Council met at 7:30 p. m.

Mayor Andelfinger stated that this
is the regular meeting of the City
Council for the purpose of transact-
ing such business as may regularly
come before the meeting.

Subject: Acceptance of sewer in
May Place.
The undersigned hereby certifies
that the contract for an eight inch
tile sanitary sewer in May Place
from the present manhole in Cornell
Street westerly about 150.5 feet,
Uhlrich -Paley Company, contractors,
has been completed.
I further certify that this work has
been done in accordance with the
plans and specifications and stiupla-
tions of the contract and I would
therefore recommend its acceptance
by the Council.

Resolution No. 303 -29
A RESOLUTION accepting improve-
ment and directing the clerk to
publish notice.
Whereas, the contract for the con-
struction of an eight inch tile sani-
tary sewer in May Place from the
present manhole in Cornell Street
westerly about 150.5 feet, has been
completed and the City Manager has
examined the work and filed his cer-
tificate stating that the same has
been completed according to the
terms of the contract, plans and
specifications and recommends its
acceptauce, now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Manag-
er be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or parcels of real estate sub-
ject to assessment for said improve-
ment and file the same in the office
of the City Clerk subject to public
inspection and said Clerk shall up-
on receipt of such plat and schedule
publish the notice of the Council's
intention to levy special assessments
therefor, as required by law.
Be it further resolved that the City

Treasurer be and he is hereby di-
rected to pay to the contractor from
the funds to be realized from the
sale of improvement bonds issued
upon the above described improve-
ment an amount equal to the amount
of his contract, less any retained
percentage provided for therein.

Be it resolved by the City Council
of the City of Dubuque, that the City

the permanent continuance of the
Governor Greys, now known as "Co."

John Cunningham addressed the
Council on behalf of the citizens of
Dubuque and various civic organiza-
tions of the City relative to the pe-
tions signed by Alfie Dietz, et al,
asking the City Council to call a
special election to submit to the
voters the matter of erecting and
equipping a memorial building, and
presenting said petitions to the
Council for their action.
Petition requesting the City Coun-
cil of the City of Dubuque to call a
special election for the purpose of
voting upon the question of erect
ing and equipping a municipal mem-
orial building and acquiring lands
for such purposes and issuing bonds
to pay for the same.
To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: The undersigned, be-
ing electors of the City of Dubuque,
Dubuque County, Iowa, hereby peti-
tion your honorable body to call a
special election in and for said City
of Dubuque for the purpose of sub-
mitting there at the question of erect-
ing and equipping a municipal mem-
orial building to commemorate the
services rendered by soldiers, sail-
ors and marines of the United States
and other purposes as provided in
Chapter 33 of the Code of Iowa,
1927, and to acquire lands for such
purpose and issue bonds to pay for
the same, said question to be sub-
stantially as follows:
"Shall the City of Dubuque, Iowa,
erect and equip a municipal memor-
ial building as provided in Chapter
33 of the Code of Iowa, 1927, and
issue bonds in the sum of $385,000.00
to cover the expense of the same ?"
Councilman McEvoy moved that
the names on the petitions be can-
vassed. Seconded by Councilman
Schuckert. Carried by the following
vote:

The petitions having been can-
vassed it was found that the same
contained sufficient number of sig-
natures to warrant the submission
of the question to the voters:

following vote:

Councilman Meuser moved that
further action on this matter be post-
poned to Thursday, June 6th, 1929,
and that a meeting be called at 7:30
P. M. for that purpose. Seconded
by Councilman McEvoy. Carried by
the following vote:

Mr. Marty addressed the Council
relative to remodeling Dr. Guthrie's
building into offices. Mr. Marty be-
ing informed to submit plans and
specifications for the same to the
Council for their action.
Mr. Scheppley addressed the Coun-
cil relative to the petition restrict-
ing the district from 14th to 17th
Street on Iowa and Main Street and
also objecting to the passage of the
proposed ordinance.
Councilman Meuser moved that
action be postponed on this ordin-
ance and that the same be laid over
for future consideration. Seconded
by Councilman McEvoy. Carried by
the following vote:

men McEvoy, Meuser and Schuckert.

