The application, staff report and related materials are attached for your review. Discussion The applicants, Wilma McDonell and Nick Bries, spoke in favor of their request to rezone a property that contains a two-story commercial building to an auto sales lot. Mr. Bries said that his intent is to operate a small auto sales lot and have his son conduct vehicle detailing in the attached garage. He stated that he was willing to abide by any conditions that the Zoning Advisory Commission members felt necessary to mitigate any potential negative impacts to the neighborhood. Staff reviewed the staff report, noting that the applicants propose to convert a former salon to an auto sales lot. Staff discussed the uses permitted in the C-1 and C-3 districts, required parking and traffic issues. Staff noted that, if the rezoning is approved, the applicants will need to receive a variance in lot area for an auto sales lot from the Zoning Board of Adjustment meeting. Neighbors submitted letters and a petition in opposition to the request and nine neighbors spoke at the meeting expressing concerns with traffic safety, parking, noise and property value. The Zoning Advisory Commission discussed the request and felt that an auto sales lot would not be appropriate given the residential nature of the neighborhood, size of the lot and the potential impacts generated by an auto related business. Property History: The subject property was platted circa 1930 as a part of the original Burden-Lawther subdivision and a two-story block structure with first-floor commercial space and residential units above was built on the lot in 1947. The structure has been operated as a mixed-use building to the present. Physical Characteristics: The subject property is an approximately 5,000 square foot level corner lot with frontage on Groveland Place and Sheridan Road and alley access on the north side of the lot. The subject lot has unlimited curb-cut access on three sides with a non-compliant parking area on the north and south sides of the building. Imagine Dubuque Comprehensive Plan Recommendations: The Imagine Dubuque Comprehensive plan encourages a mix use development but recommends that incompatible uses be buffered from each other. Future Land Use Map — Commercial. Impact of Request on: Utilities: City water and sanitary sewer are available to the site with adequate capacity to serve the building. Traffic Patterns/Counts: There are no IDOT traffic counts for the surrounding streets. However, there are some permitted uses in the C-3 General Commercial district that can generate significant traffic volumes on what are primarily residential streets. Rezoning Staff Report— 785 Groveland Place Page 2 Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment because the site is currently almost fully developed and any expansion would be subject to current setback, required parking and parking lot design standards. Adjacent Properties: The proposed rezoning to C-3 General Commercial district has the potential to introduce relatively intense commercial uses into a primarily single-family neighborhood. The amount of noise, activity, traffic and demand on parking that could result may be excessive given the proximity of the surrounding residential properties. CIP Investments: None proposed. Staff Analysis: The applicant's request is to rezone a 5,000 square foot lot that is currently zoned C-1 Neighborhood Commercial district to C-3 General Commercial district. The building has been operated as a commercial entity such as a grocery store, office and hair salon with upper story residential uses since it was built in 1947. However, most of the former commercial uses were relatively low intensity neighborhood-oriented businesses. The preamble of the C-3 General Commercial district states that the district is intended to provide locations for commercial uses which are designed to serve the motoring public or uses requiring highway or arterial locations. The proposed rezoning to C-3 General Commercial district has the potential to introduce relatively intense commercial uses into a primarily single-family neighborhood. The amount of noise, activity, traffic and demand on parking that could result may be excessive given the proximity of the surrounding residential properties. In addition, the parking areas on the property are substandard with no well-defined access and no drive aisle thus requiring vehicles to back directly into the public right-of-way. If approved, the Zoning Board of Adjustment must review and approve a variance in lot area prior to commencement of an auto sales dealership. I strongly oppose approval of the zoning change for the following reasons, and I thank you for considering the following points as you review this matter. Sincerely, Jade Angelica 1. NO BENEFIT TO THE NEIGHBORS: Having a general commercial zoning permit in this location seems absurd, since this is a completely residential neighborhood. The G 1 neighborhood commercial permit was likely granted in 1940 when the building was built as a corner grocery store to benefit the residents living in the neighborhood. A C-3 zoning permit in general, but specifically this auto sales/repair business, will provide NO benefit to any of the neighborhood homeowners except Wilma McDonnell who has been unsuccessful at selling or renting this property that is in serious disrepair. 