Be it resolved by the .City Coun-
cil of the City of Dubuque that it is
deemed advisable to lend its assist-
ance in so far as possible to the
promotion of baseball in Dubuque in
order that this sport may be encour-
aged and that Dubuque may receive
its full measure of benefit which na-
turally comes to a City having a
live well managed cclub.
Be it further resolved that the
Mayor be and he is hereby author-
ized to enter into a lease with Fred
Leiser, the owner of the Dubuque
Baseball Club, for a period com-
mencing April 1, 1926 and ending
September 15, 1926, and from April
1, 1927 to Sept. 15, 1927, for the
use of the Municipal Athletic field
upon such terms and conditions as
will result in mutual advantage to
the City of Dubuque and the owners
of said Club and return said lease
to this Council for its approval.

appointed as Mayor of this Council
for the ensuing term. Seconded by

officers and employees who are now

and appropriation Ordinance hereto-
fore adopted by such Council.

Petition of John Vogt, stating that

Place. That the lot was purchased

al assessment and 5 per cent in-
terest accrued, and the penalty to
be cancelled.

Summer Hill Add. That on August
18th, 1925 there was levied against
this lot for the improvement of
South Grandview Ave. an assess-
ment of $453.55, that at the time
the assessment was due she was
unable to pay this assessment, ow-
ing to unemployment, and she here-
by asks the Council to allow her to
pay the assessments due to date
with interest, and the balance on the
installment plan.
Councilman Maclay moved that the
prayer of the petition be granted
and the Treasurer be so instructed.

Report of the City Solicitor on the
case of the I. C. R. R. Co. vs. City
of Dubuque, equity 21,917 which
was involved in this appeal paid
according to the agreement made at
that time. The costs in this case
amount to $9.15 for which amount
the City Solicitor recommends a
warrant to be drawn in favor of
Robert Marshall, Clerk of the Dis-
trict Court.

the recommendation of the. City So-
licitor be approved and the Auditor
be instructed to draw a warrant for
this amount in favor of Robert Mar-

Mayor Melchior read the call and
stated that this meeting is called
for the purpose of adopting a reso-
lution of condolence on the death
of Ex -mayor Chris. Berg and a reso-
lution of condolence on the death of
Ex- mayor Daniel Haas, and any
other business that may come be-
fore the Council.
Resolution of condolence on the
death of Ex -mayor Chris Berg pre-
sented.
On the occasion of the death of
Hon. C. H. Berg, the City Council of
Dubuque desires to express that ap-
preciation of his useful life which
the citizens of this community gen-
erally entertain.
Mr. Berg was a resident of Du-
buque and vicinity for practically the
entire active period of his life of 85
years. He was a gallant soldier in
the Civil War, and, coming to Du-
buque from Galena after his period
of military service, took up his trade
of printer and became and remained
to the end of his career one of the
successful business men of our city.
He was president of the Union Trust
& Savings Bank for many years and
until his death.
Mr. Berg's attractive personal
qualities, his mildness, kindness and
courtesy, drew the attention of his
fellow citizens to his eligibility for
public life. He was chosen alder-
man from the Fourth Ward in 1896
and served as chairman of the City
Council Committee on Finance in a
difficult period with such demonstra-
tion of ability that in 1898 he was
chosen Mayor. He served in this
latter position for four terms, or
from 1898 to 1906, and his admin-
istration was distinguished by care - ,
ful, capable and economical manage-
ment of the financial affairs of this
municipality and by genuine regard
for the interests of the taxpayers.
Following his retirement from the
mayoralty, Mr. Berg resisted every
appeal for his return to public life,
but continued his activity on behalf
of his comrades of the Civil War and
his interest in their affairs. He was
for many years, and until his death,

commander of the Hyde Clark Post,
Grand Army of the Republic, of
which he was a charter member, and
this body and this community sin-
cerely sympathize with his comrades
in the loss of their devoted and be-
loved leader.
Be it resolved by the City Council
of the City of Dubuque that the sen-
timents expressed in this resolution
be made a matter of record 111 the
permanent council proceedings of
this Council and that a copy hereof
be sent to the bereaved family of
said deceased.