J. F. Stampfer addressed the Coun-
cil relative to an assessment levied
against his property in the sum of
$73.18 for the improvement of O'Neill
Street.
Councilman Schuckert moved that
this matter be referred to the Coun-
cil to view the grounds. Seconded
by Councilman McEvoy. Carried by
the following vote:
Yeas —Mayor Andelfinger, Council-
men McEvoy, Meuser and Schuckert.

Absent — Councilman Jansen.
In the year 1920 Barbara Kieffer
acquired a piece of property with a
street assessment against the same
in the sum of $67.00 and that the
same went to tax sale and the City
acquired a deed for same. City So-
licitor Czizek recommended that the
City accept the sum of $25.00 as
settlement for the same and that
when same is paid that the City give
a quit claim deed to said Barbara
Kieffer.
Councilman Schuckert moved that
the recommendation of the City So-
licitor be approved and that the City
Treasurer be instructed to accept
the sum of $25.00 in full for delin-
quent assessment and upon payment

of same surrender the deed now held
by the City. Seconded by Council-
man McEvoy. Carried by the fol-
lowing vote:

and call of the special meeting and
stated that service thereof had been
duly made.
Notice and Call of Special Meeting
of the City Council of the
City of Dubuque
To Councilman:
You are hereby notified and there
is hereby called a special meeting
of the City Council of the City of
Dubuque to be held at 7:30 o'clock
P. M. on Thursday, June 6, 1929, at
the Council Chamber. At this meet-
ing there will be introduced and pro-
posed for passage and adoption a
resolution entitled "Resolution call-
ing a special election for submission
of question of erecting and equiping
a municipal memorial building and
issuing bonds in the sum of $385,000
to cover the expense of same." Such
other business may be transacted at
this meeting which may properly
come before a regular meeting of
the City Council.

Whereas, John Stuber, heretofore
appointed City Clerk of the City of
Dubuque, is incapacitated on account
of illness to perform his duties as
such Clerk and it is necessary and
advisable that a City Clerk be im-
mediately appointed to perform the
duties of such office: now therefore
Be it resolved by the City Coun-
cil of the City of Dubuque, Iowa,
that said John Stuber be and he
is hereby relieved of all duties as
such City Clerk and that J. J. Shea
be and he is hereby appointed City
Clerk in and for said City of Du-
buque and directed and authorized
to do and perform all acts neces-
sary to be done under the laws of
Iowa and of the ordinances of the
City of Dubuque as such City Clerk,
including among other things, the
preparation of all proceedings, the
publishing of all notices and the
signing, attesting and recording of
all ordinances and resolutions passed
and adopted by this Council until
the further pleasure of this Council.

