Council met at 5 o'clock P. M.

Mayor Maclay stated that this is
the regular monthly meeting of the
Council for the purpose of acting
on any business that may properly
come before the meeting.
Petition of property owners on
Emmett Street, protesting against
the proposed improvement of said
street, stating that Emmett Street
should have been on the petition
protesting against the improvement
of St. Mary's Street as this street
is practically a continuation of said
St. Mary's Street. Signed by Mrs.
Rose Rooney, Mrs. Hannah Hyde,
St. Raphael's Cathedral, J. A. Ker-
per, secretary, J. J. Nagle, et al (9

Councilman McEvoy moved that
the petition be referred to Council
to be acted on at the next meeting

Report of the City Treasurer on
the petition of C. B. Trewin, rela-
tive to cancellation of the tax sale
certificate against lot 40 Quigley's
Sub. The treasurer reported on Dee.
5th, 1927, this property was sold
to the City of Dubuque in the
amount of $152.40 plus penalty and
interest, which was $76.20 more than
the balance on the books showed,
therefore the actual balance against
this lot for this improvement is
$76.20 or one -half of the amount of
the sale of Dec. 5th, 1927.
He recommends the cancellation
of the tax sale certificate on receipt
from Mr. Trewin of $76.20 with in-
terest at the rate of 6 per cent from
April 1st, 1926.
Councilman Meuser moved that
the recommendation of the Treasur-
er be approved and. that he be in-
structed to accept this amount from

Mr. Trewin and upon receipt of same
assign the tax certificate to him.

Honorable Mayor and City Council,
City of Dubuque.
Gentlemen: Six years ago the
City Council, under the authority
vested in them by the Iowa laws
created a Playground Commission
to promote and develop a suitable
playground program for the children
of the community. The Council is
familiar with the work which this
commission has performed and it is
now our desire to enlarge upon this
work.
The commission established four
playgrounds during its first year of
existence and the number was then
increased to six, then eight, and at
the present time we have ten play-
grounds in operation. For some
time there has been a conviction on
the part of the members of the Play-
ground Commission that an all year
program for the children, together
with recreational activities for cer-
tain groups of adults. would be ad-
vantageous.
This is directly in line with the
recommendation of the Playground
and Recreation Association of
America and the work being, done
for some years past by other cities
such as: Rock Island,, Cedar Rapids,
Waterloo, Madison and Des Moines.
Our. Commission has gone on rec-
ord favoring the adoption of the
year round program and it is now
our desire to present to you details
of our plan which will enable us, to
extend our program without costing
the tax payers of the community
any additional money.
We want to suggest thar much of
the added activities that wilI be in-
dulged in by the adults will be en-
tirely without expense on the part
of the commission.
We have arranged to have our
representatives at your meeting
when this petition is presented so
that they may answer any questions
that, you wish to ask about this. mat -
ter.
We therefore respectfully petition
your honorable body to change the
name of the City Playground Com-
mission to, the Municipal Playground
and Recreation Commission.. We
further request that you arrange
your appropriations, in accordance
with the recommendation set out
hereinbefore.

HARBOR COMPANY'S- ADDITION
TO THE CITY OF DUBUQUE"
SAID ORDINANCE HAVING
BEEN ADOPTED ON OCTOBER
7', 1895.
Whereas, An ordinance entitled
"Ordinance No.. G -14. An ordinance
for the vacation of Huff street and
alley in Block 29 in Dubuque Har-
bor Company's Addition to the City
of Dubuque," was adopted by the
City Council on October 7, 1895,
which ordinance provided for the
vacation of said str•eet, and alley and
the use thereof was granted' to •
Svendsen and Ott for' the purpose of
maintaining lumber yards or saw
mill thereon and it was: specifically
provided therein that whenever said
street and alley would cease to be
used for such purposes the same
should revert to the City of Du-
buque; and
Whereas, Said Svendsen and Ott,
their successors or assigns, have not
used said premises for the purposes
stated for many years; now there-
fore,
Be It Ordained by the City Council
of the City of Dubuque:
Par. 953. Section 1. That said
ordinance No. G -14 above referred to
be and the same is hereby repealed
and Huff street between Blocks 29
and 30 of Dubuque Harbor Com-
pany's Addition and the alley in
Block 29 of said Addition be and
the same is hereby declared to be
opened and established as a street
and alley of the City of Dubuque,
the dimensions thereof being as
shown upon the plat of said street
and alley heretofore made and re-
corded and as the same appears to
have been dedicated to the City of
Dubuque for street and alley pur-
poses.
Section 2, That this ordinance
shall be in force • and effect ten days
from and after its final passage and
adoption by the City Council and
publication as provided by law.

