Present —Mayor Meuser, Council-

Schuckert.
Council met at 7:45 P. M.
Mayor Meuser stated that this is
the regular monthly meeting of the
City Council for the transaction of
such business as may regularly come
before it, and that this date has also
been fixed for the purpose of con-
ducting a hearing upon the adoption
of resolutions of necessity for the
improving of Auburn Street from the
north property line of West Four-
teenth Street to the south property
line of Dexter Street, Wood Street
from the north property line of West
Fourteenth Street to the south prop-
erty line of Rosedale Avenue, Foye
Street from the north property line
of Lowell Street to the south prop-
erty line of Napier Street and Na-
pier Street from the east curb line
of Foye Street about 70 feet west-
erly, also for the acting on bids for
the improving of Algona Street
from the north property line of
West Fourteenth Street to the
south property line of Delaware
Street and also for the installing of
boulevard lights on Central Avenue
from 18th Street to East 22nd Street.
Councilman Schuckert moved that
J. J. Shea be appointed City Clerk,
Pro Tem. Seconded by Councilman
McEvoy. Carried by the following
vote:

Nays —None.
Petition of Morris Poise, relative
to be granted a fruit peddler's lic-
ense permit owing to the fact that
he has been sick for the past two
years and unable to do hard work,
presented and read. Councilman
Schuckert moved to refer the peti-
tion to the City Manager and City
Solicitor to investigate. Seconded by
Councilman Andelfinger. Carried by
the following vote:

Petition of Julien Dubuque Hotel
requesting that they be granted per-
mission to replace their small sign,
now located on the City property be-
tween the Shell Gasoline Station and
the Johnson Oil Co., on Fourth
Street, with a new sign, the size to
be 10 feet by 30 feet, presented and
read.

grade, clearing and grubbing, con-
structing concrete sidewalks, drive-
ways and paving said street with a
concrete pavement thirty -one (31)
feet wide and six (6) inches thick
with integral curb or by resetting
and replacing old stone curb of con -
tract is awarded on that basis or by
paving with a three (3) inch Tarvia
Pre -mixed Re -tread top or three (3)

contract for the construction of sani-
tary sewer in Union Street from the
manhole in Rush Street to a point
three hundred feet northerly, to
Cook & Kean, contractors, they be
ing the lowest bidders, said resolu-
tion having been approved and
placed on file for one week for public
inspection on June 30th, 1930, now
presented for final adoption.

pend the rules for the purpose of al-
lowing any one present in the Coun-
cil Chamber to address the Council.

Mr. Lean addressed the Council
relative to the paving of Algona
Street with tarvia. Mr. Graham ad-
dressed the Council relative to the
paving of Algona Street with Emul-
sified Asphalt. Messrs. Loftus and
Kuehnle addressed the Council ask-
ing that Algona Street be paved with
concrete and that the old macadam
taken from the street be used In the
repairing of the alleys in that vic-
inity, and also asking that the Coun-
cil defer action on the awarding of
the contract until they are able to
circulate a petition amongst the
property owners as to their attitude
on the paving of said street with
concrete.
Councilman McEvoy moved that
the Council defer action on the
awarding of the contract for the pav-
ing of Algona Street from the north
property line of West Fourteenth
Street to the south property line of
Delaware Street. Seconded by Coun-
cilman Schuckert. Carried by the
following vote:

