CITY COUNCIL PROCEEDINGS
REGULAR SESSION
OFFICIAL
The Dubuque City Council met in regular session at 6:30 p.m. on November 2, 2020.
Due to the COVID-19 pandemic and mandates for social distancing, this meeting was
conducted virtually via GoToMeeting and aired live on CityChannel Dubuque (Mediacom
cable channels 8 and 117.2), streamed live on the city’s website at www.cityofdubu-
que.org/media, and streamed live on the City’s Facebook page at www.face-
book.com/cityofdubuque.
Present: Mayor Buol; Council Members Cavanagh, Jones, Lynch, Resnick, Roussell,
Sprank; City Manager Van Milligen, City Attorney Brumwell
Mayor Buol read the call and stated this is a regular session of the City Council called
for the purpose of conducting such business that may properly come before the City
Council.

PRESENTATION(S)
1. COVID-19 Update: Mary Rose Corrigan, Public Health Specialist for the City of
Dubuque, and Mark Dalsing, Chief of Police, provided an update on the COVID-19 pan-
demic and response activities.

1. Philanthropy Day (November 15, 2020) was accepted by Christel Tatro of the As-
sociation of Fundraising Professionals Tri-State Chapter.
2. Hospice Month Proclamation (November 2020) was accepted by Mayor Buol on
behalf of Hospice of Dubuque.

tion, the documents were received and filed.
2. Approval of City Expenditures: City Manager recommended City Council approval
for payment of City expenditures. Upon motion, the documents were received and filed,
and Resolution No. 328-20 Authorizing the Director of Finance and Budget/City Treasurer
to make certain payments of bills that must be paid and approved for payment in accord-
ance with City procedures was adopted.

AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO
MAKE CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR
PAYMENT IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that
the Finance Director-City Treasurer shall keep an accurate account of all disbursements,
money, or property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods
and services have been pre-audited by Finance Department personnel in accordance
with generally accepted internal control procedures and have been determined to have
been requisitioned for a lawful municipal purpose; and
Whereas, the Finance Director-City Treasurer has provided a list of Expenditures at-
tached hereto, and by this reference made a part hereof, to be drawn to pay for goods
and services provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -
18 adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks
in payment of certain expenditures known as Exception Expenditures prior to City Council
approval and such list is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The Finance Director-City Treasurer is hereby authorized to issue payment
for goods and services provided for City purposes in response to the purchase orders
and contracts issued in compliance with state and municipal code requirements as re-
quested by designated requisitioning authorities in accordance with approved budget ap-
propriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance
Director are hereby authorized and directed to provide the statement of receipts and dis-
bursements to the City Council, and to publish a summary thereof.

3. School Resource Officer (SRO) Agreement with Dubuque Community Schools for
School Year 2020-2021: City Manager recommended approval of the Fiscal Year 2020-
2021 School Resource Officer Agreement between the City of Dubuque Police Depart-
ment and the Dubuque Community School District. Upon motion the documents were
received, filed, and approved.

4. Drug Abuse Resistance Education (DARE) Program Agreement with Dubuque Com-
munity Schools for School Year 2020-2021: City Manager recommended approval of the
Fiscal Year 2020-2021 Drug Abuse Resistance Education (DARE) Agreement between
the City of Dubuque Police Department and the Dubuque Community School District.
Upon motion the documents were received, filed, and approved.
5. Neighborhood Resource Center Usage Agreement Renewal with Dubuque Commu-
nity School District: City Manager recommended approval of the 28E Agreement between
the Dubuque Community School District and the City of Dubuque for the usage of the
Neighborhood Resource Center located within Prescott Elementary School for another
10-year term with an automatic 5-year extension. Upon motion, the documents were re-
ceived, filed, and approved.
6. Downtown Rehabilitation Loan for 1132 Locust Street: City Manager recommended
approval of a Loan Agreement between the City of Dubuque and Judy C. Davison for
residential improvements made at 1132-1136 Locust Street. Upon motion, the documents
were received and filed, and Resolution No. 329-20 Approving a Downtown Rehabilitation
Loan Agreement Between the City of Dubuque, Iowa and Judy Davison for the Redevel-
opment of 1132 Locust Street was adopted.
RESOLUTION NO. 329-20
APPROVING A DOWNTOWN REHABILITATION LOAN AGREEMENT BETWEEN
THE CITY OF DUBUQUE, IOWA, AND JUDY DAVISON FOR THE REDEVELOPMENT
OF 1132 LOCUST STREET
Whereas, the City Council of the City of Dubuque, Iowa, created a Downtown Rehabil-
itation Loan/Grant Program (the Program) for the purpose of stimulating reinvestment in
the Greater Downtown Urban Renewal District; and Whereas, the loan application from
Judy Davison for the redevelopment of 1132 Locust Street (the Property) meets the re-
quirements of the Program; and
Whereas, the City Council authorized the execution of all necessary loan documents
and further authorized disbursement of said loan funds by Resolution 53 -11, adopted on
February 22, 2011; and
Whereas, the Loan Agreement, hereto attached and by this reference made a part
hereof, sets forth the terms and conditions of Judy Davison’s participation in the Program;
and
Whereas, it is the determination of the City Council that approval of the Loan Agree-
ment for redevelopment of the Property by Judy Davison, according to the terms and
conditions set out in the Loan Agreement, is in the public interest of the City of Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. That the Loan Agreement between the City of Dubuque and Judy Davison,
is hereby approved.
Section 2. That the Mayor is hereby authorized and directed to execute the Loan
Agreement on behalf of the City of Dubuque and the City Clerk is authorized and directed
to attest to his signature.