pany's Addition," said Ordinance
having been approved on September
25, 1905, and by establishing or re-
establishing said street and alley as
a public street and alley of the city
of Dubuque:
WHEREAS, Huff Street from the
south end of Railroad Avenue to the
south Iine of Dubuque Harbor Com-
pany's Addition and the alley be-
tween Huff and Salina Streets from
the south line of Railroad Avenue
to the south line of Dubuque Harbor
Company's Addition was heretofore
conditionally vacated to Ott - Meuser
and Company, the condition being
that said Ott - Menser Company used
said premises for lumber yard or
manufacturing purposes, and in the
event said grantee should fail to use
said premises for said purposes for
a period of 12 months the said va-
cated street and alley should revert
to the City of Dubuque; and
WHEREAS, said grantee, their
heirs, executors, administrators, suc-
cessors, or assigns have permitted
said premises to remain unemployed
for lumber or manufacturing pur-
poses for a period of more than 12
months, it is now deemed advisable
by the city council of the city of Du-
buque that it declare said vacated
street and alley to be the property
of said city of Dubuque; and
WHEREAS, it is also deemed ad-
visable by the council of said city
to cause said street and alley to be
opened and reestablished as a street
and alley in the city of Dubuque;
now therefore,
Be it ordained by the city council
of the City of Dubuque:
Par. 954. Section 1. That an or-
dinance entitled "Ordinance No. 0-5.1.
An Ordinance for the vacation of
Huff Street from the south end of
Railroad. Avenue to the south line of
Dubuque Harbor Company's Addi-
tion, also the alley between Huff and
Salina Streets from the south line of
Railroad. Avenue to the south line cl
the Dubuque Harbor Company's Ad-
dition" be and the same is hereby
repealed.
Par. 955. Section 2. That that
portion of Huff Street and the alley
lying between Huff and Salina
Streets from the south line of Rail-
road Avenue to the south line of the
Dubuque Harbor Company's, Addi-
tion, as platted and, heretofore va-
cated as herein stated, be and the
same aro hereby reestablished as a
street and alley of the city of Du-
buque and the name of said street
shall be restored to the name of
Huff Street.
Par. 9561. Section 3. That the

City Clerk be and he is hereby di-
rected to record this ordinance with
the recorder of Dubuque County,
Iowa, and thereafter said street and
alley shall be opened for public trav-
el thereon and all obstructions shall
be removed therefrom.
Section 4. This Ordinance shall
be in force and effect ten days from
and after its final passage and adop-
tion by the city council and publica-
tion as provided by law.

RESOLUTION OF NECESSITY
FOR THE CONSTRUCTION OF
STREET IMPROVEMENTS CON-
SISTING OF GRADING, PAVING,
CURBING, GU T T E R N G AND
DRAINING; FOR THE MAKING
OF UNDERGROUND CONNEC-
TIONS; AND FOR THE CON-
STRUCTION OR REPAIR OF
PERMANENT SIDEWALKS .
DRIVEWAYS AND WATER
DRAINS.
WHEREAS, a plat and schedule
have been duly prepared by the City
Council and is now on file in the
office of the Clerk, showing the
streets to be improved, the bound-
aries of the district, if any, the width
of the improvements, each lot pro-
posed to be assessed, an estimate of
the cost of the proposed improve-
ment for each type of construction
and kinds of materials to be used,
and in each case the amounts which
it is estimated will be assessed
against each lot for such improve-
ments:
BE IT, THEREFORE, RESOLVED
by the City Council of the City of
Dubuque, on its own motion or upon
petition of property owners, that it
is deemed necessary or advisable to
build, construct and put in place cer-
tain street improvements, as herein
described, in, upon and along the
following streets to wit:
East 16th Street from the east
property line of Washington Street
to the east property line of Pine
Street except where already paved.
East 13th Street from the east
property line of Washington Street
to the east property line of Pine
Street except where already paved.
Dell Street from the south pro-
perty line of West 14th Street to
the north property line of Arlington
Street.
Burch Street from the north pro-
perty line of Fenelon Street to the
south property line of Hill Street.
Perry Street from the west pro-

