Council requesting that South Hill

to the proposed improvement of
South Hill Street from the south
property line of Curtis Street to the
north property line of South Grand-
view Avenue be received and filed.

Mr. McMullen addressed the Coun-
cil relative to the sewer and water
connections installed on his lot 011
the improvement of West 17th and
Clark Streets stating that the same
are not installed where he would
like to have them and that in case
they are not serviceable when he
builds he is now entering his objec-
tions at this time.

Gentlemen: At your meeting held
December 12th, 1928, a petition from
the Dubuque Baseball Club request-
ing that the billboards located on
City property just west of the Ath-
letic Field be moved approximately
75 feet north in order to provide a
greater and more adequate parking
space, was referred to your City
Manager for report and this is to
advise that your City Manager had
a talk with Mr. Louis Murphy, the
owner of the boards, and it is his
desire that he be allowed to main-

tain the sign boards in their present
location.

ing that he would have a conference
with the baseball association rela-

That in consideration of the sum of

$1.00 in hand paid by the City of
Dubuque, Iowa, a municipal corpor-
ation, the receipt whereof is hereby
acknowledged, the undersigned be-
ing the owner of Lot 1 of Mineral
Lot 346, in the City of Dubuque,
hereby grants and conveys to said
City of Dubuque a perpetual right of
easement in, over and across said
Lot 1 of Mineral Lot 346, three (3)
feet wide along north lot line from
Burlington Street to Sabula Street,
for the purpose of installing and
maintaining therein a sanitary sewer
with the right to go upon said prem-
ises at all reasonable times for the
purpose of inspecting and repairing
the same when installed;' provided,
however, that said City of Dubuque
shall replace whatever earth, sod or
shrubbery that may be disturbed in
the installation or repair of said
sanitary sewer to as good condition
as it was in before the same was
disturbed. This grant of easement
shall be binding upon the under-
signed, his heirs, executors, adminis-
trators, purchasers and assigns, for-
ever.

Dear Sir: At the Council meeting
held May 24th a petition from the
C. B. & Q. Railroad Company asking
for the vacation of an alley in
Booth's Addition was referred to the
Council to view the grounds and it
was their opinion that it would be
entirely proper to vacate the alley
as requested provided the railroad
company deed a continuation of the
alley running parallel to 3rd Street
twenty feet wide out to the water
front and your City Manager there-
fore informed the railroad company
on the decision of the Council in this
regard. Your City Manager there-
fore recommends that the petition
be filed with no further action at
this time or until the railroad com-
pany is in a position to make the
dedication as requested by the Coun-
cil.

Dear Sir: At the Council meeting
held on May 31st the verbal objec-
tion of Mr. Henry Becker as agent
for several property owners on as-
sessments for the paving of O'Neill
Street was referred to the Council
to view the grounds, property being
handled by Mr. Becker being Lots
29 to 34 inclusive, O'Neill's River-
view Addition, together with anoth-
er lot owned by the Midwest Lum-
ber Company.
This is to advise that the Council
did view the grounds on June 29th
and deemed that all of the property
which Mr. Becker was handling was
well worth the assessments and that
no change should be made in the
assessments as originally assessed.

the Council viewed this proposition
on the ground and it was their opin-
ion that the alley was not in proper
condition for the City to maintain
and that if same was to be placed in
condition for travel that the alley
should be paved.

I further certify that this work
has been done in accordance with
the, plans and specifications and sti-
pulations of the contract and I would
therefore recommend its acceptance
by the Council.

A RESOLUTION accepting improve-
ment and directing the Clerk to
publish notice.
Whereas, the contract for the con-
struction of a sewer in Wilbur
Street from the manhole in Grove
Terrace to Lot 12 of Out Lot 688,
has been completed and the City
Manager has examined the work and
filed his certificate stating that the
same has been completed according
to the terms of the contract, plans
and specifications and recommends
its acceptance, now therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Man-
ager be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provement and file the same in the
office of the City Clerk subject to
public inspection, and the Clerk
shall upon receipt of such plat and
schedule publish the notice of the
Council's intention to levy special
assessments therefore, as required
by law.
Be It Further Resolved that the
Regular Session, July 1st, 1929 259
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is-
sued upon the above described im-
provement an amount equal to the
amount of his contract, less any re-
tained percentage provided for