Section 3. That the City Manager is authorized to take such actions as are necessary
to comply with the terms of the Loan Agreement as herein approved.

7. Olde Davenport Road Water Main & Sanitary Sewer Extension Iowa Department of
Transportation - Preconstruction Funding Agreement: City Manager recommended ap-
proval for the Mayor to execute the Iowa Department of Tran sportation Preconstruction
Funding Agreement for the purpose of constructing public water main and sanitary sewer
service to the new Iowa DOT Maintenance Facility. Upon motion, the documents were
received and filed, and Resolution No. 330-20 Approving the Preconstruction Funding
Agreement (Agreement No. 2021-2-020) between the City of Dubuque and Iowa Depart-
ment of Transportation for the Construction of Water Main and Sanitary Sewer along Olde
Davenport Road was adopted.

APPROVING THE PRECONSTRUCTION FUNDING AGREEMENT (AGREEMENT NO.
2021-2-020) BETWEEN THE CITY OF DUBUQUE AND IOWA DEPARTMENT OF
TRANSPORTATION FOR THE CONSTRUCTION OF WATER MAIN AND SANITARY
SEWER ALONG OLDE DAVENPORT ROAD
Whereas, the Iowa Department of Transportation (Iowa DOT) is currently constructing
a new Maintenance Garage Facility at the corner of the Southwest Arterial US61 -151
interchange and Olde Davenport Road; and
Whereas, the Iowa DOT collaborated with the City for the extension of public wate r
main and sanitary sewer to serve the new facility; and
Whereas, as part of the new Maintenance Garage Facility, the Iowa DOT is paying for
the construction and extension of new water main and sanitary sewer along Olde Daven-
port; and
Whereas, upon completion of the utility extensions, the water main and sanitary sewer
will become the property of the City as public utilities; and
Whereas, , the City determined the water main should be a 16 -inch water main to
accommodate potential annexation growth and future demand in the area; and
Whereas, the City agreed to pay the incremental cost difference between an 8 -inch
water main and the 16-inch water main to be installed.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS FOL-
LOWS:
Section 1. City of Dubuque and the Iowa Department of Transportation hereby agree
to partner on the extension of public water main and sanitary sewer to serve the new
facility.
Section 2. Whereas, City hereby agrees to pay the incremental cost difference between
an 8-inch water main and the 16-inch water main to be installed.
Section 3. The Mayor is hereby authorized to execute the Preconstruction Funding
Agreement (Agreement No. 2021-2-020), between the City of Dubuque and the Iowa De-
partment of Transportation for the purpose of constructing public water main and sanitary
sewer to provide service to the new Iowa DOT Maintenance Facility.

8. Request for Proposal - Port of Dubuque Dock Expansion Consultant: City Manager
recommended approval to initiate the Request for Proposals process for Professional
Consultant Services to complete the Final Engineering Design Phase for the Port of
Dubuque Riverfront Dock Expansion. Upon motion, the documents were received, filed,
and approved.
9. Request for Proposal - East / West Corridor Capacity Improvements: City Manager
recommended approval to initiate the Request for Proposals process for Professional
Consultant Services to complete the Preliminary Engineering Design and NEPA / Envi-
ronmental Study Phase to advance the development of East-West Corridor Capacity Im-
provements along University Avenue at the intersections at Loras Boulevard, Asbury
Road and Pennsylvania Avenue. Upon motion, the documents were received, filed, and
approved.
10. Contracted Services Agreement for DuRide: City Manager recommended approval
of a Contracted Services Agreement for Fiscal Year 2021 with DuRide to provide trans-
portation services for senior citizens. Upon motion, the documents were received, filed,
and approved.
11. Sister of Charity of the Blessed Virgin Mary / BVM-PHS Senior Housing, Inc. Up-
dated and Restated Water Meter Equipment Agreement: City Manager recommended
approval of an Updated Water Meter Wireless Network Equipment License Agreement
between the City of Dubuque, Sisters of Charity of The Blessed Virgin Mary and BVM -
PHS Senior Housing Inc. for the location of wireless water meter reading collection equip-
ment at the Motherhouse Building, 1150 Carmel Drive. Upon motion, the documents were
received, filed, and approved.
12. Purchase of 1001 Garfield Avenue: City Manager recommended authorization to
acquire land located at 1001 Garfield Avenue from Berach Land Holdings 20, LLC for the
purpose of combining the lot with the property at 1908 Schiller Street, making that lot
more desirable for building a new affordable home for an income-qualified homebuyer.
Upon motion, the documents were received and filed, and Resolution No. 331-20 Approv-
ing the Acquisition of Real Estate Owned by the Berach Land Holdings 20, LLC, a Ne-
braska Limited Liability Company at 1001 Garfield Avenue in t he City of Dubuque was
adopted.

