Special session April 1st, 1930.
Meeting called by order of Mayor
Andelfinger and Councilman Jansen.
Council met at 7:50 o'clock p. m.
Present —Mayor Andelfinger, Coun-
cilmen Jansen, McEvoy, Meuser and
Schuckert.
Mayor Andelfinger read the call
and stated that service thereof had
been made and that this meeting is
called for the purpose of canvassing
the vote cast at the Municipal elec-
tion held March 31st, 1930, and act-
ing on any other business that may
come before the meeting. The vote
of the election of March 31st, 1930,
was then canvassed and showed the
following result:

Resolution No. 162 -30
Whereas the City Council of the
City of Dubuque having met this
day for the purpose of canvassing
the vote cast at the regular Munici-
pal Election held on the 31st day of
March, 1930, and;
Whereas said Council having can-
vassed said vote finds that Edward
McEvoy and Henry F. Schuckert re-
ceived the greatest number of votes
cast at said election for the office of
councilmen, the term to commence
in April, 1931; and Frank J. Piek-
enbrock for the office of park com-
missioner.
Now, therefore, be it resolved by
the City Council of the City of Du-
buque, that Edward McEvoy and
Henry F. Schuckert be and they are
hereby declared elected to the office
of Councilmen of the City of Du-
buque for the term to commence in
April, 1931, and Frank J. Pieken-
brock to the office of park commis-
sioner.

Councilman McEvoy moved that
the rules be suspended to allow any
one present who wished to do so, to
address the Council. Seconded by

C. L. Sheffield addressed the Coun-
cil stating that when Plymouth St.
was improved the assessment levied
against lots 19 and 20 Grandview
Heights Add. was $620.00, the lots
are assessed for taxation at $50.00
each. The assessment as levied is
exhorbitant and he hereby asks that
the Council reduce the assessments.
Councilman Meuser moved that
the Council view the grounds. Sec-
onded by Councilman Jansen. Car-
ried by the following vote:

men Jansen, McEvoy, Meuser, and
Schuckert.
Nays —None.
Harvey Lange addressed the Coun-
cil relative to J. J. Duffy's petition
for the position of Police Judge,
stating that Mr. Duffy is 'a lawyer,
having graduated from college with
high honors and that he has also
had several years practice, is an ex-
service man and the Veteran's Coun-
cil hereby endorses him for said
position. There was no action taken
at this time.
An Ordinance establishing 'a cen-
ter line grade on Robinson Street
from the West property line of Bluff
Street to a point about 210 feet
westerly, being profile No. 1268, pre-
sented and read.
Councilman Meuser moved that
this be considered the first reading
of the ordinance. Seconded by Coun-
cilman McEvoy. Carried by the fol-
lowing vote:

Councilman Schuckert moved that
the rules requiring an ordinance to
be read on three separate days be

the assessment against N.E. 25 feet

ment and the Treasurer be notified
accordingly. Seconded by Council-
man Schuckert. Carried by the fol-
lowing vote:

Grant of Easement
Know all men by these presents:
That in consideration of the sum of
$1.00 in hand paid by the City of Du-
buque, Iowa, a municipal corpora-
tion, the receipt whereof is hereby
acknowledged, the undersigned be-
ing the owner of Lot 22 of Quigley's
Subdivision of Outlot 710, in the
City of Dubuque, hereby grants and
conveys to said City of Dubuque a
perpetual right of easement, in, over
and across said Lot 22 of Quigley's
Subdivision of Outlot 710, for the
purpose of installing and maintain-
ing therein a sanitary and storm
sewer, with the right to go upon
said premises at all reasonable times
for the purpose of inspecting and
repairing the same when installed;
provided, however, that said City of
Dubuque shall replace whatever
earth, sod or shrubbery that may be
disturbed in the installation or re-
pair of said sewers to as good con-
dition as it was before the same was
disturbed.
This grant of easement shall be
binding upon the undersigned, his
heirs, executors, 'administrators, pur-
chasers and assigns forever.

Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council, and also the first
meeting of the fiscal year 1930, for
the transaction of such business as
may properly come before the meet-
ing.
Mayor Andelfinger moved that
Councilman Meuser be appointed
Mayor for the ensuing year. Second-
ed by Councilman Jansen. Carried
by the following vote: Mayor Andel-
finger, Councilmen Jansen, McEvoy,
Schuckert.
Nays —None.
Not voting — Councilman Meuser.
Whereupon Mr. Meuser was de-
clared Mayor of the City of Dubuque
for the ensuing year. He thanked
the Council for the honor bestowed
upon him and took his seat in the
Mayor's chair.

cil stating that he represented Mrs.
Ed. Milligan and that he hereby pro-

nections, stating that the assess-
ments are too high in comparison
to valuation of the property and
asks that the Council reconsider
their action and reduce the assess-
ments.
Councilman McEvoy moved that
the matter be referred to the Coun-

give him a further reduction.

did view the grounds on April 5th
and decided that the assessments
were just and not entitled to any

owners in the vicinity of the Maize -
wood Company complaining about
the noise and odor from the manu-
facturing plant was referred to the
Council to view the grounds.
This is to advise that the Council
did view the grounds on April 5th
and decided that the Maizewood
Company was doing everything in
their power to correct the matters
complained of in said petition and
therefore said petition should be
filed at this time awaiting develop-
ments from the Maizewood Company.

ruary 24th a petition from three
property owners on Simpson Street
requesting that Simpson Street be
paved from Freemont Avenue to the
westerly terminus of said street was
referred to the Council to view the
grounds and this is to advise that
the Council did view the grounds
and decided that not a sufficient
number of property owners were re-
questing the improvement and there-
fore the improvement should be de-
layed until additional property own-
ers were in favor of same.

In checking up the names on the
petitions it was shown that 98 pro-
perty owners representing 227 lots
out of 628 lots were opposed to the
sewer, and 135 property owners rep-
resenting 188 lots were in favor of
it.
Spokesmen for the remonstrators
were Carl Page, E. C. Loetscher, Mrs.
Grace Jaeger, Mrs. Michael Theis,
John P. Frantzen, and E. B. Lyons.
Briefly summarized, the points
they brought out were along the fol-
lowing lines:
That property owners with septic
tanks, installed at much expense.
will have to duplicate this expense
i� the sewer is installed.
That streets, lawns and shrubbery
will be torn up and repairs will be
another big item of expense.
That the assessments are so high
that many property owners will be
unable to pay and be deprived of
their homes.
That times were hard during the
past winter and that many property
owners cannot withstand the added
burden.
That septic tanks are functioning
satisfactorily, the sewage stays un-
derground and there is no outlet.
That part of the district has a nat-
ural drainage in the direction of Cat-
fish creek.
That because of the topography of
the district, it will be impossible for
many property owners to make con-
nections with the sewer and it will
be of no benefit to them; also that
many lots assessed are practically
worthless, just "chicken yards."
That there is no danger of the
city's water supply becoming con-
taminated under the present system
of sewage disposal.
That it is an inopportune time to
carry out such a costly project.
Spokesmen for the installation of
the sewer were Dale D. Welch, E.
C. Kuehnle, Mrs. Maude Hutchings,
T. M. Stampfer, Carl Peterson, Ste-
phen Bennett, City Engineer Walter
Cullen, Dr. W. J. Connell and A. H.
Wieter of Des Moines, chief engineer
of the Iowa state board of health.
Mr. Welch, in his remarks said
that sanitation and health is the real
issue and that conditions in the dis-
trict in which he resides are far
from being sanitary at the present
time. He referred to a "fragrant
odor" that lasts for days at a time.
He declares that the "inopportune
time" argument of the objectors was
an ancient alibi, and aimed against
all public improvements at all times.
"If the sewer is a good thing, and
we all know that it is," he said,
"let's build it now."
Session, April 14th, 1930
Dr. Connell, director of the city
health department, told of the men-
ace of a typhoid epidemic in a' dis-
trict where sewage disposal is ac-
complished by the use , of septic
tanks, crevasses and fissures and of
the peril to the city's water supply.
He said that the city was responsi-
ble if an epidemic was caused by an
impure water supply. He added that
it is now necessary to chlorinate wat-
er from the level pumping station on
Kaufmann Avenue.
It was his statement also, that in
a limestone area it is impossible to
determine where sewage goes.
Questioned as to his opinion on a
tank, he said that the septic tank
at is best, was nothing more than
a substitute for a sewer.
Mr. Wieters, state board of health
engineer, said that plans and speci-
fications for the proposed sewer were
submitted to the state board of
health by City Engineer Cullen and
NI ere approved. He declared that the
present proposal is feasible and that,
later on, if the district served by the
sewer should grow, that the system
can be extended to Catfish creek.
He added that the proposed system
would also be an advantage to the
city if, at some future time, the city
should be forced to build its own
sewage treatment plant. It was his
opinion that all larger cities along
the Mississippi river will eventually
have to discontinue dumping sewage
in the river and have their own sew-
age treatment plants.
"Any improvement is almost cer-
tain to work hardships on some in-
viduals," Mr. Wieters said. "Because
of the topography of the district in
which the proposed sewer is to be
installed, the proposal is expensive.
"However, the state board of
health is interested in public health
and public health cannot be meas-
ured in dollars and cents. We can-
not place a monetary value on a hu-
man life."
Municipalities are held responsible,
the speaker said, for epidemics tha
are traceable to impure water.
"So, council," he said, "in permit-
ting the use of crevasses for sewage
disposal, you are violating all rules
of sanitation. You haven't got a leg
to stand on in court."
Throughout his talk, he empha-
sized the fact that it is his belief,
and that of the state board of health,
that the West Dubuque sewer pro-
ject should go through without fur-
ther delay.

