At a session of the City Council
held February 10th, 1926, the petition
of Edward Milligan asking to redeem
his property sold to the City at tax
sale was referred to the City Man-
ager, Engineer and Clerk, the Clerk
to look up record of the action taken
at a previous meeting on a petition
filed by Mr. Milligan on this matter.
The Clerk reports that the assess-
ment was levied against this prop-
erty for the construction of a sani-
tary sewer in West 17th Street, De-
cember 20th, 1921, a remonstrance
was filed against this assessment by
property owners along said street,
signed by Edward Milligan, W. F.
Neuman et al. On motion and vote
the remonstrance was received and
filed at said meeting of December
20th, 1921.
The Clerk was instructed to notify
Mr. Milligan relative to this report.
No further action was taken by the
Council at this time.

the regular session of the City Coun-
cil for the transaction of such busi-
ness as may regularly come before
the meeting.
Petition of H. R. Thill protesting
against the proposed vacation of the
alley running on Cora Street a dis-
tance of 120 feet, east of Grandview,
abutting Lots 13- 14 -15, Stewart's Sub.
Councilman Brede moved that; the
Council view the grounds. Seconded
by Councilman Melchior. Carried by
the following vote:

Notice of claim against the City of
Dubuque, in the sum of $5,000.00,
filed by Henry C. Winders, on ac-
count of person injuries sustained by
falling on an icy sidewalk January
26th, 1926, at 909 Spruce Street,
whereby he fractured the patella and
otherwise lacerated and bruised
thigh, hip and other parts of his
body.

petition he referred to the City Soli-

that on account of a misunderstand-
ing he failed to make the first pay-
ment for the construction of a sani-
tary sewer in the Southern Avenue
District, and he hereby asks that he
be allowed to make these payments
on the installment plan. He also
petitions that the assessment be re-
duced, stating that it is more than a
25 per cent valuation of the property.
The number of the lot is 29, on Val-
ley Street, assessed for $79.41.

Petition of Mrs. Chris Ingwerson
stating that she is the owner of Lot

11 and of the easterly 5 feet of Lot
10 in Porter's Add. A special asess-
ment for the improvement of Semin-
ary Street levied November 23rd,
1893, was levied and the records
show that it was not paid. The ab-
stract shows that this lot was sold
on December 5th, 1899, for taxes of
1898 and .conveyance made by the
City of Dubuque December 4th, 1907,
and said deed is recorded in book 69,
TL page 336. An attempt was made
to sell and on July 8th, 1921, this lot
was sold to the City of Dubuque for
the special assessment above men-
tioned. The County Auditor's and
Treasurer's books report it as Lot
11, but the City Treasurer's Bonded
Special book reports it as Lot 10.
The sale book for 1921 does not show
the sale. The petitioner hereby re-
quests the cancellation of said sale
certificate as it is of no value and -
only a source of annoyance.

taining 17.87 acres, used entirely for
agricultural purposes. They hereby
ask that the said property be ex-
empted from certain levies as pro-
vided for in Section 6210 of the Code
of 1924.

Petition of James H. Barry stating
that last fall in making his payment
on sewer and water connections, on
South Grandview Avenue, he was un-
der the impression that he was pay-
ing on the sewer and street also. He
was informed at the County Treas-
urer's office that the entire amounts
for the sewer and street improve-
ments are due this March. Inasmuch
as this was a misunderstanding on
his part, he hereby asks that he be
granted permission to pay the assess-
ments on the installment plan.

the prayer of the petition be granted.

Gentlemen:
The petition of Margaret Hansen
asking for a reduction on Lot 7,
Loetscher & Trueb's Subdivison, has
been referred to me for examination
and report. As you remember the
Board of Supervisors had this matter
before them and recommended a re-
duction of the actual valuation from
$2,800 to $1,400, which would mean
an agreement to accept 50 per cent
of the tax as levied.
I have examined into the condition
of this petitioner, and find that she is
entirely worthy of consideration by
your honorable body. Her husband
is at home suffering hopelessly from
tuberculosis. She has three children,
two of them are of school age and
the other helps earn a little money.
She is a wash woman and the earn-
ings of herself and her daughter
amount to $80.00 a month. Out of
that, she pays $35.00 a month on a
home which she bought and upon
which there is a mortgage of more
than $3,000. She has a very heavy
doctor bill and she is trying to take
care of her husband without any ex-
pense to the County and at the same
time save her home out of the small
income which she has.
I thought I would advise you of
these facts so that you could deter-
mine what the tax should be.

ment of the assessments levied
against their respective properties
for the sewer in Overview Court, re-
ferred to the City Solicitor at a pre-
vious meeting.
The Solicitor reports that he sees
no reason why this cannot be done,
and he recommends that the assess-
ment roll be changed so as to dis-
tribute the sum of $362.50 upon the
lots of Mr. Jones, and the balance of
$1,615 be divided equally among the
lots of Mrs. Ilg, Mr. Buettell and Mr.
Stampfer, so that each of these three
parties be assessed the sum of $417.50
with interest that has accumulated.
Further that these parties should be
given the privilege to pay these as-
sessments on the installment plan.
He suggests that the Engineer re-
figure these assessments as stated
upon the Treasurer's books and after
the same is rearranged the petitioner
be notified.

