Whereas, the contract heretofore entered into by the City of Dubuque for the improvement of Cooper Heights hereinafter described has been completed and said improve- ment has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $9,392.29. And whereas, public notice as pro- vided by law, has been published by the City Clerk stating the inten- tion of the City Council to issue bonds to pay the cost of s -irl im- provement and a public hearing has been held pursuant thereto, and all objections filed ther °to have been considered and determined. New therefor. be it resolved by the City Council of the City of Du- buque that to provide for the cost of improving Cooper Heights from Gilmore Street to Raymond Place; Raymond Place from Maiden Lane to the south line of Lot 34 in Coop- er Heights and Maiden Lane from Gilmore Street to Raymond Place, there be issued improvement bonds to the amount of $9392.29. Said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1924, which bear date as of the 4th day of February, A. D. 1926; shall be in the denominations of 500.00 each, except that there shall be one bond to the amount of $392.29; they shall be numbered from 1160 to 1178 inclusive and shall be divided into 10 series of which the bond numbered 1160 shall con- stitute the first series and shall be payable on the 1st day of April, A. D. 1926; the bonds numbered from 1161 to 1162 shall constitute the sec- ond series and shall be payable on 4 Regular Session, January 4th, 1926 the 1st day of April, 1927; the bonds numbered from 1163 to 1164 shall constitute the third series and shall be payable the 1st day of April, 1928, the bonds numbered from 1165 to 1166 shall constitute the fourth ser- ies and shall be payable the 1st day of April, 1929; the bonds numbered from 1167 to 1168 shall constitute the fifth series and shall be payable the 1st day of April, 1930; the bonds numbered from 1169 to 1170 shall constitute the sixth series and shall be payable the 1st day of April, 1931; the bonds numbered from 1171 to 1172 shall constitue the seventh series and shall be payable the 1st day of April, 1932; the bonds num- bered 1173 to 1174 shall constitute the eighth series and shall be pay- able the 1st day of April, 1933; the bonds numbered from 1175 to 1176 shall constitute the ninth series and shall be payable the 1st day of April, 1934; the bonds numbered from 1177 to 1178 shall constitute the tenth series and shall be payable the 1st day of April, 1935. Said bonds shall bear interest at the rate of 5 per cent per annum which interest shall be payable semi- annually, in accordance with the terms of the coupons thereto at- tached; and said bonds shall be pay- able out of the proceeds of the spe- cial assessment levied for said im- provement. Both principal and in- terest shall be payable at the office of the City Treasurer in the City ot Dubuque. Said bonds shall be sub- stantially in the following form: No. 1160 to 1178. Series No. CITY OF DUBUQUE IMPROVEMENT BOND The City of Dubuque in the State of Iowa promises to pay as herein- after mentioned to the bearer here- of, on the first day of April, A. D. 19 , or any time before that date at the option of the City the sum ot Five Hundred Dollars with interest at the rate of 5 per cent per annum payable on the presentation and sur- render of the interest coupons here to attached, both interest and prin- cipal are payable at the office of the City Treasurer in the City of Du- buque in the State of Iowa. This bond is issued by the City of Du- buque pursuant to and by virtue of Chapter 311 of the Code of Iowa, 1924, and in accordance with a reso- lution of the City Council of said city duly passed on the 4th day of January, 1926. This bond is one of a series of 19 bonds, 18 for $500.00 each and num- bered 1160 to 1177 inclusive and one for $392.20 numbered 1178; all of like tenor and date, and issued for the purpose of paying the cost of the improvement of Cooper Street, from Gilmore Street to Raymond Place; Raymond Place from Maiden Lane to the South line of Lot 34 in Cooper Heights and Maiden Lane from Gilmore Street to Raymond Place and described in said resolu- tion; which cost is assessable and levied along said improvement, and is made by law a lien on all abutting or adjacent property and payable in ten annual installments, with in- terest on all deferred payments at the rate of five per cent per annum, and this bond is payable only out of the money derived from the col- lection of said special tax, and said money can be used for no other purpose. And it is hereby certified and re- cited that all the acts and condition and things required to be done pre - cedent to and in the issuing of this series of bonds, have been done, hap- pened and performed in