RESOLUTION calling a special elec-
tion for submission of question of
erecting and equipping a munici-
pal memorial building and issuing
bonds in the sum of $385,000.00 to
cover the expense of same.
Whereas, a petition reading:
To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: The undersigned, be-
ing qualified electors of the City of
Dubuque, Dubuque County, Iowa,
hereby petition your honorable body
to call a special election in and for
said City of Dubuque for the pur-
pose of submitting thereat the ques-
tion of erecting and equipping a
municipal memorial building to com-
memorate the services rendered by
soldiers, sailors and marines of the
United States and other purposes as
provided in Chapter 33 of the Code
of Iowa, 1927, and to acquire lands
for such purpose and issue bonds
to pay for the same, said question
to be substantially as follows:
"Shall the City of Dubuque, Iowa,
erect and equip a municipal mem-
orial building as provided in Chap-
ter 33 of the Code of Iowa, 1927,
and issue bonds in the sum of
$385,000.00 to cover the expense
of the same ?"
has been filed with the Mayor and
this City Council of the City of Du-
buque, in Dubuque County, Iowa;
and
Whereas, said petition has been
examined and found to be signed by
not less than ten per cent of the
qualified electors of said City as
shown by the poll lists in the last
preceding regular municipal election,
said petition is in all other respect
sufficient and complies with the pro-
visions of Section 484 of the Code
of Iowa, and this City Council has
jurisdiction of said petition and the
request evidenced by said petition
should be granted; and
Whereas, it is deemed to the best
advantages of said City that a mem-
orial building be erected and equip-
ped and suitable grounds for a site
therefor be acquired; and
Whereas, for the purpose of pro-
ducing funds to pay the cost of
erecting and equipping said memor-
ial building and acquiring lands for
a site therefor it is necessary that
bonds of said city in the amount of
$385,000 be issued as provided by
Chapter 33 of the Code of Iowa, as
amended; now, therefore,
Be it and it is hereby resolved by
the City Council of the City of Du-
buque, Dubuque County, Iowa, as
follows:
Section 1. That the petition as
hereinbefore referred to and as filed
with this City Council, requesting
a special election on the proposition
of erecting and equipping a munici-
pal memorial building and assuing
bonds of said City in the sum of
$385,000 to pay the cost of same,
bears the signatures of not less than
ten per cent of the qualified elect-
ors of said City as shown by the poll
lists in the last preceding municipal
election.
Sec. 2. That a special election
be and is hereby called to be held
in and for .said City on the 8th day
of July, 1929, from seven o'clock A.
M. until eight o'clock P. M., at which
election there shall be submitted to
the qualified electors of said City to
be by them voted upon, the propo-
sition of erecting and equipping a
municipal memorial building as pro-
vided in Chapter 33 of the Code of
Iowa, 1927, and issuing bonds of
said City in the sum of $385,000 to
cover the expense of the same.
Sec. 3. That said election shall
be held in the several voting pre-
cincts of said City, the boundaries
of which shall be as delimited by Or-
dinance No. 159 of said City. The
polling places within the respective
voting precincts shall be as follows:
1st precinct —At the Grandview
Avenue Fire Station.
2nd precinct —At the Washington
Junior High School.
3rd precinct —At the Franklin
School.
4th precinct —At the Court House.
5th precinct —At the Lincoln
School.
6th precinct —At the Irving School.
7th precinct —At the City Hall.
8th precinct —At the Chamber of
Commerce.
9th precinct —At the 18th Street
Fire Station.
10th precinct —At the Central
Junior High School.
11th precinct —At 1932 Central
Avenue.
12th precinct —At the Fulton

Section 4. That at said election
voting machines will be used and
the ballots for the aforesaid propo-
sition shall be prepared by the City
Clerk on yellow colored paper in sub-
stantially the following form, to wit:
"Shall the City of Dubuque, Iowa,
erect and equip a municipal mem-
orial building as provided in Chap-
ter 33 of the Code of Iowa, 1927,
and issue bonds in the sum of
$385,000 to cover the expense of the
same ?"
Said ballots shall be prepared in
such size as will permit the same
to be inserted in the proper place
in each voting machine. Voters shall
be instructed as to the use of such
machines.
Sec. 5. That the Mayor and City
Clerk are authorized, empowered and
instructed to issue a notice of the
submission of said proposition at
said election, and of the time and
places thereof by publication there-
of in the Telegraph- Herald and
Times - Journal, a legal newspaper
printed and published in said City,
such publication to be made one each
week for at least four consecutive
weeks and the last of such publica-
tion shall be not more than twenty
days nor less than five days before
the date of said election. Such no-
tice shall be substantially the fol-
lowing form:

Public notice is hereby given that
at a special election in and for the
City of Dubuque, Iowa, to be held
on 8th day of July, 1929, from seven
o'clock A. M. to eight o'clock P. M.,
there will be submitted to the quali-
fied electors of said city, to be by
them voted upon, the proposition of
erecting and equipping a municipal
memorial building as provided in
Chapter 33 of the Code of Iowa,
1927, and issuing bonds of said City
in the sum of $385,000 to cover the
expense of the same.
At said special election voting
machines will be used for the sub-
mission of the aforesaid proposition
and ballots prepared therefor- will
have printed thereon the proposition
in substantially the following form:
"Shall the City of Dubuque, Iowa,
erect and equip a municipal memor-
ial building as provided in Chapter
33 of the Code of Iowa, 1927, and
issue bonds in the sum of Three

