WORK SESSION Broadband Expansion Acceleration Initiative Information Services Manager Chris Kohlmann, Traffic Engineer Dave Ness, and Sus- tainable Innovation Consultant for the Greater Dubuque Development Corporation David Lyons conducted a work session on Dubuque Broadband Expansion/Acceleration Initia- tive. Topics included: • Dubuque Broadband Acceleration Initiative history: status, new strategy, cations, innovations, and deliverables. • Partners, growth, value • Creating capacity • 2020/2021 “Tiger by the Tail” o Record new collaborative builds o Acceleration of fiber-to-the-home (FTTH) initiatives o Efforts on equity o Alliant joint build o SW Arterial build: ITS corridor development partnership with IDOT o Unite Private Network (UPN)/US Cellular (USCC) o Chavenelle and Radford Roads • Leveraging public/private partnerships to lower city costs and improve city ser- vices • ImOn new area communication timeline • MVLink • Comelec Internet Services • Acting on Equity: collaborations, data collection systems • Building for equity opportunities • Wireless status in Dubuque 2 The presenters responded to questions from the City Council following the presenta- tion. COVID-19 Update: Mary Rose Corrigan, Public Health Specialist for the City of Dubuque, provided an update on the COVID-19 pandemic and response activities includ- ing case data from the Dubuque County Public Health Incident Management Team; in- formation from Governor Reynolds’ most recent proclamation and guidelines; community testing / Testiowa.gov update; contact tracing and target testing; housing needs, personal protective equipment donations and requests; Brain/Mental Health Month (May); Joint Information System / Public Information coordination and media outlets; and information and guidelines on looking ahead and what can be done now. 2. Renee Tyler Receives University of Arkansas Clinton School Public Service Award : Assistant City Manager Cori Burbach introduced Clinton School. Clinton School of Public Service Dean Susan Hoffpauir who virtually presented Transportation Services Director Renee Tyler with the Public Service Award as the student who has demonstrated excel- lence in public service. Ms. Tyler was also chosen by her peers as a commencement speaker along with journalist Wolf Blitzer and President Bill Clinton. PROCLAMATION(S) 1. Public Health Nurses’ Recognition Day (May 18, 2020) was accepted by Mary Rose Corrigan, Public Health Specialist for the City of Dubuque. 4 2. Upon motion the documents were received, filed, and concurred. 4. Approval of City Expenditures: City Manager recommending City Council approval for payment of City expenditures. Upon motion the documents were received and filed, and Resolution No. 145-20 Authorizing the Director of Finance and Budget/City Treasurer to make certain payments of bills that must be paid and approved for payment in accord- ance with City procedures was adopted. RESOLUTION NO. 145-20 AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT IN ACCORDANCE WITH CITY PROCEDURES Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the Finance Director-City Treasurer shall keep an accurate account of all disbursements, money, or property, specifying date, to whom, and from what fund paid; and Whereas, the invoices, presented by those firms and persons providing such goods and services have been pre-audited by Finance Department personnel in accordance 5 with generally accepted internal control procedures and have been determined to have been requisitioned for a lawful municipal purpose; and Whereas, the Finance Director-City Treasurer has provided a list of Expenditures at- tached hereto, and by this reference made a part hereof, to be drawn to pay for goods and services provided for City purposes; and Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 - 18 adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks in payment of certain expenditures known as Exception Expenditures prior to City Council approval and such list is attached hereto. Upon motion the documents were received and filed, and Resolution No. 147-20 Approving Release of Mortgage by the City of Dubuque, Iowa on the property at 137-153 Main Street owned by Lower Main Development, LLC was adopted. RESOLUTION NO. 147-20 APPROVING A RELEASE OF MORTGAGE BY THE CITY OF DUBUQUE, IOWA ON THE PROPERTY AT 137-153 MAIN STREET OWNED BY LOWER MAIN DEVELOP- MENT, LLC Whereas, on January 20, 2003, the City Council of the City of Dubuque, Iowa (City) approved a Memorandum of Understanding with Lower Main Development, between City and Lower Main Development, LLC (Company) to provide certain financial assistance, including a $300,000 Downtown Rehabilitation Loan (the Loan) to support a capital in- vestment of not less than $2,000,000 in building improvements, equipment, and furniture and fixtures on the property located at 137 Main Street and adjacent parking lots; and Whereas, the Loan was secured by a mortgage on the property dated August 26, 2006, recorded as Instrument Number 2006-15995; and Whereas, the Loan has been paid in full; and Whereas, Company has requested a release of the mortgage by City. 7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The Release of Mortgage attached hereto is hereby approved. Section 2. The Mayor is authorized and directed to execute the Release of Mortgage on behalf of the City of Dubuque. Request for Proposals - COVID-19 Shelter Staffing Assistance: City Manager trans- mitting a Request for Proposals for Shelter Staffing Assistance for the COVID -19 City Isolation Shelter that was released on May 8, 2020, which would be paid through Com- munity Development Block Grant Funds. Upon motion the documents were received, filed, and approved. 