perty line of South Grandview to
end of present improvement.
Railroad Street from the east
property line of South Locust Street
to the east property line of South
Main Street and South Main Street
from the north property line of
Railroad Street to the end of the
present brick pavement.
Carlotta Street from the east pro-
perty line of Alpine Street to the
west property line of Alta Vista
Street.
Such street improvements shall
consist of grading, paving, draining,
curbing and guttering, the curb and
gutter shall be constructed of con-
crete or old stone curb may be re-
set, and the paving shall be con-
structed of one or more of the fol-
lowing materials and methods, to
wit:
By paving with 6 inch plain con-
crete.
All of the grading, paving, curb-
ing and guttering shall be construct-
ed and done in accordance with the
plans and specifications which have
been prepared therefor by the City
Engineer which have been or will
be approved by the City Council be-
fore a contract is entered into. The
railway portion on any of said
streets will be paved with either 2
inch Kentucky Rock Asphalt or 2
inch Carey Elastite Block on a 4
inch by 8 inch timber foundation
between the rails and one one foot
outside thereof. That sewer drains
shall be constructed where neces-
sary to take care of surface water.
That the cost and expense of mak-
ing said improvements shall be as-
sessed upon and against all privately
owned property lying within the as-
sessable distance provided by law,
whether the same abuts thereon or
is adjacent thereto, according to
area and in porportion to the special
benefits conferred, and any deficien-
cy shall be paid out of the general
or improvement funds of the City,
or partly out of each of such funds.
Bonds shall be issued and sold in
anticipation of deferred payments of
assessments when the contract has
been performed and accepted and
the proceeds thereof used to pay the
contractor. The railway portion of
any street shall be assessed to and
paid by said railway.
Be it further resolved that under-
ground connections with sewer,
water and gas mains in said streets
be deemed necessary and the same
are ordered made to the curb lines
of adjacent property before said
streets are improved and that a
written notice to make such con-
nections within ten days from the
service thereof be given to the own-

er or owners of such property and,
in the event, such connections are
not made within said time, then such
work will be done under contract
and the cost thereof will be as-
sessed to the property for which the
same have been made. One con-
nection shall be required for each
lot of 50 linear feet unless the lot
is subdivided or in acreage, in which
will be required as will adequately
serve the property, and the notice
shall state the number of connec-
tions that are required for each lot
or parcel of real estate.
Be it further resolved that the
sidewalks and water drains therein
and driveways to private property
along such streets be deemed neces-
sary to be constructed, reconstruct-
ed or repaired and the same are
hereby ordered constructed or re-
paired and such work shall be done
under contract and the cost thereof
assessed to the property for whose
benefits such improvements are
made in the manner provided by
law.
All underground connections, side-
walks, drains and driveways shall
be constructed according to specifi-
cations prepared therefor.
That separate contracts will be
entered into for each street improve-
ment unless two or more streets
constitute a continuous or connected
thoroughfare and the limits are de-
fined, and the cost of each improve-
ment will be separately assessed.
Be it further resolved that the
above and foregoing improvements
are hereby proposed to be made and
constructed as hereinbefore set
forth, and that this proposed resolu-
tion, except this paragraph, be and
the same is hereby set down for fur-
ther and final hearing, consideration
and determination at a meeting of
this Council to be held on the 21st
day of June, 1928 at 5 o'clock P. M.
in the Council Chambers of the City
Hall of this City ,and the Clerk be
and he is hereby instructed to cause
notice of the pendency of this reso-
lution and of the time and place,
when and where the same will be
considered for passage, to be given
by publication in the official news-
paper of said City, in the manner
and for the time prescribed by law,
at which time the owners of proper-
ty subject to assessment for any of
said proposed improvements may ap-
pear and make objection to the
boundaries of the district, if any,
the cost of any of the proposed im-
provements, the amount to be as-
sessed against any lot, and to the
passage of the proposed resolution
and unless property owners at the
time of the final consideration of
said resolution have on file with the
Clerk written objections to the
amounts of any of the proposed im-
provements, they shall be deemed
to have waived all objections there-
to.
The above resolution was intro-
duced, approved and ordered placed
on file with the City Clerk and no-
tice of its pendency ordered pub-
lished this 4th day of June, 1928.

