Frank Fuhrman addressed the
Council asking that Auburn Street
be paved with Concrete, that the
majority of the property owners on
said street are in favor of this type
of paving and object to the Emul-
sified Asphalt type.
John J. Loftus addressed the Coun-
cil relative to the petition on Al-
gona Street, stating that the major-
ity of property owners on Algona
Street want the Concrete paving and
are opposed to the Emulsified As-
phalt type of paving.
Mr. I. Plamondon objected to the
paving of Wood Street with Emul-
sified Asphalt stating that the ma-
jority of the property owners on this
street want the Concrete paving.
Councilman Jansen moved that
the petitions be received and filed.
Seconded by Councilman Andel-
finger. Carried by the following vote:

Mr. A. J .Hartig, et al., represent-
ing the Main Street Merchants, ap-
peared before the Council and asked
that signs reading "City route U. S.
No. 20" be placed on Main Street
between Fourth Street and 14th
Street and presented a sample of
the sign they suggest the City to use
to direct East and West bound tour-
ists on No. 20 over Main Street.
Councilman Andelfinger moved
that the prayer of the petition be
granted and the signs be purchased
and placed as suggested. Routes No.
61 and No. 55 be routed down Cen-
tral Avenue. Seconded by Council-
man Schuckert. Carried by the fol-
lowing vote:

An Ordinance providing for an an-
nual tax for the purpose of de-
fraying the cost of street improve-
ments in the city, and declaring an
emergency.
Whereas, the City of Dubuque, in
the County of Dubuque acid State of
Iowa, heretofore, pursuant to and in
strict compliance with all laws ap-
plicable to said City, ordered and
contracted for certain street improve-
ments in said City, the cost whereof
to the amount of Sixty Thousand
Dollars ($60,000) because of deficien-
cies in assessments and for plats and
schedules as provided by law and
for the construction, reconstruction
and repair of street improvements at
intersections and one -half the cost
at intersections not crossings, and
for spaces opposite property owned
by the City and by the United States,
is to be borne by the City of Du-
buque, and to be paid from a tax lev-
ied on all the taxable property with-
in said City, and it is now advisable
to make provision with respect to the
levying of said tax:
Now, therefore, be it ordained by
the City Council of the City of Du-
buque:
Section 1. That in pursuance of
Paragraph 3 of Section 6211 of the
Code of Iowa there shall be and there
is hereby levied and there shall be
assessed and collected a direct an-
nual tax upon all the taxable pro-

perty within said City of five (5)
mills on the dollar (or such portion
thereof as may be necessary) upon
said taxable property sufficient to
produce the net annual sums as here-
inafter provided:

Section 2. Said taxes shall be col-
lected each year at the same time
and in the same manner, and in ad-
dition to all other taxes in and for
said City, and when collected shall
be converted into a special fund
which is hereby pledged for and
shall be used only to pay the portion
of the cost of constructing street
improvements by the payment of the
principal and interest of bonds is-
sued therefor.
Section 3. That a certified copy
of this ordinance be filed with tiff-)
County Auditor of Dubuque County
and that said Auditor be and he is
hereby instructed in and for each of
the years 1930 to 1945 inclusive to
levy and assess the tax hereby au-
thorized.
Section 4. That all ordinances of
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Section 5. That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the public
peace, health and safety that this
ordinance become effective upon its
passage, approval and publication,
and it is so ordered.