Twelfth and Fourteenth Streets, in

to be performed at an early date by

er condemned or remodeled and
kept in a sanitary condition.

stated that service thereof had been
duly made and that this meeting is
called for the purpose of consider-
ing bids for the improvement of
Robinson Street from the west prop-
erty line of Bluff Street to about 210
feet westerly, and acting on any oth-
er business that may properly come
before the meeting.

tractors of receipt of proposals for
the construction of pavement im-
provement of Robinson Street from

grading said street to proper sub -

An Ordinance amending an Ordin-
ance entitled "An Ordinance creat-
ing and establishing 'West Dubuque
Sewer District,' which district em-
braces all the lands within the drain-
age area of the sewer system to be
constructed within the same declar-
ing that all lands therein and sub-
ject to a special assessment for the
payment of the cost of such sewers
and appurtenances thereto and de-
fining all of such lands which are
subject to be furnished with sewer
connections or drainage by said
sewer system to be adjacent prop-
erty by changing the name of the
district 111 the title thereof to West
Dubuque Sewer District No. 1, also
by changing the limits of said dis-
trict by eliminating therefrom cer-
tain defined areas; also by elimin-
ating therefrom the construction of
certain sanitary sewers, force mains,
storm sewers and appurtenances, re-
ferred to in said Ordinance, present-
ed and read.

purtenances in what is known as the
West Dubuque Sewer District.
Whereas a resolution of necessity
providing for the construction of
Storm and Sanitary sewers and ap-
purtenances in what is known as the
West Dubuque Sewer District, was
introduced and approved by the City
Council on March 24th, 1930, and no-
tice of its pendency was duly pub-
lished as provided by law and the
date was set for final hearing there-
on on April 14th, 1930, and
Whereas said hearing was held by
said Council on said date and the
Council after having heard all ob-
jections to the passage and adoption
of said resolution, and it being deem-
ed advisable by said Council to
change and amend said resolution;
now therefore,
Be it resolved by the City Council
of the City of Dubuque, that said
original resolution of necessity be
and the same is hereby changed,
modified and amended so that said
resolution as amended hereby shall
provide for the construction of the
following sewers and appurtenances
in and along the streets, alleys and
other places, as herein set forth.
Be it further resolved that, except
for the changes herein set forth,
said original resolution of necessity
shall remain as originally approved
on March 24th, 1930, with the only

F. C. Potterveldt addressed the
Council asking what the Council did
with the petition that he sent in
some time ago asking that Simpson
Street be improved. He was inform-
ed that the petition was received
and filed, owing to the fact that the
street will not be improved before
a sewer is constructed in said street,
he . stated that the street is in bad
condition and if it is not possible
to improve it at this time there
should be some cinders hauled there
so that he can get to his home with
his automobile. Manager will inves-
tigate. No motion.
Mr. G. H. Wolff addressed the
Council stating that he heard that a
filling station was going to be erect-
ed at the corner of Delhi Street and
No. Grandview Avenue. This lot was
formerly included in the restricted
residential district, but has recently
been excluded therefrom. He hereby
objects to the erection of a filling
station claiming that it will be detri-
mental to his property which is the
second lot below this corner.
No action taken.
Mr. C. Caquelin addressed the
Council asking permission to con-
struct an approach to his garage
and lower the sidewalk on the alley
back of the southwest corner of 17th
and Jackson Streets. The matter
was referred to the City Manager to
view the premises. No motion.
Amendment to claim of Ethel Lo-
per filed March 17th, 1930. Claim for
$10,000 on account of personal in-

