Council met at 7:45 P. M.
Present — City Manager Kratz,
Mayor Andefinger, Councilmen Jan-
sen, McEvoy, Meuser, Schucklert.
Meeting called for the purpose of
considering any matter which may
properly come before the Council at
a regular meeting.
Councilman Schuckert moved to
recieve and file the petitions of W.
H. Day, Jr., and L. H. Fritz, pro-
testing to the construction of the
sanitary sewer in Wilbur Street.
Seconded by Councilman Jansen.
Carried by the following vote:
Yeas —Mayor Andelfinger, Council-
men Jansen, McEvoy, Meuser and
Schuckert.
Nays —None.
Councilman Schuckert moved to
receive and file the petitions of Vic-
tor McGrath and Frank R. Lacy,
protesting against the construction
of the sanitary sewer in Farley
Street. Seconded by Councilman
Jansen. Carried by the following
vote:
Yeas —Mayor Andelfinger, Council-
men Jansen, McEvoy, Meuser and
Schuckert.
Nays —None.
Councilman McEvoy moved to re-
ceive and file the petition of the In-
terstate Garage, et al, requesting the
City Council to grant them permis-
sion to continue the use of curb
gasoline pumps at the present fee,
also to repair and replace curb
pumps now in use, also to set aside
a no parking space of 15 feet on
each side of curb pumps. Second-
ed by Councilman Meuser. Carried
by the following vote:

Schuckert.

this is the regular monthly meeting
of the City Council to consider any
business that may properly come be-
fore the meeting.
Petition of the American Legion
requesting permission to hold their
annual Poppy Sale on Saturday, May
25th, 1929, presented and read.
Councilman McEvoy moved to
grant the prayer of the petition.
Seconded by Councilman Schuckert.
Carried by the following vote:

Schuckert.
Nays —None.
Petition of Grandview Avenue M.
E. Church, et al, requesting the City
to take over as a part of the sewer
system of the City the private sew-
er in Bennett Street from Grand-
view Avenue westerly about 120
feet, presented and read.
Councilman Schuckert moved to
refer the petition to the Council.
Seconded by Councilman Jansen.
Carried by the following vote:

Petition of Masonic Temple Asso-
ciation, New Building Committee, re-
questing a building permit to erect
a "Masonic Temple" on the north

Communication of Iowa National
Bank with attached copies of an as-
signment of the contract of Railroad
Avenue and South Main Street made
and entered into by and between
the City of Dubuque and the James
F. Lee Paving Co., and requesting
the signing of an acknowledgement
on the bottom of the assignment and

returning the original to them, pre-
sented and read.
Councilman Meuser moved to
grant the request and that the May-
or and City Clerk be instructed to
sign the acknowledgement on the

Gentlemen: At your meeting held
March 29th a communication from
the Izaak Walton League requesting
that water be furnished to the
League free of charge for propaga-
tion of fish in the pond near Asbury
Road, was referred to your City
Manager and Superintendent of Wat-
er Works and this is to advice that
we recommend that a meter be in-
stalled and that the Izaak Walton
League be permitted to use water
free of cost up to $100.00 based on
our regular'water rates.

Gentlemen: At the Council meet-
ing held March 4th a petition from
Charles P. Fay, et al, requesting a
water main to be constructed in
Rowan Street, along with other re-
quests, was referred to the Council
to view the grounds.
This is to advise that the Council
did view the grounds and it was
their opinion that the water main
should be installed but that the street
at this time. Kindly present this
at this time. Kindly present this
matter to the Council ' for definite
disposition.

