ACTION TO BE TAKEN Should the City Council confirm the establishment of this Residential Parking Permit District around Senior High School, the attached ordinance creating the residential parking zone should be adopted. That the recommendation of the City Manager based upon the petition and the parking study to designate the area as a Residential Parking Permit Distdct during the hours of 7:00 a.m. to 2:30 p.m. daily, except Saturdays, Sundays, and holidays, is hereby approved and accepted. Section 4. That the Code of Ordinances of the City of Dubuque, Iowa, be amended by; enacting a new Section of 32-398 as follows: "Sec. 32-398. Koch, Public Works Director Parking - Senior High School Area INTRODUCTION This is in response to two petitions to remove a Two-Hour Parking Time Zone and to amend the existing Residential Parking-P~rmit District (RPPD) in the Senior High School area. BACKGROUND In October, 1985, the City Council adopted an ordinance allowing the designation of certain streets as Residential Parking Permit Districts. The purpose of such a district was to reduce traffic congestion resulting from the use of parking within residential districts by persons not residing within the district, to protect the residents of these districts from an unreasonable burden in gaining access to their residences, to preserve the character of such districts as residential districts, and other various purposes. The ordinance provides for such a designation only after a petition of residents representing 60 percent (60%) of the dwelling units in the proposed area is received, a parking study is conducted by the City Engineering Division and a public hearing is held by the City Council. To be eligible for such a district, there must be at least 80 percent (80%) of the curbside parking utilized during peak periods, and must have at least 25 percent (25%) of such utilization by non-residents of the area. Under such a designation, no one can park curbside within the district during the restricted hours without a residential or guest parking permit issued by the City. DISCUSSION On July 7, 2000, a petition containing sufficient signatures was received from residents on the south'side of Grandview Avenue east of Avoca Street requesting that this area be included in the existing adjacent Residential Parking Permit District C. This area is currently des'ignated as a Two-Hour Parking Time Zone. The residents would like the Two-Hour Rarking Time Zone removed, but believe that if that were done, the students would totally be utilizing these spaces during school hours. Therefore, they are requesting the RPPD designation where the Two-Hour Parking Time Zone currently exists. A Two-Hour Parking restriction also extends immediately west on the south side of Rosedale from Avoca Street to the alley east of St. Ambrose Street. When the July 7 petition was received, Engineering contacted a resident of this section of Rosedale to see if there would be any interest among the neighbors to extend the RPPD further and to repeal the Two-Hour Parking Time Zone for this area as well. It should be noted that currently there are no parking restrictions on the north side of Rosedale between Avooa and the St. Anthony's School property. In response to the City's inquiry, a petition containing sufficient signatures has since been received from residents representing 60 percent (60%) of the dwelling units on both sides of Rosedale Street from Avoca Street to the alley west of Avoca. Copies of both petitions are attached. Although the current Ordinance requires that staff conduct a parking study to determine parking usage in the affeote'd area, this was not possible due to the existing Two-Hour Parking Zone. It is clear that should the Two-Hour Parking Time Zone be removed that parking would relocate to this area and the 80 percent (80%) parking usage criteria would subsequently be met. RECOMMENDATION I would recommend approval of the petitions, and would recommend that the south side of North Grandview Avenue from the east property line of 1961 North Grandview to Avoca Street and the south side of Rosedate Street from Avoca Street to the alley east of St. Ambrose Street be removed from the ordinance for Two-Hour Time Zones. In addition, I would recommend that the following areas be included in the existing Residential Parking Permit District C: the south side of North Grandview Avenue from Avoca Street to the east property line of 1961 North Grandview Avenue; the south side of Rosedale Street from Avoca Street to the alley east of St. Ambrose Street; and the north side of Rosedale Street from Avoca Street to the west property line of 2095 Rosedale Street. The district parking regulations would be from 7:30 a.m. to 10 p.m. daily, except Sundays and holidays. I would further recommend that the City Council set a public hearing on the designation of portions of North Grandview Avenue and Rosedale Street as a Residential Parking Permit District between the hours of 7:30 a.m. and 10:00 p.m. daily, except Sundays and holidays. After the public hearing, the City Council may reject the petition, adopt an ordinance designating the proposed a~ea as a Residential Parking Permit District, or adopt an ordinance modifying the proposed district. The City Council may also adopt alternate hours other than 7:30 a.m. to 10:00 p.m. parking restriction. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution setting a public hearing on December 4 on the proposed Residential Parking Permit District on portions of North Grandview Avenue and Rosedale Street.