APPROVING THE ACQUISITION OF REAL ESTATE OWNED BY THE BERACH LAND
HOLDINGS 20, LLC A NEBRASKA LIMITED LIABILITY COMPANY AT 1001 GAR-
FIELD AVENUE IN THE CITY OF DUBUQUE

Whereas, the City of Dubuque intends to acquire certain real estate for the purpose of
combining two parcels to construct a new home and resell to an income qualified house-
hold; and
Whereas, the acquisition of this property is a voluntarily negotiated purchase by the
City of Dubuque under Section 6B.1A of the Code of Iowa, and is not an acquisition by
the City of Dubuque through its exercise of the power of eminent domain under Chapte r
6B of the Code of Iowa; and
Whereas, a purchase agreement has been finalized with Berach Land Holdings 20,
LLC a Nebraska Limited Liability Company of the property scheduled for acquisition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. That the City of Dubuque hereby approves the agreement for and acquisi-
tion of the following legally described property:
The Easterly 93.5 feet of Lot 5 in T. McCraney’s Second Addition to Dubuque in the
City of Dubuque, Iowa, according to the recorded plat thereof
At the cost of Two Thousand Dollars ($2,000.00).
Section 2. That the City of Dubuque be and is hereby authorized to accept a Warranty
Deed from Berach Land Holdings 20, LLC a Nebraska Limited Liability Company, co n-
veying the owner’s interest of the property to the City of Dubuque, Iowa for the herein
described real estate.
Section 3. That the City Clerk be and is hereby authorized and directed to cause said
Deed to be recorded in the office of the Dubuque County Recorder, together with certified
copy of the Resolution.

13. E.K.M., LLC Housing TIF Agreement (Sky Blue Housing Urban Renewal Area):
City Manager recommended approval of a Housing Tax Increment Financing (TIF) Agree-
ment between the City of Dubuque and E.K.M., LLC for the development of property in
the Sky Blue Housing Urban Renewal Area. Upon motion the documents were received
and filed, and Resolution No. 332-20 Approving an Agreement between the City of Dubu-
que, Iowa and E.K.M., LLC for the development of property in the Sky Blue Urban Re-
newal Area was adopted.

APPROVING AN AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND
E.K.M., LLC FOR THE DEVELOPMENT OF PROPERTY IN THE SKY BLUE HOUSING
URBAN RENEWAL AREA
Whereas, the City Council, by Resolution No. 250-19, dated July 1, 2019, declared its
intent to establish the Sky Blue Housing Urban Renewal Area; and
Whereas, pursuant to published notice, a public hearing was held on the intent to es-
tablish the Sky Blue Housing Urban Renewal Area on August 5, 2019 at 6:00 p.m. in the
City Council Chambers at the Historic Federal Building, 350 W. 6th Street, Dubuque, Iowa;
and

Whereas, the City Council, following the public hearing, by Resolution No. 281-19, ap-
proved the Sky Blue Housing Urban Renewal Area; and
Whereas, E.K.M, LLC is the owner of property in the Sky Blue Housing Urban Renewal
Area (the Property); and
Whereas, the City Council and Sky Blue, LLC desire to enter into the Agreement at-
tached hereto for the development of the Property; and
Whereas, it is the determination of the City Council that approval of the Agreement
according to the terms and conditions set out in the Agreement is in the public interest of
the City of Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Agreement by and between the City of Dubuque and E.K.M., LLC
is hereby approved.
Section 2. That the Mayor is hereby authorized and directed to execute the Agreement
on behalf of the City and City Clerk is authorized and directed to attest to hi s signature.
Section 3. That the City Manager is authorized to take such actions as are necessary
to comply with the terms of the Agreement as herein approved.

14. Letter of Support for National Mississippi River Museum & Aquarium REAP Appli-
cation: City Manager providing a copy of a letter of support on behalf of the City of Dubu-
que in support of the National Mississippi River Museum & Aquarium’s application to the
Iowa DNR REAP CEP grant program. Upon motion, the documents were received and

1. Merge Urban Development - 2nd Amendment to Development Agreement: City
Manager recommending that the City Council set a public hearing for November 16, 2020,
on the proposed Second Amendment to Development Agreement between the City of
Dubuque, Iowa and Port of Dubuque LLC which provided for the proposed issuance of

Urban Renewal Tax Increment Revenue Grant Obligations by increasing the number of
such grants, and providing for the publication of notice thereof . Upon motion, the docu-
ments were received and filed, and Resolution No. 334-20 Fixing the date for a public
hearing of the City Council of the City of Dubuque, Iowa on the Second Amendment to
Development Agreement between the City of Dubuque, Iowa and Port of Dubuque LLC
which provided for the proposed issuance of Urban Renewal Tax Increment Re venue
Grant Obligations by increasing the number of such grants, and providing for the publica-
tion of notice thereof was adopted setting a public hearing for a meeting to commence at
6:30 p.m. on November 16, 2020.