The undersigned hereby certifies
that the contract for the paving of
Brunswick Street from the north
property line of O'Neill Street to the
City Limits, Groveland Street from
the west property line of Burden
Street to the east property line of
Brunswick Street and O'Neill- Street
from the west property line of Bur-
den Street to the west property line
of Brunswick Street, Uhlrich -Paley
Co., contractors, has been completed.
I further certify that this work
has been done in accordance with
the plans and specifications and
stipulations of the contract and I
would therefore recommend its ac-

A Resolution Accepting Improvement
and Directing the Clerk to
Publish Notice
Whereas, the contract for the im-
provement of Brunswick Street from
the north property line of O'Neill
Street to the City Limits, Grove -
land Street from the west property
line of Burden Street to the east
property line of Brunswick Street
and O'Neill Street from the west
property line of Burden Street to the
west property line of Brunswick
Street, by paving with six inch plain
concrete, has been completed and
the City Manager has examined the
work and filed his certificate stating
that the same has been completed
according to the terms of the con-
tract, plans and specifications and
recommends its acceptance, now
therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Manag-
er be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provement and file the same in the
office of the City Clerk subject to
public inspection and said Clerk
shall upon receipt of such plat and
schedule publish the notice of the
Council's intention to levy special
assessments therefor, as required by
law.
Be it further resolved that the
City Treasurer be and he is here-
by directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is-
sued upon the above described im-
provement an amount equal to the
amount of his contract, less any re-
tained percentage provided for there-
in.

petual right of easement in, over and

Whereas, during the past winter
season severe snows and freezing
weather visited the City of Dubuque
and caused the streets to become al-

not adequate to cope with the situa-
tion; and
Whereas, at a mass meeting held
by citizens of the city with the City
Council, demand was made for the
purchase by the City of certain snow
and ice removing apparatus at once
in order to relieve the existing con-
ditions; and
Whereas, the Council in informal
session decided to purchase said
equipment and said equipment was
purchased by the Manager under di-
rection of the Council. and
Whereas, it now appears that no
formal record was made in the Coun-
cil proceedings of the authorization
for such purchase and it is deemed
advisable by the City Council to
have such record in order that such
purchase may appear therein; now
therefor
Be it resolved by the City Council
of the City of Dubuque that the pur-
chase of certain snow and ice re
moving machinery and apparatus,

Par. Section 1. That, for the
collection and disposal of garbage
and other such waste material as
may become dangerous to the pub-
lic health or detrimental to the best
interests of the community, there be
and there is hereby created and es-
tablished a sanitary district in the
City of Dubuque and the boundaries
thereof are hereby defined to be the
entire corporate limits of such City.
Par. Section 2. That this or-
dinance, being deemed urgent and of
immediate necessity for the preser-
vation of the public health, comfort
and convenience of the City of Du-
buque and the inhabitants thereof,
shall be in force and effect from and
after its final passage and adoption
by the City Council and publication,
as provided by law.

Mayor Andelfinger read the call
and stated that this meeting is called
for the purpose of awarding con-
tracts for an 8 -inch tile or concrete
sanitary sewer, manholes and Y
branches and an 18 -inch tile or con-
crete storm sewer in Dodge to Reed-
er Street, a 15 -inch tile or concrete
storm sewer in Reeder Street with
manholes and catch basins. For an
8 -inch tile or concrete sewer, man-
holes and Y branches in Edith and
Burden Streets and for the construc-
tion of an 8 -inch tile or concrete
sanitary sewer in 'May Place, and
acting on any other business that
may come before the meeting.
Petition of Fred H. Hintz referred
to the City Council by the Board of
Supervisors, asking to have the 1924-
1925 1926 tax cancelled on Lots 1 -2-
3-11-12-13-14 and 15, King's Grove
Add., stating that the above mention-
ed property was deeded to him in
June 1928, and he finds that the tax
as above mentioned was not paid by
the Ernst Mueller Estate. Mr. Muel-
ler was a Civil War veteran and re-
ceived an exemption for the above
mentioned years, which exemption
was not enough to exempt the full
value of the property as assessed by
the Assessor for the above men-
tioned years, and as Mr. Mueller at
that time thought his exemption
would take care of all the taxes for
those years. Mr. Hintz therefore asks
that his petition be granted and the
County Treasurer be instructed to
cancel the 1924 -1925 and 1926 tax on
the above mentioned lots.