Resolution No. 262 -30.
RESOLUTION providing for the is.
suance of public improvements.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improving of Viola Street,
hereinafter described, has been com-
pleted and said improvement has
been accepted by the City Council of
said City, and the City Engineer has.
computed the cost and expense
thereof to be $3,354.69.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Viola Street from the
north property line of Eagle Street
to the north curb line of Merz
Street there be issued improvement
bonds to the amount of $3,354.69.
Said bonds shall be issued under the
provisions of Chapter 311 of the
Code of Iowa, 1927, which, bear date
as of the 7th day of August, 1930;
shall be in the denominations of
$300.00, except that there shall be
one bond to the amount of $54.69.
They shall be numbered from 2636
to 2647, inclusive, and shall be di-
vided into ten series of which the
bond numbered 2636 shall constitute
the first series and shall be payable
the 1st day of April, A. D. 1931; the
bond numbered 2637 shall constitute
the second series and shall be pay-
able the lst day of April, A. D. 1932;
the bond numbered 2638 shall consti-
tute the third series and shall be
payable the 1st day of April, A. D.
1933; the bond numbered 2639 shall
constitute the fourth series and shall
be payable the 1st day of April, A.
D. 1934; the bonds numbered 2640
and 2641 shall constitute the fifth
series and shall be payable the 1st
day of April, A. D. 1935; the bonds
numbered 2642 and 2643 shall con-
stitute the sixth series and shall be
payable the lst day of April, A. D.
1936; the bond numbered 2644 shall
constitute the seventh series and
shall be payable the 1st day of April,
A. D. 1937; the bond numbered 2645
shall constitute the eighth series
and shall be payable the 1st day of
April, A. D. 1938; the bond number-
ed 2646 shall constitute the ninth
series and shall be payable the lst
day of April, A. D. 1939; the bond
numbered 2647 shall constitute the
tenth series and shall be payable the

Said bonds shall bear interest at
the rate of five per cent per annum,
which interest shall be payable
seml - annually, in accordance with
the terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said
improvement.
Both principal and interest shall
be payable at the office of the City
of Dubuque. Said bonds shall be
substantially in the following form:

IMPROVEMENT BOND.
The City of Dubuque in the State
of Iowa" promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 , or any time before that date
at the option of the City, the sum
of $300.00, with interest thereon at
the rate of five per cent per annum,
payable on the presentation and sur-
render of the interest coupons here-
to attached, both interest and prin-
cipal are payable at the office of the
City Treasurer in the City of Du-
buque in the State of Iowa. This
bond is issued by the City of Du-
buque pursuant to and by virtue of
Chapter 311 of the Code of Iowa,
1927, and in accordance with a reso-
lution of the City Council of said
City, duly passed on the 7th day of
July, 1930. This bond is one of a
series of 12 bonds, 11 for $300.00,
numbered 2636 to 2646 inclusive, and
one for $54.69, numbered 2647, all of
like tenor and date, and issued for
the purpose of improving Viola
Street from the north property line
of Eagle Street to the north curb
line of Merz Street, and described
in said resolution; which cost is as-
sessable and levied along said im-
provement, and is made by law a
lien on all abutting or adjacent prop-
erty, and payable in ten annual in-
stallments, with interest on all de-
ferred payments at the rate of five
per cent per annum, and this bond
is payable only out of the money de-
rived from the collection of said spe-
cial tax, and said money can be used
for no other purpose. And it is here-
by certified and recited that all the
acts and condition and things re-
quired to be done precedent to and
in the issuing of this series of bonds,
have been done, happened and per-
formed in regular and due form as
required by said law and resolution;
and for the assessments, collections
and payment hereon of said special
tax, the faith and diligence of said
City of Dubuque are hereby irrevoc-
ably pledged.
In witness whereof the City of Du-
buque by its City Council has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,
with the seal of said City affixed
this 7th day of July, 1930, and has

Gentlemen: The petition from resi-
dents on South Locust Street request-
ing bus service on South Locust
Street was referred to the Acting
City Manager and I wish to report
as follows:
Mr. Dove states that the present
bus routes are so regulated and plan-
ned to take care of the maximum
number of bus passengers in the dis-
tricts they serve . Mr. Dove express-
ed the opinion that the International
Harvester Company, Standard Oil
Company, the Maizewood Products
Company, the Ott Rubber Company
and the Consumers Ice Company con-
tributed more bus business than the
two blocks on Southern Avenue with
residences on one side only. How-
ever, he stated that he would go over
the proposition with other company
officials and would get in touch with
us at an early date.