FIXING THE DATE FOR A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA ON THE SECOND AMENDMENT TO DEVELOPMENT AGREE-
MENT BETWEEN THE CITY OF DUBUQUE, IOWA AND PORT OF DUBUQUE LLC
WHICH PROVIDED FOR THE PROPOSED ISSUANCE OF URBAN RENEWAL TAX
INCREMENT REVENUE GRANT OBLIGATIONS BY INCREASING THE NUMBER OF
SUCH GRANTS, AND PROVIDING FOR THE PUBLICATION OF NOTICE THEREOF
Whereas, the City of Dubuque, Iowa (City) and Merge, LLC entered into a Develop-
ment Agreement dated the 18th day of November 2019, as amended by First Amendment
dated the 6th day of April, 2020, which provided among other things for the issuance of
urban renewal tax increment revenue grant obligations (the Grants); and
Whereas, Merge, LLC assigned the Development Agreement to Port of Dubuque, LLC
on the 13th day of February 2020, with the consent of City; and
Whereas, City and Port of Dubuque, LLC. now desire to further amend the Develop-
ment Agreement as set forth in the attached Second Amendment, subject to the approval
of the City Council; and
Whereas, the Second Amendment provides for an increase in the number of Grants;
and
Whereas, the City Council has tentatively determined that it would be in the best inter-
ests of City to approve the Second Amendment to Development Agreement; and
Whereas, before said Second Amendment may be approved, Chapter 403 of the Code
of Iowa requires that the City Clerk publish a notice of the proposal and of the time and
place of the meeting at which the City Council proposes to take action thereon and at
which meeting the City Council shall receive oral and/or written objections from any resi-
dent or property owner of said City to such proposed action.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The City Clerk is hereby authorized and directed to cause a notice to be
published as prescribed by Iowa Code Section 364.7 of a public hearing on the City’s
intent to approve the Second Amendment, to be held on the 16th day of November, 2020
in the form attached hereto.
Section 2. The City Council will meet at said time and place for the purpose of taking
action on the matter of approval of the Second Amendment to Development Agreement,
increasing the number of Tax Increment Revenue Obligations Revenue Grant Obliga-
tions, the proceeds of which obligations will be used to carry out certain of the special
financing activities described in the Urban Renewal Plan for the Greater Downtown Urban

Renewal District, under the terms and conditions of said Urban Renewal Plan. It is ex-
pected that the aggregate amount of the Tax Increment Revenue Grant Obligations will
be approximately $2,770,000.
Section 3. The City Clerk is hereby directed to cause at least one publication to be
made of a notice of said meeting, in a newspaper, printed wholly in the English language,
published at least once weekly, and having general circulation in said City, said publica-
tion to be not less than four days nor more than twenty days before the date of said
meeting on the disposal of the City’s interest in t he Property and the issuance of said
obligations.
Section 4. That the notice of the proposed action shall be in substantially the form
attached hereto.

APPROVING THE AMENDED AND RESTATED URBAN RENEWAL PLAN FOR THE
GREATER DOWNTOWN URBAN RENEWAL DISTRICT
Whereas, by Resolution 154-20 on May 18, 2020, the City Council of the City of Dubu-
que, Iowa authorized the preparation of an Amended and Restated Urban Renewal Plan
(the "Amended and Restated Plan") for the Greater Downtown Urban Renewal District
(the "District"); and
Whereas, the City of Dubuque's primary objective for the Amended and Restated Plan
is to provide opportunities which will further economic development purposes and objec-
tives and remediate blighting conditions, and to address these objectives, additional pro-
jects are being added as described in the Amended and Restated Plan; and
Whereas, a consultation process has been undertaken with affected taxing entities in
accordance with Chapter 403 of the Code of Iowa with no written objections or recom-
mended changes to the Amended and Restated Plan received; a nd

Whereas, the City Council, in accordance with Chapter 403 of the Code of Iowa, has
held a public hearing on the proposed Amended and Restated Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

Whereas, sealed proposals have been submitted by contractors for the Dubuque Wa-
ter Supply Well Repair and Rehabilitation Project 2020 (Wells 3, 6, and 8), (the Project)
pursuant to Resolution No. 299-20 and Notice to Bidders published on the City of Dubu-
que, Iowa website and plan room service with statewide circulation on the 25th day of
September 2020; and
Whereas, said sealed proposals were opened and read on the 22nd day of October
2020 and it has been determined that Peerless Well & Pump of Dubuque, Iowa, in the
base bid amount of $31,460.00, is the lowest responsive, responsible bidder for the Pro-
ject.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:

A Public Improvement Contract for the Dubuque Water Supply Well Repair and Reha-
bilitation Project 2020 (Wells 3, 6, and 8) is hereby awarded to Peerless Well & Pump
and the City Manager is hereby directed to execute a Public Improvement Contract on
behalf of the City of Dubuque for the Project in the amount of $31,460.00 plus costs, listed
in the Unit Price Item Schedule as approved by the Change Order process, estimated to
be $43,231 plus labor at the provided labor rates.