Dear Sir: At the Council meet-
ing held June 3rd a petition from L.
O. Hillyard requesting that Henion
Street be opened up to connect with
West 16th Street was referred to
the Council to view the grounds.
This is to advise that the Council
did view the grounds on June 29th
and the proposition of extending
Henion Street to West 16th Street
from the present improvements was
considered and it was deemed that
the improvement would be a very
expensive one and would also give
an impractical grade and also the
proposition of contouring Henion
Street back of the house owned by
Mr. Alexander and running thence
easterly almost parallel to East 16th
Street in order to gain grade and
make a connection with 16th Street
was considered by the Council. This
proposition was also not approved
due to the large expense that would
be involved in constructing the
street and the fact -that so few pro-
perty owners would derive any ma-
terial benefit from same.

ing held, May 6th, a petition front
the Grandview Avenue, Methodist
Church„ et, al, asking, the City to
take over as a part of the City, sew-
er system. -the private sewer in
nett Street from the alley first, west
of Grandview, Avenue; to a manhole
in Grandview• Avenue was referred
to the to, view the grounds.
The private sewer is an 8 inch
sewer with a very slight fall from
the alley to Grandview Avenue and
is continually in danger of being
plugged up, for that reason and also
for the reason that there is a curve
in said sewer and inasmuch as there
would be no material_ benefit to, the
'City in taking over this sewer, it
was deoided. that same be not taken
over by the City.

Dear Sir: At the Council meet-
ing held June 17th a petition from
H. F. Mackert, et al, requesting that
the side strips of Roosevelt Street
be paved from Rhomberg Avenue to
the westerly terminus of the pave-
ment on Roosevelt Street was re-
ferred to the Council to view the
grounds.
This is to advise that the Council
did view the grounds on June 29th
and your City Manager recommend-
ed that inasmuch as Roosevelt
Street is more or less of a water
street, that the City pay one -half
the cost of paving the side strips
with a six inch concrete pavement
properly reinforced and the balance
of the cost, including the resurfac-
ing of the center strip, be assessed
to the property. This seemed to
meet with the aproval of the Coun-
cil. However, it was not decided
when the im provement should be
made.

it was decided . that the Council
should, view the, grounds and this is,
to advise that, the Council did view,
the grounds on June 29th and it was
decided that inasmuch. as the, pro,
perty lines come so close to the pres-
ent curbs, that the corner be not
rounded. off but that traffic condi-
tions should be improved by remov-
ing the triangular parking space in
said intersection.

that Marquette Place he re- surfaced
from Queen Street to the concrete
pavement on the top of the hill at
Marquette Place was referred to the
Council to view the grounds.
This is to advise that the Council
did view the grounds on June 29th
and it was decided to pave with con-
crete pavement Queen Street from
the south line of Edwards Street or
from the present pavement on
Queen Street to the north line of
Marquette Place and also Marquette
Place from Queen Street to a con-
nection with the pavement on Mar-
quette Place at the top of the hill
and I have therefore requested the
City Engineer to prepare the nec-
essary plans and specifications for
same.

to advertise for bids.
Whereas, it is deemed necessary
and advisable by the City Council
of the City of Dubuque that perman-
ent sidewalks be constructed and
repaired in front of the lots and par-
cels of real estate herein described
and general plans and specifications
therefor have been duly prepared by
the Engineer and approved by the
Council, the cost and expense there-
of to be assessed against such real
estate, as provided by law; Now
therefor
Be it resolved by the City Council
of the City of Dubuque that perman,
ent sidewalks be and the same are
hereby ordered constructed and re-
paired, laid and put in place accord-
ing to general plans and specifica-
tions heretofore prepared therefor. in
front of and abutting upon the fol-
lowing described real estate, namely,

shall state the location of the pro-
posed sidewalks, when the work shall
be done, the terms of payment, the
time when bids will be acted upon
and refer the contractor to the plans
and specifications as to the manner
of construction 'and materials to be
used.
Be it further resolved that the walk
shall be fully completed on or be-
fore the 15th day of August, 1929.
Be it further resolved that, upon
the completion of said sidewalks,
the cost thereof shall be assessed
against the lots or parcels of real
estate before which the Same are
laid and the contractor shall be paid
in sidewalk certificates in form and
manner provided by law and the or-
dinances of the City of Dubuque.
Be it further resolved that a con-
tract will be awarded to the lowest
bidder reserving, however to the
Council, the right to reject all bids
and re- advertise for bids, if neces-
sary.