suance of $60,000 City improvement
bonds.
WHEREAS, the City of Dubuque,
in the County of Dubuque, State of
Iowa, is a municipal corporation, duly
incorporated, organized and existing
under and by virtue of the general
laws and Constitution of the State
of Iowa, and has adopted the City
Manager form of government as con-
templated by Chapter 328 of the Code
of Iowa; and
WHEREAS, said City has hereto-
fore ordered and provided for cer-
tain street improvements in and for
said City, the cost whereof to the
amount of not less than Sixty Thou-
sand Dollars ($60,000) is to be borne
by the City as a whole; and
WHEREAS, it is necessary and ad-
visable to at this time make pro-
vision for the issuance of bonds for
the payment of said cost; and
WHEREAS, except for bonds of
said City in the principal amount 'if
$ now outstanding no other
bonds or other obligations of said
City are now outstanding and pay-
able from the taxes authorized to be
levied by Paragraph 3 of Section
6211 of the Code of Iowa:
NOW, THEREFORE, Be It Re-
solved by the City Council of the
City of Dubuque, Iowa:
Section 1. That in pursuance of
Section 6261 and Paragraph 3 of Sec-
tion 6211 of the Code of Iowa, and
in anticipation of the City improve-
ment fund tax to be levied by Or-
dinance Number 15 -30 being adopt-
ed concurrently herewith, there shall
be and there is hereby ordered is-
sued the City Improvement Fund
Bonds of said City, in the amount of
Sixty Thousand Dollars ($60,000);
that said bonds be sixty (60) in
number, dated July 15, 1930, bear
interest at the rate of four and one -
half per centum (4 %) per annum
from the date of said bonds until
payment, payable semi- annually on
the fifteenth days of January and
July in each year; that said bonds
be signed by the Mayor and attested
by the City Clerk and the seal of
said City attached, and be register-
ed as to issuance by the City Treas-
urer and a certificate of registration
endorsed thereon; that interest ou
said bonds be evidenced by coupons
thereto attached and maturing on the
several days when such interest ma-
tures, such coupons to be executed
with the fac - simile signatures of said
Mayor and City Clerk, and said offic-
ials by the execution of said bonds
shall adopt as and for their proper
signatures, their respective fac- simile
signatures appearing on each of said
coupons, and that both principal and
interest be payable at the office of
the City Treasurer of said City in
the City of Dubuque, Iowa; that said
bonds be of the denomination of
$1,000 each, be numbered consecu-
tively from 1 to 60, both numbers in-
clusive, become due and payable in
their numerical order, $5,000 on July
15, 1941, $10,000 on July 15 of each
of the years 1942 to 1945 inclusive,
and $15,000 on July 15, 1946.
Section 2. That each of said bonds
be subject to registration as to prin-
cipal in the name of the holder on
the books of the City Treasurer, such
registration being noted upon each
bond so registered, and after such
registration payment of the princi-
pal thereof shall be made only to
the registered holder. Any bonds
so registered, upon the request in
writing of such holder, personally or
by attorney in fact, may be trans-
ferred either to a designated trans-
feree or to bearer, and the prin-
cipal of any bonds so transferred
and registered to bearer shall there-
upon be and become payable to bear-
er in like manner as if such bond
had never been registered. Registra-
tion of any bonds as to principal
shall not restrain the negotiability
of the coupons thereto attached by
delivery merely.

spectfully become due; that the faith,
credit, revenues and resources and

An Ordinance providing for the is-
suance of $115,000 sewer bonds,
providing for the levy of taxes to
pay the same and declaring an
emergency.
WHEREAS, the City of Dubuque,
in the County of Dubuque and State
of Iowa, heretofore, pursuant to and
in strict compliance with all laws ap-
plicable, lawfully ordered and provid-
ed for building and constructing sew•
ers in and for said City at a cost of
not less than $115,000; and
WHEREAS, it is necessary and
advisable that provisions be made
for the issuance of bonds of said
City, in the sum of $115,000, to de-
fray the cost of building and con-
structing said sewers and
WHEREAS, notice and hearing on
the initiation of proceedings for the
issuance of said bonds has hereto-
fore been given in manner and form
required by Section 363 of the Code
of Iowa and no petition nor protest
has been filed:
NOW, THEREFORE, Be It Or-
dained by the City Council of the
City of Dubuque, as follows:
Section 1. That pursuant to and
as authorized by Section 6125 of the
Code of Iowa, there shall be and
there is hereby ordered issued the
negotiable Sewer Bonds of said City
of Dubuque in the principal amount
of $115,000; said bonds to be 115 in