2. Dubuque Racing Association Memorandum of Understanding Regarding Endow-
ment Fund: City Manager recommended that the City Council approve the Memorandum
of Agreement that would redirect DRA endowment contributions for two years, 2020 and
2021. Motion by Lynch to receive and file the documents and approve the Memorandum.
Seconded by Jones. Responding to questions from the City Council, City Manager Van
Milligen discussed the history of the City’s lease agreement with the DRA, the purpose of
the endowment, and the reasons that the DRA delayed charitable giving this year. City
Council expressed the need for a plan for the DRA as COVID continues. City Attorney
Brumwell responded to City Council questions about the agreement, stating that she
would need to review the agreement to confirm if there are any violations to the agree-
ment by not taking certain steps. Brumwell stated that the action item related to the en-
dowment could be handled as recommended at this Council meeting and that any issues
with other provisions of the agreement could be handled separately following review re-
lated to compliance.
Van Milligen requested the motion be amended to hold in abeyance the clause that
would force the distribution of funds this year at a certain level. Lynch moved to amend
the motion. Seconded by Jones. Motion carried 6-1 with Resnick voting nay.
3. Greater Downtown Urban Renewal District – Ordinance: City Manager recom-
mended adoption of an ordinance amending the Tax Increment Financing District for the
Greater Downtown Urban Renewal District that will expand the District to include the new
Stafford Street Subarea. Motion by Cavanagh to receive and file the documents and that
the requirement that a proposed ordinance be considered and voted on for passage at
two Council meetings prior to the meeting at which it is to be passed be suspended. Se-
conded by Resnick. Motion carried 7-0.
Motion by Cavanagh for final consideration and passage of Ordinance No. 41-20
Amending Ordinance No. 20-20, Previously Amended, providing that general property
taxes levied and collected each year on all property located within the Greater Downtown
Urban Renewal District of the City of Dubuque, County of Dubuque, State of Iowa, by and
for the benefit of the State of Iowa, City of Dubuque, County of Dubuque, Dubuque Com-

Subarea B, Ice Harbor Subarea C, Industrial Harbor, Kerper Boulevard, Old Main, South
Bluff, South Main, South Port, Town Clock, Town Clock Expansion, Upper Main , Ware-
house, Washington Street, North Kerper Boulevard, Quebecor, Harrison Street, Holy
Ghost, Almond Street, North End, West Locust Street Corridor, University Avenue Corri-
dor, Brewing & Malting, 15th Street, and Lower Kaufmann Subareas being added to wha t
is now known as the Amended and Restated Greater Downtown Urban Renewal District;
and
Whereas, consistent with the amendments to the Urban Renewal Plan, Ordinance No.
30-82 subsequently was amended on numerous occasions to provide for the division of
taxes within the Amended and Restated Greater Downtown Dubuque Urban Renewal
District, most recently by Ordinance No. 26-17, creating separate base valuations for the
Bluff Street, Cable Car, Chaplain Schmitt, East 7th Street, Ice Harbor Subarea A, Ice Har-
bor Subarea B, Ice Harbor Subarea C, Industrial Harbor, Kerper Boulevard, Old Main,
South Bluff, South Main, South Port, Town Clock, Town Clock Expansion, Upper Main,
Warehouse, and Washington Street, North Kerper Boulevard, Quebecor, Harrison Street,
Holy Ghost, Almond Street, North End, West Locust Street Corridor, University Avenue
Corridor, Brewing & Malting, 15th Street Subarea, Lower Kaufmann, and North Peru Road
Subarea; and
Whereas, the Urban Renewal Plan for the Greater Downtown Urban Renewal District
was further amended and restated as an Amended and Restated Urban Renewal Plan,
pursuant to Resolution No. 335-20 approved on November 2, 2020, for the purpose of
expanding the Greater Downtown Urban Renewal District to include an additional area
described as the Stafford Street Subarea; and
Whereas, indebtedness has been incurred by the City, and additional indebtedness is
anticipated to be incurred in the future, to finance urban renewal project activities within