Whereas Central Avenue from
Third Street to Twenty- second Street
has been ordered repaired by the
City Council of the City of Dubuque
and it is proposed to sell or other-
wise dispose of the waste material
salvaged from the old pavement:
Now, therefore, be it resolved by
the City Council of said city that
the City Clerk be and he is hereby
directed to cause to be personally
served upon all of- the owners of
property to be assessed for such im-
provements a ten day notice in writ-
ing requiring such owner or owners
to elect whether they desire to take
such salvage, but if such owner or
his agent, cannot be found, then such
notice shall be posted in a conspicu-
ous place upon the property. The
election, if made, shall be in writing
and filed with said clerk. Any own-
er electing to take such salvage shall
not be entitled to a pro rata distri-
bution derived from the proceeds of
the sale of the same.
Be it further resolved that, should
such owner fail to exercise his right
to take such salvage within the time
stated, then such owner, if such sal-
vage be sold or otherwise disposed
of, shall be entitled to an equitable
distribution of the proceeds to be de-
rived from such sale, the same to
be applied upon the cost of the new
improvements.
Be it further resolved that, such
salvage may be sold to the contrac-
tor who shall submit a bid there-
fore in any case where the property
owner fails to elect to take such
salvage himself.

to be assessed as moneys and cred-

Bell Telephone Company for a cer-
tain right of way through. Lot 15,
Block 5, Grandview Park Addition to
Dubuque, being property owned by
the City of Dubuque and occupied
by a fire station at the corner of
Bradley Street and South Grand-
view Avenue. Said right of way is
for the purpose of laying under-
ground conduits to connect the ser-
vice on Grandview Avenue to a pole
in the alley in the rear of the fire
station.
I have referred this matter to the
Chief or the Fire Department and
his approval is attached hereto and
I therefore recommend to the Coun-

feet westerly, Uhlrich -Paley Com-
pany contractors, in front of and ad-
joining the same, a special tax be
and is hereby levied on the several
lots, and parts of lots, and parcels of
real estate hereinafter named, situ-
ate and owned, and for the several
amounts set opposite each lot or par-
cel of real estate, as follows: Spe-
cial assessment submitted July 9th,

special tax, and said money can be
used for no other purpose. And it
is hereby certified and recited that
all the acts and condition and things
required to be done precedent to and
in the issuing of this series of bonds,
have been done, happened and per-
formed in regular and due form as
required by said law and resolution;
and for the assessments, collections
and payments hereon of said special
tax, the faith and diligence of said
City of Dubuque are hereby irrevoc-
ably pledged. In witness whereof
the City of Dubuque by its City
Council has caused this bond to be
signed by its Mayor and counter-
signed by its City Clerk, with the
seal of said City affixed this 9th day
of July, 1929, and has authorized the
use of their fac- simile signatures to

to Schroeder Street, hearing objec-
tions thereto, levying a special as-
sessment for the construction of a
sanitary sewer in Edith Street, and
acting on any other business that
may come before the meeting.

rant for $27.40 should be authorized
in payment of this erroneous collec-
tion, check made payable to L. C.

by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 16th day of July, 1929.
This bond is one of a series of
twenty -seven bonds, twenty -six for
$300.00 each and numbered from
1884 to 1909 inclusive and one for
$162.80 numbered 1910, all of like
tenor and date, and issued for the
purpose of improving South Main
Street from the north property line
of Railroad Street to the end of the
present brick pavement, and de'
scribed in said resolution; which
cost is assessable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest on
all deferred payments at the rate of
five per cent per annum, and this
bond is payable only out of the
money derived from the collection
of said special tax, and said money
can be used for no other purpose.
And it is hereby certified and recited
that all the acts and condition and
things required to be done precedent
to and in the issuing of this series
of bonds, have been done, happened
and performed in regular and due
form as required by said law and
resolution; and for the assessments,
collections and payments hereon of
said special tax, the faith and dili-
gence of said City of Dubuque are
hereby irrevocably pledged. In wit-
ness whereof the City of Dubuque by
its Council has caused this bond to
be signed by its Mayor and counter-
signed by its City Clerk, with the
seal of said City affixed this 16th
day of July, 1929, and has authorized
the use of their fac - simile signatures

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Railroad
Street hereinafter described has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $10,295.32, and
Whereas, public notice as provid-
ed by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined. Now, therefor,
Be it resolved by the City Coun-
cil of the City of Dubuque that to
provide for the cost of improving
Railroad Street from the east pro-
perty line of South Locust Street
to the east property line of South
Main Street, there be issued im-
provement bonds to the amount of
$10,295.32. Said bonds shall be is-
sued under the provisions of Chap-
ter 311 of the Code of Iowa, 1927,
which bear date as of the 16th day
of July, 1929; shall be in the denom-
inations of $500.00, except that there
shall be one bond to the amount of

bidding on the individual items as

should be constructed in advance of

able to construct such sewer at this
time;
Now Therefore:
Be it resolved by the City Council
of the City of Dubuque that this
Council hereby gives assurance to
said property owners that, should it
develop after the pavement is con-
structed, that a storm water sewer
is absolutely necessary on said street
in order to take care of storm water
being discharged thereon and there-
by protect private property from
damage therefrom, said storm water
sewer will be constructed.