Council and stated that he is the
owner of Mineral lot number 14 com-
prising 10.85 acres and is used for

matter be referred to the City So-
licitor for investigation and report.

Frank Smith addressed the Coun-
cil stating that he is the owner of
property situated directly back of
the Washington Junior High School
on the street formerly called South
Street, that when the School was
built several years ago the grads
on this street was c1u:nge,. +, and that
since then he has had trouble with
the water, when it rains heavily the
water off of Grandview Ave. and
Fremont Street overflows his prop-
erty and runs into his cellar, and
does damage to ' his property. He
states further that he has put in
several complaints to the Council,
but there never was any action tak-
en by said Council. He hereby asks
that something be done to relieve
this situation.

matter be referred to the City Man-
ager and Engineer for investigation
and report. Seconded by Council-
man Melchior. Carried by the fol-

DUBUQUE FOR FISCAL YEAR, 1926.
(OFFICIAL NOTICE)
The following budget of expenditures for the fiscal year of 1926, on
`.he basis of the expenses for the several departments of the City of Du-
buque has been submitted by the City Manager to the City Council, and
such budget has been adopted by the City Council as its budget for the
fiscal year 1926. This budget will be considered for final adoption by the
City Council at a special session to be held in the council chamber of the
City Hall on the 26th day of March, 1926, at 4:30 o'clock p. m. Any tax
payer objecting thereto or protesting to the same or to any item thereof,
Dr to any omission therefrom, shall present his objections to the City
Council on or before said date.

Resolution of the City Council of the
City of Dubuque
Be it resolved by the City Coun-
cil of the City of Dubuque that a
budget of estimated expenditures for
the fiscal year, 1926, as prepared and
submitted by the City Manager be
and the same is hereby directed to
be placed on file with the City
Clerk of the City of Dubuque for
public inspection for a period of
two weeks the same to be further
taken up and considered for final
adoption on the 26th day of March,
1926.
Be it further resolved that said
Budget of estimated expenditures
for the fiscal year, 1926, as submit-
ted by the City Manager be ap-
proved and adopted as the City
Council's budget for said fiscal year
and the Clerk is hereby directed to
publish said budget in the official
newspapers of the City of Dubuque
for two weeks, as provided by law.
Be it further resolved that this
Council meet in special session for
the purpose of finally considering
said budget and hearing any objec-
tions that may be filed thereto and
making any corrections therein or
omissions therefrom at 4:30 o'clock
P. M. on the 26th day of March,
1926 in the Council Chamber of the
City of Dubuque.

712 assessed for $128.00 for same
sewer. These lots were purchased
by the City at a tax sale, the lot
number 9 was purchased in 1923 for
two assessments, $13.41 and $17.00
Dec. 3rd, 1923. Lot 4 was purchased
for $134.04, this includes interest and
costs. She states that she will re-
deem these lots, but asks the City
Council to reduce the assessments
claiming that they are assessed
much too high.

ial Games of America, State of
Iowa, Borough No. 1, stating that
they are heartily in favor of having

Hall, no effort nor money should
be spared in restoring the City Hall
to its original beauty, without stuc-
co or paint. The communication

tion of Such Inspector.
Be it resolved by the City Council
of the City of Dubuque that there
be and there is hereby created the
office of Municipal Inspector of boil-
ers, which office shall be conducted
in connection with the office of
Building Commissioner.
Be it further resolved that the
compensation to be paid such inspec-
tor shall be paid from Lees to be
charged for the inspection of boilers
by any person, firm or corporation
engaging .the service of such inspec-
tor and this shall be the only com-
pensation paid to such inspector.
Be it further resolved that the
duties of such inspector 'shall be to
inspect such boilers as require in-
spection under the A. S. M. E. Boil-
er construction code and to furnish
to the persons, firms or corporations
for whom inspections are made such
data as indicates the method and
form of inspection and the approval
or disapproval of boiler construction.
This Resolution being urgent and
of immediate importance shall be in
force and effect from and after its
passage and adoption by the City
Council.

want to lease it or rent it to some-
body who does not intend to use it

the board to remain on your prop-
erty under the conditions stated;
permit us to remove it, if we want
to, following 30 days notice to you;
and you agree that the boards shall
remain our property.

