Frank Fuhrman addressed the Council asking that Auburn Street be paved with Concrete, that the majority of the property owners on said street are in favor of this type of paving and object to the Emul- sified Asphalt type. John J. Loftus addressed the Coun- cil relative to the petition on Al- gona Street, stating that the major- ity of property owners on Algona Street want the Concrete paving and are opposed to the Emulsified As- phalt type of paving. Mr. I. Plamondon objected to the paving of Wood Street with Emul- sified Asphalt stating that the ma- jority of the property owners on this street want the Concrete paving. Councilman Jansen moved that the petitions be received and filed. Seconded by Councilman Andel- finger. Carried by the following vote: Yeas — Councilmen Andelfinger, Jansen, McEvoy, and Schuckert. Nays —Mayor Meuser. Mr. A. J .Hartig, et al., represent- ing the Main Street Merchants, ap- peared before the Council and asked that signs reading "City route U. S. No. 20" be placed on Main Street between Fourth Street and 14th Street and presented a sample of the sign they suggest the City to use to direct East and West bound tour- ists on No. 20 over Main Street. Councilman Andelfinger moved that the prayer of the petition be granted and the signs be purchased and placed as suggested. Routes No. 61 and No. 55 be routed down Cen- tral Avenue. The Ordinance was then read a third time. Ordinance No. 15 -30 An Ordinance providing for an an- nual tax for the purpose of de- fraying the cost of street improve- ments in the city, and declaring an emergency. Whereas, the City of Dubuque, in the County of Dubuque acid State of Iowa, heretofore, pursuant to and in strict compliance with all laws ap- plicable to said City, ordered and contracted for certain street improve- ments in said City, the cost whereof to the amount of Sixty Thousand Dollars ($60,000) because of deficien- cies in assessments and for plats and schedules as provided by law and for the construction, reconstruction and repair of street improvements at intersections and one -half the cost at intersections not crossings, and for spaces opposite property owned by the City and by the United States, is to be borne by the City of Du- buque, and to be paid from a tax lev- ied on all the taxable property with- in said City, and it is now advisable to make provision with respect to the levying of said tax: Now, therefore, be it ordained by the City Council of the City of Du- buque: Section 1. Resolution No. 279 -30 providing for the issuance of $60,000 City im- provement bonds, having been ap- proved and placed on file for one week in the office of the City Clerk for public inspection, presented for final reading and adoption. Resolution No. 279 -30. RESOLUTION providing for the is- suance of $60,000 City improvement bonds. WHEREAS, the City of Dubuque, in the County of Dubuque, State of Iowa, is a municipal corporation, duly incorporated, organized and existing under and by virtue of the general laws and Constitution of the State of Iowa, and has adopted the City Manager form of government as con- templated by Chapter 328 of the Code of Iowa; and WHEREAS, said City has hereto- fore ordered and provided for cer- tain street improvements in and for said City, the cost whereof to the amount of not less than Sixty Thou- sand Dollars ($60,000) is to be borne by the City as a whole; and WHEREAS, it is necessary and ad- visable to at this time make pro- vision for the issuance of bonds for the payment of said cost; and WHEREAS, except for bonds of said City in the principal amount 'if $ now outstanding no other bonds or other obligations of said City are now outstanding and pay- able from the taxes authorized to be levied by Paragraph 3 of Section 6211 of the Code of Iowa: NOW, THEREFORE, Be It Re- solved by the City Council of the City of Dubuque, Iowa: Section 1. That in pursuance of Section 6261 and Paragraph 3 of Sec- tion 6211 of the Code of Iowa, and in anticipation of the City improve- ment fund tax to be levied by Or- dinance Number 15 -30 being adopt- ed concurrently herewith, there shall be and there is hereby ordered is- sued the City Improvement Fund Bonds of said City, in the amount of Sixty Thousand Dollars ($60,000); that said bonds be sixty (60) in number, dated July 15, 1930, bear interest at the rate of four and one - half per centum (4 %) per annum from the date of said bonds until payment, payable semi- annually on the fifteenth days of January and July in each year; that said bonds be signed by the Mayor and attested by the City Clerk and the seal of said City attached, and be register- ed as to issuance by the City Treas- urer and a certificate of registration endorsed thereon; that interest ou said bonds be evidenced by coupons thereto attached and maturing on the several days when such interest ma- tures, such coupons to be executed with the fac - simile