An Ordinance regulating the use
and occupancy of lands within the
control and under the jurisdiction of
the Department of Public Docks and
fixing and regulating the fees and
charges to be paid for the use and
occupancy of lands lying along and
constituting the water front of the
City of Dubuque.
Whereas, the Department of Pub-
lic Docks has exclusive charge and
control of the wharf property be-
longing to the City of Dubuque, to-
gether with the water front of said
City and the structures located
thereon, with the power of control
the use, occupancy and leasing of
said property and to fix and regulate
the fees and charges to be paid for
the use and occupancy of any por-
tion of said water front;
Now therefore:
Be it ordained by the Board of
Dock Commissioners of the City of
Dubuque:
Section 1: That, by the term, "wa-
ter front," shall be meant all lands
which are publicly owned and the
waters adjacent thereto which lie
outside of and beyond the property
lines of privately owned property
abutting upon or adjacent to the
Mississippi river and Lake Peosta.
Sec. 2. That from and after the
passage and adoption of this ordin-
ance, every person, firm, or corpor-
ation, desiring to use or occupy any
part or portion of the water front of
the City of Dubuque, as the same ex-
tends along the Mississippi river
and Lake Peosta, from the souther-
ly to the northerly limits of said
City, shall make written application
to the Commission of Public Docks
for the right and privilege to use
and occupy the same, said applica-
tion to state the purpose for which
the same is to be used, describe the
location of the lands or water front
desired, and give the number of
square feet or water front feet with-
in the area for which request is
made.
Sec. 3. The application herein re-
ferred to shall be filed with the
Commission of Public Docks on or
before the 15th day of May in each
year commencing with the month of
May, 1930. The applicant shall ac-
company his application with the
fees and charges herein provided for
and no permit will be granted unless
and until such fees and charges are
paid. All permits shall expire on the

