Council met at 7:40 P. M.
Present —City Manager Kratz, May-
or Andelfinger, Councilmen Jansen,
McEvoy, Meuser and Schuckert.
Absent —None.
Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting on any business that may reg-
ularly come before the meeting, and
that this date was also fixed for the
purpose of levying a special assess=
ment and conducting -a hearing on the
issuance of bonds to pay for the im-
provement of Dodge Street, from the
easterly line of North and South
Grandview Avenue to the westerly
line of Bryant Street.
Notice of publication certified to
by the publisher of the City Coun-
cil's intention to levy a special as-
sessment as provided by law to pay
for the improvement of Dodge Street
from the easterly line of North and
South Grandview Avenue to the west-
erly line of Bryant Street. Amount
of assessment $33,450.99. James
Saul & Son, contractors.
Councilman Schuckert moved that
the notice be received and filed. Sec-
onded by Councilman McEvoy. Car-
ried by the following vote:

Notice of publication certified to
by the publisher of a hearing on the
City Council's intention to issue pub-
lic improvement bonds in the sum
of $33,450.99 to provide for the pay-
ment of the improvement of Dodge
Street from the easterly line of North
and South Grandview Avenue to the
westerly line of Bryant Street.
Councilman Meuser moved that
the notice be received and filed. Sec-
onded by Councilman Schuckert. Car-
ried by the following vote:

Schuckert.
Nays —None.
Remonstrance of A. L. Rhomberg
against the assessment as levied
against lots 1, 2 and 3 of sub. lot 1
and 2 M. lot 62 and lots 1A, 2A and
3A of Min. lot 149 for the improve-
ment of Dodge Street and making
connections, amounting to $2,076.87,
with the assessment in the offing for
installing boulevard lights. Also re-
monstrance against the assessment,
by W. A. McClain, Nathan McClain,
Bernice and Lillian McClain. Also
remonstrance of James Saul, Sr.,
against the assessment as levied
against his property for said im-
provement, and a petition of proper-
ty owners signed by 40 signers, con-
tending that the entire of these im-
provements including boulevard
lights should not and may not reas-
onably be borne alone by assess-
ment against 'the adjacent property,
stating that the improvement exists
for the city at large, therefore they
petition the Council that the proper-
ties now liable under these improve-
ments be not held liable for spe-
cial assessments to exceed 85 per
cent of the cost of said paving and
lighting.
Councilman McEvoy moved that
the rules be suspended to allow any-
one present who desires to do so,
to address the Council. Carried by
the following vote:

men Jansen, McEvoy, Meuser, and
Schuckert.
Nays —None.
Attorney Allan J. Kane addressed
the Council on behalf of the proper-
ty owners whose names appear on
the petition who ask to be allowed
to pay 85 per cent of the cost, and
the City take over the 15 per cent.
He spoke along the lines as set forth
in the petition and hoped that the
Council would see the merits of it
and take favorable action.
Councilman Meuser moved that
the petition be referred to the Coun-
cil for consideration and action on
the levying of the assessment and
issuance of bonds be deferred until
after the investigation by the Coun-
cil. Seconded by Councilman Mc-
Evoy. Carried by the following vote:
Yeas —Mayor Andelfinger, Council-
men Jansen, McEvoy, Meuser, and
Schuckert.
Nays —None.
Several citizens and property own-
ers in the vicinity of 24th and White
Streets addressed the Council, pro-
testing to the change made, by mov-
ing the street light from the inter-
section of these streets to the middle
of the block, and hereby ask that
the light be moved back to where it
was or a new light be installed.
Councilman Meuser moved' !that
the matter be referred to the City
Manager. Seconded by Councilman
McEvoy. Carried by the following
vote:

men Jansen, McEvoy, Meuser, and
Schuckert.