Here Are the Details
The plan calls for the erection of
a sign at Fourth and White Streets
to attract the attention of motorists
driving west on Highway No. 20 and
which will read, "Central Avenue
business district one block west;
Main Street business district three
blocks west." Motorists desiring to
pass north on either Central Ave-
nue or Main Street can turn from
Fourth Street and travel as far as
Fourteenth Street, then turn to the
left and meet up with the regular
No. 20 route at West Fourteenth
and Locust Streets.
Another sign will be erected at
West Fourteenth and Locust Streets
bearing the words, "Main Street busk
ness district one block east; Central
Avenue business district three blocks
east." This sign will attract the at-
tention of motorists driving east on
No. 20. They can proceed east on
West Fourteenth Street to either
Main Street or Central Avenue, then
turn south to Fourth Street and con-
nect with the regular No. 20 route.
Three More Signs
Motorists driving west on Highway
No. 61 will see a sign at Twentieth
and Jackson Streets reading, "Busi-
ness district two blocks west." This
will permit them to travel south on
Central Avenue to Fourteenth Street,
where they will connect up with the
regular 61 route.
A sign at First and Locust Streets
will convey the information that the
business district is one block east.
This will take motorists driving east
on No. 61 over to Main Street, then
north on Main to Fourteenth and re-
sume the regular 61 route.
At Twenty- second and Jackson
Streets a sign will be erected calling
'attention to motorists driving south
on Jackson Street over Highway No.
55 that there is a business district
two blocks west. This will bring
tourists who so desire south from
Twenty- second Street on Central Ave-
nue to Fourteenth Street, where they
will again connect up with the regu-
lar 55 routing.
Councilman McEvoy moved that
the City Engineer be instructed co
construct a storm water sewer over
and across the property owned by Ru-
dolph Jones which is located on Ov-
erview Court. Seconded by Council-
man Andelfinger. Carried by the fol-

City Manager has examined the work

otherwise would have been spread
over the assessment from West 14th
to Dexter Streets. After considerable
debate on this matter, Councilman
Jansen moved that all bids be reject-

point three hundred (300) feet north-
erly, Coo k& Kean, contractors, has
been completed.
I further certify that this work has
been done in accordance with the
plans and specifications and stipula-
tions of the contract and I would
therefore recommend its acceptance
by the Council.

WHEREAS, the contract for the
construction of an eight (8) inch
sanitary sewer in Union Street from
the manhole in Rush Street to a point
three hundred (300) feet northerly
has been completed and the City Man-
ager has examined the work and filed
his certificate stating that the same
has been completed according to the
terms of the contract, plans and speci-
fications and recommends its accept-
ance, now therefore,
BE IT RESOLVED, by the City
Council of the City of Dubuque, that
the recommendation of the City Man-
ager be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing the
lots or parcels of real estate subject
to assessment for said improvement
and file the same in the office of the,
City Clerk subject to public inspec-
tion and said Clerk shall upon receipt
of such plat and schedule publish the
notice of the Council's intention to
levy special assessments therefor, as
required by law.
BE IT FURTHER RESOLVED,
that the City Treasurer be and he
is hereby directed to pay to the con-
tractor from the funds to be realized
from the sale of sewer bonds issued
upon the above described improve-
ment in amount equal to the amount
of his contract, less any retained per-
centage provided for therein.