Council,
Dubuque, Iowa.
Gentlemen : At your meeting
held May 21st a communication
from the Retail Food Distributors
requesting the use of the Athletic
Field for the week of September
10th to 16th inclusive for the pur-
pose of putting on a Fall Exposition
of food and household exhibits and
a side show, for which a charge
would be made, was refererd to your
City Manager for report.
Your City Manager has taken this
matter up with representatives of
the Retail Food Distributors and is
of the opinion that due to the fact
that the exposition will be more or
less of an educational nature and
will bring a great many people to
the City of Dubuque and stimulate
trade, that no rental should be
charged for the use of the Athletic
Field during the week requested.
However, it is recommended that
the usual charge for holding side
shows be collected in the usual man-
ner as specified by ordinance, name-
ly that $25.00 be collected for the
first day and $12.50 for each suc-
ceeding day.

Mayor Maclay read the following
call and stated that service thereof
had been duly made.
Notice and Call of Special Meeting
of City Council.
To Schuckert, councilman:
You are hereby notied and there
is hereby called a special meeting of
the City Council of the City of Du-
buque to be held at 5 o'clock P. M.
on June 11, 1928, at the Council
Chamber in the City Hall. At this
meeting there will be considered for
final adoption a resolution entitled
"Resolution providing for the sale
and award of $65,000 Dock Bonds
and approving and authorizing the
agreement of such sale and award."
There will also be considered for
final passage and adoption an ordin-
ance entitled "Ordinance No. 201.
An Ordinance amending an ordin-
ance authorizing the issuance of
$65,000 Dock Bonds, providing for
the payment of same and declaring
an emergency," and such other busi-
ness will be transacted at such meet-
ing as may properly come before a
regular meeting of the City Council.

Resolution providing for the sale
and award of $65,000 Dock Bonds
and approving and authorizing the
agreement of such sale and award.
Whereas, notice of sale of $65,000
Dock Bonds of the City of Dubuque,
Dubuque County, Iowa, has hereto-
fore been given in strict compliance
with the provisions of Chapter 63 of
the Code of Iowa, 1927, by publica-
tion of notice for two or more suc-
cessive weeks in one of the official
newspapers of Dubuque County; and
Whereas, all sealed bids have been
received and placed on file, after
which open bids were called for and
received, the highest of which was
as follows: par, accrued interest,
with a premium of $55.00 based on
a rate of interest of 4 and there-
after such sealed bids were opened,
the substance of the best sealed bid
being as follows: (None were re-
ceived).

Now, Therefore, Be it resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That upon being ad-
vised in the premises it is hereby
determined that the bid of George
M. Bechtel & Co. for the purchase of
$65,000 Dock Bonds, is the highest
and best bid received, and that said
bonds be and the same are hereby
awarded to the said George M. Bech-
tel & Co.
Section 2. That the form of agree-
ment of sale of said bonds to Geo.
M. Bechtel & Co. be and the same
is hereby approved and the Mayor,
City Clerk and City Treasurer are
hereby authorized to execute said
agreement for arid, on behalf of the
City of Dubuque, Iowa,. and to fix the
corporate seal of said "City thereto.
Section 3. That all resolutions or
parts of resolutions in conflict here-
with be and the same are 'hereby
repealed.