31st day of March, following. In the
event that an application for space,
as herein provided for, be not made
to the Commission of Public Docks
within the time stated, then the
Commission may declare the right to
use or occupy water front lands ter-
minated and annulled and any struc-
ture or materials located or erected
upon said lands shall be removed
therefrom by the owners thereof
within the time prescribed by said
Commission and, should the owner
of such structures or materials fail
or refuse to remove the same within
the time fixed by said Commission,
said Commission may, by appro-
priate proceedings instituted for
that purpose, cause such structure
or materials to be removed. Permits
may be issued, however, upon appli-
cations filed at any time by persons,
firms, or corporations who had not
previously used or occupied river
front property or the waters adja-
cent thereto.
Sec. 4. All applications for space
upon or along the water front, as
herein defined, shall be considered
by the Commission and granted or
refused. within thirty days after the
same have been filed.
Sec. 5.- New structures or repairs
to existing structures upon or along
said water front shall not be under-
taken except upon application to the
Commission and under permit from
the Commission and then such struc-
ture or repairs shall be made in ac-
cordance with the general plans of
said Commission and in pursuance
of specifications submitted to it and
approved by it.
Sec. 6. That the schedule of fees
and charges to be paid for use and
occupancy of any part of the water
front and the water adjacent there-
to (except as provided in subdivis-
ions H and J hereof) shall be as
follows:
A. For space northerly from the
southerly limits of the City of Du-
buque to the South line of Railroad
Avenue, one- fourth cent per square
foot and /or fifty cents per water
front foot.
B. For space northerly from the
South line of Railroad avenue to the
South line of the Ice Harbor, three -
fourths cents per square foot and /or
one dollar per water front foot.
C. For space along the southerly
and westerly line of the Ice arbor,
three- fourths cents per square foot
and /or one dollar per water front
foot.
D. For space along the northerly
line of the Ice Harbor, three - fourths
cents per square foot and /or one
dollar per water front foot.
E. For space northerly from the
north line of the Ice Harbor to the
North line of East 7th Street, three
fourths cents per square foot and
/or one dollar per water front foot.
F. For space northerly from the
North line of East 7th Street along
Lake Peosta to the northerly end of
said lake, one - fourth cent per square
foot and /or fifty cents per water
front foot.
G. For space northerly of the
northerly end of Lake Peosta to the
northerly City Limits, three - fourths
cent per square foot and /or one dol-
lar per water front foot.
H. The Dock Board shall have the
right to permit any department of
the Federal, City, or Municipal Gov-
ernment to occupy space in the har-
bor or any part of the water front
on a basis other than those outlined
under the foregoing schedule of fees
and charges and may exempt such a
government from the payment of
any fees or charges if, in the judg-
ment of the Commission, it is de-
sirable or advisable so to do.
I. It is understood that the rental
of any water front property carries
with it the right to use whatever
land there may be up to twenty feet
beyond low water mark.
J. The Dock Board shall have the
right to grant a reduction of 35 per
cent in the rentals herein provided
for to any person, firm, or corpora-
tion using any of the property under
the jurisdiction of the Board for in-
, dustrial purposes.
Sec. 7. Whenever a permit is
granted to use or occupy any part of
the water front or the waters adja-
cent thereto, the space so occupied
and used shall be maintained at all
times in a clean and sanitary con-
dition and in good state of repair,
consistent with the purposes for
which it is used. Boat houses or
other wooden or metal structures
shall be painted a uniform gray col-
or. If the occupants of said prem-
ises fail or refuse to maintain the
same in such condition, the Com-
mission may revoke the permit
0rantgd and thereafter the occu-
pants shall discontinue using the
same. Permits may also be revoked
if the occupants use or occupy the
premises for an illegal or immoral
purpose. Whenever a permit is re-
voked no part of the fees or charges
theretofore paid shall be refunded.
Sec. 8. That any part of the wa-
ter front which is now or may here-
after be occupied by any person,
firm or corporation, which has lo-
cated upon it buildings or structures
which are not occupied or in good
state of repair, the same may be ta-
ken down or removed by order of
the Commission.
Sec. 9. The owner of a permit
shall be required to occupy only
such space along the water front or
the waters adjacent thereto as are
provided for in such permit. Per-
mits provided for hereunder shall
not be transferable nor shall any
part of the premises covered by the
permit be subject to any other per-
son, firm, or corporation without the
consent of the Commission.
Sec. 10. That upon the passage
and adoption of this ordinance a cer-
tified copy thereof shall be filed with
the City Clerk of the City of Du-
buque to be by him transscribed in
the Book of Ordinances of said City
and the same shall go into effect
from and after its publication by
said Clerk in the official newspaper
of said City, as provided by laly,
and a copy thereof shall be kept
posted in a conspicuous place in the
office of the Board of Dock Commis-
sioners.

owners on West Fifth Street re-
questing a reduction in their assess-
ments due to the fact that John
Street was vacated between West

vestigation and report.
Your City Manager feels that the
Council erred in vacating John
Street before those benefiting there-
by or those acquiring the vacated
street paid for the assessment of
the intersection of John Street, and
therefore believes that the prayer of

of West Fourteenth Street to the

City owns four lots in the assess-
ment district and the City's share of
this improvement would be approx-
imately twenty per cent of the total
or approximately $1,000 and due to
the fact that this street, at the pres-
ent time, has no houses on it that
will be benefited by this improve-
ment and the fact that the City has
such a small appropriation for pub-
lic improvements and the fact that
so many more needed improvements
have been eliminated from the 1930
program, I am recommending that
bids be rejected on this street and
that the improvement be not made
during 1930.