Council of said City, bearing inter-
est at the rate of 5% per annum,
payable semi - annually; and $200,-
000.00 of which become due between
the years 1937 and 1943, both years
inclusive, and bear interest at the
rate of 4% per cent per annum pay-
able semi - annually; and $125,000.00,
of which become due between the
years 1937 and 1944, both years in-
clusive and bear interest at the rate
of 4% per cent per annum, payable
semi - annually; and
Whereas, By the terms of the Or-
dinance providing for the issuance
of said bonds, it is necessary to cre-
ate a Sinking Fund for the purpose
of paying principal and interest of
said Bonds as the same respectively
mature and for no other purpose;
now therefore,
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That for the purpose
of paying principal and interest of
water works bonds heretofore issued
by appropriate proceedings of this
Council, and for no other purpose,
there be and there is hereby created
a Sinking Fund to be known as
Water Works Sinking Fund.
Section 2. That immediately upon
the passage and adoption of this Or-
dinance there shall be deposited in
said Sinking Fund from funds now
available in the Water Works De-
partment the sum of $11,000.00, and
thereafter they shall be deposited
monthly from the current revenues
of said Water Works Department a
sum not to exceed $2,700.00; pro-
vided, however, that should the
earnings of said Department at any
time warrant the depositing of a
larger amount into the Sinking Fund
than the amount herein provided for,
the City Council may, by the adop-
tion of a Resolution therefor, direct
the payment of such additional sums
into said Fund as may be determined
upon, the intention hereby being to
maintain the Sinking Fund in such
a condition that all principal and in-
terest of the bonds will be paid
therefrom at maturity without the
levy of a special tax therefor.
Section 3. That all moneys re-
maining in said Sinking Fund and
not needed for the payment of cur-
rent interest or the principal of
bonds shall be temporarily invested
in interest bearing securities con-
sisting of either Government, State
or Municipal Bonds and the interest
accruing thereon, when collected.

Fund.
Section 4. That for the purposo
of supervising the distribution and
investment of the funds of said Sink-
ing Fund, there is hereby appointed
a Committee which shall consist of
the City Manager, City Auditor, City
Solicitor and the Superintendent of
the Water Department.
Section 5. That when all of the
bonds shall have been retired and in
the event that there should be re-
maining a surplus in said Sinking
Fund, then said surplus shall be
transferred to the general fund of
said Water Department and said
Sinking Fund shall cease to be and
discontinued.
Section 6. This Ordinance, being
deemed urgent and of immediate
necessity, shall be in force and ef-
fect from and after its final pass-
age and adoption by the City Coun-
cil and publication, as provided by
law.

Julien Avenue caved in shortly af-
ter the street was improved some
years ago, that he was assessed for
the resetting of same, which amount-
ed to $16.62 and that his property

• 1923 for the above amount, which
amounts to date with interest and
penalty to $21.52, he hereby asks
that he be allowed to redeem his
property, that he is willing to pay
the original assessment and inter-
est to date, and asks that the pen-
alty be deducted.

WHEREAS, the City Council o f
the City of Dubuque has this day
met in special session for the pur-
pose of canvassing the vote cast at
the regular Municipal election held
on the 29th day of March, 1926, at
which three Councilmen and one
Park Commissioner were voted up-
on; and
WHEREAS this is the next day
after said election; and
WHEREAS, said Council, sitting
as a Board of Canvass, has can-
vassed the vote cast at said election
for Councilmen and Park Commis-
sioner and the result of said elec-
tion having been determined;
THEREFORE, it is resolved and
publicly declared that a majority of
the votes cast resulted in the elec-
tion of John H. Maclay, William H.
Meuser and Earl Yount, for Coun-

promotion of baseball in Dubuque in
order that this sport may be encour-
aged and that Dubuque may receive
its full measure of benefit which na-
turally comes to a City having a
live well managed cclub.
Be it further resolved that the
Mayor be and he is hereby author-
ized to enter into a lease with Fred
Leiser, the owner of the Dubuque
Baseball Club, for a period com-
mencing April 1, 1926 and ending
September 15, 1926, and from April
1, 1927 to Sept. 15, 1927, for the
use of the Municipal Athletic field
upon such terms and conditions as
will result in mutual advantage to
the City of Dubuque and the owners
of said Club and return said lease
to this Council for its approval.