Communication from the Director
of Health .(Dr. W. J. Connel), stat-
ing that the property of Dennis Mor-
iarty, 179 Bryant Street, is not con-
nected with the sanitary sewer. Mr.
Moriarty was notified to connect his
property with the sewer, which he
failed to do, he was brought into
court August 7th and was given 15
days times to connect. He was
brought into court again August 22
and was fined or given the alter-
native of serving 15 days in jail,
he also stated that the property is
not worth connecting with the sew-
er and that the house would be va-
cated and kept vacant. He was al-
lowed to go without penalty. Some
time during the winter the house
was again rented, and the neigh-
bors are complaining about the con-
dition which exists on this piece of
property. The Health Department
therefore desires the City Council
to consider the proposition of get-
ting an injunction against Mr. Mor-
iarty requiring him to keep this
house vacant inasmuch he possibly
will not connect with the sewer.

An ordinance designating and es-
tablishing as a restricted residence
district all that territory lying with-
in the following defined area, to-
wit:
The east and west side of Bluff
Street from the north property line
of West 1st Street northerly to the
south property line of West 7th
Street including all lands abutting
upon and adjacent to all cross
streets westerly from the alley be-
tween Locust and Bluff Streets; pro-
viding that no building or structure,
except residences, school houses,
churches and other similar struc-
tures shall hereafter be erected, al-
tered or repaired or occupied with-
in said district without first secur-
ing from the City Council of the
City of Dubuque a permit therefor;
and prescribing a penalty for viola-
tion hereof.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Par. 31. District defined. Sec-
tion 1. That all of that territory ly-
ing within the following defined
area be and the same is hereby des-
ignated and established as a restrict-
ed residence district, to -wit:
The East and West side of Bluff
Street from the north property line
of West 1st Street northerly to the
south property line of West 7th
Street including all lands abutting
upon and adjacent to all cross

Par. 32. Structures permitted
therein. Section 2. That hereafter
no bill board, sign board, poster
board, building or other structure,
except residences, school houses,
churches, and other similar struc-
tures shall be erected, altered, re-
paired or occupied within said dis-
trict without first securing from the
City Council of the City of Dubuque
a permit therefor.
Par. 33. Permit. Section 3. Be-
fore any building or structure, other
than a residence, school house,
church or building of a similar na-
ture, can be erected, altered, re-
paired or occupied within said dis-
trict, the owner or lessee of the real
estate upon which the same is to
be erected, altered, repaired or oc-
cupied shall file a written applica-
tion with a plan drawn to scale
showing the character and dimen-
sions of the same; the location and
description of the lot; the kind of
buildings or structures located with-
in 150 feet in all directions there-
from; the purpose for which the
building or structure is to be used;
the materials out of which the same
is to be built and the cost thereof
when completed; and shall furnish
said Council any other additional
facts or information which it may
request. When the Council has been
furnished with all of the necessary
information upon which to act, it
shall either grant or refuse a per-
mit within ninety (90) days from
the time the application has been
filed and, in doing so, it shall take
into consideration whether or not
the building or structure to be erect-
ed, altered, repaired or occupied
constitutes a fire hazard to adjacent
property; whether or not the same
is a menace to health or safety of
the occupants of property within the
district; whether or not the same
is or will become unsightly or an
obstruction to the views in the use
of the street; and every other fact
or circumstance which will ,tend to
add to or detract from the general
appearance or condition of the dis-
tract. In the event a permit be
granted the Council may prescribe
the distance from the street that
such structure may be erected and
provide for any other reasonable
rules or regulations as a condition
precedent to the erection, alteration,
repairing or occuping of such struc-
ture as said Council may, by resolu-
tion or ordinance, deem necessary or
advisable to impose.'
Par. 34. Penalty. Section 4. Any
building or structure erected, alter-
ed, repaired or used in violation of
any of the provisions hereof, or in
violation of the restrictions con-
tained within any permit granted, or
without a permit being granted, shall
be deemed a nuisance and any per-
son, firm or corporation causing the
same shall be fined not to exceed
$100.00 or imprisoned not to to ex-
ceed 30 days in jail or such nuis-
ance may . be abated by an action
in the district court of Dubuque
County, Iowa, or both such fine may
be imposed and the nuisance abated
as herein provided.
Par. Section 5. Immediate-
ly upon the passage of this ordin-
ance the City Clerk shall certify the
same together with a plat of the dis-
trict to the County Recorder of Du-
buque County, Iowa, to be by him
recorded, as provided by law.
Section 6. Publication. This or-
dinance being deemed urgent and in
the interest of public health„ peace
and general welfare shall be in force
and effect from and after its final
passage and adoption by the City
Council and publication as provided
by law.

