Council met at 4:30 P. M.
Mayor Melchior stated that this is
the regular monthly meeting of the
Council for the transaction of such
business as may regularly come be-
fore the meeting.
Notice of publication, certified to
by the publisher, of the City Coun-
cil's intention to levy a special as-
sessment as provided by law to pay
for the making of gas connections
on the improvement of Race Street.
There being no remonstrance,
Councilman Yount moved that the
notice be received and filed. Sec-
onded by Councilman Maclay. Car-
ried by the following vote:

Resolved, by the City Council of
the City of Dubuque, that to pay
for Gas connections on the improve-
ment of Race Street from the north
property line of West 11th Street to
the south property line of Rose
Street, by Key City Gas Co., con-
tractor, in front of and adjoining
the same, a special tax be and is
hereby levied on the several lots,
and parts of lots, and parcels of
real estate hereinafter named, sit-
uate and owned, and for the several
amounts set opposite each lot or
parcel of real estate, as follows:

Resolution Awarding Contract
Whereas, proposals have been sub-
mitted by contractors for the con.
struction of a sanitary sewer in
West Eighth Street from the end of
the present sewer to a point 327
ft. west and Cook & Kean, contract-
or, has submitted the lowest bid for
the furnishing of all labor and ma-
terials and performing the work as
provided for in the plans and speci-
fications; now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
contract for the construction of a
sanitary sewer in West Eighth St.
be awarded to Cook & Kean and the
Mayor and Manager be and they are
hereby directed to execute a con-
tract on behalf of the City of Du-
buque for the complete performance
of said work.
Be it further resolved that this
resolution being deemed urgent and
of immediate necessity become ef-
fective from and after its passage
and adoption by the City Council.

file for one week for public inspec-

Claim of Wm. Hanten against the
City of Dubuque, on account of a
collision with Waterworks truck,
near the intersection of Bryant and
Dodge Streets, claiming $150.00 for
damage done to his automobile.

Petition of Dennis Meara claim-
ing that since the improvement of

duct estimated damages from his as-
sessment.
Councilman Maclay moved that
the petition be received and filed.

Petition of John J. McDonnell, ask-
ing that the money he had on de-
posit with the City of Dubuque in

will comply with the laws relative
to operating a soft drink parlor.

price for concrete is $2.17 per sq. yd.
The Engineer's estimate for this
work is $825.00.

Mrs. Farrell,. residing on Curtis
Street, addressed the Council rela-
tive to the assessment against her
property, lots 11 and 12 Bonson and
Stewart's Sub., for the improvement
of Curtis Street, stating that she
had neglected to make the first pay-
ment when due owing to the fact
that she could not very well afford
to pay it at that time and she here-
by asks that she be allowed to pay
the payments due to date with in-
terest and that the balance be spread
on the assessment book on the in-
stallment plan.
Councilman Maclay moved that
the prayer of the petition be granted
and the Treasurer be so instructed.

structing sidewalks.
In accordance with your instruc-
tions, bids were received for con-
structing concrete sidewalks along
various streets in the City of Du-
buque.
Only one bid was received, that of
Albert Becker whose bid is $0.159
per square foot.
I would respectfully recommend
that a contract be awarded to Albert
Becker for the construction of side-
walks as advertised.