removal and abandonment of an out-
side water closet and privy located
upon lot number 3 of Hoskins Sub-
division to the City of Dubuque, be-

179 Bryant Street and has ordered
that a sanitary toilet and toilet facil-
ities be installed and said lot and
residence be connected with the san-
itary sewer now located in Bryant
Street and said Dennis Moriarity has
failed and refuses to comply with
said order of said Board of Health
within the time specified: and
Whereas the City Council of the
City of Dubuque has determined that
said property owner is unable to pay
for the installation of the sanitary
toilet and toilet facilities and for
connecting them to the sanitary

Now therefore: Be it resolved by
the City Council of said City, that
the City Engineer and Plumbing In-
spector be and they are hereby in-
structed to prepare plans and speci-
fications for the installation of pro-
per sanitary toilet and toilet facilit-
ies in the premises above stated and
connect the same with the sanitary
sewer in Bryant Street and submit
the same to this Council for approv-

as provided by law for the receipt

Be it further resolved, that the
cost of doing all this work and fur-
nishing of all material provided for
in the plans and specifications shall
be assessed against the lot benefited

buque in the same manner as other
special assessments are levied and
collected and the contractor shall be
paid either in cash or with public

tric Company, addressed the Coun-
cil claiming that the bid of the
George Kennelly Company is a quali-
fied bid and is illegal and that the
Dron Electric Company being the
next low bidder is entitled to the
contract for boulevard lights inas-
much as the Kennelly Company bid
was low for steel standards, and he
agreed after the bids were received
to furnish cast iron standards for
the same price, City Solicitor Czizek
contended that the bid is not a qual-
ified bid and Mr. Kennelly can fur-
nish the cast iron standards if he
wishes to do so without extra cost
to the taxpayers.
No further action taken at this
time.
Henry Young addressed the Coun-
cil asking that Solon Street be op-
ened from Hill to Alpine Streets off-'
ering to donate the ground on his
Side of the street abutting his pro-
perty.

the matter be referred to the Coun-

Mayor Andelfinger read the call
and stated that service thereof had
been duly made and that this meet-
ing is called for the purpose of
awarding contracts for various im-
provements, having been approved
and placed on file for not less than
one week, adopting an ordinance
granting an easement to the North-
western Bell Telephone Company,
adopting budget of expenditures for
1930 and acting on any other busi-
ness that may come before the meet-
ing.
Resolution No. 420 -29 awarding
contract for the installation of boule-
vard lights on Central Avenue and
West 8th Street to George Kennelly
Electric Company, presented and
read.
A remonstrance by property own-
ers and merchants located on Cen-
tral Avenue in the proposed Street
Lighting district, on which bids were
received July 15th, 1929, requesting
that the contract be awarded on the
strict basis of the approved speci-
fications, and as understood by them
to provide the exact type and de-
tails of lamp post and lighting fix-
tures, as are now in use on Central
Avenue between 14th and 16th
Streets, and as around the City Hall,
which is known as Union Metal No.
2616 (combination iron and steel)
posts, equipped with General Elec-
tric Form 8 Cat. No. 286547 fixture,
and General Electric Type I L trans-

Glenn Brown, attorney for the pe-
titioners addressed the Council rela-
tive to the petition. Mr. Brown stat-
ed in addressing the Council in be-
half of the petitioners, who are op-
posed to the proposed plans for the

installation of the lights which would
make the new lights different from
the ones now in use between Four-
teenth and Sixteenth Streets and
around the City Hall, that it is very
essential that having adopted some
form of light you should stick to
that type.
Councilman Meuser moved that
action on the awarding of the con-
tract for the installing of the boule-
vard lights also for the awarding of
the contract for improving Central
Avenue, by James F. Lee Paving
Co., be deferred to the next meet-
ing of the Council. Seconded by

purpose of laying and maintaining
underground conduits therein.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Par. 44. Section 1. That there be
and there is hereby granted to the
Northwestern Bell Telephone Com-
pany an easement over and across
Lot 15 in Block 5, in Grandview
Park Addition to the City of Dubuque
for the purpose of laying and main-
taining underground conduits there-
in, the same to be used for the pur-
pose of connecting the service on
Grandview Avenue to a pole in the
alley in the rear of the Fire Station
located upon said Lot, said ease-
ment being granted upon the ex-
press condition that said company
shall do all work necessary in con-
nection therewith in a skillful and
proper manner and shall restore the
surface of the ground to as good con-
dition as it was before disturbed.
Par. 45. Section II. This ordin-
ance shall be in force and effect ten
days after its passage and adoption
by the City Council and publication
as provided by law.