Resolution of condolence on the
death of Ex -mayor Daniel Haas pre-
sented.
The City Council of Dubuque re-
cords with regret the death of Hon.
Daniel J. Haas, former mayor of the
City of Dubuque and former member
of this city's board of aldermen.
Mr. Haas entered the public life
of this community as alderman -at-
large and served in this capacity
with such usefulness and fidelity
that his election to the mayoralty
followed. He retired from this posi-
tion with an honorable record of
public service to resume his profes-
sion of pharmacist which engaged
his attention for the remainder of
his life. His was the career of which
America affords so many examples,
that of the young emigrant appreci-
ating the opportunities afforded by
our country and struggling unaided
to improve himself until he obtained
honorable recognition in business
circles and also in public life. His
unpretentious demeanor, and his
democracy of spirit, evidenced in h>$
kindly consideration for all, begot
for him the large degree of favor he
enjoyed in private business and in
public affairs.
Resolved by the City Council of
the City of Dubuque that the senti-
ments expressed in this resolution
be made a matter of record in the
permanent council proceedings of
this Council and that a copy hereof
be sent to the bereaved family of
said deceased.

personal injuries sustained by Ma-

Ordinance No. 172.
An Ordinance amending an Ordi-
nance entitled, "An Ordinance
regulating billiard and pool sa-
loons in the City of Dubuque, and
providing a penalty for violation
hereof," said Ordinance having
been heretofore passed and adopt-
ed on June 5, 1922.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That an Ordinance en-
titled "An Ordinance regulating Bil-
liard and Pool saloons in the City
of Dubuque, and providing a penalty
for violation hereof," the same hav-
ing been heretofore adopted on the
5th day of June, 1922 be and the
same is hereby amended by adding
to section four thereof following the
period at the end of the section, the
following:
"Provided, further, that the City
Council may authorize the erection
and maintenance of a partition sep-
arating a business of one kind from
the room in which a pool or billiard
saloon is being conducted whenever
it is made to appear by the party
applying for such a permit that all
of the provisions of this ordinance,
except as herein modified, can be en-
forced and compiled with. When-
ever such a permit is granted the
party to whom the same is given
shall construct such partition in
such a manner and of the materials
that the Council may prescribe and
failing to do so shall operate as a
revocation of such permit. Any par-
tition erected pursuant to a permit,
as herein provided for, shall be tak-
en down and removed whenever any
of the provisions of the ordinance
relating to the regulation of billiard
and pool saloons, as hereby amend-

ed, shall be violated or whenever
the Council shall deem it advisable
to prohibit absolutely the mainten-
ance of partitions of any kind in
places of this character."
Section 2. This Ordinance shall
be in force and effect ten (10) days
from and after its final passage and
adoption by the City Council and
publication as provided by law.

Petition of Wm. Werdehoff, stat-
ing that he is part owner of the Mer-
chants Billiard Parlor, No. 326 Main
Street, and he hereby asks permis-
sion to construct a partition between
this Billiard Parlor and a Barber
Shop which he also operates at such
location. Mr. Werdehoff was in-
formed to submit request with plan
of said partition and material to be
used, to Council. No further action
taken at this time.
Report of City Manager on vacan-
cy of the Fire Department. Stating
that Wm. E. Blaser has been act-
ing on said Department as substi-
tute, and he hereby recommends on
the recommendation of the Civil Ser-
vice Commission that Mr. Blaser be
appointed as a regular member of
the Fire Department.

The Traffic Ordinance was then
discussed ,to be taken up again at
the next meeting of the Council.
To the Honorable Mayor and Coun-
cil of the City of Dubuque:
Gentlemen: The case of Beutin
et al vs. City of Dubuque, Equity
21,825 was an appeal taken from the
levy of certain special assessments
for the construction of a main sew-
er and laterals in the Eagle Point
Sewer District. Many questions
were involved in this action and
among them was the objection that
the assessments were in excess of
25 per cent of the actual value of
the lots upon the date of levy. The
case came on for trial at this term
of Court and it was deemed advis-
able by the Council and myself, in
order to lessen the expense incident
to the trial of the case which ap-
parently would take considerable
time to dispose of to appoint a com-
mittee of disinterested citizens who
would act as appraisors of the in-
dividual lots and fix the value and
the assessment would be based up-
on one - fourth of such value. It was
agreed that three appraisors be ap-
pointed, one by the City, the other
by the plaintiffs in the suit and the
+bird by these two and the expense
incident to such appraisement to be
borne partly by the City and partly
by the Plaintiffs. This appraise-
ment was made and the valuations
fixed. The result of this appraise -
ment has been to decrease the valu-
tions of the lots and correspond-
ingly decrease the assessments, as
many of these lots were of little or
no value. After the appraisement
was made the Court made a finding
of fact and entered its decree there-
on fixing the valuations. the assess-
ments and Providing for the reduc-
tion therein. The valuations as
fixed and the assessments as reduced
are as follows:
Lot 1 McCraney's 1st Add. —Value
$40.00; assessment $10.00.
Lot 2 McCraney's 1st Add. —Value
$75.00; assessment $18.75.
Lot 3 McCraney's 1st Add. —Value
$125.00; assessment $31.25.