a sanitary sewer in Wilbur Street,
for construction of a sanitary sewer
in Farley Street, Thomas Place,
Eagle and Viola Streets, and acting
on any other business that may come
before the meeting.
Petition of the Chicago, Burlington
& Quincy R. R. Co., stating that-it is
the owner of part of Block K & M,
Booth's Add., known as Lot 16, Block
K, Lots 1 -2 -3 -4 and 5 in Block M, and
the Company requests that that part
of the alley lying east and adjacent

That the petitioner herewith ten-
ders the sum of $88.52 in payment

Whereas, resolutions of necessity
for the improving of the streets
herein described have been duly ad-
opted by the City Council of the

prepared, approved and adopted and
resolutions ordering the construc-
tion of such improvements have
been adopted and approved by said

Whereas, it is deemed advisable
by this Council to amend the speci-

Gentlemen: In accordance with
your instructions and our advertise-
ment, bids were received at 10 A.
M. Friday, May 24th, for the con-
struction of a 6 inch sewer in Far-
ley Street from High Bluff Street
to Thomas Place, a 6 inch sewer in
Eagle Street from Thomas Place to
a point 580 feet westerly therefrom
and an 8 inch sewer from the afore-
said mentioned point to Viola
Street and a 6 inch sewer from
Eagle Street to a point 98 feet south
of Eagle Street on Viola Street.
The resolution drawn up starting
this improvement was erroneously
prepared inasmuch as it stated that
an 8 inch sewer would be construct-
ed the full length of the improve-
ment, also . a mistake was made in
preparing the proposal sheets for
the contractors in that two of the
proposals called for 1383 feet of 6
inch sewer and that of Uhlrich -Paley
Company calling for 1383 feet of 8
inch sewer, whereas bids should
have been called for on the basis of
896 feet of 6 inches sewer and 487
feet of 8 inch sewer and I therefore
recommend that all bids be rejected
and that the improvement be re-
started by drawing up a correct res-
olution to start the improvement and
that all bids be rejected as shown
on the accompanying tabulation.

has become necessary and advisable
to amend such resolutions insofar
as the same relate to the construc-
tion of said improvements in accord-
ance with specifications theretofore

cil of the City of Dubuque.
Gentlemen: This is to advise you
that I have negotiated settlements in
certain matters involving claims for
damages against the City and I re-
quest your approval of the same:
Julia Kemler and Minnie L. Kem-
ler vs. City of Dubuque. This action
involved a claim for damages to prop-
erty. The amount asked for was
$725.00. I have agreed to settle the
same for $200.00 and pay the costs.
Janet Peters and Henry Peters vs.
City of Dubuque. These actions were
brought to recover damages sustain-
ed by Janet Peters on October 24th,
1928, by falling upon a defective side-
walk on East 14th Street, near Jack-
son Street. One claim was brought
for damages for the child in the sum
of $5,000.00 and the other was
brought by the father for expenses
incurred as a result of the injuries
to the child in the sum of $500.00.
I have agreed to settle these two
eases for the sum of $400.00 and pay
the costs.
A claim for a broken arm was
made by Mrs. A. Busch. The acci-
dent occurred on February 24th, 1929,
on Rose Street near Alta Vista. I
have agreed to pay the doctor bill
and x -ray examinations which
amount to $71.50 as shown by bill
hereto attached.
Maud Carlson vs. City of Dubuque.
This case was brought to recover
damages in the sum of $10,000.00 on
account of injuries sustained by the
plaintiff on November 1, 1926, by fall-
ing over a cellar door abutting the
property of the Hollenagel GEocery
Store at 22nd and Central Avenue.
The case was tried to the jury and
resulted in a verdict against the City
in the sum of $800.00.
I would respectfully recommend
that warrants be drawn in favor of
Special Session,
E. E. Bowen, attorney for Kemlers,
in the sum of $200.00; in favor of
J. J. Kintzinger, attorney for Janet
and Henry Peters in the sum of
$400.00; in favor of A. Busch in the

Council met at 7:30 P. M.