regular and due form as required by said law and resolution; and for the assess- ments, collections and payment here- on of said special tax, the faith and diligence of said City of Dubuque are hereby irrevocably pledged. In witness whereof the City of Dubuque by its City Council has caused this bond to be signed by its Mayor and countersigned by its City Clerk, with the seal of said City affixed this 4th day of Feb., 1926, and has authorized the use of their fac - simile signatures to the interest coupons hereto attached. Be it further resolved that the Mayor and City Clerk be and they are -hereby instructed to cause said bonds to be prepared and when so. prepared to execute said bonds; and that the City Clerk be and he is hereby instructed to register said bonds in a book to be kept by him for that purpose, and to then de- liver them to the City, Treasurer Regular Session, January 4th, 1926 5 who will also register them in a book to be kept by him for that purpose. Be it further resolved that the City Treasurer be and he is hereby instructed to sell said bonds in the manner provided for in Section 845 of the Code of Iowa, the proceeds of said sale to be kept in a special fund to be known as Improvement Fund. Be it further resolved that the in- terest coupons attached to the bonds be signed with the fac- simile sig- nature of the Mayor and counter- signed with the fac- simile signature of the City Clerk. Notice of meeting for issuance of Main Sewer Bonds, certified to by the publisher, that the City Council will meet Jan. 4th, 1926 for the pur- pose of instituting proceedings and taking action for the issuance of $29,563.41 Main Sewer bonds of the City of Dubuque, for the purpose of defraying the cost of constructing a main sewer in the ditch commonly known as the Bee Branch Sewer. At any time before the date of said meeting five or more taxpayers may file a petition in the office 01 the City Clerk, setting forth their objections thereto. RESOLUTION providing for the issuance of bonds in the sum of $29,563.41 for the purpose of de- fraying the cost of a main sewer. Whereas: the City of Dubuque, in the County of Dubuque, State of Iowa, had heretofore, pursuant to and in strict compliance with all laws applicable to said City, law- fully ordered an improvement con- sisting of constructing a main sew- er to be located in the open itch commonly known as "Bee Branch Sewer" in said City; and Whereas, the cost of said improve- ment to the amount of Twenty Nine Thousand Five Hundred Sixty Three Dollars and Forty -one cents ($29,563.41) is to be paid by said City and it is now advisable to make provision for said payment; Now, therefore, Be it Resolved by the City Council of the City of Du- buque, Iowa, as follows: Section 1. That the cost of con- structing a main sewer to be located in the open ditch commonly known as "Bee Branch Sewer" in said City, to the amount, of Twenty Nine Thou- sand Five Hundred Sixty Three Dol- lars and Forty One Cents ($29,563.41) is hereby ordered paid from the proceeds of Main Sewer 6 Regular Session, January 4th, 1926 Bonds of said City issued in antici- pation of the collection of a main sewer fund tax heretofore levied by an ordinance entitled "Ordinance No. 170." An Ordinance providing for an annual tax for the purpose of defraying the cost of constructing a main sewer to be located in the open ditch commonly known as "Bee Branch Sewer," in said City, and declaring an emergency, and the tax thereby levied is hereby pledged and when collected shall be used only for the payment of the bonds here- by authorized. Section 2. That bonds of said City, in the amount of Twenty Nine Thousand Five Hundred Sixty Three Dollars and Forty One Cents ($29,563.41) be issued in anticipation of the collection of said Main Sewer Fund Taxes, pursuant to the pro- visions of Chapter 320 of the Code of Iowa, 1924; that each of said bonds be designated as a "Main Sewer Bond," be Thirty (30) in num- ber, dated January 1, 1926, bear in- terest at the rate of four and one - half per centum (4 per annum from the date of said bonds until payment thereof, payable November 1, 1926 and semi- annually thereafter, on the first days of May and No- vember in each year; that said bonds be signed by the Mayor and attested by the City Clerk and the seal of said City be attached, and be reg- istered by the City Treasurer, and a certificate of registration endorsed thereon; that interest on said bonds be evidenced by coupons thereto at- tached and maturing on the several days when such interest matures, such coupons to be executed with the fac- simile signatures of said Mayor and City Clerk, and said offic- ials by the execution of said bonds, shall adopt as and for their own proper signatures, their