Robert Tschudi addressed the
Council stating that the light at 25th
and White Streets was moved to the
middle of the block between 24th and
25th Streets, that 25th Street is used

a great deal especially when there
is something going on at Comisky
Park, and the light ought to be
placed back to where it was.
Councilman Meuser moved that
the matter be referred to the City
Manager. Seconded by Councilman
McEvoy. Carried by the following
vote:

men Jansen, McEvoy, Meuser, and
Schuckert.
Nays —None.
Nick Lombardi addressed the Coun-
cil stating that he is an ex- service
man and has a family to support.
He hereby asks that he be allowed
to peddle fruit in the city without
paying the customary license.
Councilman Meuser moved that
the prayer of the petitioner be grant-
ed and he be exempted from paying
a license for 1930. Seconded by
Councilman McEvoy. Carried by the
following vote:
Yeas —Mayor Andelfinger, Council-
men Jansen, McEvoy, Meuser, and
Schuckert.
Nays —None.
Petition of J. C. Donahue stating
that the citizens in the lower part
of the City, namely South Locust
Street and Southern Avenue derive
no benefit from the bus service what-
soever, that the Interstate Power
Company has routed their bus on
South Main Street to Railroad Av-
enue, west on Railroad Avenue to
South Locust Street to Grandview
Avenue, this does not give the peo-
ple on South Locust Street and
Southern Avenue any transportation
whatsoever.
Councilman Meuser moved, that
the petition be received and filed.
Seconded by Councilman Schuckert.
Carried by the following vote:

Petition of Mrs. Margaret Flynn re-
ferred to the Council by the Board
of Supervisors, asking that the tax-
es on her property, Lot Sub. of City
Lot 567 Lot 2 for the year 1928 be
cancelled, presented and read.
Counciuman Meuser moved that
the petition be referred to the City
Solicitor. Seconded by Councilman
Schuckert. Carried by the following
vote:

Petition of merchants on 8th Street
from Main to Bluff Streets, asking
that the parking on said street be
limited to 15 minutes during the
building activities in this district, re-
ferred to the City Manager at the
meeting of October 18th. The City
Manager reports that this matter has
been taken care of and the Chief of
Police has had the proper parking
notice installed.
Councilman McEvoy moved that
the report be received and placed on
file. Seconded by Councilman Jan-
sen. Carried by the following vote:

Smith asking a reduction in the as-
sessment for the improvement of
West 17th Street against Lot 14

Association, asking permission to
use the Armory from Dec. 4th to

Petition of property owners on
South Hill Street asking that a con-
crete steps be constructed on
South Hill Street from Curtis Street
to Dodge Street, signed by Lyman E.
Allen, R. L. Shambaugh, Eldo Block,
et al (40 signers).
Councilman Schuckert moved that
the petition be referred to the Coun-
cil to view the grounds. Seconded
by Councilman Meuser. Carried by
the following vote:

Petition of property owner on Foye
Street, asking that the Council re-
consider their action relative to pav-
ing Foye Street. That the street
is only one block long and that - by
repairing the street with macadam
and tarvia, that the street would then
be good for a long time. They also
request that instead of installing
street light on Napier Street, it
should be placed on Foye Street.

Dear Sir: At a Council meeting
held October 18th, 1929, Mr. George
Wild presented to the Council a verb-
al protest against his assessment for
the improvement of Saunders Street
extending from Lemon Street south-
westerly as levied against Lot 1 of
1 of 59 Fairmont Park. The assess-
ment as levied against said piece of
property is $1,020.80 and at the in-
formal meeting of the Council held
October 30th it was decided to re-
duce this assessment by $200.00. Will
you therefore present this matter to
the Council at their next meeting for
confirmation and record and author
ization to pay said $200.00 out of the
public improvement fund and cancel
same on assessment roll?

held September, 26th a protest from
Margaret Barry objecting to the as-
sessment levied against Lots 14 and
15 Chas. Klingenberg's Addition for
the improvement of Lowell Street
was referred to the Council and this
is to advise that on November 2nd
the Council viewed the ground and
decided to reduce the assessments on
those two lots so that each lot will
pay $50.00. Will you therefore pre-
sent this matter to the Council for
authorization to pay the balance of
the assessment against both lots out
of the Public Improvement Fund and
cancel same on the assessment roll?