John Loftus addressed the Council
and again asked the Council to re-
consider their action, property own-
ers on Algona Street want Concrete
paving, that Emulsified Asphalt is
an experiment and they do not want
to pay their money unless they know
what they are getting; they know
that Concrete will last and they are
willing to pay the difference in the
cost of paving.
A petition was presented, signed
by the abutting and adjacent prop-
erty owners on Wood Street, from
West 14th Street to Rosedale Ave-
nue, asking that the street be paved
with concrete paving. It is their
opinion that Emulsified Asphalt will
not stand up under the conditions
found in their street. However, if the
Council insists that the Emulsified
Asphalt paving be used, they will
not accept it unless the street re-
ferred to be reconditioned by first
reinforcing all weak spots caused by
the installing of sewer, water and
gas connections, recently put in, and

The issue of this bond has been
duly and properly registered in my
office as of the fifteenth day, of July,

Section 4. That said bonds be ex-
ecuted as herein provided as soon
after the adoption of this resolution
as may be and thereupon they shall
be delivered to the Treasurer of said
City, who shall register the fact of
the issuance of same in a book pro-
vided for that purpose and shall de-

Section 5. That for the purpose of
providing for the levy and collection
of a direct annual tax sufficient to

falls due, and also to pay and dis-
charge the principal thereof at ma-
turity, there be and there is hereby
levied upon all the taxable property
in said City in each of the years
while said bonds or any of them are
outstanding, a tax sufficient for that
purpose, and in furtherance of this
provision but not in limitation there-
of that there be and there is hereby
levied on all the taxable property in
said City the following direct annual
tax, to -wit:
For the year 1930, a tax sufficient
to produce the sum of $7,762.50, be-
ing $2,587.50 to reimburse current
funds for advancements to pay in-
terest, due January 15, 1930, and
$5,175.00 for interest.
For each of the years 1931 to 1936
inclusive a tax sufficient to produce
the sum of $5,175.00 each year for
interest:
For the year 1937 a tax sufficient
to • produce the sum of $10,062.50 for
principal and interest;
For the year 1938 a tax sufficient
to produce the sum of $9,837.50 for
principal and interest;
For the year 1939 a tax sufficient
to produce the sum of $9,612.50 for
principal and interest;
For the year 1940 a tax sufficient
to produce the sum of $9,387.50 for
principal and interest;
For the year 1941 a tax sufficient
to produce the sum of $14,050.00 for
principal and interest;
For the year 1942 a tax sufficient
to produce the sum of $18,487.50 for
principal and • interest.
For the year 1943 a tax sufficient
to produce the sum of $22,700.00 for
principal and interest;
For the year 1944 a tax sufficient
to produce the sum of $26,687.50 for
principal and interest;
For the year 1945 a tax sufficient
to produce prior to July 15, 1946, the
sum of $25,562.50 for principal and
interest.
Said taxes when collected shall be
converted into a special fund for the
payment of principal and interest of
the bonds hereby authorized and no
other purpose whatsoever.
That the principal or interest com-
ing due at any time when there are
insufficient funds on hand to pay the
same be promptly paid when due
from current funds on hand, and re-
imbursement be made to such cur-
rent funds in the sums thus ad-
vanced when the taxes herein pro-
vided shall have been collected.
Section 7. That a certified copy of
this ordinance be filed with the
County Auditor of Dubuque .County
and that said Auditor be and he is
hereby instructed in and for each of
the years 1930 to 1945, inclusive, to
enter for collection and assess the
tax hereby authorized.
Section 8. That all ordinances and
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Section 9. That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the public
peace, health and safety that this
ordinance become effective upon its
passage, approval and publication,
and it is so ordered.