The said special election will be

RESOLUTION providing for the is-
suance of public improvement
bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Carlotta
Street hereinafter described has been
completed and said improvement has
been accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $1,341.83.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
thereto, and all objections filed there-
to have been considered and de-
termined.
Now therefor, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Carlotta Street from the
east property line of Alpine Street
to the west property line of Alta
Vista, these be issued improvement
bonds to the amount of $1,341.83.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 10th day of June, 1
shall be in the denominations of
$100.00, except that there shall be
one bond to the amount of $41.83.
They shall be numbered from 1855
to 1868 inclusive and shall be divid-
ed into 10 series of which the bond
numbered 1855 shall consttiute the
first series and shall be payable the
1st day of April, A. D. 1930; the
bond numbered 1856 shall constitute
the second series and shall be pay-
able the 1st day of April, A. D. 1931;
the bond numbered 1857 shall consti-
tute the third series and shall be
payable the lst day of April, A. D.
1932; the bonds numbered 1858 and
1859 shall constitute the fourth ser-
ies and shall be payable the 1st day
of April, A. D. 1933; the bonds num-
beerd 1860 and 1861 shall constitute
the fifth series and shall be payable
the 1st day of April, A. D. 1934; the
bonds numbered 1862 and 1863 shall
constitute the sixth series and shall
be payable the 1st day of April, A. D.
1935; the bonds numbered 1864 and
1S65 shall constitute the seventh ser-
ies and shall be payable the 1st day
of April, A. D. 1936; the bond num-
bered 1866 shall constitute the
eighth series and shall be payable
the lst day of April, A. D. 1937; the
bond numbered 1867 shall constitute
the ninth series and shall be payable
the 1st day of April A. D. 1938; the
bond numbered 1868 shall constitute
the tenth series and shall be payable
the 1st day of April, A. D. 1939.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessments levied for said im-

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April 19 ..... _..;
or any time before that date at the
option of the City the sum of $100.0Q.
with interest thereon at the rate of
5 per cent per annum, payable on
the presentation and surrender of
the interest coupons hereto attached,
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. The bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 10th day of June, 1929.
This bond is one of a series of 14
bonds, 13 for $100.00 each and num-
bered from 1855 to 1867 inclusive
and 1 for $41.83, numbered 1868, all
of like tenor and date, and issued
for the purpose of improving Car-
lotta Street from the east property
line of Alpine Street to the west
property line of Alta Vista Street,
and described in said resolution;
which cost is assessable and levied
along said improvement, and is made
by law a lien on all abutting pro-
perty, and payable in ten annual in-
stallments, with interest on all de-
ferred payments at the rate of five
per cent per annum, and this bond
is payable only out of the money de-
rived from the collection of said spe-
cial tax, and said money can be used
for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payments
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged. In witness whereof the
City of Dubuque by its City Coun-
cil has caused this bond to be signed
by its Mayor and countersigned by
its City Clerk, with the seal of said
City affixed this 10th day of June,
1929, and has authorized the use of
their fac - simile signatures to the in-
terest coupons hereto attached.

Be it further resolved that as fast
as funds allow beginning with the
second year after the payment of in-
terest due, these bonds shall be
called and retired in the same or-

