south line
of Fourteenth Street to the north-
erly terminus of said Central Aven-
ue, East 20th Street from the east
line of Central Avenue to the east
line of Jackson Street, and Locust
Street from the south line of West
14th Street to West Locust Street,
over West Locust Street to Semin-
ary Street over Seminary to St. Am-
brose Street, over St. Ambrose Street
to Asbury Street, over Asbury Street
to the north line of Delhi St.; amend-
ing Rule 51, paragraph 89, section

An Ordinance amending an ordin-
ance entitled, "Ordinance No. 2 -30.
An ordinance regulating the use of
motor and other vehicles upon the
streets of the City of Dubuque; des-
ignating the provisions hereof as the
Traffic Code of the City of Dubuque;
repealing all ordinances heretofore
enacted governing this subject and
all ordinances or parts of ordinances
inconsistent herewith; and providing
a penalty for violation hereof," by
repealing Subdivision "A" of Rule 56,
paragraph 89, section 3 and enacting
a substitute thereof, and by adding
to said Rule 56, additional provisions
designating as boulevards Central

Be it ordained by the City Council
of the City of Dubuque:
Par. 280, Section 1. That Ordin-
ance No. 2 -30, entitled An ordin-
ance regulating the use of motor and
other vehicles upon the streets of
the City of Dubuque; designating
the provisions hereof as the Traffic
Code of the City of Dubuque; repeal-
ing all ordinances heretofore enacted
governing this subject and all or-
dinances or parts of ordinances in-
consistent herewith; and providing
a penalty for violation hereof" be
amended by repealing Subdivision
"A" of Rule 56, paragraph 89, sec-
tion 3, thereof, and that the follow-
ing provisions be enacted in lieu
thereof, to -wit:
"(A) Jackson Street from the
North line of East 14th Street to the
South line of East 20th Street and
from the North line of East 20th
Street to the North line of East 32nd
Street.
Par. 281, Section 1. That said ordi-
nance be further amended by adding
to Rule 56, additional provisions
designating the following streets
and parts of streets as boulevards,
to-wit:
"(L) Central Avenue from the
North line of 14th Street to the
northerly terminus of said Central
Avenue."
"(M) East 20th Street from the
East line of Central Avenue to the
East line of Jackson Street."
"(N) Locust Street from the
South line of West 14th Street to
West Locust Street, thence over
West Locust Street to Seminary
Street, thence over Seminary Street
to St. Ambrose Street, thence over
St. Ambrose Street to Asbury Street,
and thence over Asbury Street to

Par. 282, Section 3. That hereafter
said Rule 56, paragraph 89, section
3 of said ordinance shall read as
follows:

Par. 283, Section 4. That said ordi-
nance be further amended by strik-
ing out the period at the end of the
sentence and substituting therefor
a comma and by adding thereto the
following: "Except at the following
intersections, to -wit: 14th Street and
Central Avenue and West 14th
Street and Locust Street, where left
hand turns are permitted."
Said Rule 51 shall hereafter read
as follows: '

"Rule 51. Left hand turns shall
not be permitted at any street inter-
section where traffic devices or sig-
nals are in operation, except at 14th
Street and Central Avenue and West
14th Street and Locust Street, where
left hand turns are permitted."
Par. 284, Section 5. That all of
the provisions of said Ordinance No.
2 -30 applicable to boulevards are
hereby made applicable to the boule-
vards herein provided for.
Par. 285, Section 6. This ordi-
nance shall be in force and effect
ten days after its final passage and
adoption by the City Council and
publication as provided by law.

Whereas, two of said depository
banks are now closed and the
amount of public funds available for
deposit exceeds the sums allowed to
be deposited in the remaining
banks; and

sary, subject to the approval of the
Treasurer of State, to increase the
limits of deposits in said banks;
Be it, therefore, Resolved that the
City Treasurer be and he is hereby
authorized to distribute public funds

Be it further resolved that the City

Grant and Easement
Know all men by these presents:
That in consideration of $1.00 in
hand paid by the City of Dubuque,
Iowa, a municipal corporation, the
receipt whereof is hereby acknowl-
edged, the undersigned being the
owner of Lots Nos. 16 and 17, in
Buseman Addition, in the City of
Dubuque, hereby grants and conveys
to said City of Dubuque, a perpet-
ual right of easement, in, over and
across said lots for the purpose of
constructing a Storm Sewer with the
right to go upon said premises at all
reasonable times for the purpose of
inspecting and repairing the same
when installed; provided, however,
that said City of Dubuque shall re-
place whatever earth, sod or shrub-
bery that may be disturbed in the
installation or repair of said Storm
Sewer to as good condition as it was
in before the same was disturbed.
This Grant of Easement shall be
binding upon the undersigned, his
heirs, executors, administrators,
purchasers and assigns forever.

Dear Sir: May I call your atten-
tion to the annual tax sale, to be
held at the Court House on January
2, 1933. Heretofore it has been the
custom of the City Council to desig-
nate some one from the City to
attend this meeting and to buy such
offered delinquent taxes, in which
the City was directly interested.
Should the Council wish to buy
some of the offerings it will be nec-
eessary for the City Council to
again appoint some one with the
authority to buy.
However, with the condition of the
City's finances, it would not be ad-
visable to purchase much of the of-
ferings at the sale, with the excep-
tion of the delinquents in special
assessments, dated December 20,
1921, and December 26, 1922 both in-
clusive. This would not represent a
very big outlay of the City's cash
and would protect the City's inter-
ests in these properties.

Gentlemen: At the meeting of
November 28th there were referred
to the City Manager by Council the
petition of Messrs. Nesler and Bue-
chel, dated November 17th, asking
that the special assessment for the
paving and improving of Auburn
Street, as charged against Lot 161,
Woodlawn Park Addition, formerly
owned by the Voelker Realty Com-
pany, be authorized to be handled
in such a way that they could pay
the first assessment at this time and
spread the balance over nine suc-
ceeding payments.
Attached is a letter written to Mr.
Nesler December 20th, explaining
that the assessment in this connec-
tion was spread December 1, 1930;
that in accordance with law the only
method in which Council could auth-
orize the spread of the assessment
was on the basis that the payments
to date, together with interest, be
received by the City Treasurer prior
to the spread of the balance of the
assessment.
Accordingly, this is to advise that
Mr. Nesler yesterday paid the City
Treasurer the following items:
$17.77 due January 1, 1931, $17.81
due January 1, 1932, together with
Special Session, December 28th, 1932
interest at 5%, amounting to $17.53,
and totalling $53.11. The next pay-
ment will come due January 1, 1933,
and it is recommended by the Man-
ager to City Council that the prayer
of the petition be granted.
For your information, this lot was
taken over by the petitioners at an
estimated 70% loss on a plumbing
bill, totalling $695.00. The lot is
estimated to be worth around $200.00
today by them.
The sower and water service con-
nections have been paid on said
property and Mr. Nesler says the