Gentlemen: Because it is appar-
ent that a misunderstanding has aris-
en over the granting of a building
permit to you for the construction
of the unit about to be built on Lo-
cust Street, I have been directed by
the City Council to write to you and
make the position of the Council
clear.
Your plans contemplate under-
ground construction beyond the pro-
perty line and a twelve foot sidewalk.
To this the Council has no objection.
However, you have been advised by
the Building Commissioner, acting
under the authority from the Coun-
cil, that you should arrange your
underground construction in such a
manner that it will admit of widening
Locust Street at least two feet on the
East side, so that, if it become nec-
essary or advisable to so widen said
street at some time in the future, no
damage or harm will result to that
portion of the building which extends
out into the street, beyond the pro-
perty line, by cutting back the walk
two , feet and using said space for
vehicle travel.
Your work not having yet been
started, you are in a better position
at this time to take whatever pre-
cautions may be necessary to protect
yourselves, in case the street should
be widened, than you would be if you
had not been informed or warned in
advance.

trust that you will understand that
a building permit is not being re-
fused, laut that you should, for your
own protection, So arrange your con-
struction as to anticipate the possible
widening of this street at some 'future
date.

the City Council of the City of Du-
buque.
To Councilman:
You are hereby notified that there
is hereby called a special meeting of
the City Council of the City of Du-
buque to be held in the Council Cham-
ber in the City Hall at 7:30 P. M.,
July 28th, 1930.
This meeting will be held for the
purpose of hearing tax payers who
may appear for and against the sup-
plemental estimate for the improve-
ment fund to pay the principal and
interest of bonds proposed to be Is-
sued in the sum of Sixty Thousand
Dollars, ($60,000).
At this meeting there will also be
considered and introduced an ordin-
ance entitled, "An ordinance provid-
ing for an annual tax for the pur-
pose of defraying the cost of street
improvements in said City, and de-
claring an emergency."
There will also be introduced and
considered at this meeting, a resolu-
tion entitled, "Resolution providing
for the issuance of Sixty Thousand
Dollars ($60,000) City improvement
fund bonds."
There will also be introduced at
said meeting an ordinance entitled,
"An ordinance providing for the issu-
ance of One Hundred Fifteen Thou-
sand Dollars ($115,000) sewer bonds,
providing for the levy of tax to pay
the same and declaring an emer-
gency."
At this meeting there will also be
considered and transacted any other
business which may properly come
before a regular meeting of the Coun-

ance of Public Sewer Bonds)
Resolution No. 281 -30.
WHEREAS, the contract heretofore
'entered into by the City of Dubuque
for the construction of sanitary sew-
er in Groveland Street and Argyle
Street hereinafter described, has been
completed and said improvement has
been accepted by the City Council of
said City and the City Engineer has
computed the cost and expense there-
of to be $722.78.
AND WHEREAS, public notice as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered and
determined:
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque that to provide for
the cost of constructing sanitary sew-
er in Groveland Street from the man-
hole in Burden Street to within
eighty (80) feet of Sheridan Street
and in Argyle Street from the man-
hole in Groveland Street one hundred

twenty (120) feet southerly there be
issued sewer bonds to the amount of
$722.78. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1927, which bear
date as of the 28th day of August,
1930; shall be in the denominations
of $100.00, except that there shall be
one bond to the amount of $22.78.
They shall be numbered from 2661
to 2668 inclusive and shall be divided
into eight series of which the bond
numbered 2661 shall constitute the
first series and shall be payable the
1st day of April, A. D. 1931; the bond
numbered 2662 shall constitute the
second series and shall be payable
the 1st day of April, A. D. 1932;
the bond numbered 2663 shall consti-
tute the third series and shall be pay-
able the 1st day of April, A. D. 1933;
the bond numbered 2664 shall consti-
tute the fourth series and shall be
payable the 1st day of April, A. D.
1934; the bond numbered 2665 shall
constitute the fifth series and shall
be payable the first day of April,
A. D. 1935; the bond numbered - 2666
shall constitute the sixth series and

or any time before that date at the
option of the City, the sum of $100.00

five per cent per annum, payable on
the presentation and surrender of the
interest coupons hereto attached, both
interest and principal are payable at
the office of the City Treasurer in
the City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 311 of the Code of
Iowa, 1927, and in accordance with a
resolution of the City Council of said
City, duly passed on the 28th day of
July, 1930. This bond- is one of a
series of 8 bonds, 7 for $100.00 num-
bered from 2661 to 2667 inclusive,
and one for $22.78 numbered 2668,
all of like tenor and date, and issued
for the purpose of constructing sani