Dear Sir: At the Council meeting
held October 18th a. verbal petition
from Peter Haupert requesting the
City to assist him in reconstructing
his sidewalk on the west side of
Woodworth Street, which he claims
was torn out by the contractor, was
referred to the Council to view the
grounds and this is to advise that
the Council did view the grounds on
November 2nd and decided that the
sidewalk must have been in a poor
state of repair before the street was
paved and therefore the City is not
obligated in any way to assist him
in reconstructing the sidewalk.

tion from J. L. Daniels asking that
when the alley between Auburn and
Algona from Custer to West 14th
Streets is improved that it be opened
all the way through was referred
to the Council to view the grounds
and this is to advise that the Coun-
cil did view the grounds on Novem-
ber 2nd and decided that the im-
provement should be held up pending
the request from more 'of the pro-
perty owners.

A RESOLUTION accepting im-
provement and directing the clerk
to publish notice.
Whereas, the contract for the pav-
ing of the alley south of the City
Hall has been completed and the City
Manager has examined the work and
filed his certificate stating that the
same has been completed according
to the terms of the contract, plans
and specifications and recommends
its acceptance, now therefor,
Be it resolved by the City Council
of the City of Dubuque, that the rec-
ommendation of the City Manager be
approved and that said improvement
be and the same is hereby accepted
and the City Engineer be and he is
hereby directed to prepare a plat and
schedule showing the lots or parcels
of real estate subject to assessment
for said improvement and file the
same in the office of the City Clerk
subject to public inspection and said
Clerk shall upon receipt of such plat
and schedule publish the notice of
the Council's intention to levy spe-
cial assessments therefor, as r e-
quired by law.
Be it resolved that the City Treas-
urer be and he is hereby directed
to pay to the contractor from the
General Fund an amount equal to the
amount of his contract, less any re-
tained percentage provided for there-

Dear Sir: At a Council meeting
held October 28, a petition from var-
ious property owners residing on
Seminary Street as follows was pre-
sented to the Council: We, the un-
dersigned, property owners and resi-
dents of Seminary Street do hereby
petition your honorable body to lim-
it Seminary Street from the inter-
section at North Main to the inter-
section at Harold Street a restrict-
ed residential district. We also re-
quest that prompt action be taken on
this petition to preclude any possible
infringement to property owners.
At the informal Council meeting
held October 30th it was decided not
only to grant the petition as present-
ed but to extend same to West Lo-
cust Street; in others words the lim-
its to be on Seminary Street from
North Main Street to West Locust
Street and you were instructed to
prepare the proper ordinance to pre-
sent at the next regular meeting to
be held November 4th.

In the above matter we return
herewith the deeds and abstracts.
The parties have agreed among them-
selves upon a division, $138.89 to the
Dubuque Stone Products Company
and the remaining $361.11 to the Die -
trichs and Kirchers.
Since we represent all these par-
ties will you kindly make a voucher
for the entire amount to us as at-
torneys for the Dubuque Stone Pro-
ducts Company and the other parties
who signed these deeds so we can
get this matter cleaned up, as they
also agreed to pay us our fee out of
the $500.00 voucher.

I made a very careful examination
into the facts and satisfied myself
that the injuries were of a serious
nature and recovery of a verdict
against the City in a substantial sum
was more than probable.
I found myself called upon to
make the best settlement possible
under the circumstances and I agreed
to pay the sum of $1,250 and the
costs in the case.
This has been accepted and if this
settlement meets with your approv-
al kindly have a warant drawn in
favor of Kane and Cooney, attor-
neys for Dora Peck, the mother of
this child who has been legally ap-
pointed her guardian, and also a war-
rant in the sum of $14.15 in favor
of R. P. Marshall, Clerk of the Dis-
trict Court.
The warrant should not be deliv-
ered until the guardian has been
duly appointed and order of Court
is submitted.