the resolution duly adopted and sign-

The Council took up for final con-
sideration the Ordinance entitled No.
201, an Ordinance amending an Or-
dinance authorizing the issuance of
$65,000 Dock Bonds, providing for
the payment of same and declaring
an emergency.
The Ordinance having passed up-
on first and second reading was pre-
sented for final passage and adop-
tion. Ordinance read a third time.
ORDINANCE NO. 201.
AN ORDINANCE AMENDING OR-
DINANCE AUTHORIZING THE
ISSUANCE OF $65;000 DOCK
BONDS, PROVIDING FOR THE
PAYMENT OF SAME AND DE-
CLARING AN EMERGENCY.
Whereas, This City Council of the
City of Dubuque, in the County of
Dubuque, State of Iowa, did hereto-
fore, under date of May 14th, 1928,
finally adopt an ordinance, entitled
"Ordinance No. 197. An Ordinance
authorizing the issuance of $65,000
Dock Bonds, providing for the pay-
ment of same and declaring an
emergency "; and
Whereas, Pursuant to advertise-
ment in the manner and form re-
quired by Chapter 63 of the Code of
Iowa 1927, the proposal for the pur-
chase of said bonds, bearing interest
at the rate of four and one - quarter
per cent per annum, has been re-
ceived; and
Whereas, Said ordinance as here-
tofore adopted provided for the issu-
ance of said bonds bearing interest
at the rate of four and one -half per
cent per annum, and it is deemed to
the advantage of said City and its
taxpayers that the saving of one -
quarter of one per cent per annum
be realized;
Now, Therefore, Be It Ordained by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That Section 1 of the
ordinance referred to in the pream-
ble hereof, entitled "Ordinance No.
197. An Ordinance authorizing the
issuance of $65,000 Dock Bonds, pro-
viding for the payment of same and
declaring an emergency," be and the
same is hereby amended to read as
follows:
"Section 1. That bonds of said
City in the amount of Sixty -five
Thousand Dollars ($65,000) be is-
sued pursuant to the provisions of
Paragraph 11 of Section 5902 of the
Code of Iowa, 1927, as amended; that
each of said bonds be designated as
a 'Dock Bond,' be sixty -five (65) in
number, numbered from 1 to 65 in-
clusive, be of the denomination of
$1,000 each, bear date of May 1, 1928,
and bear interest at the 'rate of four
and one - quarter per centum (4 %)
per annum from the date of said
bonds until payment thereof, payable
semi- annually on the first days of
May and November in each year;
that said bonds be signed by the
Mayor and attested by the City
Clerk, and the seal of said City be
attached, and be registered by Lie
City Treasurer, and a certificate of
registration endorsed thereon; that
interest on 'said bonds be evidenced
by coupons thereto attached and ma-
turing on the several days when such
interest matures, such coupons to be
executed with the facsimile signa-
tures of said Mayor and City Clerk,
and said officials, by the execution
of said bonds, shall .adopt as and for
their own proper signatures their re-
spective facsimile signatures appear-
ing on each of said coupons, and
that both principal and interest be
payable at the office of the City
Treasurer in the City of Dubuque,
State of Iowa; said bonds shall be-
come due and payable in numerical
order $5,000 on November 1 of each
of the years 1935 to 1947 inclusive.
"Said City shall reserve the right
and option of calling and retiring
any or all of said bonds before ma-
turity, in numerical order, on May
1, 1929, or on any interest payment
date thereafter pursuant to notice
as hereinafter. rovi –
Section 2. hat all ordinances or
resolutions or parts thereof insofar
as same may be in conflict herewith
be and the same are hereby repeal-
ed.
Section 3. That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the public
peace, health and safety that this
ordinance become effective upon its
passage, approval and publication,
and it is so ordered.