respective fac- simile signatures appearing on each of said coupons, and that both principal and interest be payable at the office of the City Treasurer in the City of Dubuque, State of Iowa; that said bonds be of the denomina- tion of One Thousand Dollars ($1,000) except that one bond shall be of the denomination of Five Hun- dred Sixty Three Dollars and forty one cents $563.41) be numbered con- secutively from 1 to 30, both num- bers included, become due and pay- able in numerical order, $3,000 on the first day of November of each of the years 1932 to 1940 inclusive, and $2,65321 on the first day of No- vember, 1941. Section 3. The bonds hereby au- thorized shall be in form substantial- ly as follows: (Form of Bond) UNITED STATES OF AMERICA STATE OF IOWA COUNTY OF DUBUQUE CITY OF DUBUQUE MAIN SEWER BOND No $1,000 Know all men by these presents: That the City of Dubuque, in the County of Dubuque, State of Iowa, for value received, promises to pay to bearer One Thousand Dollars ($1,000) lawful money of the United States of America on the first day of November, 19 , with interest on said sum from the date hereof until paid, at the rate of Four and One Half per cent (4 per annum, pay- able Novemlber 1, 1926, semi- annual- ly thereafter on the first days of May and November in each year, upon presentation and surrender of the interest coupons hereto at- tached, both principal and interest payable at the office of the City Treasurer in the City of Dubuque, Iowa. This bond is one of a series of bonds issued by the City of Dubuque pursuant to and in strict compliance with the porvisions of Chapter 320 of the Code of Iowa, 1924, and all laws amendatory thereof and supple- mentary thereto, and in conformity with a resolution of the Council of said City duly passed on the 4th day of January, 1926, and approved and recorded, for the purpose of de- fraying the construction of a main sewer in said City. James Mulligan addressed the Council stating that when the City constructed the Southern Avenue District Sewer, he gave the privilege to construct the sewer through and across his property, with the under- standing that the lots would be put back in as good condition as they were before the sewer was construct- ed. This was not done, and further- more the contractor placed a man- hole in one of the lots, which de- preciates the value of this lot very much. If the City has this manhole removed and the lots levied as they were he will be perfectly satisfied. Whereas, the City of Dubuque, in the County of Dubuque, and State of Iowa, heretofore, pursuant to and in strict compliance with all laws applicable to said city lawfully or- dered an improvement consisting of the construction of a main sewer to be located in the open ditch com- monly known as the "Bee Branch Sewer" in said city, the cost there- of to the amount of Twenty -nine Thousand Five Hundred Sixty Three Dollars and forty -one cents ($29,563.41) to be borne by the City of Dubuque and to be paid from a tax levied on all the taxable prop- erty within said city and it is now advisable to make provision with respect to the levying of said tax; Now, therefore, be it ordained, by the City Council of the City of Du- buque; Special Session, January llth, 1926 Section 1. —That in pursuance of Section 6213 of the Code of Iowa, 1924, there shall be and there is hereby levied and there shall be as- sessed and collected a direct an- naul tax upon all the taxable prop- erty within said city of five (5) mills on the dollar or such portion thereof as may be necessary upon said taxable property sufficient to produce the net annual sums as hereinafter provided: Years of Levy Amount 1926 $2,438.97 1927 1,330.36 1928 1,330.36 1929 1,330.36 1930 1,330.36 1931 4,330.36 1932 4,195.36 1933 4,060.36 1934 3,925.36 1935 3,790.36 1936 3,655.36 1937 3,520.36 1938 3,385.36 1939 3,250.36 1940 2,678.76 Section 2. —Said taxes shall be collected each year at the same time and in the same manner, and in addition to all other taxes in and for said city, and when collected shall be converted into a special fund which is hereby pledged for and shall be used only to pay the portion of the cost of constructing the main sewer hereinbefore re- ferred to, to pay the principal and interest of bonds issued therefor. Section 3. —That a certified copy of this ordinance be filed with the county auditor of Dubuque county and that said auditor be and he is hereby instructed in and for each of the years 1926 to 1940 inclusive to levy and assess the tax hereby authorized. Section 4. —That all ordinances or resolutions or parts thereof in con- flict herewith be and the same are hereby repealed. Section 5. —That it is hereby found and declared that an emergency ex- ists and that it is necessary for the immediate preservation of the pub- lic peace, health and safety that this ordinance become effective up- on its passage, approval and publi- cation, and it is so ordered. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of a Sanitary Sewer in Roosevelt Street, herein- after described, has been completed and said improvement has been ac- cepted by the City Council of said City, and the City Engineer has computed the cost and expense thereof to be $2,25L79. And whereas, public notice as pro- vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: .Now, therefor, be it resolved by the City Council of the City of Du- buque that to provide for the cost of constructing a Sanitary Sewer in Roosevelt Street from the end of a Manhole in Roosevelt Street to a point opposite the end of the Water Main, there be issued Sewer Bonds to the amount of $2,25.1.79. Said bonds shall be issued under the pro- visions of Chapter 311 of the Code of Iowa, 1924, which bear date as of the 17th day of February, A. An Ordinance ordering and requir- ing Dubuque Electric Company, their successors and assigns, to construct and maintain a high- tension line from its power plant to connect with the high- tension lines of the Inter- state Power Company between Du- buque and Clinton; authorizing said Company, its successors and assigns to erect and maintain poles, wires and towers along the route to be . used by it; and prescribing limita- tions and conditions upon this grant. Whereas, Dubuque Electric Com- pany, its successors and assigns, has a franchise from the City of Dubuque to erect, maintain and operate poles, wires and other fixtures in the streets, alleys and public places for the purpose of distributing electric- ity for light, power and other pur- poses, the terms of such franchise being embodied in an Ordinance regularly passed and adopted by this Council and approved by the electors of the City of Dubuque dated Feb- ruary 14, 1922; and Whereas, by the provisions of such franchise ordinance the City Council retains the power and authority to order said Company to construct, maintain and operate such additions and extensions to said system as the 20 Special Session, January 11th, 1926 Council may from time to time es- tablish to be proper and reasonably necessary; and Whereas, said Company has made and will make valuable improve- ments and additions to its power plant and thereby develop greater electric energy than is reasonably necessary for the accommodation of the citizens of Dubuque; and Whereas, this Council believes that it will be to the best interest of the people of Dubuque to have developed the distributing system of said Com- pany into adjacent territory; and Whereas, in order to construct said system it is necessary that poles and towers be placed and er- ected and wires strung thereon,, up- on, over and across the streets and alleys of the City of Dubuque: now therefore Be it Ordained by the City Coun- cil of the City of Dubuque, pursuant to the power and authority vested in it by virtue of the Franchise Ordin- ance of said Company heretofore re- ferred to: Section 1. R. Waller Es- tate and across Illinois Central right of way and Iowa Street, Rail- road Avenue, South Main Street, and Salina Street, the property of the Consumers' Ice Company and City property to the intersection of South Locust Street with the Cascade road and thence about Five Hundred feet westerly along said Cascade Road; thence southeasterly across the pri- vate property and across Grandview Avenue and to the City Limits. Sec. 2. That said Company shall procure all leasements from the own- ers of private property upon, over and across which it will erect and maintain its poles, towers, wires and other fixtures. Sec. 3. That said Company, its successors and assigns, are hereby granted the right and authority to erect and maintain towers of ap- proved construction upon public property, as follows: One approximately at the inter- section of Bell and Commercial Streets; One approximately at the inter- section of Wall and Bell Streets; One approximately at the inter- section of Fifth and Bell Streets; One approximately at the inter- section of Third and Bell Streets; One at the foot of First Street on the river front near the south side of the entrance to Dubuque Harbor; One on the river front approxim- ately at the foot of Dodge Street; One on the river front between the foot of Camp Street and the foot of Railroad Avenue in an old stone foundation approximately 100 feet southerly from the foot of Camp Street; One on Illinois Central property near the intersection of Railroad Avenue and South Main Street; One on City property east of Lo- cust Street, and south of Railroad Avenue; and One on the Cascade Road above