10. Subdivision Development Agreement for a Portion of Silver Oaks Estates: City Manager recommending approval of a Subdivision Development Agreement with devel- oper Royal Oaks Development Corporation for construction of public improvements and the dedication of public street right-of-way and associated easements in Silver Oaks Es- tates in the City of Dubuque. Upon motion the documents were received and filed, and Resolution No. 148-20 Approving a Subdivision Development Agreement for a portion of Silver Oaks Estates between the City of Dubuque, Iowa and Royal Oaks Development Corporation was adopted. RESOLUTION NO. 148-20 APPROVING A SUBDIVISION DEVELOPMENT AGREEMENT FOR A PORTION OF SILVER OAKS ESTATES BETWEEN THE CITY OF DUBUQUE, IOWA, AND ROYAL OAKS DEVELOPMENT CORPORATION Whereas, the City of Dubuque is party to a Subdivisio n Development Agreement with Royal Oaks Development Corporation, dated April 22, 2020, for construction of public improvements and the dedication of public street right of way and associated easements over Lots 31 through 42, inclusive, of Silver Oaks Estates, and a portion of Lot A of Silver Oaks, in the City of Dubuque.; and Whereas, the developer desires to construct and provide subdivision improvements including streets with longitudinal subdrains and concrete curb and gutter, a paved cul - de-sac, sanitary sewer mains, water mains, a storm water detention basin, storm sewers and catch basins, boulevard street lighting, fiber optic conduit and vaults, accessible side- walk ramps, concrete sidewalks, and appropriate erosion control devices, to the site and will need to construct and carry out any other activities associated with the project in accordance with City plans and specifications; and Whereas, upon completion of the project, the developer wishes to dedicate the public Project improvements, street right of ways, storm water detention basin lot, and associ- ated easements to the City; and Whereas, the City of Dubuque has reviewed and approved the design and construction plans, and has reviewed and approved the dedication of right of way and easement plats, 8 for said public improvements as required by the Subdivision Development Agreement; and Whereas, Royal Oaks Development Corporation has executed the Subdivision Devel- opment Agreement. Upon motion the documents were received and filed, and Resolution No. 149-20 Approv- ing the First Amendment to Development Agreement between the City of Dubuque, Iowa and CARich Properties, LLC was adopted. RESOLUTION NO. 149-20 APPROVING THE FIRST AMENDMENT TO DEVELOPMENT AGREEMENT BE- TWEEN THE CITY OF DUBUQUE, IOWA AND CARICH PROPERTIES, LLC Whereas, the City of Dubuque (City) and CARich Properties, LLC (Developer) previ- ously entered into a Development Agreement dated May 20, 2019, for the redevelopment of 278 W. 17th Street in the City of Dubuque, Iowa (the Project); and Whereas, the Project is eligible for Downtown Rehabilitation Grants; and Whereas, funding for Downtown Rehabilitation Grants is now available; and Whereas, City and Developer desire to amend the Development Agreement as set forth in the attached First Amendment to Development Agreement to provide additional funds to the Project. Upon motion the documents were received and filed, and Resolution No. 150-20 Au- thorizing the City to apply for membership in the Iowa Municipalities Workers' Compen- sation Association (IMWCA) was adopted. RESOLUTION NO. 150-20 AUTHORIZING THE CITY TO APPLY FOR MEMBERSHIP IN THE IOWA MUNICIPAL- ITIES WORKERS' COMPENSATION ASSOCIATION (IMWCA) Whereas, the Iowa Municipalities Workers' Compensation Association, a Chapter 28E association, bas been established as a group self-insurance program, for the purpose of providing coverage for workers' compensation and related employer liability to Iowa cities, counties, 28E entities and a political subdivision; and Whereas, the City of Dubuque desires to become a member of the Association, a self- insured group, in order to obtain coverage for workers' compensation and related em- ployer liability. NOW THEREFORE BE IT RESOLVED that the City of Dubuque hereby adopts the Agreement of the Iowa Municipalities Workers' Compensation Association and authorizes and directs. M. Van Milligen and S. The taxes so determined shall be referred herein as the "base period taxes" for such Subarea. 52 (b) As to the Old Main Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1993, being the assessment roll as of January 1 of the calendar year pre ceding the effective date of Ordinance No. 23-94. (c) As to the Town Clock Expansion Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1996, being the assessment roll as of January 1 of the calendar year preceding the effective date of Ordinance No. 67 -97. (d) As to the Upper Main Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2001, being the assessment roll as of January 1 of the calendar year preceding the effective date of Ordinance No. 26-02. (e) As to the Ice Harbor Subarea A, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1988, being the assessment roll as of January 1 of the calendar year preceding the effective date of Ordinance No. 66-89. (f) As to the Ice Harbor Subarea B, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1999, being the assessment roll as of January 1 of the calendar year preceding the effective date of Ordinance No. 97-00. (g) As to the Ice Harbor Subarea C, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2006, being the assessment roll as of January 1 of the calendar year preceding the effective date of Ordinance No. 20-07. (h) As to the Warehouse Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2006, being the first day of the calendar year preceding the effective date of Or- dinance No. 63-07. (i) As to the South Main Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2006, being the first day of the calendar year preceding the effective date of Or- dinance No. 63-07. (j) As to the South Port Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2007, being the first day of the calendar year preceding the effective date of Or- dinance No. 60-08. (k) As to the Cable Car Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2008, being the first day of the calendar year preceding the effective date of Or- dinance 58-09. (l) As to the Bluff Street Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2009, being the first day of the calendar year preceding the effective date of Or- dinance 51-10. (m) As to the South Bluff Street Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of 53 January 1, 2010, being the first day of the calendar year preceding the effective date of Ordinance 33-11. (n) As to the Kerper Boulevard Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1993, being