Gentlemen: The undersigned be-
ing the owners of all the property
subject to assessment for the im-
provement herein requested, hereby
petitions your Honorable Body to
cause to be paved Spruce Street
from Wilbur Street to Jefferson
Street, said improvement to be con-
structed in the same manner, at the
same price and by the James F. Lee
Paving Company under a contract to
be awarded to said James F. Lee
Paving Company, the same to be
done and constructed under the same
specifications as have heretofore
been prepared for the improvement
of Spruce Street from Julien Avenue
to Wilbur Street. The undersigned
further herein expressly waive the
preparation and adoption by the City
Council of the City of Dubuque of
all and every preliminary proceeding
by law required to be taken for the
construction of public improvements
and relieve the City Council of the
duty to adopt such proceedings and
agree that a contract be awarded to
James F. Lee Paving Company with-
out further advertising for bids, the
contract price to be the same as that
provided for in the contract for the
improvement of Spruce Street from
Julien Avenue to Wilbur Street, the
same specifications and plans to be
used for both improvements. The
undersigned further agree that when
such improvements have been com-
pleted and accepted that they and
each of them will pay the cost there-
of as the same may be levied against
their respective properties as special
assessments either at one time or
on the basis of 10 annual equal in-
stallments in the manner provided by
law. The signing of this petition
and waiver shall foreclose forever
the undersigned from objecting to
any errors, irregularities or illegal-
ities connected with the awarding
of said contract or preliminary there-
to.

Whereas, petitions and waivers
have been signed by all of the pro-
perty owners to be affected by the
improvement of Spruce Street from
Wilbur Street to Jefferson Street
having been filed , with the City
Council of the City of Dubuque re-
questing that said street be perman-
ently improved by paving with con-
crete pavement in the same manner
and under the same specifications
as have been heretofore prepared
for the improvement of Spruce
Street from Julien Avenue to Wil-
bur Street and that a contract there-
for be awarded to James F. Lee Pav-
ing Company for the same amount
for which said improvement of

Now therefor be it resolved by the
City Council of the City Dubuque
that said petition and waiver be
made a matter of record and that
pursuant thereto and upon its own
motion, this Council does hereby or-
der that said improvement, namely
t11e paving of Spruce Street from
Wilbur Street to Jefferson Street be
constructed of the same materials
and in the same manner and for the
same price and according to the
same plans and specifications hereto-
fore adopted for the improvement
of Spruce Street from Julien Avenue
to Wilbur Street.
Be it further resolved that said
contract be awarded to James F.
Lee Paving Company which com-
pany shall be required to furnish a
performance and maintenance bond
in the same manner as is required
under other contracts and said con-
tractor shall be paid in cash to be
realized from the sale of public im-
provement bonds after the comple-
tion of the work and its acceptance
by the Council, the intention herein
being that said contractor shall be
paid at the same time and in the
same manner as is provided for in
the contract heretofore awarded to
said James F. Lee Paving Company

Gentlemen: At the Council meet-
ing held May 6th, 1929, a verbal pro-
test of Mr. George W. Holmes, own-
er of the west 80 feet of subdivision
of lots 14 and 15 Bush's Subdivision,
protesting against his assessment for
the construction of sanitary sewer in
Burns and Oak Streets was referred
to your City Manager for report.
The total amount of Mr. Holmes'
assessment for the construction of
said sewer is $202.71 and your City
Manager inspected this proposition
on the ground and finds that Mr.
Holmes' property is accessible and
can be connected to the sewer with
perhaps some rock excavations as
is necessary for all property in this
district and that ordinarily his as-
sessment is a proper one inasmuch
Mr. Holmes has a frontage of 95.8
feet and with a $3.00 assessment lim-
itation on that frontage the assess-
ment could be made up to $287.40.
Your City Manager has made an
investigation of damage done to plas-
tering inside the house due to blast-
ing while constructing the sewer and
wishes to recommend that an allow-
ance be made Mr. Holmes on his
assessment of $50.00 on account of
said damage and that the City fur-
nish the air compressor without cost
to Mr. Holmes when he desires to
make a connection to the sewer.

