Attorney Gilloon addressed the Council relative to the gasoline curb pumps operated by Edward Bowman stating that the old pumps have been replaced with new pumps and due to that fact the Building Commissioner has placed a chain and key on them, locking them up. The pumps are lo- cated on East Fourth Street. Also the representative of the Quality Oil Co., stated that the curb pump as operated by Sam Caatigny was in the same position. Councilman McEvoy moved that the matter of curb pump regulation be referred to the Council for fur- ther consideration. Seconded by Councilman Jansen. Gentlemen: At your meeting held March 25th a petition from Frank A. Zemanek relative to assessments lev- ied against Lots 7, 8 and 9 Mills West Dubuque Addition, was refer- red to your City Manager for report. This is to advise that your City Manager has checked over the com- putations of the Engineering Depart- ment in connection with the pro- posed assessments and also viewed the property on the ground and it is his belief that the assessments are more than fair and should be collected as levied. It will be remembered that Mr. Zemanek was one of the instigators and promoters of the sewer for which he is being assessed and also owns Lot 10 on which he has a home and which said sewer very adequately serves. It is your City Manager's opinion that Lots 7, 8 and 9 carry a very low assessed valuation as these lots are valuable lots for building purposes. Mr. Zemanek has also ov- erlooked the fact that sewers are not assessed on the basis of 1 / 4 val- ues, but the law states that the as- sessments cannot exceed $3.00 per front foot and none of his assess- ments exceed this amount. Gentlemen: At your meeting held March 25th a petition from Joseph F. Huber, et al, requesting the City not to take out the stone curb on Main Street from Madison Park to Seminary Street was referred to your City Manager for report. Your City Manager has investigat- ed this proposition on the ground and finds that a large majority of the stone curb is in good condition and it is not our intention to re- move same where it is possible to make the new improvement conform to the old curb. On the east side of Main Street along the park pro- perty it is our intention to construct a concrete curb inside of the present stone curb due to the fact that the east side of the street will be cut down materially over the way it Is at present and the old stone curb will serve as a retaining wall for the parking space between the curb and sidewalk and between the very southerly end of the improvement the stone curb will have to come out to conform to the new lines and grade of the street. On the balance of the street nearly all of the stone curb can remain and as we are call- ing for bids on both the integral curb and plain concrete slab, no change will have to be made in our plans. Your City Manager therefore rec- ommends that the petition be placed on file as the petition will be prac- tically satisfied when the improve- ment is made Very respectfully submitted, O. A. Ordinance No. 25 -29 An Ordinance designating and es- tablishing as a restricted residence district all that territory lying with- in the following defined area, to wit: Locust and Bluff Streets from the north property line of West 10th Street northerly to the end of such streets, including the lands abutting upon and adjacent to all cross streets from Main Street to Bluff Street commencing with the northerly side of West 10th Street; providing that no building or structure, except resi- dences, school houses, churches and other similar structures shall here- after be erected, altered or repaired or occupied within said district with- out first securing from the City Council of the City of Dubuque a permit therefor; and prescribing a penalty for violation hereof. Be it ordained by the City Coun- cil of the City of Dubuque: Par. District defined. Section 1. That all of that territory lying within the following defined area be and the same is hereby designated and established as a restricted resi- dence district, to wit: Locust and Bluff Streets from the north property line of West 10th Street northerly to the end of such streets, including all lands abutting upon and adjacent to all cross streets from Main Street to Bluff Street commencing with the norther- ly side of West 10th Street. Par. Structures permitted therein. Section 2. That hereafter no bill board; sign board, poster board, building or other structure, except residences, school houses, churches and other similar struc- tures shall be erected, altered, re- paired or occupied within said dis- trict without first securing from the City Council of the City of Dubuque a permit therefor. Par. Permit. Section 3. Be- fore any building or structure other than a residence, school house, church or building of a similar na- ture can be erected, altered, repaired or occupied within said district, the owner or lessee of the real estate upon which the same is to be erect- ed, altered, repaired or occup'ied shall file a written application with the City Council for a permit there- for and accompany such application with a plan drawn to scale showing the character and dimensions of the same; the location and description of the lot; the kind of buildings or structures located withinu 150 feet in all directions therefrom; the pur- pose for which the building or struc- ture is to be used; the materials out of which the same is to be built and the cost thereof when complet- ed; and shall furnish said Council any other additional facts or infor- mation which it may request. When the Council has been furnished with all of the necessary information up- on which to act, it shall either grant or refuse a permit within ninety (90) days from the time the application has been filed and, in doing so, it shall take into consideration wheth- er or not the building or structure to be erected, altered, repaired or occupied constitute a fire hazard to adjacent property; whether or not the same is a menace to health or safety of the occupants of property within the district; whether or not the same is or will become unsight- ly or an obstruction to the views in the use of the street; and every oth- er fact or circumstance which will tend to add to or detract from the general appearance or condition of the district. In the event a permit be granted the Council may pre- scribe the distance from the street that such structure may be erected and provide for any other reasonable rules or regulations as a condition precedent to the erection, alteration, repairing or occupying of such struc- ture as said Council may, by resolu- tion or ordinance, deem necessary or advisable to impose. Pa. Penalty. Section 4. Any building or structure erected, alter- ed, repaired or used in violation of any of the provisions hereof, or in violation of the restrictions con- tained within any permit granted, or without a permit being granted, shall be deemed a nuisance and any per- son, firm or corporation causing the same shall be fined not to exceed $100.00 or imprisoned not to exceed 30 days in jail or such nuisance may be abated by an action in the dis- trict court of Dubuque County, Iowa, or both such fine may be imposed and the nuisance abated, as herein provided. Par. Section 5. Immediately upon the passage of this Ordinance the City Clerk shall certify the same, together with a plat of the district to the County Recorder of Dubuque County, Iowa, to be by him recorded, as provided by law. Section 6. Publication. This ordi- nance being deemed urgent and in the interest of public health, peace and general welfare shall be in force and effect from and after its final passage and adoption by the City Council and publication as provided by Iaw. Gentlemen: At your meeting held April 1st a verbal protest from Mr. Frank Blocker protesting against his assessment for a sewer in Green Street and Avoca Street assessed against Lot 176 Finley's Addition was referred to your City Manager for report. Mr. Blocker's Lot 176 is a very large lot on the northwest corner of Green and Avoca Street, being 198 feet long, with an average depth of 85 feet and it is possible to divide this lot up into three building Tots, one facing on Green Street with an average width of 65 feet and a depth of 100 feet and two lots facing on Avoca Street with an average width of 49 feet, one lot with an average depth of 95 feet and the other with an average depth of 115 feet. The total assessment against this proper- ty is $198.28 and has a total frontage on Avoca Street of 215% feet. The same frontage on the east side of Avoca Street has a total assessment of $300.91 or $102.63 more than Mr. Blocker's property is being assessed and it would therefore appear that his assessment is an equitable one and should stand as assessed.