the first day of the calendar year preceding the effective date of Ordinance 43-94. (o) As to the Washington Neighborhood Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2010, being the first day of the calendar year preceding the effective date of Ordinance 33-11. (p) As to the Industrial Harbor Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2010, being the first day of the calendar year preceding the effective date of Ordinance 33-11. (q) As to the East 7th Street Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 1996, being the first day of the calendar year preceding the effective date of Or- dinance 64-97. (r) As to the Chaplain Schmitt Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2010, being the first day of the calendar year preceding the effective date of Ordinance 33-11. (s) As to the North Kerper Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2011, being the first day of the calendar year preceding the effective date of Or- dinance 60-12. (t) As to the Quebecor Subarea, base period taxes shall be computed in the same manner using the total assessed value shown on the assessment roll as of January 1, 2001, being the first day of the calendar year preceding the effective date of Or- dinance 88-02. (u) As to the Harrison Street Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the ass essment roll as of January 1, 2011, being the first day of the calendar year preceding the effective date of Ordinance 60-12. (v) As to the Holy Ghost Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2013, being the first day of the calendar year preceding the effective date of Or- dinance 45-14. (w) As to the Almond Street Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2013, being the first day of the calendar year preceding the effective date of Or- dinance 45-14. (x) As to the North End Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2015, being the first day of the calendar year preceding the effective date of this Ordinance. 54 (y) As to the University Avenue Corridor Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2015, being the first day of the calendar year preceding the effective date of this Ordinance. (z) As to the West Locust Corridor Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2015, being the first day of the calendar year preceding the effective date of this Ordinance. (aa) As to the Brewing and Malting Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2007, being the first day of the calendar year preceding the effective date of Ordinance 61-08. (bb) As to the 15th Street Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of Jan- uary 1, 2016, being the first day of the calendar year preceding the effective date of Ordinance 6-17 and 6-17-A. (cc) As to the Lower Kaufmann Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2016, being the first day of the calendar year preceding the effective date of Ordinance 26-17. (dd) As to the North Peru Road Subarea, base period taxes shall be computed in the same manner, using the total assessed value shown on the assessment roll as of January 1, 2019, being the first day of the calendar year preceding the effective date of Ordinance 20-20. Section 4: That portion of the taxes each year in excess of the base period taxes for the Amended Project Area, determined for each Subarea thereof as provided in Section 3 of this Ordinance, shall be allocated to and when collected be paid into the special tax increment fund previously established by the City of Dubuque to pay the principal of and interest on loans, monies advanced to, or indebtedness, whether funded, refunded, assumed or otherwise, including bonds issued under authority of Section 403.9 or Section 403.12 of the Code of Iowa, incurred by the City of Dubu- que, Iowa to finance or refinance, in whole or in part, urban renewal projects under- taken within the Amended Project Area pursuant to the Urban Renewal Plan, except that taxes for the regular and voter-approved physical plant and equipment levy of a school district imposed pursuant to Section 298.2 of the Code of Iowa and taxes for the instructional support program of a school district imposed pursuant to Section 257.19 (but in each case only to the extent required under Section 403.19(2)), taxes for the payment of bonds and interest of each taxing district, and taxes imposed under Section 346.27(22) related to joint county -city buildings shall be collected against all taxable property within the Amend ed Project Area without any limitation as hereinabove provided. Section 5: Unless or until the total assessed valuation of the taxable property in the Subareas of the Amended Project Area exceeds the total assessed value of the taxable property in said Subareas shown by the assessment rolls referred to in Sec- tion 3 of this Ordinance, all of the taxes levied and collected upon the taxable prop- erty in the Amended Project Area shall be paid into the funds for the respective 55 taxing districts as taxes by or for the taxing districts in the same manner as all other property taxes. Section 6: At such time as the loans, monies advanced, bonds and interest thereon and indebtedness of the City of Dubuque referred to in Section 4 hereof have been paid, all monies thereafter received from taxes upon the taxable property in the Amended Project Area shall be paid into the funds for the respective taxing districts in the same manner as taxes on all other property. Section 7: All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. The provisions of this Ordinance are intended and shall be construed so as to continue the division of taxes from property within the Amended Project Area under the provisions of Section 403.19 of the Code of Iowa, as authorized in Ordinance No. 26 -17, as previously amended, and to fully imple- ment the division of taxes in the North Peru Road Subarea. In the event that any provision of this Ordinance shall be determined to be contrary to law it shal l not affect other provisions or application of this Ordinance which shall at all times be construed to fully invoke the provisions of Section 403.19 of the Code of Iowa with reference to the Amended Project Area and the territory contained therein.