2. PARKING—There is currently 1 tenant living in the building who has a car and will park in the very small lot area around the building at 785 Groveland Place. Not to mention the business owner's personal car, and then cars for sale and repair as well as customers' cars. Where will all these cars be parked? Some of them will likely be parked in the street on Sheridan Road and/or in front ar on the side of neighbors' houses, taking away parking for our own vehicles and those of our guests. One neighbor, directly across from the front parking area had a visitor's car damaged when a beauty shop customer backed out and crashed into this visitor's car. 3. VISIBILITY—This is a problem that pre-dates the proposed tenant/auto repair sales business. Cars parked in the side lot and/or at the curb (along Sheridan Rd) of 785 Groveland Place, create a visibility hazard for cars emerging from the alley adjacent to the property, for cars turning onto Sheridan Road from Groveland Place, for pedestrians crossing Sheridan road at either location, AND for cars travelling north on Sheridan Road. Because of the way the street is constructed, this parking area juts out into the right of way by nearly 16'. Emerging from the alley, I have had multiple near collisions with cars driving north on Sheridan Rd. because I cannot see oncoming cars due to the cars parked at 785, and the on-coming cars cannot see me. This experience of driving out of the alley had been very stressful, and I was about to call the City to ask them to investigate this parking situation, when Willie's Beauty Shop closed. So, I didn't call. Some of the key times would be especially when school is dismissed for the afternoon,and on weekends when there is more free time and nice weather. Even though people cross at the corner,there is no defined crosswalk. Any driver not paying attention,or is distracted by other means, could cause an accident, resulting in injuries. 3.) Traffic Increase and Flow: As I stated above, the used car lot would cause an increase of traffic to Sheridan Road,along with the possibility of traffic increase to Groveland Place. Also, on the north end ofSheridan Road, leading to Peru Road, is the staff and service entrance to Stonehill Care Facility. Traffic is higher at the times of shift changes at the facility, along with delivery and other necessary services. In all, while someone is willing to bring a new business to Dubuque's north end, it is equally important to give strong consideration to the location of said business.. I am not against a business going into that area. I feel, after some thought, a smaller,similar business like a hair salon,or small bakeshop, would be very appropriate. First of all I want to state that Wilma McDonell is not from this neighborhood,she bought a building and had a Beauty Salon in it for years, she decided to sell the building and when she couldn't decided to rent it as a car lot. This property sits on the corner of Sheridan and Groveland on the bad bend in the street on Sheridan I wonder if any one has come and viewed the property? First of all it only has a 3 car parking lot,so if you put three cars in that lot to sell where are customers to park. The streets in this neighborhood are narrow,they were not built for large trucks and SUV'S at times we have one lane traffic on Sheridan when people park on both sides of the street,same for Groveland,and there are very few if any sidewalks on Groveland or Sheridan. I drive Sheridan everyday and somedays I wonder how I made it home, and this is without added parking,we were over joyed when the beauty shop closed and we didn't have to worry about the people parked on both sides of the street any more, now you want to rezone for a business that will surely have to park in the streets. I as a resident and tax payer of this neighborhood for over 20 year object strongly to the change in zoning especially for someone who cares so little about the neighborhood she doesn't even live in.. My property is adjacent to this property and I have noticed some changes in recent weeks with the activity taking place at 785 Groveland Place that are concerning. On the weekend of 9/19/20-9/20/20 I was coming back to my house in the south bound lane of Sheridan Road, I was unable to get to my house because there was a truck and trailer with a car on it parked across the road (west to east).The individuals involved proceeded to unload what appeared to be a race car and placed it in the garage,This took no less than 30 min. (I did not wait the entire time but watched when i got to my house as car after car tried to pass) I drove around the block roadway to get to my residence.This was an inconvenience to myself and several other commuters and could have been far more serious should an emergency vehicle needed to pass. I also noticed there was an old rusty car next to the garage in the grass (that does appear to have been removed). Another incident on the weekend of 9/26/20-9/27/20 woke me up at 6:OOam on both Saturday and Sunday to the loud banging of inetal, a pneumatic drill, and the revving V8 engine with poor or no exhaust.This activity continued throughout both days. If this is any indication of what is to come, I strongly disagree with both the rezoning and the auto sales business. Given the choice, I would vote against the rezoning and vote against the auto sales business.This activity is not appropriate in a peaceful,well established neighborhood. Sheridan and Groveland both already have high volumes of traffic due to Sheridan being a main through way for thousands of citizens. Sheridan is also an emergency vehicle route and a school route. My concerns are that this intersection will be overwhelmed with the added traffic of an auto dealer,the noise pollution (which others and I had the displeasure of experiencing already),the blocking of the roadways when loading and unloading vehicles,the parking availability (of which there is already very little for residents)for auto dealer customers, and the safety of residents in the neighborhood walking along or crossing the street on these two through ways while traffic attempts to navigate through moving dealership cars and customer parked cars. Safety being my biggest concern, evident by my contacting the city about vehicles traveling well above the posted speed limit on Sheridan Road. Now the council had before it another proposal for a business at this corner,this is a residential neighborhood a business being brought into this neighborhood again would not only cause parking problems but a car dealership I believe is not possible because of lack of space for cars to be sold. The person who wants to open this dealership went to one of the neighbors and told her that Wilma McDonell sold this property to his father and if they could not open a car dealership they would open a canabus shop(which is not legal in lowa) or a tattoo parlor, neither of which belongs in this neighborhood.