Mayor Andelfinger read the call
and stated that services thereof had
been duly made and that this meet-
ing is called for the purpose of levy-
ing special assessments for the im-
provements of Groveland Street,
Brunswick Street and O'Neill Street,
a hearing on plans and specifications
and form of contract for sanitary
sewer in Saunders Street and acting
on any other business that may
come before the meeting.
Petition of St. Patrick's Church,
by J. J, Hanley et al, requesting the
adoption of a restricted residence
district ordinance on Iowa Street
and Main Street from Fourteenth
Street to Seventeenth Street includ-
ing therein the area between the al-
ley east of Iowa Street and the alley
west of Main Street.
Councilman McEvoy moved to sus-
pend the rules for the purpose of al-
lowing any one present in the Coun-
cil Chamber to address the Council.

Labor Congress relative to wages
paid for unskilled labor, stating that
while the City pays 50 cents per hour
which is a fair wage, that contract-
ors on street work pay 35 cents per
hour and that some cities have it
stipulated in their specifications that
contractors pay the highest wages
and asking the City Council to do
the same presented and read.
Councilman McEvoy moved to re-
ceive and file the petition as the City
has no right to dictate what wages
contractors should pay laborers. Sec-
onded by Councilman Jansen. Car-
ried by the following vote:

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April 19 •
or any time before that date at the
option of the City the sum of $200.00
with interest thereon at the rate of
5 per cent per annnum, payable on
the presentation and surrender of
the interest coupons hereto attached,
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 31st day of May, 1929.
This bond is one of a series of 11
bonds, 10 for $200.00 each and num-
bered from 1844 to 1853 inclusive
and one for $96.89, numbered 1854,
all of like tenor and date and issued
for the purpose of improving Grove -
land Street from the west property
line of Burden Street to the east
property line of Brunswick Street,
and described in said resolution;
which cost is assessable and levied
along said improvement, and is made
by law a lien on all abutting or ad-
jacent propert, and payable in ten
annual installments, with interest on
all deferred payments at the rate of
5 per cent per annum, and this bond
is payable only out of the money de-
rived from the collection of said spe-

cial tax, and said money can be used
for no other purpose. And it is here-
by certified and recited that all the
acts and condition and things re-
quired to be done precedent to and
in the issuing of this series of bonds,
have been done, happened and per-
formed in regular and due form as
required by said law and resolution;
and for the assessments, collectons
and payments hereon of said special
tax, the faith and diligence of said
City of Dubuque are hereby irrevoc-
ably pledged. In witness whereof the
City of Dubuque by its City Council
has caused this bond to be signed by
its Mayor and countersigned by its
City Clerk, with the seal of said City
affixed this 31st day of May, 1929,
and has authorized the use of their
fac- simile signatures to the interest
coupons hereto attached.

Bonds.
Whereas, the contract hertofore
entered into by the City of Dubuque
for the improvement of Groveland
Street, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City, and the City
Engineer has computed the cost and
expense thereof to be $2,096.89 and
Whereas, public notice as provided
by law has been published by the
City Clerk stating the intention of
the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined. Now therefore
Be it resolved by the City Council
of the City of Dubuque that to pro-
vide for the cost of improving Grove -
land Street from the west property
line of Burden Street to the east
property line of Brunswick Street,
there be issued improvement bonds

wick Street from the north property
line of O'Neill Street to the City
Limits, there be issued improvement

Said bonds shall be issued under the
provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 31st day of May, 1929; shall

be numbered from 1819 to 1833 in-
clusive and shall be divided into 10
series of which the bond numbered

constitute the ninth series and shall
be payable the 1st day of April, A.