the combined area known as the Greater Downtown Urban Renewal District (the “Greater
Downtown Urban Renewal District”), and the continuing needs of redevelopment within
the Greater Downtown Urban Renewal District are such as to require the continued ap-
plication of the incremental tax resources within the expanded Greater Downtown Urban
Renewal District; and
Whereas, the following enactment is necessary to accomplish the objectives described
in the premises.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA, THAT:
Ordinance No. 20-20 is hereby amended to read as follows:
Section 1: For purposes of this Ordinance, the following terms shall have the following
meanings:
(a) Town Clock Subarea of the District shall include that area described as follows:
Beginning at the intersection of the north right-of-way line of Ninth Street with the east
right-of-way line of Central Avenue; thence south along the east right-of-way line of
Central Avenue to its intersection with the south right-of-way line of Fourth Street;
thence west along the south right-of-way line of Fourth Street to its intersection with
the west right-of-way line of Locust Street; thence north along the west right -of-way
line of Locust Street to its intersection with the north right-of-way line of Ninth Street,
but also including the adjacent City Lots 623 and 624 (Dubuque Museum of Art), the
Locust Street Parking Ramp between 8th and 9th Streets and the former U.S. Federal
Building located on City Lots 101, 102, 139, 140, and the N 54.5’ of City Lots 103 &
138, and the vacated alley between said lots; thence east along the north right -of-way
line of Ninth Street to its intersection with the east right -of-way line of Central Avenue,
and point of beginning, including all public rights-of-way.
(b) Town Clock Expansion Subarea shall include the following described properties:
South 1/2 of City Lot 167, City Lot 168 and City Lot 168A (Iowa Inn property); and Lots
1 & 2 of City Lots 204, 205, 206, 2 07 and 208, N. 23' of City Lot 263, S. 28.5' of City

(d) Upper Main Subarea of the District shall include that area generally bounded on
the North by Fourteenth Street, on the West by Locust Street but including City Lots
658A, 659, 660, and the balance of City Lots 658 (Carnegie -Stout Public Library), on
the South by the northerly boundary of the Town Clock Subarea and on the East by
Central Avenue, and including all public rights-of-way.
(e) Ice Harbor Subarea A of the District shall include that area generally bounded
on the north by the public alley located bet ween the vacated Fourth Street and Third
Street, on the west by the Chicago, Central and Pacific Railroad right -of-way, on the
south by East First Street and on the east by the municipal limits of the City of Dubu-
que, Iowa and including any adjoining public right-of-way.
(f) Ice Harbor Subarea B of the District shall include that area generally bounded on
the north and west by the Chicago, Central and Pacific Railroad right -of-way, on the

(ee) Stafford Street Subarea of the district shall include the following described
properties:

Dubuque, Iowa, according to the recorded Plat thereof
All in the City of Dubuque, Iowa
(ff) Amended Project Area shall mean the areas of the City of Dubuque, Iowa
included within the Town Clock Subarea, the Old Main Subar ea, the Town Clock

Expansion Subarea, the Upper Main Subarea, the Ice Harbor Subarea A, the Ice
Harbor Subarea B, the Ice Harbor Subarea C, the Warehouse Subarea, the South
Main Subarea, the South Port Subarea, the Cable Car Subarea, the Bluff Street
Subarea, the South Bluff Street Subarea, the Kerper Boulevard Subarea, the Wash-
ington Neighborhood Subarea, the Industrial Harbor Subarea, the East 7 th Street
Subarea, the Chaplain Schmitt Subarea, the North Kerper Subarea, the Quebecor
Subarea, the Harrison Street Subarea, the Holy Ghost Subarea, the Almond Street
Subarea, the North End Subarea, the University Avenue Corridor Subarea, the West
Locust Corridor Subarea, the Brewing and Malting Subarea, the 15th Street Sub-
area, the Lower Kaufmann Subarea, the North Peru Road Subarea, and the Stafford
Street Subarea, each as described in this Section.
(gg) Urban Renewal Plan shall mean the Amended and Restated Urban Renewal
Plan for the Greater Downtown Urban Renewal District, approved by Resolution No.
335-20 on November 2, 2020, as the same may be amended from time to time.
Section 2: The taxes levied on the taxable property in the Amended Project Area, le-
gally described in Section 1 hereof, by and for the benefit of the State of Iowa, City of
Dubuque, County of Dubuque, Dubuque Community School District, and all other taxing
districts from and after the effective date of this Ordinance shall be divided as hereinafter
in this Ordinance provided.
Section 3: Taxes.
(a) As to the Town Clock Subarea, that portion of the taxes which would be pro-
duced by the rate at which the tax is levied each year by or for each of the taxing
districts taxing property in the Town Clock Subarea upon the total sum of the as-
sessed value of the taxable property in the Town Clock Subarea as s hown on the
assessment roll as of January 1, 1966, being the assessment roll last equalized
prior to the date of the initial adoption of the Urban Renewal Plan for the Downtown
Dubuque Urban Renewal Project, Iowa R-15, shall be allocated to and when col-
lected be paid into the fund for the respective taxing district as taxes by or for said
taxing district into which all other property taxes are paid. The taxes so determined
shall be referred herein as the "base period taxes" for such Subarea.
(b) As to the Old Main Subarea, base period taxes shall be computed in the same
manner using the total assessed value shown on the assessment roll as of January
1, 1993, being the assessment roll as of January 1 of the calendar year preceding
the effective date of Ordinance No. 23-94.
(c) As to the Town Clock Expansion Subarea, base period taxes shall be com-
puted in the same manner using the total assessed value shown on the assessment
roll as of January 1, 1996, being the assessment roll as of January 1 of the calendar
year preceding the effective date of Ordinance No. 67-97.
(d) As to the Upper Main Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2001, being the assessment roll a s of January 1 of the calendar year
preceding the effective date of Ordinance No. 26 -02.
(e) As to the Ice Harbor Subarea A, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 1988, being the assessment roll as of January 1 of the calendar year
preceding the effective date of Ordinance No. 66 -89.