RESOLUTION providing for the is-
suance of public improvement
bonds.
Whereas, the contract heretofore
entered into by the City of Du-
buque for the improvement of
Dodge Street hereinafter described,
has been completed and said im-
provement has been accepted by the
City Council of said City and the
City Engineer has computed the cost
and expense thereof to be $33,450.99.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention

of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving Dodge Street from the
easterly line of North and South
Grandview Avenue to the westerly
line of Bryant Street there be is-
sued improvement bonds to the
amount of $33,450.99. Said bonds
shall be issued under the provisions
of Chapter 311 of the Code of Iowa,
1927, which bear date of the 8th day
of November, 1929; shall be in the
denominations of $500.00, except that
there shall be one bond to the
amount of $450.99. They shall be
numbered from 2272 to 2338 inclu-
sive and shall be divided into ten
series of which the bonds numbered

MUNICIPAL GOVERNMENT AND
ADMINISTRATION IN IOWA
There are more than nine hundred
incorporated muncipalities within
the State of Iowa. For these cities
and town the Iowa law provides
sevens different forms of government.
There are also variations based on
population and location.
The State Historical Society of
Iowa has undertaken the compilation
and publication of a comprehensive
study of these several forms of mu-
nicipal government in Iowa. Under
the direction of the Society, thirteen
persons have co- operated in the pre-
paration of twenty -four chapters
which are to be published in two
volumes of approximately 600 pages
each.
Volume I deals with the legal stat-
us, forms, and functions of municipal
government, and with the powers and
duties of municipal officials. The
second volume is devoted exclusive-
ly to administrative problems.
To obtain first hand information
on the problems of Iowa municipal-
ities and the procedure followed in
actual administration, the writers
have made many personal visits to
cities and towns of the State. They
have studied the operation of mu-
nicipal governments, consulted mu-
nicipal officials, and attended meet-
ings where municipal affairs have
been discussed.
The writers of these volumes have
made a careful study of the laws, de-
cisions of courts, and official reports
relating to cities and towns in Iowa.
Since this work has been carried
on in the hope that its results would
be helpful to municipal officials, the
State Historical Society of Iowa is
offering the two volumes to munici-
palities and municipal officials at the
nominal price of $3.00 for the set
of two volumes. To other purchas-
ers the price is $6.00 for the set.
The volumes may be ordered by
municipalities or by individual mu-
nicipal officials, at the special price
quoted, by filling out the order blank
and mailing it to the State Historical

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of South Hill
Street hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $5,094.84.
And whereas, public notice as pro-
vided by law, has been published uy
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving South Hill Street from
the south property line of Curtis
Special Session, November 25th, 1929
Street to the north property line

RESOLUTION providing for the is-
suance of public improvement
bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Roosevelt
Street hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the Cost and
expense thereof to be $3,881.22.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Roosevelt Street from the
end of the present pavement north-
erly about 1005 feet there be issued
improvement bonds to the amount of
$3,881.22. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1927, which bear
date as of the 25th day of November,
1929; shall be in the denominations
of $300.00, except that there shall be
one bond to the amount of $281.22.
They shall be numbered from 2354
to 2366 inclusive and shall be divid-

A RESOLIJTION providing for the
Issuance of 'Public Sewer Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in the Alley between Argyle
and Burden Streets, hereinafter de-
scribed, has been completed and
said improvement has been accepted
by the City Council of said City, and
the City Engineer has computed the
cost and expense thereof to be
$396.48.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that to provide for the cost of
constructing a sanitary sewer in the
Alley between Argyle. and Burden
Streets from the manhole in Lawth-
er Street, northwesterly about 228
feet, there be issued sewer bonds to
the amount of $396.48. Said bonds
shall be issued under the provision
of Chapter 311 of the Code of Iowa,
1927, which bear date as of the 25th
day of November, 1929; shall be in
the denominations of $100.00, except
that there shall be one bond to the
amount of $96.48. They shall be
numbered from 2354 inclusive and
shall be divided into four series of
which the bond numbered 2350 shall
constitute the first series and shall
be payable the 1st day of April, A.D.
1930; the bond numbered 2351 shall
constitute the second series and
shall be payable the 1st day of April,
A. D. 1931; the bond numbered 2352
shall constitute the third series and
shall be payable the 1st day of April,
A. D. 1932; the bond numbered 2353
shall constitute the fourth series and
shall be payable the 1st day of April,
A. D. 1933.
Said bonds shall bear interest at
the rate of five per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment.
Both principal and interest shall
be payable at the office of the City
Treasurer in the City of Dubuque.