shall constitute the tenth series and
shall be payable the 1st day of April,
A. D. 1939.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessments levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City
of Dubuque. Said bonds shall be

bered from 1819 to 1832 inclusive

for the purpose of improving Bruns-
wick Street from the north property
line of O'Neill Street to the City
Limits, and described in said resolu-
tion; which cost is assessable and
levied along said improvement, and
is made by law a lien on all abutting
or adjacent property, and payable in
ten annual installments, with inter-
est on all deferred payments at the
rate of five per cent per annum, and
this bond is payable only out of the
money derived from the collection
of said special tax, and said money
can be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payments
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of Du-
buque by its City Council has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,

An Ordinance amending an ordin-
ance entitled "An Ordinance regulat-
ing street traffic within the City of
Dubuque, prescribing rules and regu-
lations for the use of streets, alleys,
boulevards and avenues by motor
and other vehicles; providing a pen-
alty for the violation of the provis-
ions hereof, designating this ordin-
ance as the traffic ordinance of the
City of Dubuque and repealing Or-
dinances Nos. 102, 122 and 125 here-
tofore adopted by the City Council
of the City of Dubuque," by adding
to rule 61 paragraph 889, section 2,
certain rules and regulations for the
observance of automatic traffic sig-
nals."
Be it ordained by the City Council
of the City of Dubuque:
Par. 36. Section 1. That an ordin-
ance entitled "An Ordinance regulat-
ing street traffic within the City of
Dubuque, prescribing rules and regu-
lations for the use of streets, alleys,
boulevards and avenues by motor

and other vehicles; providing a pen-
alty for the violation of the provis-
ions hereof, designating this ordin-
ance as traffic ordinance of the City
of Dubuque and repealing Ordin-
ances Nos. 102, 122 and 125 hereto-
fore adopted by the City Council of
the City of Dubuque" be and the
same is hereby amended by adding
to rule 1 of paragraph 889, section 2,
the following:
"The driver or operator of vehicles
approaching automatic signal devices
or lights shall bring his vehicle to a
complete stop before traversing an
intersection when the red light is dis-
played in the direction from which
he is proceeding. If the amber light
is displayed' he shall get ready to
stop his vehicle. If the green light
is displayed he shall proceed. In
other words, the green light is a sig-
nal to go; the amber light is a sig-
nal to get ready to stop; and the red
light is the signal to stop. No vehicle
shall be permitted to cross an inter-
section when either the red or the
amber lights are displayed. At cor-
ners where signal lights are in
operation no left hand turns are per-
mitted. Right hand turns may be
made at such corners only when the
green light is displayed in the direc-
tion the vehicle is traveling. Pedes-
trans shall, as far as possible, obey
these rules in crossing street inter-
sections."
Par. 37. Section 2. That hereafter
rule 61 of paragraph 889, section 2,
as amended, will read as follows:
"Rule 61. Whenever automatic sig-
nal devices are manipulated for the
purpose of directing traffic on the
streets, such signals shall be com-
piled with by the operators of all
vehicles, and a failure to obey the
same shall subject the offender to
the fine as in this ordinance pro-
vided.
The driver or operator of vehicles
approaching automatic signal devices
or lights shall bring his vehicle to a

is displayed he shall get ready to
stop his vehicle. If the green light is

Par. 38. Section 3. That this ordi-
nance being deemed urgent and of
immediate necessity shall be in force
and effect from and after its final
passage, adoption and approval by
the City Council and publication as
provided by law.