(f) As to the Ice Harbor Subarea B, base period taxes shall be computed in the
same manner using the total assessed value shown on th e assessment roll as of
January 1, 1999, being the assessment roll as of January 1 of the calendar year
preceding the effective date of Ordinance No. 97 -00.
(g) As to the Ice Harbor Subarea C, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2006, being the assessment roll as of January 1 of the calendar year
preceding the effective date of Ordinance No. 20 -07.
(h) As to the Warehouse Subarea, base period taxes shall be compu ted in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2006, being the first day of the calendar year preceding the effective date
of Ordinance No. 63-07.
(i) As to the South Main Subarea, base period taxes shal l be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2006, being the first day of the calendar year preceding the effective date
of Ordinance No. 63-07.
(j) As to the South Port Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2007, being the first day of the calendar year preceding the effective date
of Ordinance No. 60-08.
(k) As to the Cable Car Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2008, being the first day of the calendar year preceding the effective date
of Ordinance 58-09.
(l) As to the Bluff Street Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2009, being the first day of the calendar year preceding the effective date
of Ordinance 51-10.
(m) As to the South Bluff Street Subarea, base period taxes shall be computed
in the same manner using the total assessed value shown on the assessment roll
as of January 1, 2010, being the first day of the calendar year preceding the effective
date of Ordinance 33-11.
(n) As to the Kerper Boulevard Subarea, base period taxes shall be computed in
the same manner using the total assessed value shown on the assessment roll as
of January 1, 1993, being the first day of the calendar year preceding the effective
date of Ordinance 43-94.
(o) As to the Washington Neighborhood Subarea, base period taxes shall be
computed in the same manner using the total assessed value shown on the assess-
ment roll as of January 1, 2010, being the first day of the calendar year preceding
the effective date of Ordinance 33-11.
(p) As to the Industrial Harbor Subarea, base period taxes shall be computed in
the same manner using the total assessed value shown on the assessment roll as
of January 1, 2010, being the first day of the calendar year preceding the effective
date of Ordinance 33-11.
(q) As to the East 7th Street Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of

January 1, 1996, being the first day of the calendar year preceding the effective date
of Ordinance 64-97.
(r) to the Chaplain Schmitt Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2010, being the first day of the calenda r year preceding the effective date
of Ordinance 33-11.
(s) As to the North Kerper Subarea, base period taxes shall be computed in the
same manner using the total assessed value shown on the assessment roll as of
January 1, 2011, being the first day of the calendar year preceding the effective date
of Ordinance 60-12.
(t) As to the Quebecor Subarea, base period taxes shall be computed in the same
manner using the total assessed value shown on the assessment roll as of January
1, 2001, being the first day of the calendar year preceding the effective date of Or-
dinance 88-02.
(u) As to the Harrison Street Subarea, base period taxes shall be computed in
the same manner, using the total assessed value shown on the assessment roll as
of January 1, 2011, being the first day of the calendar year preceding the effective
date of Ordinance 60-12.
(v) As to the Holy Ghost Subarea, base period taxes shall be computed in the
same manner, using the total assessed value shown on the assessment roll as of
January 1, 2013, being the first day of the calendar year preceding the effective date
of Ordinance 45-14.
(w) As to the Almond Street Subarea, base period taxes shall be computed in the
same manner, using the total assessed value shown on the assessment roll as of
January 1, 2013, being the first day of the calendar year preceding the effective date
of Ordinance 45-14.
(x) As to the North End Subarea, base period taxes shall be computed in the
same manner, using the total assessed value shown on the assessment roll as of
January 1, 2015, being the first day of the calendar year preceding the effectiv e date
of this Ordinance.
(y) As to the University Avenue Corridor Subarea, base period taxes shall be
computed in the same manner, using the total assessed value shown on the as-
sessment roll as of January 1, 2015, being the first day of the calendar year preced-
ing the effective date of this Ordinance.
(z) As to the West Locust Corridor Subarea, base period taxes shall be computed
in the same manner, using the total assessed value shown on the assessment roll
as of January 1, 2015, being the first day of the calendar year preceding the effective
date of this Ordinance.
(aa) As to the Brewing and Malting Subarea, base period taxes shall be computed
in the same manner, using the total assessed value shown on the assessment roll
as of January 1, 2007, being the first day of the calendar year preceding the effective
date of Ordinance 61-08.
(bb) As to the 15th Street Subarea, base period taxes shall be computed in the
same manner, using the total assessed value shown on the assessment roll as of
January 1, 2016, being the first day of the calendar year preceding the effective date
of Ordinance 6-17 and 6-17-A.