Petition of the Dubuque Lumber &
Coal Company, calling the attention

of the Council to the condition at
the corner of Rhomberg and Lincoln
Avenues, and as far north as Rhom-
berg Avenue as the Eagle Point Park
steps, regarding the storm sewer
drainage and the possible dangers
which may resudt unless something
is done to prevent it.
Since the retaining wall north of
the Lime Works is being replaced
the water intake just south of the
old steps has been closed. This
means that all the water out of
Eagle Point Park gulley and the wat-
er out of the Stone Quarry must be
carried on the concrete paving to
the sewer at the corner of Rhom-
berg and Lincoln Avenues in addi-
tion to other water coming from
other sources. They are convinced
that such a condition is inadequate
to take care of such storm waters
and great damage is bound to result
to adjoining property as well as
theirs. Anticipating such damage
they now properly notify the City
that it will be held for such damages
as may be done to their property
unless some action is taken to avoid

specifications and form of contract
which have been heretofore ap-

Streets, against the improvement of
these streets with concrete, stating
that the streets as they are now
are in good enough condition for the
little traffic that is done on these
streets, and furthermore if these
streets are to be improved they do
not want to have concrete, and that
the property owners ought to be
consulted and have an opportunity
to choose the material to be used in
construction of such improvement.
Furthermore the contemplated im-
provement is not calculated to car-
ry the water which aggregates at
such points in said streets, so as
to be a menace and danger to abut-
ting property. This condition can
be remedied by, proper plans adopted
for any improvement contemplated,
with the exercise of proper skill on
the part of the Engineer, in the con-
struction of such improvements.
Also a remonstrance filed by the
Iowa Coffin Co., objecting to the pav-
ing of East 16th Street. Signed by
T. E. Rhomberg, secretary and treas-
urer. Petition was along the same
lines as the petition filed by the
property owners on this and East
13th Street.
Councilman Meuser moved that
the rules be suspended to allow any
one present who wished to do so to

Gentlemen: At your meeting held
April 25th, 1928, a communication
from the Dubuque Dock, Board re-
questing that the City turn back to
the Dock Board the sum of $1,323.23,
account of money spent by the City
of Dubuque in connection with the
establishment of a Dock Commission
in the City of Dubuque, was referred
to your City Manager and City Solic-
itor for report.
Your City Manager and City Solic-
itor have investigated this matter
and find that the above mentioned
money was spent in the interest of
establishing a Dock Commission and
that it is an expense that should be
borne out of Dock funds. However,
the fact that both the Dock Commis-
sion and the City Government of Du-
buque are supported from taxation,
and the same taxpayers pay the bill
regardless of where the expense is
charged, it is our opinion that in
order to keep an accurate cost of
operating our public docks, that this
charge should remain as a charge
against the Dock Commission and
we so recommend.

sessed valuation of this property is

proposed assessment for street im-
provement in the amount of $1,129.65
is not in proportion to the special
benefits derived, and they object to
the payment of any amount in ex-
cess of 25% of the actual value of
said property.

Charles Skemp and John O'Rourke
addressed the Council relative to the
improvement of Burch Street, stat-
ing that they had no objection to
the paving of said street, but that
they did object to having the curb
and brick gutter torn out, that the
brick gutter and also the stone curb
are as good to -day as when they
were put in and that they as well as
all of the owners on their side of the
street object to the tearing up of the
gutter.
Councilman Schuckert moved that
action on Burch Street be postponed.