Council,
Dubuque, Iowa.
Gentlemen: This is to inform you
that our 4 ton roller, commonly
called the pup roller, is in a very
bad state of repair and that it will
cost approximately $300.00 to put
same in usable condition.
This roller was purchased in Sep-
tember, 1925, and cost $2200.
We are now able to trade this roll-
er in its present condition to the
Austin Western Road Machinery
Company on a new roller at an al-
lowance of $500 on a roller that will
cost $2725 including a front road
planer. This roller is a 5 ton roller
and will make a net cost to the City
of $2225 f. o. b. Harvey, Ill.
We have no allowance in the bud-
get for the purchase of a piece of
machinery of this kind and therefore
I recommend that the partial pay-
ment plan proposed by the Austin
Western Road Machinery Co., name-
ly 20% or $445.00 be paid now and
the balance to be paid next year
at the rate of 6% on deferred pay-
ments be accepted.
We have continual use for a roll-
er of this kind and are very much
handicapped at the present time due
to the fact that the roller is in need
of repairs and I sincerely trust that
the Council will approve of this pro-
position.

vices, if laid, would not be usable
without a gas main to supply them;
and it is not economically possible
to supply the gas main which would
require an investment of approxi-
mately eleven hundred dollars
($1100.00), or over eleven times the
cost of service pipes at the price we
should charge for them.

all petitions and remonstrances rela-
tive to sanitary sewer in 28th Street
be received and filed and action be
deferred, and all previous action be

ral curb from Third Street to Sev-

Attorney John L. Duffy addressed
the Council on behalf of Mrs. Anna
Trexler, relative to the boulevard
lighting on Central Avenue, stating
that if the lights are installed, she
is in favor of the same kind of
boulevard lights as are on Central
Avenue between 14th - and 16th
Streets and around the City Hall.
Fred Weidlich addressed the Coun-
cil and stated that he preferred the
steel post or standard, because he
thinks it is a better post.
Attorney Frantzen addressed the
Council, stating that he represented
about 56 signers of the petition re-
questing that the contract providing
for ornamental street lighting im-
provement on Central Avenue be
awarded on the basis of the approved
specifications, and understood by
them to provide for • one piece cast
iron standards and duplex brackets
to be made locally by the Dubuque
Foundry Corporation, equipped with
Westinghouse lighting units and
transformers, all to be equal in every
respect, practically a duplicate in
appearance with equipment now in
use on Central Avenue between 14th
and 16th Street, and around the City
Hall. The petitioners being con-
vinced of the superiority of the one
piece cast iron standard, and they
furthemore recommend that where -
ever possible all contracts for the im-
provement of Central Avenue shall
be let local manufacturers. Signed

Attorney Glen Brown addressed
the Council relative to a petition
presented to the, Council July 16th,
1929, on the proposed street lighting
improvement, stating that the con-
tract be awarded on the strict basis
of the approved specifications, and
as understood by them to provide
the exact type and details of lamp
post and lighting fixtures as are now
in use on Central Avenue between
14th and 16th Streets and around
the City Hall, which is known as
Union Metal No. 2616, combination
iron and steel posts, equipped with
General Electric Form 8, Cat. No.
286547 fixture, and General Electric
Type I. L. transformers. 38 signers.
He urged the Council that when they
award the contract for the lights to
keep the above facts in mind.
Attorney Frank Galloon addressed
the Council relative to the Central
Avenue boulevard lighting, and urged
the Council to have the lights as uni-
form as possible, but to keep in mind
the fact that the work of casting the
posts and as much of the other work
as can possibly be done here should
be done in Dubuque, thereby not only
giving work to Dubuque people, but
keeping the money in Dubuque.
Mr. Butt addressed the Council on.
behalf of the Crescent Electric Co.,
stating that they are a Dubuque con-
cern, they have their business here,
employ all Dubuque help, and do all
their banking in Dubuque, and there-
fore are entitled to consideration.