(cc) As to the Lower Kaufmann Subarea, base period taxes shall be computed in
the same manner, using the total assessed value shown on the assessment roll as
of January 1, 2016, being the first day of the calendar year preceding the effective
date of Ordinance 26-17.
(dd) As to the North Peru Road Subarea, base period taxes shall be computed in
the same manner, using the total assessed value shown on the as sessment roll as
of January 1, 2019, being the first day of the calendar year preceding the effective
date of Ordinance 20-20.
(ee) As to the Stafford Street Subarea, base period taxes shall be computed in
the same manner, using the total assessed value shown on the assessment roll as
of January 1, 2019, being the first day of the calendar year preceding the effective
date of Ordinance 41-20.
Section 4: That portion of the taxes each year in excess of the base period taxes for
the Amended Project Area, determined for each Subarea thereof as provided in Section
3 of this Ordinance, shall be allocated to and when collected be paid into the special tax
increment fund previously established by the City of Dubuque to pay the principal of and
interest on loans, monies advanced to, or indebtedness, whether funded, refunded, as-
sumed or otherwise, including bonds issued under authority of Section 403.9 or Section
403.12 of the Code of Iowa, incurred by the City of Dubuque, Iowa to finance or refinance,
in whole or in part, urban renewal projects undertaken within the Amended Project Area
pursuant to the Urban Renewal Plan, except that taxes for the regular and voter-approved
physical plant and equipment levy of a school district imposed pursuant to Section 298.2
of the Code of Iowa and taxes for the instructional support program of a school district
imposed pursuant to Section 257.19 (but in each case only to the extent required under
Section 403.19(2)), taxes for the payment of bonds and interest of each taxing distric t,
and taxes imposed under Section 346.27(22) related to joint county-city buildings shall
be collected against all taxable property within the Amended Project Area without any
limitation as hereinabove provided.
Section 5: Unless or until the total assessed valuation of the taxable property in the
Subareas of the Amended Project Area exceeds the total assessed value of the taxable
property in said Subareas shown by the assessment rolls referred to in Section 3 of this
Ordinance, all of the taxes levied and collected upon the taxable property in the Amended
Project Area shall be paid into the funds for the respective taxing districts as taxes by or
for the taxing districts in the same manner as all other property taxes.
Section 6: At such time as the loans, monies advanced, bonds and interest thereon
and indebtedness of the City of Dubuque referred to in Section 4 hereof have been paid,
all monies thereafter received from taxes upon the taxable property in the Amended Pro-
ject Area shall be paid into the funds for the respective taxing districts in the same manner
as taxes on all other property.
Section 7: All ordinances or parts of ordinances in conflict with the provisions of this
Ordinance are hereby repealed. The provisions of this Ordinance are intended and shall
be construed so as to continue the division of taxes from property within the Amended
Project Area under the provisions of Section 403.19 of the Code of Iowa, as authorized
in Ordinance No. 20-20, as previously amended, and to fully implement the division of
taxes in the Stafford Street Subarea. In the event that any provision of this Ordinance
shall be determined to be contrary to law it shall not affect other provisions or application

of this Ordinance which shall at all times be construed to full y invoke the provisions of
Section 403.19 of the Code of Iowa with reference to the Amended Project Area and the
territory contained therein.
Section 8: This Ordinance shall be in effect after its final passage, approval and publi-
cation as provided by law.

pal Parking Ramps. Motion by Jones to receive and file the documents and that the re-
quirement that a proposed ordinance be considered and voted on for passage at two
Council meetings prior to the meeting at which it is to be passed be suspended. Seconded
by Lynch. Responding to questions from City Council, City Manager Van Milligen stated
that the parking system was completed through the budget process and that the system
is an enterprise fund that is designed to support itself from an operational perspective.
Van Milligen stated that having a more dynamic system will be valuable as the City looks
to adjust parking prices on a daily or weekly basis. Motion carried 7-0.

5. Request for Work Session - Equitable Poverty Prevention Plan: City Manager rec-

COUNCILMEMBER REPORTS
Council Member Resnick reported witnessing many citizens wearing masks and social
distancing while Trick-or-Treating. Resnick thanked citizens for continuing to follow health
protocols.
Council Member Roussell reported that she attended a National League of Cities webi-
nar on how equitable fines and fees strengthen financial security. Roussell stated the
webinar pertains to the Council’s goal of equitable fines and fees. She has shared the
webinar information with her Council colleagues and certain city staff.
Council Member Jones reported that Election Day is November 3rd and requested cit-
izens vote if they had not already done so.
CLOSED SESSION
Motion by Jones to convene in closed session at 8:21 p.m.to discuss pending litigation
pursuant to Chapter 21.5(1)(c) Code of Iowa. Seconded by Resnick. Mayor Buol stated
for the record that the attorneys who will consult with City Council on the issues to be
discussed in the closed session are City Attorney Crenna Brumwell and Attorney Les
Reddick. Motion carried 7-0.
Upon motion, the City Council reconvened in open session at 9:11 p.m. stating that
staff had been given proper direction.