viting attention to certain violations
of the ordinance of the City of Du-
buque, especially the building code
now in force and effect with refer-
ence to the remodeling of the Grand
Theatre building.
At that time I called your atten-
tion to Section 79 in addition to Sec-
tion 590. This oral protest was made
at your open meeting of the City
Council, either regular or special ses-
sion at the City Council Hall of Du-
buque, Monday, August 4, 1930.
I now serve you with written no-
tice of the open violations of these
sections, providing as to how such
buildings shall be reconstructed, re-
paired or made over, so as to be fire-

ing that the installation of said lights
amounted to approximately $9,000 of
which $4,100 is paid, and they hereby
ask that the City accept the lights
and assume the unpaid balance of
$4,850.
Councilman Schuckert moved that
the rules be suspended to allow any-
one who wished to do so, to address
the Council. Seconded by Council-

Mr. E. C. Fairfield addressed the
Council relative to the petition, stat-
ing that the Baseball Club has been
losing money and the ticket sale was
not enough to pay for the installation
of the lights, and that the City will
reap the benefit of the installation
by being able to 'to have night foot-
ball games, hockey games, industrial
exhibitions, etc., and he hoped that
the Council would see it in that light
and act favorably on the proposition.
Councilman McEvoy moved that
the petition be referred to the Coun-

ance of Public Improvement bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Nowata
Street, hereinafter described, has
been completed and said improve-
ment has been acceptd by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $5,314.94;
And Whereas, public notice, as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and determined:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Nowata Street from the
south curb line of West 14th Street
to the north curb line of Julien Ave-
nue there be issued improvement
bonds to the amount of $5,314.94.
Said bonds shall be issued under the
provisions of Chapter 311 of the Code
of Iowa, 1927, which bear date as of
the 18th day of September, 1930;
shall be in the denominations of
$500.00, except that there shall be
one bond to the amount of $314.94.
They shall be numbered from 2669
to 2679 inclusive and shall be di-
vided into ten series of which the
bond numbered 2669 shall constitute
the first series and shall be payable
the 1st day of April, A. D. 1931; the
bond numbered 2670 shall constitute
the second series and shall be pay-
able the lst day of April, A. D. 1932;
the bond numbered 2671 shall con-
stitute the third series and shall be
payable the 1st day of April, A. D.
1933; the bond numbered 2672 shall
constitute the fourth series and shall
be payable the 1st day of April, A.
D. 1934; the bond numbered 2673
shall constitute the fifth series and
shall be payable the 1st day of April,
A. D. 1935; the bonds numbered 2674
and 2675 shall constitute the sixth
series and shall be payable the lst
day of April, A. D. 1936; the bond

seventh series and shall be payable

Said bonds shall bear interest at
the rate of five per cent. per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment.
Both principal and interest shall
be payable at the office of the City
Treasurer in the City of Dubuque.

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
1930 , or any time before that date
at the option of the City, the sum of
$500.00 with interest thereon at the
rate of five per cent per annum, pay-
able on the presentation and sur-
render of the interest coupons here-
to attached, both interest and prin-
cipal are payable at the office of the
City Treasurer in the City of Du-
buque in the State of Iowa. This
bond is issued by the City of Du-
buque pursuant to and by virtue of
Chapter 311 of the Code of Iowa,
1927, and in accordance with a reso-
lution of the City Council of said
City, duly passed on the 18th day of
August 1930. This bond is one of a
series of 11 bonds, 10 for $500.00,
numbered from 2669 to 2678 inclu-
sive, and one for $314.94, numbered
2679, all of like tenor and date and
issued for the purpose of improving
Nowata St. from the south curb line
of West 14th St. to the north curb
line of Julien Avenue and described