bond improvement fund credited

you will order the Auditor to draw
a warrant upon the general fund in

Mayor Melchior read the call and
stated that service thereof had been
duly made and accepted, and that
this meeting is called for the pur-
pose of considering for adoption the
Traffic Ordinance as amended, and
acting on any other business that
may come before the meeting.
Councilman Schrempf moved that
the rules be suspended for the pur-
pose of giving anyone present an
opportunity to address the Council.
Seconded by Councilman Maclay.

Frank B. Lacy, attorney for Auc-
tioneers at the Hopkin's Store, ad-
dressed the Council relative to the
license fee charged said Auctioneers
for selling out this stock. Claiming
that the fee of $25.00 per day is
exhorbitant, and illegal, and ..ie
hereby asks that the Council reduce
this fee.
Councilman Meuser entered and
took his seat at 4:40 P. M.

Petition of Mrs. Elizabeth Kep-
pler, referred to the Council by the
Board of Supervisors, asking that

lots 21, 22, 23 of Newberry and
Hale's Sub.

Legion, asking permission to have

Street, building destroyed by fire in
February, 1917, owned by Klauer Es-
tate; these walls were condemned
by this department in August, 1921.

Walls of St. Anthony's School, lo-
cated at the intersection of St. Am-
brose Street and Rosedale Avenue,
building destroyed by fire in Decem-

pose of considering for adoption of
Ordinance No. 173. An Ordinance
regulating street traffic in the City
of Dubuque; prescribing rules and
regulations for the use of streets,
alleys, boulevards and avenues by
motor and other vehicles; providing
a penalty for the violation of the
provisions hereof, designating this
Ordinance as the "Traffic Ordinance
of the City of Dubuque;" and repeal-
ing Ordinances No. 102 -122 and 125,
heretofore adopted by the City Coun-
cil of the City of Dubuque.
Councilman Schrempf moved that
this be considered the first reading
of the Ordinance. Seconded by
Councilman Maclay. Carried by the
following vote:

Mr. John Quinn representative of
the Dubuque Labor Congress, ad-
dressed the Council relative to the
. Canfield Hotel Annex, stating that
the contractor who is constructing
said building is violating the Build-
ing Code, he alleged that the con-
tractor is using bolts in the steel
frame work of the annex instead
of rivets as provided for in the code,
and hereby asks the Council to stop
work on said building unless the
Code is complied with.
Councilman Schrempf moved that
the matter be referred to the City
Manager, Engineer, and City Solicit-
or for investigation. Seconded by
Councilman Meuser. Carried by tha
following vote:

Captain Ryan of the Fire Depart-
ment reported to the Council, that
if the owners of the Princess Thea-
tre intend to feature vaudeville acts
in their theatre, they must comply
with the fire regulations, by install-
ing a two ply asbestos curtain,, and
direct exits from the balcony. H2
also stated that some of the other
theatres and schools where shows
are staged are not in conformity
with these regulations and ought to
be investigated.
Councilman Meuser moved that
this matter be referred to the City
Manager, Engineer, City Solicitor,
and Chief of the Fire Dept. for in-
vestigation. Seconded by Council-
man Maclay. Carried by the follow-
ing vote:

erty.

Stampfer et al addressed the Coun-
cil relative to a petition presented
to the Council objecting to .that part
of the Traffic Ordinance eliminating
the left hand turn at the Corner of
Main and 8th Streets. Petition was
signed by 40 business and profes-
sional men and women. No action
taken at this meeting of the Coun-
cil.