WHEREAS, the City of Dubuque,
in the County of Dubuque and State
of Iowa, heretofore, pursuant to and
in strict compliance with all laws
applicable to said City, lawfully or-
dered and contracted for certain
street improvements in said City, the
cost whereof to the amount of Sixty
Thousand Dollars ($60,000) because
or deficiencies in assessments and for
plats and schedules as provided by
law and for the construction, recon-
struction and repair of street im-
provements at intersections and one -
half the cost at intersections not
crossings, and for spaces opposite
property owned by the City and by
the United States, is to be borne by
the City of Dubuque and to be paid
from a tax levied on all the taxable
property within said City, and it is
now advisable to make provision with
respect to the levying of said tax:

Section 2. Said taxes shall be col-
lected each year at the same time
and in the same manner, and in ad-
dition to all other taxes in and for
said City, and when collected shall
be converted into a special fund
which is hereby pledged for and
shall be used only to pay the portion
of the cost of constructing street im-
provements by the payment of the
principal and interest of bonds issued
therefor.
Section 3. That a certified copy of
this ordinance be filed with the Coun-
ty Auditor of Dubuque County and
that said Auditor be and he is here-
by instructed in and for each of the
years 1930 to 1945 inclusive to levy
and assess the tax hereby authorized.
Section 4. That all ordinances or
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Section 5, That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the public
peace, health and safety that this or-
dinance become effective upon its
passage, approval and publication,
and it is so ordered.

RESOLUTION Providing for the Is-
suance of $60,000 City Improvement
Fund Bonds.'
WHEREAS, the City of Dubuque,
in the County of Dubuque, State of
Iowa, is a municipal corporation, duly
incorporated, organized and existing
under and by virtue of the general
laws and Constitution of the State
of Iowa, and has adopted the City
Manager form of government as con-
templated by Chapter 328 of the Code
of Iowa; and
WHEREAS, said City has hereto-
fore ordered and provided for cer-
tain street improvements in and for
said City, the cost whereof to the
amount of not less than Sixty Thou-
sand Dollars ($60,000), is to be borne
by the City as a whole; and
WHEREAS, it is necessary' and ad-
visable to at this time make provis-
ions for the issuance of bonds for
the payment of said cost; and
WHEREAS, except for bonds of
said City in the principal amount
of $ now outstanding on oth-
er bonds or other obligations of said
City are now outstanding and pay-
able from the taxes authorized to be
levied by Paragraph 3 of Section
6211 of the Code of Iow:

days of January and July in each

the Mayor and attested by the City
Clerk and the seal of said City at-

certificate of registration endorsed
thereon; that interest on said bonds
be evidenced by coupons thereto at-
tached and maturing on the several
days when such interest matures,

AN ORDINANCE Providing for the
Issuance of $115,000 Sewer Bonds,
Providing for the Levy to Pay the
Same and Declaring an Emergency.
WHEREAS, the City of Dubuque,
in the County of Dubuque and State
of Iowa, heretofore, pursuant to and
in strict compliance with all laws
applicable, lawfully ordered and pro-
vided for building and constructing
sewers in and for said City at a
cost of not Less than $115,000; and
WHEREAS, it is necessary and ad-
visable that provisions be made for
the issuance of bonds of said City
in the sum of $115,000 to defray the
cost of building and constructing said
sewers; and
WHEREAS, notice and hearing on
the initiation of proceedings for the
issuance of said bonds has heretofore
been given in manner and form re-
quired by Section 363 of the Code of
Iowa and no petition nor protest has
been filed:
NOW, THEREFORE, Be It Or-
dained by the City Council of the
City of Dubuque, as follows:
Section 1. That pursuant to and
as authorized by Section 6125 of the
Code of Iowa, there shall be and
there is hereby ordered issued the
negotiable Sewer Bonds of said City
of Dubuque in the principal amount
of $115,000; said bonds to be 115 in
number, dated July 15, 1930, bearing
interest at the rate of Four and One -
half Per Cent (4% %) per annum,
from the date of said bonds until
paid; payable semi - annually on the
fifteenth days of January and July in
each year; that said bonds be signed
by the Mayor and attested by the
City Clerk and the seal of said City
attached, and be registered as to is-
suance by the City Treasurer and a
certificate of such registration en-
dorsed thereon; that interest on said
bonds be evidenced by coupons there-
to attached and maturing on the sev-
eral days when such interest matures,
which coupons shall be executed with
the fac - simile signatures of said offic-
ials, and said Mayor and City Clerk,
by the execution of said bonds, shall
adopt as and for their proper signa-
tures, their respective fac - simile sig-
natures appearing on said coupons;
and that both principal and interest
be payable in lawful money of the
United States of America, at the office
of the City Treasurer in and of the
City of Dubuque, Iowa; that said
bonds be of the denomination of

and declared that an emergency ex-

majority of the property owners on

John J. Loftus addressed the Coun-
cil relative to the petition on Al-
gona Street, stating that the major-
ity of property owners on Algona
Street want the Concrete paving and
are opposed to the Emulsified As-
phalt type of paving.
Mr. I. Plamondon objected to the
paving of Wood Street with Emul-
sified Asphalt stating that the ma-
jority of the property owners on this
street want the Concrete paving.
Councilman Jansen moved that
the petitions be received and filed.

Mr. A. J .Hartig, et al., represent-
ing the Main Street Merchants, ap-

that signs reading "City route U. S.

Street and presented a sample of
the sign they suggest the City to use
to direct East and West bound tour-
ists on No. 20 over Main Street.
Councilman Andelfinger moved
that the prayer of the petition be
granted and the signs be purchased
and placed as suggested. Routes No.
61 and No. 55 be routed down Cen-
tral Avenue. Seconded by Council-

An Ordinance providing for an an-
nual tax for the purpose of de-
fraying the cost of street improve-
ments in the city, and declaring an
emergency.
Whereas, the City of Dubuque, in
the County of Dubuque alid State of
Iowa, heretofore, pursuant to and in
strict compliance with all laws ap-
plicable to said City, ordered and
contracted for certain street improve-
ments in said City, the cost whereof
to the amount of Sixty Thousand
Dollars ($60,000) because of deficien-
cies in assessments and for plats and
schedules as provided by law and
for the construction, reconstruction
and repair of street improvements at
intersections and one -half the cost
at intersections not crossings, and
for spaces opposite property owned
by the City and by the United Statas,
is to be borne by the City of Du-
buque, and to be paid from a tax lev-
ied on all the taxable property with-
in said City, and it is now advisable
to make provision with respect to the
levying of said tax:
Now, therefore, be it ordained by
the City Council of the City of Du-
buque:
Section 1. That in pursuance of
Paragraph 3 of Section 6211 of the
Code of Iowa there shall be and there
is hereby levied and there shall be
assessed and collected a direct an-
nual tax upon all the taxable pro-

perty within said City of five (5)
mills on the dollar (or such portion
thereof as may be necessary) upon
said taxable property sufficient to
produce the net annual sums as here-
inafter provided:

improvements by the payment of the
principal and interest of bonds is-
sued therefor.
Section 3. That a certified copy
of this ordinance be filed with thui
County Auditor of Dubuque County
and that said Auditor be and he is
hereby instructed in and for each of
the years 1930 to 1945 inclusive to
levy and assess the tax hereby au-
thorized.
Section 4. That all ordinances 01
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Section 5. That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the public
peace, health and safety that this
ordinance become effective upon its
passage, approval and publication,
and it is so ordered.