RESOLUTION OF NECESSITY
FOR THE CONSTRUCTION OF
STREET IMPROVEMENTS CON -
SISTING OF GRADING, PAVING,
CURBING, GUTTERING AND
DRAINING; FOR THE MAKING
OF UNDERGROUND CONNEC-
TIONS; AND FOR THE CON-
STRUCTION OR REPAIR OF
PERMANENT SIDEWALKS,
DRIVEWAYS AND WATER
DRAINS.
Whereas, a plat and schedule has
been duly prepared by the City
Council and is now 011 file in the of-
fice of the Clerk, showing the streets
to be improved, the boundaries of
the district, if any, the width of the
improvements, each lot proposed to
be assessed, an estimate of the cost
of the proposed improvement for
each type of construction and kinds
of materials to be used, and in each
case the amounts which it is estim-
ated will be assessed against each
lot for such improvements:
Be It, Therefore, Resolved by the
City Council of the City of Dubuque,
on its own motion or upon petition
of property owners, that it is deemed
necessary or advisable to build, con-
struct and put in place certain street
improvements, as herein described,
in, upon and along the following
streets, to -wit:
Dell Street from the south prop-
erty line of West 14th Street to the
north property line of Arlington
Street.
Burch Street from the north prop-
erty line of Fenelon Street to the
south property line of Hill Street.
Perry Street from the west prop-
erty line of South Grandview Avenue
to end of present improvement.
Railroad Street from the east
property line of South Locust Street
to the east property line of South
Main Street and South Main Street
from the north property line of Rail-
road Street to the end of the present
brick pavement.
Carlotta Street from the east prop-
erty line of Alpine Street to the west
property line of Alta Vista Street.
Such street improvements shall
consist of grading, paving, draining,
curbing and guttering, the curb and
gutter shall be constructed of con-
crete or old stone curb may be reset,
and the paving shall be constructed
of one or more of the following ma-
terials and methods, to -wit:
By paving with 6 inch plain con-
crete.
All of the grading, paving, curbing
and guttering shall be constructed
and done in accordance with the
plans and specifications which have
been prepared therefor by the City
Engineer which have been or will be
approved by the City Council before
a contract is entered into. The rail-
way portion on any of said streets
will be paved with either 2 inch
Kentucky Rock Asphalt or 2 inch
Carey Elastite Block on a 4 inch by
8 inch timber foundation between
the rails and on one foot outside
thereof. That sewer drains shall be
constructed where necessary to take
care of surface water.
That the cost and expense of mak-
ing said improvements shall be as-
sessed upon and against all private-
ly owned property lying within the
assessable distance provided by law,
whether the same abuts thereon or
is adjacent thereto, according to
area and in proportion to the special
benefits conferred, and any defic-
iency shall be paid out of the gen-
eral or improvement funds of the
City, or partly out of each of such
funds. Bonds shall be issued and
sold in anticipation of deferred pay-
ments of assessments when the con-
tract has been performed and ac-
cepted and the proceeds thereof
used to pay the contractor. The rail-
way portion of any street shall be
assessed to and paid by said rail -
way.
Be it further resolved that under -
ground connections with sewer, wa-
ter and gas mains in said streets be
deemed necessary and the same are
ordered made to the curb lines of
adjacent property before said streets
are improved and that a written no-
tice to make such connections with-
in ten days from the service there-
of be given to the owner or owners
of such property and, in the event
such connections are not made with-
in said time, then such' work will be
done under contract and the cost

thereof will be assessed to the prop-
erty for which the same have been
made. One connection shall be re-
quired of each lot of 50 linear feet
unless the lot is subdivided or in
acreage, in which event such addi-
tional connections will be required
as will adequately serve the prop-
erty, and the notice shall state the
number of connections that are re-
quired for each lot or parcel of real
estate.
Be it further resolved that the
sidewalks and water drains therein
and driveways to private property
along such streets be deemed neces-
sary to be constructed, reconstruct-
ed or repaired and the same are
hereby ordered constructed or re-
paired and such work shall be done
under contract and the cost thereof
assessed to the property for whose
benefits such improvements are
made in the manner provided by
law.
All underground connections, side-
walks, drains and driveways shall be
constructed according to specifica-
tions prepared therefor.
That separate contracts will be
entered into for each street improve-
ment unless two or more streets
constitute a continuous or connected
thoroughfare and the limits are de-
fined, and the cost of each improve-
ment will be separately assessed.
Be it further resolved that the
above and foregoing improvements
are hereby proposed to be made and
constructed as hereinbefore set
forth, and that this proposed resolu-
tion, except this paragraph, be and
the same is hereby set down for fur-
ther and final hearing, consideration
and determination at a meeting of
this Council to be held on the 21st
day of June, 1928, at 5 o'clock P. M.,
in the Council Chambers of the City
Hall of this City, and the Clerk be
and he is hereby instructed to cause
notice of the pendency of this reso-
lution and of the time and place
when and where the same will be
considered for passage, to be given
by publication in the official news-
paper of said City, in the manner
and for the time prescribed by law,
at which time the owners of prop-
erty subject to assessment for any
of said proposed improvements may
appear and make objection to the
boundaries of the district, if any, the
cost of any of the proposed improve-
ments, the amount to be assessed
against any lot, and to the passage
of the proposed resolution and un-
less property owners at the time of
the final consideration of said reso-
lution have on file with the Clerk
written objections to the amounts of
any of the proposed improvements,