signatures of said Mayor and City Clerk, and said offic- ials by the execution of said bonds shall adopt as and for their proper signatures, their respective fac- simile signatures appearing on each of said coupons, and that both principal and interest be payable at the office of the City Treasurer of said City in the City of Dubuque, Iowa; that said bonds be of the denomination of $1,000 each, be numbered consecu- tively from 1 to 60, both numbers in- clusive, become due and payable in their numerical order, $5,000 on July 15, 1941, $10,000 on July 15 of each of the years 1942 to 1945 inclusive, and $15,000 on July 15, 1946. Section 2. That each of said bonds be subject to registration as to prin- cipal in the name of the holder on the books of the City Treasurer, such registration being noted upon each bond so registered, and after such registration payment of the princi- pal thereof shall be made only to the registered holder. Any bonds so registered, upon the request in writing of such holder, personally or by attorney in fact, may be trans- ferred either to a designated trans- feree or to bearer, and the prin- cipal of any bonds so transferred and registered to bearer shall there- upon be and become payable to bear- er in like manner as if such bond had never been registered. Registra- tion of any bonds as to principal shall not restrain the negotiability of the coupons thereto attached by delivery merely. Section 3. Ordinance No. 16 -30 An Ordinance providing for the is- suance of $115,000 sewer bonds, providing for the levy of taxes to pay the same and declaring an emergency. WHEREAS, the City of Dubuque, in the County of Dubuque and State of Iowa, heretofore, pursuant to and in strict compliance with all laws ap- plicable, lawfully ordered and provid- ed for building and constructing sew• ers in and for said City at a cost of not less than $115,000; and WHEREAS, it is necessary and advisable that provisions be made for the issuance of bonds of said City, in the sum of $115,000, to de- fray the cost of building and con- structing said sewers and WHEREAS, notice and hearing on the initiation of proceedings for the issuance of said bonds has hereto- fore been given in manner and form required by Section 363 of the Code of Iowa and no petition nor protest has been filed: NOW, THEREFORE, Be It Or- dained by the City Council of the City of Dubuque, as follows: Section 1. John Loftus addressed the Council and again asked the Council to re- consider their action, property own- ers on Algona Street want Concrete paving, that Emulsified Asphalt is an experiment and they do not want to pay their money unless they know what they are getting; they know that Concrete will last and they are willing to pay the difference in the cost of paving. A petition was presented, signed by the abutting and adjacent prop- erty owners on Wood Street, from West 14th Street to Rosedale Ave- nue, asking that the street be paved with concrete paving. It is their opinion that Emulsified Asphalt will not stand up under the conditions found in their street. However, if the Council insists that the Emulsified Asphalt paving be used, they will not accept it unless the street re- ferred to be reconditioned by first reinforcing all weak spots caused by the installing of sewer, water and gas connections, recently put in, and that the Council request the Barber Asphalt Co. to extend their guar- antee that the street will hold up for at least 15 years. We, the undersigned- property own- ers who have previously signed a petition duly presented to your Council, expressing our desire for Concrete paving on Auburn Street, from West Fourteenth to Dexter Streets, protest as a protection of our individual rights as taxpayers, on the assessment for Emulsified As- phalt paving on said street, as a pro- tective measure against your action in awarding a contract for a type of pavement which, in our opinion, is experimental as evidenced from the fact that from the best information obtainable there has been no Emul- sified Asphalt used as a permanent paving material successfully up to the present time. Councilman McEvoy moved that ac- tion on the awarding of contracts for the improving of Algona Street from West 14th Street to Delaware Street, Auburn Street from West 14th Street to Dexter Street, and Wood Street from West 14th Street to Rosedale Avenue, for Emulsified Asphalt, to Uhlrich -Paley Co., be postponed for one week and the Barber Asphalt Company be asked to guarantee that this type of paving will hold up for at least 15 years. Killeen presented by her attorney, John J. Kintzinger, stating that the old sewer on her property on corner of Bluff and Robinson Streets has be- come clogged and filled with roots and it is desirable to connect with the new sewer installed in Robinson Street. She hereby petitions the Council to issue her a permit for the purpose of constructing