Gentlemen: I am attaching here-
to a letter received from the U. S.
Engineers in regard to a proposed
high line which the Interstate Power
Company proposes to build over the
Mississippi River from the tower
now located on the island and to
extend to East Dubuque, said cable
to have a clearance at the lowest
point of 65 feet above high water.
Immediately upon receipt of this
communication I took the matter up
with Mr. John Kerper of the Dock
Commission and it is his opinion that
if a 65 foot clearance is maintained
that no objection should be made to
the crossing and I therefore recom-
mend that the U. S. Engineers be so
informed.

district all that territory lying with-

Beginning at West 14th Street at
the west side of the alley between
Central Avenue and Iowa Street,
thence running northerly along the
west side of said alley to the south
side of West 17th Street, thence
westerly along the south side of
West 17th Street to the east side
of the alley between Locust and
Main Streets, thence southerly along
the east side of said alley to the
north side of West 14th Street, and
thence easterly along the north side
of West 14th Street to the place of
beginning; providing that no build-
ing or structure, except residences,
school houses, churches and other
similar structures shall hereafter be
erected, altered, or repaired or oc-
cupied within said district without
first securing from the City Council

Par. 40. Structures permitted
therein. Section 2. That hereafter
no bill board, sign board, poster

tures shall be erected, altered, re-
paired or occupied within said dis-
trict without first securing from the
City Council of the City of Dubuque
a permit therefor.
Par. 41. Permit. Section. 2. Be-
fore any building or structure, other
than a residence, school house,
church or building of a similar na-
ture, can be erected, altered, repaired
or occupied within said district, the
owner or lessee of the real estate
upon which the same is to be erect-
ed, altered, repaired or . occupied
shall file a written application with
the City Council for a permit there-
for and accompany such application
with a plan drawn to scale showing
the character and dimensions of the
same; the location and description
of the lot; the kind of buildings or
structures located within 150 feet in
all directions therefrom; the purpose
for which the building or structure
is to be used; the materials out of
which the same is to be built and
the cost thereof when completed;
and shall furnish said Council any
other additional facts or information
which it may request. When the
Council has been furnished with all
of the necessary information upon
which to act, it shall either grant or
refuse a permit within ninety (90)
days from the time the application
has been filed and, in doing so, it
shall take into consideration wheth-
er or not the building or structure
to be erected, altered, repaired or
occupied constitutes a fire hazard to
adjacent property; whether or not
the same is a menace to health or
safety of the occupants of property
within the district; whether or not
the same is or will become unsight-
ly or an obstruction to the views
in the use of the street; and every
other fact or circumstance which
will tend to add to or detract from
the general appearance or condition
of the district. In the event a per-
mit be granted the Council may pre-
scribe the distance from the street
that such structure may be erected
and provide for any other reasonable
rules or regulations as a condition
precedent to the erection, alteration,
repairing or occuping of such struc-
ture as said Council may, by reso-
lution or ordinance, deem necessary
or advisable to impose.
Par. 42. Penalty. Section 4. Any
building or structure erected, alter-
ed, repaired or used in violation of
any of the provisions hereof, or in
violation of the restrictions contained
within any permit granted, or with-
out a permit being granted, shall be
deemed a nuisance and any person,
firm or corporation causing the same
shall be fined not to exceed $100.00
or imprisoned not to exceed 30 days
in jail or such nuisance may be abat-
ed by an action in the district court
of Dubuque County, Iowa, or both
such fine may be imposed and the
nuisance abated as herein provided.
Par. 43. Section 5. Immediately
upon the passage of this ordinance
the City Clerk shall certify the same
together with a plat of the district
to the County Recorder of Dubuque
County, Iowa, to be by him record-
ed, as provided by law.
Section 6. Publication . This or-
dinance being deemed urgent and in
the interest of public health, peace
and general welfare shall be in
force and effect from and after its
final passage and adoption by the
City Council and publication as pro-
vided by law.

Whereas, there is prevalent in the
City of Dubuque a disease among
dogs known as rabies which is a
menace and dangerous to the public
health and, in order to prevent the
spread of said disease and to pre-
serve the public health, it is deemed
necessary and advisable by the
Board of Health of said city to pro-
mulgate a rule and regulation rela-
tive to dogs running at large; now
therefore
Be it resolved by the Board of
Health of the City of Dubuque, Iowa,
that until all danger to public health
arising from rabies in dogs and the
spread thereof shall have passed
there be and there is hereby pro-
mulgated a rule and regulation that
all dogs shall be securely muzzled