Locust Street approximately 500 fect westerly from the intersection of said Cascade Road with South Lo- cust Street. Sec. 3. That these towers shall be erected under the supervision of the City Electrician and shall be so lo- cated that they will not form an obstruction to the use of said streets for public travel, or to the inconven- ience or use of private property. Sec. 4. That high - tension cables and wires shall be strung and placed upon all towers and poles used by said Company in a safe, secure and approved manner and shall be so in- sulated as to prevent the possibility of damages resulting from coming in contact therewith. Special Session, January 11th, 1926 21 Sec. 5. That the wires and cables to be placed and strung upon said towers or poles shall be of sufficient height as to conform to the National Electric Safety Code. See. 6. That said Company, its successors or assigns, shall be liable for any injury or ,damage to persons or property by reason of the negli- gent ,construction, maintenance or operation of said distributing system. It shall .pay any and all judgments for damages that may be secured in any court of record in any action brought against the City of Dubuque arising on account of the negligent construction, maintenance and oper- ation .of said system, but notice of the pendency of any such action shall be given by the said City to said Company, its successors and assns. S.e 7. That said .Company shall pay to the City of Dubuque the sum of $7.50 for each day that the elec- trical inspector shall be engaged in the supervision of the construction of said electrical system, a statement of the total amount thereof to be rendered said Company upon the completion of the work. Sec. 8. That this Ordinance and the rights granted hereunder shall expire at the same time that the Franchise Ordinance of said Com- pany, heretofore referred to, ex- pires, provided however that a re- newal of the Franchise Ordinance shall operate as a renewal of the rights herein granted. Sec 9. This Ordinance shall take effect and be in force ten days from and after its final passage, adoption and approval by the City Council of the City of Dubuque and publication as provided by law. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of Sewer in Woodworth Street, hereinafter de- scribed, has been completed and said improvement has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $1,091.59. And whereas, public notice as pro- vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: Now therefor, be it resolved by the City Council of the City of Du- buque that to provide for the cost of constructing of a Sanitary Sewer in Woodworth Street from Lowell Street to Cottage Place, and in Cot- tage Place from Woodworth Street to about 300 feet East, and in Cot- Special Session, January 18th, 1926 25 tage Place from Woodworth Street to Abbott Street, and in Abbott Street from Cottage Place about 200 feet South, there be issued Sewer Bonds to the amount of $1,091.59. Said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1924, which bear date as of the 18th day of February, A. D. 1926; shall be in the denomination of $100.00 each, except that there shall be one bond to the amount of $91.59; they shall be numbered from 1191 to 1201 inclusive and shall be divi- ded into 10 series of which the bonds numbered 1191 to 1192 shall consti- tute the first series and shall be pay- able on the lst day of April, A. D. 1926; the bond numbered 1193 shall constitute the second series and shall be payable on the 1st day of April, 1927; the bond numbered 1194 shall constitute the third series and shall be payable the 1st day of April, 1928; the bond numbered 1195 shall constitute the fourth series and shall be payable the lst day of April, 1929; the bond numbered 1196 shall con- stitute the fifth series and shall be payable the lst day of April, 1930; the bond numbered 1197 shall con - stitute the sixth series and shall be payable the lst day of April, 1931; the bond numbered 1198 shall con- stitute the seventh series and shall be payable the 1st day of April, 1932; the bond numbered 1199 shall consti- tute the eighth series and shall be payable the 1st day of April, 1933; the bond numbered 1200 shall consti- tute the ninth series and shall be payable the 1st day of April, 1934; the bond numbered 1201 shall con- stitute the tenth series and shall be payable the let day of April, 1935. Said bonds shall bear interest at the rate of 5 per cent per annum, which interest shall be payable semi- annually, in accordance with the terms of the coupons thereto at- tached; and said bonds shall be pay- able out of the proceeds of the spe- cial assessment levied for said im• provemnt. Both principal and inter- est shall be payable