sanitary sewer in Division Street

Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets and alleys
and other places along which the
sewers are to be constructed, the ter-
minal points of the same, each lot
proposed to' be assessed therefor, an
estimate of the cost of the same for
each different type of construction
and the kind of materials to be used
and in each the amount thereof
which it is estimated will be as-
sessed against each lot.
Be it therefore, resolved by the
City Council of said City, on its own
i motion:
That it is deemed necessary and
advisable to construct, lay and put
in place a 6 inch tile sanitary sewer
in Division Street from a point about
90 feet north from the sanitary sew-
er in West 24th Street to a point
about 176 feet north.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in ac-
cordance with the plans and specifi-
cations prepared by the City Engin
eer, having been duly approved by
the City Council and Manager and
State Board of Health and now on
file in the office of the City Clerk.
That the cost and expense of mak-
ing and constructing said sewer shall
be assessed against the privately
owned property abutting thereon not
to exceed the amount provided by
law and upon such adjacent property
as might be benefited thereby and
in proportion to such benefits, and
any deficiency shall be paid out of
the general fund or sewer fund, or
partly from each of said funds and
bonds shall be issued and sold in an-
ticipation of deferred payment of as-
sessments and the proceeds thereof
used to pay the contractor.
Be it further resolved that the
above and foregoing sewers are here-
by proposed to be constructed as
hereinbefore set forth, and that this
proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determin-
ation, at a meeting of this Council
to be held on the 10th day of July,
1928, at 5 o'clock P. M. in the Coun-
cil Chamber of the City Hall of this
City, and the City Clerk be and he
is hereby instructed to cause notice
of the pendency of the above resolu-
tion, and the time and place, when
and where said proposed resolution
will be considered for passage, to be
given by publication in the official
newspapers of said City, in the man-

beg to state that since the Code
went into effect in 1924, fees have
been collected on all oil fuel tanks
installed.
In all instances fees were paid
voluntarily by the party applying for
the permit. An inspection was given
when the Department was notified
before the tanks were covered up. I
recommend that the communication
and bill attached be received and
filed.

paid for by levying special assess-
ments against the privately owned
property lying within the assessable
distance from the improvements,
whether such property abut upon
the same or are adjacent thereto,
according to the area thereof and in
proportion to the special benefits
conferred, and any deficiency will
be paid out of the general or the
improvement funds of the City, or
partly from each of such funds. Pay-
ment will be made to the contractor
out of the funds realized from the
sale of bonds to be issued in antici-
pation of deferred payments of as-
sessments as provided by law after
the work has been completed and ac-
cepted by the City Council.
The cost and expense of making
underground connections shall be
levied against the lots or parcels of
real estate for whose benefit they
are made and the cost of expense
of constructing, reconstructing or
repairing sidewalks, drains and
driveways shall be levied against the
lots or parcels of real estate for
whose benefit they are constructed
and the contractor shall be paid eith-
er in cash upon completion and ap-
proval or from the proceeds of bonds
that may be issued in anticipation
of the collection of the assessments.
Be it further resolved that separ-
ate contracts will be entered into
for each street improvement unless
two or more streets constitute a con-
tinuous or connected thoroughfare
and the limits are defined, and as-
sessments for the cost will be made
for each improvement. Be it fur-
ther resolved that the City Clerk be
and he is hereby ordered and direct-
ed to advertise for proposals for the
construction of the various improve -_
ments herein provided for in the
manner provided by law, all of which
improvements shall be completed on
or before the 1st day of October,
1928. Be it further resolved that
this resolution be deemed urgent and
of immediate necessity shall be in
force and effect from and after its
passage and 'adoption by the City
Council.