in said resolution; which cost is as-
sessable to and levied along said im-
provement, and is made by law a
lien on all abutting or adjacent prop-
erty, and payable in ten annual in-
stallments, with interest on all de-
ferred payments at the rate of five
per cent. per annum, and this bond
is payable only out of the money
derived from the collection of said
special tax, and said money can be
used for no other purpose. And it is
hereby certified and recited that all
the acts and conditions and things
required to be done precedent to and
in the issuing of this series of bonds
have been done, happened and per-
formed in regular and due form as
required by said law and resolution;
and for the assessments, collections
and payment hereon of said special
tax, the faith and diligence of said
City of Dubuque are hereby irrevoc-
ably pledged.
In Witness Whereof, the City of
Dubuque by its City .Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 18th day of August, 1930,
and has authorized the use of their

provement Fund.
Be It Further Resolved, that the
interest coupons attached to the
bonds be signed with the fac- simile
signature of the Mayor and counter-

of the City Clerk.
Be It Further Resolved, that as
fast as funds allow, beginning with
the second year after the payment
of interest due, these bonds shall be
called and retired in the same order
as numbered.

Mr. Nolan are as follows:

Dear Mr. McKay:
The present preliminary stage of
the city planning studies make it
necessary to present suggestions and
recommendations with some reserva-
tion in the light of future and more
comprehensive conclusions. The
matters referred to your commission
for recommendation on July 17 by
the Council pertaining to 4th Street
and 8th Street are matters having
considerable connection and atten-
tion along with other related matters
at the present time.
As basic factors to be kept in mind
in considering the present problems
in question, we would point out the
following items applicable to the
business sections of the city.
(a) The street for the purpose of
this statement is the right -of -way
used for street purposes and extend-
ing from property line to property
line.
(b) The pavement includes the
space between curbs.
(c) The pavement in the cases
mentioned should be divided into an
equal number of traffic lanes and
parking spaces for traffic in each di-
rection.
(d) The traffic lanes should be ten
feet wide.
(e) The space for parking of cars
parallel to the curb should be eight
feet in width and for parking 45 de-
gree angle, should be twelve to 11
teen feet.
(f) The space for trolley cars
should be ten feet wide per track.
(g) The width of the sidewalk in
this type of street is very important
and should not be less than ten feet
and preferably fifteen feet wide, in-
cluding the curb. The effective width
will be somewhat reduced by the nee-

essary and permitted lighting stan-
dards or poles.
The width of 4th and 8th Streets
is indicated on. the maps available
to us as being sixty -four (64') feet
wide. This overall width would al-
low-

We interpret the expression "street
widening" as used in your letter to
mean the widening of the pavement
on 4th and 8th Streets. From a city
planning point of view widening of
a street pavement should be clearly
related to the type of property abut-
ting on the street, the resultant traf-
fic doing business there, the loading
and unloading of merchandise from
street to store, the parking space
available nearby, or in garages, and
the amount of through traffic using
the street as a channel to other parts
of the city, and the amount of ped-
estrian use for sidewalks, the width
of the street right -of -way, and the
relation of the street to the general
thoroughfare system of the city.
There are certain fallacies regard-
ing streets and thoroughfares that
should be pointed out, namely: the
supposition that traffic on a street
always means greater business for
the abutting stores, and that there is
no longer need for ample sidewalks.
While we are not in a position yet
to state final conclusions, there are
certain observations that may be
made to aid the commission in mak-
ing their recommendations.
1. In so far as possible the load-
ing and unloading of merchandise or
freight from trucks should be in
the alleys or platforms located with-
in the buildings.
2. Balance should be preserved
between sidewalks and street pave-
ment even to the extent of having
only parallel parking on the 64 foot
streets.
3. Certain of the business streets
are now too narrow and the only
satisfactory recourse is to prohibit
parking entirely, a very drastic
measure, or to actually widen the
street right -of -way by establishing
building set -back lines and gradual-

ly at the time of the construction of
new buildings to increase the street
width.
4. A means probably can be found
to relieve the pressure of traffic on
the downtown business streets by by-
passing through traffic around these
streets.
5. Specifically, 4th Street is relat-
ed to the elimination of the grade
crossing over the railroads to the
east and 8th Street is related to the
approach from the west, so that both
are linked up most directly with the
thoroughfare system which will be
devised for the city.

Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in Union Street, hereinafter
described, has been completed and
said improvement has been accepted
by the City Council of said City and
the City Engineer has computed the
cost and expense thereof to be
$327.14.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered

ers of the east 140 feet of the east
erly 240 feet of Lot 8 and the north

Sisters Addition to the City of Du-
buque, hereby petition your Honor-
able Body to lay and construct a
sanitary sewer, together with all
necessary appurtenances thereto in-
cluding a manhole along the wester-
ly side of Fremont Street from the
easterly manhole to be constructed
on St. Joseph Street in order to
serve the above described premises.
In consideration of the granting of
this petition, the undersigned ex-
pressly agree that the construction
of this sewer be considered a part
of the general contract heretofore
awarded to Uhlrich -Paley Co. for the
construction of sewers in West Du-
buque Sewer Dis. and that no furth
er procedure be adopted by your
Honorable Body, such as the passage
of preliminary resolutions, advertis-
ing for bids or awarding of contract,
or that any other procedure need be
taken in order to charge the de-
scribed premises with a special as-
sessment to pay the cost of the
sewer herein requested, all of such
Proceedings being hereby expressly
waived and consent be given to in-
clude the requested extention of said
sewer and appurtenances in the ex-
isting contract of said Uhlrich -Paley
Company.
The undersigned further agree

be included in the assessment

part of the West Dubuque Sewer Dis-
trict assessment and will be paid by
them upon completion and accept-
ance thereof by your Honorable

est on all deferred payments at the

money derived from the collection of
said special tax, and said money can
be used for no other purpose. And

that all the acts and conditions and
things required to be done precedent

Be It Further Resolved, that the
Mayor and City Clerk be and they
are hereby instructed to cause said
bonds to, be prepared and when so
prepared to execute said bonds, and
that the City Clerk be and he is
hereby instructed to register said
bonds in a book to be kept by him
for that purpose, and to then deliver
them to the City Treasurer who will
also' register them in a book to be
kept by him for that purpose.
Be It Further Resolved, that the
City Treasurer be and he is hereby
instructed to sell bonds in the man-
ner provided by law, the proceeds of
said sale to be kept in a special fund
to be known as Sewer Fund.
Be It Further Resolved, that the
interest coupon attached to the
bonds be signed with the fac- simile
signature of the Mayor and counter-
signed with the fac- simile signature
of the City Clerk.
Be It Further Resolved, that as
fast as funds allow, beginning with
the second year after the payment of
interest due, these bonds shall be
called and retired in the same order
as numbered.

for permission to erect a cement
garage on the east side of his lot,

Manager for investigation and re-
port Seconded by Councilman Mc-

Petition of Patrick Kearney stat-
ing that a petition was on file with
the City Manager for the construc-
tion
of a sanitary sewer from Cleve -
land Avenue to Villa and South
Bluff Streets, stating that due to the
unsanitary condition arising from
outhouses and drainage into crevices
along this street, that some action
should be taken to place the same
in a healthful condition.
Councilman Schuckert moved that
the petition be referred to the Coun-
cil for investigation. Seconded by
Councilman Jansen. Carried by the
following vote:

Manager be approved and the con-
tract be awarded to F. C. Burdt, he
being the low bidder. Seconded by

Councilman Jansen moved that
the rules be suspended to allow any-
one who wishes to do so to address
the Council. Seconded by Council-

Mr. Mulligan addressed the Coun-
cil again stressing on the necessity
of a sanitary sewer in Valley Street,
he having been before the Council
several times on this matter.

the matter be referred to the Coun-
cil to view. Seconded by Councilman
Jansen. Carried by the following
vote:
