Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicants, Wilma McDonell and Nick Bries, spoke in favor of their request to
rezone a property that contains a two-story commercial building to an auto sales lot. Mr.
Bries said that his intent is to operate a small auto sales lot and have his son conduct
vehicle detailing in the attached garage. He stated that he was willing to abide by any
conditions that the Zoning Advisory Commission members felt necessary to mitigate
any potential negative impacts to the neighborhood.
Staff reviewed the staff report, noting that the applicants propose to convert a former
salon to an auto sales lot. Staff discussed the uses permitted in the C-1 and C-3
districts, required parking and traffic issues. Staff noted that, if the rezoning is
approved, the applicants will need to receive a variance in lot area for an auto sales lot
from the Zoning Board of Adjustment meeting.
Neighbors submitted letters and a petition in opposition to the request and nine
neighbors spoke at the meeting expressing concerns with traffic safety, parking, noise
and property value.
The Zoning Advisory Commission discussed the request and felt that an auto sales lot
would not be appropriate given the residential nature of the neighborhood, size of the lot
and the potential impacts generated by an auto related business.

Recommendation
By a vote of 0 to 7, the Zoning Advisory Commission recommends that the City Council
deny the request to rezone the property at 785 Groveland Place from C-1 Neighborhood
Commercial to C-3 General Commercial district.
A super majority vote is needed for the City Council to approve the request.

Property History: The subject property was platted circa 1930 as a part of the original
Burden-Lawther subdivision and a two-story block structure with first-floor commercial
space and residential units above was built on the lot in 1947. The structure has been
operated as a mixed-use building to the present.
Physical Characteristics: The subject property is an approximately 5,000 square foot
level corner lot with frontage on Groveland Place and Sheridan Road and alley access
on the north side of the lot. The subject lot has unlimited curb-cut access on three sides
with a non-compliant parking area on the north and south sides of the building.
Imagine Dubuque Comprehensive Plan Recommendations: The Imagine Dubuque
Comprehensive plan encourages a mix use development but recommends that
incompatible uses be buffered from each other.
Future Land Use Map — Commercial.
Impact of Request on:
Utilities: City water and sanitary sewer are available to the site with adequate
capacity to serve the building.
Traffic Patterns/Counts: There are no IDOT traffic counts for the surrounding
streets. However, there are some permitted uses in the C-3 General Commercial
district that can generate significant traffic volumes on what are primarily residential
streets.

Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
because the site is currently almost fully developed and any expansion would be
subject to current setback, required parking and parking lot design standards.
Adjacent Properties: The proposed rezoning to C-3 General Commercial district
has the potential to introduce relatively intense commercial uses into a primarily
single-family neighborhood. The amount of noise, activity, traffic and demand on
parking that could result may be excessive given the proximity of the surrounding
residential properties.
CIP Investments: None proposed.
Staff Analysis: The applicant's request is to rezone a 5,000 square foot lot that is
currently zoned C-1 Neighborhood Commercial district to C-3 General Commercial
district. The building has been operated as a commercial entity such as a grocery store,
office and hair salon with upper story residential uses since it was built in 1947.
However, most of the former commercial uses were relatively low intensity
neighborhood-oriented businesses.
The preamble of the C-3 General Commercial district states that the district is intended
to provide locations for commercial uses which are designed to serve the motoring
public or uses requiring highway or arterial locations. The proposed rezoning to C-3
General Commercial district has the potential to introduce relatively intense commercial
uses into a primarily single-family neighborhood. The amount of noise, activity, traffic
and demand on parking that could result may be excessive given the proximity of the
surrounding residential properties. In addition, the parking areas on the property are
substandard with no well-defined access and no drive aisle thus requiring vehicles to
back directly into the public right-of-way.
If approved, the Zoning Board of Adjustment must review and approve a variance in lot
area prior to commencement of an auto sales dealership.
Recommendation
Planning staff recommends that the Zoning Advisory Commission review the
information provided with this packet and forward a recommendation regarding the
rezoning to the City Council in accordance with Section 16-9-5 of the Unified
Development Code for zoning reclassification.

Development Code, is hereby amended by reclassifying the hereinafter—described property
from C-1 Neighborhood Commercial District to C-3 General Commercial District, to wit:
Lot 106 Burden-Lawther Add and to the centerline of the adjoining public right-of-
way, all in the City of Dubuque, lowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, lowa.

provided by law.

Dear Zoning Advisory Commission and Dubuque City Council,
I am contacting your regarding the requested zoning change from G1 to C-3 at 785
Groveland Place.
I strongly oppose approval of the zoning change for the following reasons, and I thank
you for considering the following points as you review this matter.

1. NO BENEFIT TO THE NEIGHBORS: Having a general commercial zoning permit in
this location seems absurd, since this is a completely residential neighborhood. The G 1
neighborhood commercial permit was likely granted in 1940 when the building was built
as a corner grocery store to benefit the residents living in the neighborhood. A C-3
zoning permit in general, but specifically this auto sales/repair business, will provide NO
benefit to any of the neighborhood homeowners except Wilma McDonnell who has been
unsuccessful at selling or renting this property that is in serious disrepair.
2. PARKING—There is currently 1 tenant living in the building who has a car and will park
in the very small lot area around the building at 785 Groveland Place. Not to mention the
business owner's personal car, and then cars for sale and repair as well as customers'
cars. Where will all these cars be parked? Some of them will likely be parked in the
street on Sheridan Road and/or in front ar on the side of neighbors' houses, taking away
parking for our own vehicles and those of our guests. One neighbor, directly across from
the front parking area had a visitor's car damaged when a beauty shop customer backed
out and crashed into this visitor's car.
3. VISIBILITY—This is a problem that pre-dates the proposed tenant/auto repair sales
business. Cars parked in the side lot and/or at the curb (along Sheridan Rd) of 785
Groveland Place, create a visibility hazard for cars emerging from the alley adjacent to
the property, for cars turning onto Sheridan Road from Groveland Place, for pedestrians
crossing Sheridan road at either location, AND for cars travelling north on Sheridan
Road. Because of the way the street is constructed, this parking area juts out into the
right of way by nearly 16'.
Emerging from the alley, I have had multiple near collisions with cars driving north on
Sheridan Rd. because I cannot see oncoming cars due to the cars parked at 785, and the
on-coming cars cannot see me. This experience of driving out of the alley had been very
stressful, and I was about to call the City to ask them to investigate this parking situation,
when Willie's Beauty Shop closed. So, I didn't call. But the problem has already
returned with the Auto shop tenant, and I am requesting that this whole situation be

investigated and safety measures be put into place—because I'm trying to figure out the
liability issues here. IF an accident occurs because visibility is obstructed, who is liable?
The owner of the property causing the obstruction? The tenant with all the cars? The
City for not remedying a known problem? Or the driver who cannot see?

4. TOXIC FUMES &WASTE—
A. Engine/Mechanical Auto Repair Business—Allowed with C-3 Zoning: There is a
large garage space on the property, and this is clearly going to be a part of the
business, which already I observe is going to be about more than selling cars. Cars
have been delivered, which presumably belong to the owner of the auto sales
business. Given the condition of the cars, it's likely there will be a lot of car repair
happening in the garage as well as in the parking area. Another neighbor and I
observed 3 cars being worked on in the parking area on 9/27.
Repairs will involve chemicals such as motor oil, anti-freeze, gasoline (and fumes
from all). Then there will be the issue of disposing of these toxic chemicals and
materials, including old tires. Where will old tires be discarded? Will our corner
begin to resemble a junk yard? Will there be a commercial dumpster delivered that
we have to contend with?

• Please note: After I was observed taking photos on 9/27, this car was removed via tow
truck on 9/28.
C-3 zoning permit will allow this business to do auto body repair, including welding
and painting. Fumes from current products used for auto painting, metal welding,
paint removal chemicals, etc. are all harmful when inhaled; and the neighbors will be
forced to inhale these fumes. In addition, auto paint removed from older cars
contains lead—which as we all know poses a danger on exposure to children and
pregnant women. It's recommended that the water used to wash these vehicles be
contained so the lead doesn't get spread around. How will this water be contained
and then, disposed of? And who will monitor compliance? Children and pets often
walk along the streets around this property, and the alley—where there is a storm
drain...does anyone want potential lead or other toxic chemicals in the storm drain?
C. NOISE—both of these repair activities will generate a lot of noise on a regular
basis...day and night.

There are a lot of children in this neighborhood as well as older people, many of whom already
have health problems, myself included, and we will be especially vulnerable. I already have a
health condition as a result exposure to toxic chemicals, and should this business, that is wholly
unwelcomed in this neighborhood, expose me further, I will have to move, although I have loved
living in this quiet, safe, well-kept neighborhood for the past 10 years. That doesn't seem fair.
But it does bring me to my next point:
5. PROPERTY VALUE—Having a G3 general commercial zoned business in our purely
residential neighborhood, specifically a used car business, could reduce our property
values. I've done some online research and realtors estimate up to a 10%reduction from
an auto sales business in the neighborhood...auto body repair could be higher. My life-
savings is in this house, as I am sure is the case for many other neighbors who have lived
here for decades. I ask you to protect us, and vote NO on this zoning change.

neighborhood, he said. "We need to be protecting and building and strengthening our residential
neighborhoods, not chipping away at them," Estrop said."

neighbor) said. "It's really a concern because once it's a�roved, there's no way to monitor how
many vehicles he has," Husted said.
A similar car lot converted from an office on Burnett Road has become an eyesore because of the
number of cars on the lot, Husted said. "It's just so crowded," she said.
Cars parked along the street would block her sign, Husted said. Traffic and crime would
increase, while property values would decrease, she said.

I recieved your notice of a public hearing for 785 Groveland PI and the possible rezoning. I most strenuously disagree
with allowing the rezoning. This is a residential area and I would prefer it stay that way. I know that when the beauty
parlor was open the traffic was constantly being reduced to a single lane on Sheridan and seeing to drive out of the alley
could be a real challenge. I really don't want a bunch of cars sitting out and truly don't know where they would put them
as the lot isn't that big. I'm aware that a lot of my neighbors are also not in favor of the change and would hope the city

Greetings! My name is Cindy (Sand) Nielsen, and I am writing to you regarding a concern I
have regarding a certain business that wishes to be located at the corner of Groveland Place
and Sheridan Road.My understanding is this is to become a used car lot.
I'm against this business locating there for the following reasons:
1.) Aesthetics: the area in which this used carlot would be placed is a residential district,with
many family homes,etc. It is in a quiet,beautiful area of the City of Dubuque; the nearest
businesses located on Peru Road. The addition of lights,etc., would cause a burden to
families living in that neighborhood, inhibiting a resident's quiet time/sleeping time. This is
an area I am proud to have grown up in, from the time I was a toddler until I married at age
24-years-old. One of my siblings still lives in the area, in our childhood home.
2.) Location: this particular area is home to many families,especially with young children.
Placing a used car lot there would create a hazard, as Sheridan Road, one of the main
streets, would increase the flow of traffic to the used car lot. This, in turn would cause
anyone driving on that road to become more aware of pedestrian traffic,particularly when
young children are involved. Some of the key times would be especially when school
is dismissed for the afternoon,and on weekends when there is more free time and nice
weather. Even though people cross at the corner,there is no defined crosswalk. Any driver
not paying attention,or is distracted by other means, could cause an accident, resulting in
injuries.
3.) Traffic Increase and Flow: As I stated above, the used car lot would cause an increase
of traffic to Sheridan Road,along with the possibility of traffic increase to Groveland Place.
Also, on the north end ofSheridan Road, leading to Peru Road, is the staff and service
entrance to Stonehill Care Facility. Traffic is higher at the times of shift changes at the
facility, along with delivery and other necessary services.
In all, while someone is willing to bring a new business to Dubuque's north end, it is equally
important to give strong consideration to the location of said business.. I am not against a
business going into that area. I feel, after some thought, a smaller,similar business like a hair
salon,or small bakeshop, would be very appropriate. One other item to consider, would the
size of that particular area be appropriate for a used car lot, or would additional structures,
ie,nearby homes, need to be torn down, displacing the owners, to satisfy the zoning
requirement? Would that be a necessary step, when in all reality itisamajorinconveniemce to
the neighbors residing there,some for many years?

It is my understanding that Wilma McDonell has requested the property at 785 Groveland Place from C-
1 to C-3. I am writing this to let you know that I am opposed to this. If I read the description for C-1 is
established in a very limited basis to provide individual parcels for commercial and residential used in
older buildings in the cities established neighborhoods while maintaining neighborhood character and
fostering. Now the description for C-3. The C-3 General Commercial is intended to provide locations for
commercial uses which are designed to serve the motoring or uses requiring highway or arterial
locations.
As I read the above I can see very valid reasons for not allowing this.the area in the request is a
residental area. It is a quiet area where people sit in our yards visit with our neighbors. I believe a used
car lot would be a mistake.This area is not an area that an used car lot would be an asset to this area. I
cannot imagine anyone thinking this would be a good fit.There are many places in the city that an used
car lot would fit, but not in the middle of a residential area.
Please consider the aesthetics of our area, a used car lot is not a good fit for this area.

I am concerned about the parking for the customers there are no sidewalks,we got people walking on
the street,the "S" shape street drive just 50ft from there,if anybody park on Sheridan on either side is
very dangerously for drivers and private park cars, I drive school bus and my route include drive thru
Sheridan on my way to Jefferson Middle School 3 times a day so is another 4 routes and is concerning to
me if they ok the Zoning change. I got a question how many parking spots they will need to qualify for
car dealer license? I don't believe they have enough space to make a profitable business and as a
residential neighborhood we do not want this kind of business in our midst. We are a quite part of
town and want to keep it that way. I also know there are city ordinances for handicap parking and
access for businesses,this has neither. This will not be a good fit for our neighborhood and I disagree
that a business like this would generate any profit and only bring discord to the neighborhood. Please
vote against this and ask Wilma if she would like to live next to a car dealership.

Good Evening,
I'm writing regarding the proposal of rezoning ...... in order to accommodate a used car lot. I am unable to attend the
virtual meeting this evening, but wanted to share my concerns.
My first concern is that allowing the rezoning and opening of the proposed used car lot will increase activity in our
neighborhood. While I support thriving neighborhoods, I feel that having this business could potentially bring increased
crime into our area.
My second concern is the increased traffic the business will bring to our neighborhood. Sheridan Rd. is currently a very
busy street with traffic coming to/from Peru Rd. to Windsor Ave.
I'm also concerned about increased noise levels, and losing our neighborhood aesthetic as one of the main reasons I
purchased a home in this neighborhood was because of how quiet it is.
With that said I am opposed to having this property rezoned. Thank you for your time and consideration.

My name is Theresa Ludovissy and I live at 740 Goethe Street. I am not able to be at the meeting on Wednesday, Oct. 7.
I work nights.
I am against the proposal to zone the propety on Groveland for auto sales.
The reason for that is we do not need any more traffic and speeding on Sherdian then we already have. I feel that if
they want to sell cars and buy them there are plenty others places to do so that are in commerical areas.
This is a pretty quiet and friendly neighborhood.
We have not have had much trouble in this area at all.
Also, where are they gonna park all the cars at.
There is not much room for that at all unless they are going to park them on the street.

A request has been made to rezone property at 785 Groveland Place and I live four houses from that
address on Goethe Street. First of all I want to state that Wilma McDonell is not from this
neighborhood,she bought a building and had a Beauty Salon in it for years, she decided to sell the
building and when she couldn't decided to rent it as a car lot.
This property sits on the corner of Sheridan and Groveland on the bad bend in the street on Sheridan I
wonder if any one has come and viewed the property? First of all it only has a 3 car parking lot,so if you
put three cars in that lot to sell where are customers to park. The streets in this neighborhood are
narrow,they were not built for large trucks and SUV'S at times we have one lane traffic on Sheridan
when people park on both sides of the street,same for Groveland,and there are very few if any
sidewalks on Groveland or Sheridan. I drive Sheridan everyday and somedays I wonder how I made it
home, and this is without added parking,we were over joyed when the beauty shop closed and we
didn't have to worry about the people parked on both sides of the street any more, now you want to
rezone for a business that will surely have to park in the streets.
I as a resident and tax payer of this neighborhood for over 20 year object strongly to the change in
zoning especially for someone who cares so little about the neighborhood she doesn't even live in..

I am writing in regards to a proposal to rezone a property(785 Groveland Place) from C-1 Neighborhood
Commercial to C-3 General Commercial to allow for an auto sales lot.
My property is adjacent to this property and I have noticed some changes in recent weeks with the
activity taking place at 785 Groveland Place that are concerning.
On the weekend of 9/19/20-9/20/20 I was coming back to my house in the south bound lane of
Sheridan Road, I was unable to get to my house because there was a truck and trailer with a car on it
parked across the road (west to east).The individuals involved proceeded to unload what appeared to
be a race car and placed it in the garage,This took no less than 30 min. (I did not wait the entire time
but watched when i got to my house as car after car tried to pass) I drove around the block roadway to
get to my residence.This was an inconvenience to myself and several other commuters and could have
been far more serious should an emergency vehicle needed to pass. I also noticed there was an old rusty
car next to the garage in the grass (that does appear to have been removed). Another incident on the
weekend of 9/26/20-9/27/20 woke me up at 6:OOam on both Saturday and Sunday to the loud banging
of inetal, a pneumatic drill, and the revving V8 engine with poor or no exhaust.This activity continued
throughout both days. If this is any indication of what is to come, I strongly disagree with both the
rezoning and the auto sales business.
Given the choice, I would vote against the rezoning and vote against the auto sales business.This activity
is not appropriate in a peaceful,well established neighborhood. Sheridan and Groveland both already
have high volumes of traffic due to Sheridan being a main through way for thousands of citizens.
Sheridan is also an emergency vehicle route and a school route.
My concerns are that this intersection will be overwhelmed with the added traffic of an auto dealer,the
noise pollution (which others and I had the displeasure of experiencing already),the blocking of the
roadways when loading and unloading vehicles,the parking availability (of which there is already very
little for residents)for auto dealer customers, and the safety of residents in the neighborhood walking
along or crossing the street on these two through ways while traffic attempts to navigate through
moving dealership cars and customer parked cars. Safety being my biggest concern, evident by my
contacting the city about vehicles traveling well above the posted speed limit on Sheridan Road.
Please consider these factors as you move forward with this matter.Thank you for your time and

It is my understanding the council will take under advisement a zoning proposal at 785
Groveland Place tonight at the council meeting. I live at 727 Goethe and use Sheridan
Road which intersects Groveland and the property in question is on the corner of
Groveland and Sheridan, daily to get to the west end and my job.
I grew up in this neighborhood, my parents build the house I now live in,they built it in
1952 so I am very familiar with the neighborhood and the people in it. When I was a
child this building was a small neighborhood grocery store, later Wilma McDonell put in
a beauty shop,the parking on this corner in the evening was always a problem because
of the narrow street and lack of off street parking and no sidewalks,several time my
neighbors had to call the beauty shop to have cars removed from blocking their
driveways because of lack of parking.
Now the council had before it another proposal for a business at this corner,this is a
residential neighborhood a business being brought into this neighborhood again would
not only cause parking problems but a car dealership I believe is not possible because of
lack of space for cars to be sold.
The person who wants to open this dealership went to one of the neighbors and told
her that Wilma McDonell sold this property to his father and if they could not open a car
dealership they would open a canabus shop(which is not legal in lowa) or a
tattoo parlor, neither of which belongs in this neighborhood.
I ask that this zoning not pass and this building should go back to a residential status we
do not need another business to come into our quiet neighborhood.
Please consider the life long residents of this neighborhood, most of which have been in
this neighborhood 30+years, as to a fly by night business which would not be good for
these neighbors.