at the office of the City Treasurer in the City of Dubuque. Said bonds shall be sub- stantially in the following form: No. 1191 to 1201. Series No CITY OF DUBUQUE Bond. The City of Dubuque, in the State of Iowa, promises to pay as herein- after mentioned to the bearer here- of, on the first day of April, A. D. 19 ; or any time before that date at the option of the City the sum of One Hundred Dollars with interest thereon at the rate of 5 per cent per annum, payable on the presentation and surrender of the interest cou- pons hereto attached, both interest and principal are payable at the of- fice of the City Treasurer in the City of Dubuque in the State of Iowa. This bond is issued by the City of Dubuque pursuant to and by virtue of Chapter 311 of the Code of Iowa, 1924, and in accordance with a reso- lution of the City Council of said City, duly passed on the 18th day of January, 1926. This bond is one of a series of 11 bonds, 10 for $100.00 each and numbered from 1191 to 1200 inclusive and one for $91.59, numbered 1201, all of like tenor and date, and issued for the purpose of constructing of a Sanitary Sewer in Woodworth Street from Lowell Street to Cottage Place, and in Cot- tage Place from Woodworth Street to about 300 feet east, and in Cot- tage Place from Woodworth Street to Abbott Street, and in Abbott Street from Cottage Place about 200 feet south, and described in said resolution; which cost is assessable and levied along said improvement, and is made by law a lien on all abutting or adjacent property, and payable in ten annual installments, with interest on all deferred pay- ments at the rate of five per cent per annum, and this bond is payable only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified and re- cited that all the acts and condition and things required to be done prec- edent to and in the issuing of this series of bonds, have been done, hap- pened and performed in regular and due form as required by said law and resolution; and for the assess- " ments, collections and payment here- on of said special tax, the faith and diligence of said City of Dubuque are hereby irrevocably pledged. In witness where - 5f the City of Du- buque by its City Council has caused this bond to be signed by its Mayor and countersigned by its City Clerk, with the seal of said City affixed this 18th day of February, 1926, and has authorized the use of their fac- simile signatures to the interest coupons hereto attached. D. 19 , the City of Dubuque, Iowa, promises to pay to the bearer, as 26 Special Session, January 18th, 1926 provided in the Bond, the sum of at the office of the City Treasurer, in the City of Dubuque, being months' interest due that day on its Improvement Bond No dated 192 Countersigned: Mayor. Be it further resolved that the Mayor and City Clerk be and they are hereby instructed to cause said bonds to be prerared and when so prepared to execute said bonds; ara that the City Clerk be and he is hereby instructed to register said bonds in a book to be kept by him for that purpose, and to then deliver them to the City Treasurer who will also register them in a book to be kept by him for that purpose. Be it further resolved that the City Treasurer be and he is hereby in- structed to sell said bonds in the manner provided for in Section 845 of the Code of Iowa, the proceeds of said sale to be kept in a sepcial fund to be known as Sewer Fund. Be it further resolved that the in- terest coupons attached to the bonds be signed with the fac- simile signa- ture of the mayor and countersigned with the fac- simile signature of the City Clerk. A copy of the General Service Rules of the Interstate Power Com- pany, governing the sale and deliv- ery of electrical energy, which are on file in all the Company's offices, and which said Company asks to be made a part of the City's records and placed on file. Heim relative to the reducing the values on lots in Fairmont Park Addition, for the 1925 tax, referred to the City Coun- cil by the Board of Supervisors for their action and to report back to the said Board, being Lot 6, Lots 13 to 45 inclusive, Lots 61 and 64 in- clusive, Lots 85 to 227 inclusive, and claiming that said lots are of very little value. Said lots are valued for taxation purposes at around $7,500.00 and were purchased by the owner for $4,000.00 about a year ago. He claims further that $3,000.00 actual value would be an outside figure for same, making a taxable value of $750.00 and hereby asks that the Treasurer be instructed to receive the tax on a basis of $750.00 taxable value, and that the balance of the 1924 taxes be cancelled and the Au- ditor be instructed to carry the valu- ation on the books for 1925 tax at $3,000.00 actual value and $750.00 taxable value.