sued by the • City of Dubuque pur-
suant to and by virtue of Chapter

ed on the 25th day of November,
1929. This bond is one of a series
of four bonds, three for $100.00, num-
bered from 2350 to 2352 inclusive,

installing boulevard lights on Dodge
Street from the east property line
of North and South Grandview Av-
enue to the west property line of
Bryant Street and described in said
resolution; which cost is assessable
and levied along said improvement,
and is made by law a lien on all
abutting or adjacent property, and
payable in ten annual installments,
with interest on all deferred pay-
ments at the rate of five per cent
per annum, and this bond is payable
only out of the money derived from
the collection of said special tax, and
said money can be used for no other
purpose. And it is hereby certified
and recited that all the acts and con-
dition and things required to be done
precedent to and in, the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by
its Mayor and countersigner by its
City Clerk, with the seal of said City

Par. 62. Conflicting Ordinances.
Section 4. All ordinances or parts
of ordinances in conflict herewith
are hereby repealed.
Par. 63. Penalty. Section 5. Any
person who violates the provisions
hereof shall be deemed guilty of a
misdemeanor and shall be fined not
to exceed $25 or imprisoned not to
exceed 10 days in jail.
Par. 64. Enacting Clause. Section
6. This ordinance being deemed
urgent and of immediate necessity
shall be in force and effect from and
after its final passage and adoption

Resolution providing for the re-
assessment and re -levy of special as-
sessments for the construction of
public improvements upon and along
• Main Street from the South property
line of Kauffmann Avenue to the
South Lot line of Lot 32, L. H. Lang -
worthy's Sub., except where already
paved.
Whereas, special assessments were
levied upon and against lots and
parcels of real estate subject to as-
sessment for the improvement of
Main Street from the South property
line of Kauffmann Avenue to the
South lot line of Lot 32, L. H. Lang -
worthy's Sub., except where already
paved on the 26th day of September,
1929, and it now becomes apparent
that in making such assessments,
certain property has been assessed
too little and other property too
much for such improvements, and it
is deemed advisable by this Council
to correct such assessments and
make a re- assessment and re -levy of
the same, and such re- assessments
have been duly prepared, examined
and approved by this Council and
are now on file in the office of the
City Clerk for public inspection.
Now therefor
Be it resolved by the City Council
of the City of Dubuque that the City
Clerk be and he is hereby directed
to cause to be published in the man-
ner provided by law, a notice of
such re- assessment stating therein
-the time and place when and where
objections will be heard to such re-
• assessment and the time and place
Special Session, November 25th, 1929
when and where such re- assessment
will be levied.
Be it further resolved that, in any
case where the special assessment
heretofore levied have been paid and
such payments are in excess of the
amounts provided for in the re-
assessments proposed to be made,
the City Treasurer be and he is
hereby directed to cause a refund to
be made to such property owners to
the extent of such excess assess-
ments.
Be it further resolved, that, in any
case where the assessments against
property are increased beyond the
amounts provided for in the original
assessments, the amount of such in-
crease shall be added to the amount
of the original assessment and such
re- assessments shall be certified by
the City Clerk to the City Auditor
and collected in installments, draw
interest at the same rate and be en-
forced in the same manner as the
original assessments.
Be it further resolved that all
bonds heretofor issued and sold as
provided for in prior resolutions to
pay the cost of such improvements
be and the same are hereby confirm-
ed and declared to be in full force
and effect just the same as if this
re- assessment and re -levy had not
been made,

Councilman Schuckert moved the
adoption of the resolution. Seconded

Mayor Andelfinger reported that
the street from the intersection of
West Locust Street easterly to Sem-
inary Street is very dark and that
there should be more street lights
in this district.
Councilman Jansen moved that
this matter be referred to the City
Manager for investigation. Second-
ed by Councilman McEvoy. Carried
by the following vote:

Frank W. Lange et al. addressed
the Council asking that Foye Street
be paved. They were informed that
the former petition they presented
to the Council has been considered
and that this improvement will be
made next year.