ing and establishing 'West Dubuque
Sewer District,' which district em-
braces all of the lands within the
drainage area of the sewer system
to be constructed within the same,
declaring that all lands within said
districts are benefited by the sewers
to be constructed therein and sub-
ject to special assessments for the
payment of the cost of such sewers
and appurtenances thereto and defin-
ing all of such lands which are sub-
ject to be furnished with sewer con-
nections or drainage by said sewer
system to be adjacent property" by
changing the name of the district in
the title thereof to "West Dubuque
Sewer District No. 1," also by chang-
ing the limits of said district by
eliminating therefrom certain de-
fined areas; also by eliminating
therefrom the construction of cer-
tain sanitary sewers, force mains,
storm sewers and appurtenances, re-
ferred to in said ordinance.
Be it ordained by the City Council
of the City of Dubuque:
Par. 109, Section 1. That an ordi-
nance entitled "An ordinance creat-
ing and establishing 'West Dubuque
Sewer District,' which district em-
braces all of the lands within the
drainage area of the sewer system
to be constructed within the same;
declaring that all lands within said
district are benefited by the sewers
to be constructed therein and sub-
ject to special assessments for the
payment of the cost of such sewers
and appurtenances thereto and de-
fining all of such lands which are
subject to be furnished with sewer
connections by said sewer system to
be adjacent property," be and the
samb is hereby amended as follows:
1. That the title of said ordinance,
being ordinance No. 3 -30, be amend-
ed so as to describe said sewer dis-
trict as "West Dubuque Sewer Dis-
trict No. 1" instead of describing the
same as "West Dubuque Sewer Dis-
trict" and hereafter said sewer dis-
trict shall be known as West Du-
buque Sewer District No. 1."
2. That par. 99, section 1, of said
ordinance be and the same is hereby
amended by striking therefrom all
of the last paragraph of said para-
graph and section commencing with
the words "and bringing at the
northerly point of Lot 1 of 4 of 64
of Simpson's Add." and ending with
the words "to the point of begin-
ning," at the end of said paargraph,
so that hereafter said district shall .
include all of the territory as shown
in par. 90, section 1, of said ordin-
ance except that portion thereof
which is hereby eliminated.
3. That par. 100, section 2, of said
ordinance be amended by striking
therefrom all of that portion com-
mencing with the words "in Concord
Street from Coates Street to Marion
Street" down to the end of said para-
graph containing the sentence "and
in Simpson Street from a point 260
feet West from Cross Street to Fre-
mont Avenue."
4. That said par. 100, section 2, of
said ordinance be further amended
wherein the same refers to the con-
struction of force mains by eliminat-
ing therefrom the following: "In
Coates Street from Cross Street to
Concord Street; in Concord Street
from Coates Street to a point 300
feet North of Coates Street."
5. That said par. 100, section 3,
be further amended wherein the
same refers to the construction of
storm sewers by eliminating there-
from the following: "across Lot 12
and Lot 7 of Sister's Add. from Stet -
more Street to Fremont Avenue."
6. That said par. 100, section 2, be
further amended wherein the same
refers to the construction and instal-
lation of Fairbanks -Morse Sewage
Lift Stations by eliminating there-
from station No. 583.
Par. 110, section 2. That with the
exception of those portions of said
ordinance which are hereby elimin-
ated and with the exception of the
changes hereby made in the title of
said ordinance, said ordinance shall
be in force and effect in form and
manner as the same was adopted by
the City Council of the City of Du-
buque on the 31st day of March,
1930.
Par. 111, section 3. This ordin-
ance being deemed urgent and of im-
mediate necessity and in the inter-
est of public health and general wel-
fare, shall be in force and effect
from after its final passage and
adoption by the City Council and
publication as provided by law.

sanitary and storm sewers within a
district described as "West Dubuque
Sewer District," said district being
delimited as defined by Ordinance
No. 6 -30; and a right of way ten
feet in width through private prop-
erty and along a ravine and natural
water course is needed for the con-
struction and maintenance of such
sewer, said property being described
as Lots 33, 51, and 52, Quigley's Sub-
division of the City of Dubuque; and
Whereas Lot 33 of said subdivis-
ion is owned by Peter Linden, whose
residence is Route No. 6, Dubuque,
Mosalem Township, Dubuque Coun-
ty, Iowa, and Lots 51 and 52 of said
subdivision are owned by John Bie-
berman Est., having their residence
at 2005 Dodge in the City of Du-
buque, Iowa; and
Whereas a plat showing and de-
scribing said right of way over and
across said lots has been duly pre-
pared by the City Engineer and a
copy thereof is hereto attached and
made a part hereof; and
Whereas the owners of said lots
and the officers of the City of Du-
buque are unable to agree upon a
price to be paid for said right of way
and it is necessary to condemn the
right of way across said lots, as
shown by said plat;
Now Therefore: Be it Resolved by
the City Council of the City of Du-
buque, that the Sheriff of Dubuque
County be and he is hereby peti-
tioned to summon a jury of six free
holders of the City of Dubuque, the
same to act as a commission to as-
