Chairperson Kluesner called the meeting to order at 2:00 p.m. in Conference Room
A of City Hall.
Present: Chairperson Loras Kluesner, Commissioner Merle Duehr
Absent: Commissioner Richard Wertzberger
Also Present: Corporation Counsel Barry Lindaht, Human Services Manager Randy
Peck, Fire Chief Dan Brown, Tom KopP, Dave Baker, Attorney Jonathan M. Conti
Human Services Manager Randy Peck requested that Agenda Item #6
considered be moved up on the agenda to Item #3. Commission agreed.
Approve Minutes of February 28, 2001
Duehr noted that the word Uquality" should be changed to "qualify" in Item
#4 of the agenda, and moved to approve the minutes of February 28, 2001,
as changed.
Seconded by Kluesner, unanimously approved.
Establish Passing Point and Certify List for Medical Officer
Duehr moved to establish the passing point for the position of Medical
Officer at 68 and to certify the list of three applicants. Seconded by
Kluesner, unanimously approved.

Request to Schedule Examination for the Position of Clerk Typist
Motion by Duehr to conduct an entrance examination for the position of
Clerk Typist on Tuesday, May 15, 2001, at 6:30 p.m., at a location to be
determined, that the test be open to the general public and current City
employees and that the list be certified for two years. Seconded by
Kluesner, unanimously approved. It was then moved by Duehr that
application deadline be established as 5:00 p.m., April 27, 2001. Seconded
by Kluesner, approved unanimously.
Request to Schedule Promotional Examination for the Position of Equipment
Operator I
Motion by Duehr to conduct a promotional examination for the position of
Equipment Operator I on May 30, 2001, at 6:30 p,m., at a location to be
determined, that the test be open to current City employees and that the list
be certified for two years. Seconded by Kluesner, unanimously approved.
Duehr moved that applications must be received in the office of the Human
Services Manager by 5:00 p.m. on May 16, 2001. Seconded by Kluesner,
unanimously approved.
Request to Schedule Promotional Examination for the Position of Equipment
Operator II.
Motion by Duehr to conduct a promotional examination for the position of
Equipment Operator II on June 12, 2001, at 6:30 p.m., at a location to be
determined, that the test be open to current City employees and that the list
be certified for two years. Seconded by Kluesner, unanimously approved.
Duehr moved that applications must be received in the office of the Human
Services Manager by 5:00 p.m. on May 25, 2001. Seconded by Kluesner,
unanimously approved.
Request to schedule Promotional Examination for the Position of Foreman.
Motion by Duehr to conduct a promotional examination for the position of
Foreman on June 27, 2001, at 6:30 p.m., at a location to be determined,
that the test be open to current City employees and that the list be certified
for two years. Seconded by Kluesner, unanimously approved. Duehr
moved that applications must be received in the office of the Human
Services Manager by 5:00 p.m. on June 15, 2001. Seconded by Kluesner,
unanimously approved.
Discussion of Commission's Jurisdiction of Tom Kopp Request
Corporation Counsel Barry Lindahl stated it was his opinion that the Civil
Service Commission had no jurisdiction over the issues identified in Mr.
Kopp's letter of January 17, 2001 to the Civil Service Commission.
Jonathon Conti, Attorney for Teamsters Local #421, stated it was their
opinion that Tom Kopp is qualified for the Engineering Assistant I position,
that the list in question is not exhausted as there are three qualified
applicants on the list, and that the City should not be allowed to request a
new test and certified list of applicants.
Tom Kopp commented that three individuals took and passed the
Engineering I test, all three were interviewed and none have been hired;
however, they have been used in a part-time capacity in the Engineering
Division.
Mr. Lindahl replied that the fact you are qualified and on a certified list does
not guarantee appointment to a position. City has right to say list is
exhausted and to re-test.
Commissioner Duehr stated that he does not feel the Commission has any
right to say who should be hired. The Commission's duty is to administer
the Civil Service test and to certify a list of applicants. He further
commented that on record he is bothered by this incident and that no one
has been hired.
Chairperson Kluesner commented that he was very uncomfortable dictating
who is qualified to the Engineering Department. Further, he commended
Mr. Kopp for this initiative to return to school; however, it was his feeling
that the law did not give Commission the authority to dictate hiring
procedures.
It was the consensus of Chairperson Kluesner and Commissioner Duehr that
the Code does not allow the Commission to have jurisdiction over the hiring
practice of the City.
Duehr moved to receive and file all communications; second by Kluesner
and passed unanimously.
There being no further business, the Commission adjourned at 2:50 p.m.

Room at Five Flags.

1. Request to Schedule Entrance Examination for the Position of Utilityworker
Duehr moved that an entrance examination for the position of Utility Worker
be scheduled for Tuesday, April 24, 2001, at 6:30 p.m., at a location to be
determined, that the test be open to the public and current City employees,
and that the list be certified for two years. Seconded by Kluesner,
unanimously approved. It was recommended that the deadline for receipt of
applications be set as 5:00 p.m. on April 16, 2001; motion by Duehr to that
effect and second by Kluesner. Unanimously approved.
There being no further business, Duehr moved to adjourn. Seconded by Kluesner.
Unanimously approved and meeting adjourned at 6:18 P.M.
Commission then conducted written exam for position of Maintenance Worker.