said sewer so that the same may connect with the new sewer in Robinson. RESOLUTION Whereas, the City Council has re- ferred to the Planning and Zoning Commission the widening of West 4th and West 8th Street, and Whereas, the City Planning and Zoning Commission has had corres- pondence with Mr. John Nolen, now employed by the City of Dubuque, regarding the proposed improvement, and Whereas, the recommendations of Mr. Nolan are as follows: August 5, 1930. Mr. Richard V. McKay, Secretary, Planning and Zoning Commission, Dubuque, Iowa. Dear Mr. McKay: The present preliminary stage of the city planning studies make it necessary to present suggestions and recommendations with some reserva- tion in the light of future and more comprehensive conclusions. The matters referred to your commission for recommendation on July 17 by the Council pertaining to 4th Street and 8th Street are matters having considerable connection and atten- tion along with other related matters at the present time. As basic factors to be kept in mind in considering the present problems in question, we would point out the following items applicable to the business sections of the city. (a) The street for the purpose of this statement is the right -of -way used for street purposes and extend- ing from property line to property line. (b) The pavement includes the space between curbs. (c) The pavement in the cases mentioned should be divided into an equal number of traffic lanes and parking spaces for traffic in each di- rection. (d) The traffic lanes should be ten feet wide. (e) The space for parking of cars parallel to the curb should be eight feet in width and for parking 45 de- gree angle, should be twelve to 11 teen feet. (f) The space for trolley cars should be ten feet wide per track. (g) The width of the sidewalk in this type of street is very important and should not be less than ten feet and preferably fifteen feet wide, in- cluding the curb. The effective width will be somewhat reduced by the nee- 18th, 1930 267 essary and permitted lighting stan- dards or poles. The width of 4th and 8th Streets is indicated on. the maps available to us as being sixty -four (64') feet wide. From a city planning point of view widening of a street pavement should be clearly related to the type of property abut- ting on the street, the resultant traf- fic doing business there, the loading and unloading of merchandise from street to store, the parking space available nearby, or in garages, and the amount of through traffic using the street as a channel to other parts of the city, and the amount of ped- estrian use for sidewalks, the width of the street right -of -way, and the relation of the street to the general thoroughfare system of the city. There are certain fallacies regard- ing streets and thoroughfares that should be pointed out, namely: the supposition that traffic on a street always means greater business for the abutting stores, and that there is no longer need for ample sidewalks. While we are not in a position yet to state final conclusions, there are certain observations that may be made to aid the commission in mak- ing their recommendations. 1. In so far as possible the load- ing and unloading of merchandise or freight from trucks should be in the alleys or platforms located with- in the buildings. 2. Balance should be preserved between sidewalks and street pave- ment even to the extent of having only parallel parking on the 64 foot streets. 3. Certain of the business streets are now too narrow and the only satisfactory recourse is to prohibit parking entirely, a very drastic measure, or to actually widen the street right -of -way by establishing building set -back lines and gradual- 268 Special Session, August 18th, 1930 ly at the time of the construction of new buildings to increase the street width. 4. A means probably can be found to relieve the pressure of traffic on the downtown business streets by by- passing through traffic around these streets. 5. Specifically, 4th Street is relat- ed to the elimination of the grade crossing over the railroads to the east and 8th Street is related to the approach from the west, so that both are linked up most directly with the thoroughfare system which will be devised for the city. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of a sanitary sewer in Union Street, hereinafter described, has been completed and said improvement has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $327.14. And Whereas, public notice as pro- vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: Now, Therefore, Be It Resolved by the City Council of the City of Du- buque that to provide for the cost of constructing an eight inch tile • Special Session, August 25th, 1930 271 sanitary sewer in Union Street from the manhole in Rush Street to a point three hundred (300) feet north- erly there be issued sewer bonds to the amount of $327.14.