Resolution granting Interstate
Power Co. (successors to Dubuque
Electric Co.) the right to abandon
the operation of its street railway
upon Central Avenue from 13th
Street to 3rd Street, on West 3rd
Street to Iowa Street, on Iowa
Street to West 2nd Street and on
West 2nd Street to Main Street; and
to replace double track on Central
Avenue from 13th Street to 22nd
Street with a single track; permit-
ting the installation of a turn -out at
19th and Central Avenue; and pre-
scribing the conditions upon which
such permission is granted.
Whereas by an ordinance duly ad-
opted on February 14th, 1922, the
Dubuque Electric Co. was granted a
franchise to maintain and operate
its lines of street railway over and
across certain streets of the City of
Dubuque and was not permitted to
abandon the same without the con-
sent of the City Council of said
City; and
Whereas as Interstate Power Co.,
the successor to said Dubuque Elec-
tric Co., has petitioned the City
Council for permission to abandon
its line of street railway on Central
Avenue from 13th Street to 3rd
Street, on West 3rd Street to Iowa
Street, on Iowa Street to West 2nd
Street, and on West 2nd Street to
Main Street, and this Council, after
full consideration, finds' that there
is no objection to the granting of
the permission requested; and
Whereas said Interstate Power
Co. has also petitioned this Council
for permission to replace the double
track of street railway on Central
Avenue from 13th Street to 22nd
Street with a single track and this
Council likewise finds that there is
no objection to the granting of such
permission; and
Whereas said Interstate Power Co.
has also' requested permission to in-
stall and maintain a turn -out at 19th
and Central Avenue to which like-
wise there appears to be no objec-
tion. Now, therefor
Be it resolved by the City Council
of the City of Dubuque:
Par. 1. That the Interstate Pow-
er Co. be and it is hereby granted
permission to abandon the operation
of its street railway upon and along
the following streets, to wit: Cen-
tral Avenue from 13th Street to 3rd
Street; on West 3rd Street from
Central Avenue to Iowa Street; on
Iowa Street from West 3rd Street
to West 2nd Street; on West 2nd

Street from Iowa Street to Main
Street.
Par. 2. That said Company be
further authorized to replace the
double track of street railway on
Central Avenue from 13th Street to
22nd Street with a single track and
abandon the operation of the double
track now located thereon.
Par. 3. That said Company be
further authorized to install and
maintain a turn out at 19th and
Central Avenue for the operation of
its street railway system.
Par. 4. That as a condition to
the permit hereby granted, said
Company shall remove from the
streets designated in Par. 1 hereof
the ties, rails, trolley wires and oth-
er appurtenances. In that portion
of Central Avenue from 13th to 3rd
Streets said Company shall supply
at its own expense sufficient crushed
stone as may be necessary by rea-
son of the removal of ties and rails
in said street to bring such portion
of the street up to sub -grade pre-
paratory for the improvement of
said street. Upon the other streets
designated in said Par. 1, said Com-
pany shall reconstruct the pavement
disturbed by the removal of ties and
rails to conform to the pavement
now in place, such work to be done
in a good and substantial manner
and under the supervision of the
CityEngineer. Upon the street des-
ignated in Par. 2 hereof said Com-
pany shall remove the double track,
and the ties and furnish, at its own
expense, whatever crushed rock is
necessary on account of the remov-
all of such rails and ties to bring
such portion of the street up to
proper sub -grade and install a
single track along said street of the
materials and in the manner pro-
vided for by plans and specifications
prepared therefor by the City Man-
ager, all of such work to be done
under the supervision of the City
Engineer. In the construction of
the turn -out at 19th and Central Av-
enue such work shall be done in ac-
cordance with plans and specifica-
tions prepared therefor and under
the supervision of the City Engineer.
Par. 5. That nothing herein shall
be construed to relieve said Com-
pany from paving its legal propor-
tion of the special assesments which
will be levied to pay the cost of the
improvement of Central Avenue
from 13th Street to 22nd Street.
Par. 6. That any and all rights
the Dubuque Electric Company or
the Interstate Power Co. or its suc-
cessors or assigns have heretofore
had to operate a street railway up-
on the streets herein named from
which it is given permission to re-
move its appurtenances and aban-

don the operation of its railway
thereon shall, from the adoption
hereof and from the time such op-
eration is discontinued, cease and
determine.
Par. 7. That said Company shall
alone be responsible and liable for
any damages that may occur to per-
sons or property on. account of the
removal of street railway appurten-
ances herein provided for while such
work is being performed and it shall
hold the City of Dubuque harmless
from any such damages.
Par. 8. That this resolution shall
be in force and effect from and af-
ter its passage and adoption by the
Gity Council and the acceptance of
the. Interstate Power Co. shall be
inferred from its abandonment of its
lines of railway and the commence-
ment of work of removing the rails
and ties from the streets, a copy
of this resolution shall be served
upon said Company by the City
Clerk.
