Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Tina Flanagan spoke regarding her request stating that she and her family intend to
purchase the 10 acres of property that is being split from JQ Acres No. 3, as requested
in the Plat of Survey. She said they intend to build their home on part of the property
and leave the remainder to be farmed as it is now.
Planning staff said that the submitted Plat of Survey for JQ Acres No.3 splits off the
eastern 10-acres of a 47-acre lot to provide a residential building site. He said that Lot
1 is the 10-acre property and Lot 2 retains 37 acres of the original lot. He noted that
neither lot has frontage on a private or public street but are accessed from a 66' wide
platted easement across City property from Metropolitan Heights. He said that access
to Lot 1 continues across the 66' wide platted easement along the south side of Lot 2.
Staff said that neither Lot 1 or Lot 2 will have frontage on a platted private or public
street and therefore, the Commission must approve both as substandard lots.
Commissioners discussed the request and felt that is was appropriate.
Recommendation
By a vote of 7 to 0 , the Zoning Advisory Commission recommends that the City
Council approve the request subject to waiving the required lot frontage for Lot 1 and
Lot 2 of JQ Acres #3.

SUBJECT: Plat of Survey of JQ Acres No. 3 all in Dubuque County, lowa
INTRODUCTION
The submitted Plat of Survey for JQ Acres No.3 splits off the eastern 10 acres of a 47
acre lot to provide a residential building site. Lot 1 is the 10 acre property and Lot 2
retains 37 acres of the original lot.
DISCUSSION
Both Lot 1 and Lot 2 are partially cultivated with row crops and both have a steep
wooded hillside to the north that drops into the Catfish Creek drainage. Both lots abut
City owned property for the E.B Lyons Interpretive Center.
Neither lot has frontage on a private or public street but are accessed from a 550' long,
66' wide platted easement across City property from Metropolitan Heights. Access to
Lot 1 continues across a 66' wide easement along the south side of Lot 2. Dubuque
County subdivision regulations allow access to two lots from an easement.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the Plat of Survey
of JQ Acres No. 3 and recommend approval as submitted subject to waiving the lot
frontage requirement for Lot 1 and Lot 2.