Be it further resolved that any dog
found to be running at large dur-
ing the time this rule and regula-
tion is in force contrary to the pro-
visions hereof shall be taken up and
confined in the city pound and shall
not be released therefrom until the
owner thereof shall have paid for
all expense of carrying for and keep-
ing the same; provided however,
that should the owner of such dog
fail or refuse to pay such expense
and reclaim the same within a per-
iod of seven (7) days after the dog
has been taken up, such animal shall
be destroyed.
Be it further resolved that any
person owning a dog who fails or
refuses to comply with the provi-
sions of this rule and regulation
shall be subject to arrest and fined,
as provided by the ordinances of the
city of Dubuque relating to the vio-
lation of a rule or regulation of the
Board of Health.
Be it further resolved that public
notice of the enactment of this rule
and regulation be published by the
Director of Public Health in the of-
ficial newspapers of the City of Du-
buque.

suance of Public Improvement
Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Dell Street
hereinafter described has been com-
pleted and said improvement has
been accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $2,040.43 and
Whereas, public notice as provid-
ed by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined. Now therefor,
Be it resolved by the City Coun-
cil of the City of Dubuque that to
provide for the cost of improving
Dell Street from the south property

line of West 14th Street to the north
property line of Arlington Street,
there be issued improvement bonds
to the amount of $2,040.43. Said
bonds shall be issued under the pro-
visions of Chapter 311 of the Code
of Iowa 1927, which bear date as of

in the denominations of $200.00, ex-
cept that there shall be one bond to
the amount of $40.43. They shall be
numbered from 1869 to 1879 inclu-
sive and shall be divided into 10 ser-
ies of which the bond numbered 1869

cial assessments levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City

for the purpose of improving Dell
Street from the South property line
of West 14th Street to the North
property line of Arlington Street, and
described in said resolution; which
cost is .assessable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten an-
nual installments, with interest on
all deferred payments at the rate of
five per cent per annum, and this
bond is payable only out of the
money derived from the collection of
said special tax, and said money can
be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condi-
tions and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payments
hereon of said special tax and the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by
its Mayor and countersigned by its
City Clerk, with the seal of said
City affixed this 21st day of June,
1929, and has authorized the use
of their fac- simile signatures to the

Walnut Street is a very narrow
street and takes a considerable
amount of traffic and with cars
parked on both sides of Walnut

tiate the turns and therefore for fire
protection alone I would respectful-
ly recommend that these four cor-
ners be rounded off at the earliest
moment.

I am pleased to advise that the
figures as published in the Tele-
graph- Herald were absolutely correct
as published and I am unable to rec-
ognize some of the figures used by
Mr. McEvoy in his comparison and '
I am at a loss to know where the
figures were obtained except those
used in connection with the improve-
ment of Dodge Street from Grand-
view to Bryant and I note that Mr.
McEvoy is using the figures for the
reset stone curb in both cases,
whereas the low bid for this im-
provement was submitted for the re-
moval of stone curb and the substi-
tution of integral curb.

Gentlemen: At your meeting held
November ,20th, 1928, a petition from
George C. Deyoe, et al, requesting
that West 6th Street be widened
from Prospect Street to Needham
Place and that said street be then
improved was presented.

Upon the suggestion of the Coun-
cil I wrote each and every property
owner on the petition, stating that
the widening of the street would be
a rather expensive proposition as
several buildings would have to be
moved and that if they desired to
have the street improved under the
present width to file another petition,
but to date another petition has not
been filed and for that reason I rec-
ommend that the petition of Mr. Dey-
oe, et al, be filed with no further
action at this time.

er, as agent for several property
owners, on assessments for paving
O'Neill Street.
6. Petition of the Grandview Av-
enue M. E. Church, et al, asking the
City to take over a private sewer as

7. The matter of improving traffic
conditions at Lincoln and Johnson
avenues.
8. Petition of property owners
and tenants asking that Marquette
Place be resurfaced from Queen

I recommend that some afternoon
be set aside in the near future so
that the Council may dispose of these