Ordinance No. 179.
An Ordinance amending an Ordin-
ance entitled "Ordinance No. 107 ",
an Ordinance creating a Board of
October 4th, 1926
Examiners for plumbers, provid-
ing for the examination and li-
censing of plumbers; fixing the
fees for certificates and licenses:
and prescribing a penalty for do-
ing plumbing work or engaging in
the plumbing business without a
certificate or license by repealing
paragraph 802 of section 39 there-
of and enacting a substitute in lieu
therefor.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an Ordinance en-
titled "An Ordinance amending an
Ordinance creating a Board of Ex-
aminers for Plumbers, providing for
the examination and licensing of
plumbers; fixing the fees for certifi-
cates and licenses; and prescribing
a penalty for doing plumbing work
or engaging in the plumbing busi-
ness without a certificate or license
by repealing paragraph 802, section
39 thereof and said section be and
the same is hereby repealed.
Section 2. That in lieu of said
section hereby repealed that there
be and there is hereby enacted a
substitute therefore so that said sec-
tion and paragraph shall hereafter
read as follows:
"Par. 802. Section 39. Floor drains
in public or commercial garages
shall be intercepted before entering
any sewer by a suitable catch basin,
properly trapped. In all cases such
drain shall be connected into a
storm sewer when such a sewer is
available. Connections shall not be
made with a sanitary sewer except
and unless a storm sewer is not
available, which shall be determined
by the City Engineer.
Catch basin shall be constructed
of cast iron, cement, brick or other
material approved by the plumbing
inspector; they shall be water tight
and not less than two (2) feet deep
below the outlet pipe, and not less
than eighteen (18) inches in diam-
eter. The outlet shall not be less
than three (3) inches in diameter.
When it is impossible to install
catch basins having the dimensions
then such a catch basin may be used
as the plumbing inspector may ap-
prove.
Sediment, grease or oils, which
may collect in catch basins must be
removed often enough to prevent ob-
struction of drainage pipes."
Section 3. This Ordinance shall
be in force and effect ten (10) days
from and after its final passage and
approval and publication as provid-
ed by law.

Resolution
Be it resolved by the City Council
of the City of Dubuque, that,
WHEREAS, Chapman, Cutler and
Parker, attorneys at law, Chicago,
Illinois, were, by this Council, en-
gaged to make an examination of
and prepare an approving legal
opinion upon proceedings taken by
this Council in the issuance of $275,-
000 improvement bonds and $75,000
grading bonds of the City of Du-
buque; and
WHEREAS, such opinion has been
rendered and the bonds have been
sold and the purchasers have paid
the City of Dubuque the price bid
therefor including a premium and
it is now proper that said attorneys
be paid for their services: Now,
therefore,
It is ordered that the bill of Chap-
man, Cutler and Parker, in the sum
of $350.00, be paid and the Treasurer
is hereby directed to pay the same
to said Chapman, Cutler and Parker
out of the premium which the City
received from the purchaser of said
bonds.
Be it further resolved that the ap-
proving opinion which is hereto at-
tached be filed by the City Clerk
with the proceedings heretofore
taken by this Council.

30th, 1926, by reading notice to him
and giving him a true copy of the
resolution, ordering said building to
be removed by October 1st, 1926,
or cause shown why said building
should not be removed, repaired or
reconstructed, and nothing having
been done in the matter, Councilman
Meuser moved that the matter be
referred to the Building Commission-
er, Health Officer and the Chief of
the Fire Department, to investigate
and report back to the Council.

states, to the end of making the
bridges state owned and free of toll.

RESOLUTION calling a Special
Election for submission of ques-
tion of creating a department of
public docks.
Whereas, it appears the City of
Dubuque, in the County of Dubuque
and State of Iowa, should develop
and improve its harbor and water
front on the Mississippi River, and
it is to the advantage of said City
Special Session, October 14th, 1926 361
to avail of the provisions of Chapter
303 of the Code of Iowa, 1924;
Now, therefore, be it resolved by
the City Council of the City of Du-
buque, Dubuque County, Iowa, as
follows:
Section 1. That in the judgment
of the City Council of the City of
Dubuque, it is deemed expedient to
create a department to be known as
the department of public docks, in
the manner authorized and provided
by Chapter 303 of the Code of Iowa,
1924.
Sec. 2. That a special election be
and is hereby called to be held in
said City on the second day of No-
vember, 1926, from seven o'clock A.
M. until seven o'clock P. M., at
which election there shall be sub-
mitted to the qualified electors of
said City to be by them voted upon,
the question of creating a depart-
ment of public docks in and for said
City.
Sec. 3. That said election shall
be held in the several voting pre-
cincts of said City, the boundaries
of which shall be as delimited by
Ordinance Number 159 of said City.
The polling places within the respec-
tive voting precincts shall be as fol-
lows:
FIRST PRECINCT: No. Five En-
gine House, South Grandview Av-
enue.
SECOND PRECINCT: Washington
Junior High School, Grandview
Avenue and Fremont Street.
THIRD PRECINCT: F r a n k l i n
School, Bluff and Jones Streets.
FOURTH PRECINCT: Court House,
Seventh and Central Avenue.
FIFTH PRECINCT: Lincoln School,
West Fifth and Nevada Streets.
SIXTH PRECINCT: Irving School,

of real estate subject to assessment
for said improvements and file the

Clerk shall upon receipt of such plat
and schedule publish the notice of
the Council's intention to levy spe-
cial assessments therefor, as re-
quired by law.

Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Engin-
eer be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provements and file the same in the
office of the City Clerk subject to
public inspection and said Clerk
shall upon receipt of such plat and
schedule publish the notice of the
Council's intention to levy special
assessments therefor, as required
by law.
Be it further resolved that said

Petition of the Trade Home Shoe
Stores, asking permission to put up
a display sign, in front of their store
at 1005 Main Street, stating that the
sign will extend over the sidewalk,
with brackets complete, six feet and
2 inches, which is 14 inches more
than provided for in the Ordinance.
They state that they have a chain
of stores and have a uniform sign
which they have contracted for and
the signs are all ready to put up
in different localities and this sign
will be a total loss to them if they
will not be allowed to put it up.
Mr. Frank Piekenbrock addressed
the Council relative to this matter
and asked the Council to deviate a
little from the rule and allow this
sign to be put up.

AGREEMENT
ARTICLES OF AGREEMENT are
hereby entered into by and between
the City of Dubuque, a municipal
corporation of Iowa, as party of the
first part and Rudolph Jones, as
party of the second part, with the
following terms and conditions to
wit:
WHEREAS, Rudolph Jones, is the
owner of Lot 2 of the Sub. of Min-
eral Lot 43 and the Sub. of Lot 3
of the Sub. of Lot 44, Dubuque, Du-
buque County, Iowa, and proposed to
subdivide the same into building lots
numbering from one (1) to seven-
teen (17), both inclusive abutting
Overview Court and, has petitioned
the City Council of the City of Du-
buque to lay and extend water mains
through said property in a street lo-
cated thereon.
WHEREAS, the City Council has
granted said petition and agreed to
extend said mains, as described; and
WHEREAS, the cost of making
such extensions has been estimated
to be $960.00, now therefor
IT IS AGREED, that said City of
Dubuque will extend said water
mains, as stated, and pay the cost
thereof, and in consideration of the
extensions of said mains and the
payment of such cost by the City,
said Rudolph Jones does hereby
agree:
1st. To pay to the City of Du-
buque, at the office of the Water
Department, the sum of $48.00, per
annum, payable semi - annually, as in-
terest at the rate of 5% upon $960.00,
the amount which has been estimat-
ed to be the actual cost of the orig-
inal placing of the water mains in
said street.
2nd. As security for the faithful
performance of this contract and the
payment of said sum, there shall be
deposited with this contract and at-
tached thereto and made a part here-
of, an approved commercial or U. S.
Government bond in the sum of
$100.00, which bond shall be forfeit-
ed to said City of Dubuque upon de-
fault in payment of said interest or
any part thereof when due, and said
City of Dubuque shall be authorized
to convert said bond into cash for
the purpose of applying the proceeds
thereof upon the payment of said
interest.
3rd. In addition to said bond, and
as further security for the payment
of said interest, he does hereby per-
sonally obligate himself to pay said
interest when due, and to that end
he does hereby bind himself, his
heirs, executors, administrators and
assigns for the whole period of this
contract.
The City of Dubuque further
agrees that whenever any lot along
the line of said extension shall be-
come a user of water the interest
herein stated shall be reduced in the
sum of $3.00, for each lot or one
sixteenth of the whole amount, until
all of said lots have become users
of the water or until such a time as
the option herein provided for shall
be exercised.
It is mutually agreed between the
parties that said Rudolph Jones
shall have the right and privilege
under this contract at any time to
repay to said City of Dubuque the
original outlay for the laying of said
mains and thereby discharge the ob-
ligation to pay the interest herein
provided for, and for that purpose
the original cost as shown by the'
records in the Water Department
shall be taken as conclusive thereof.
The intention hereof being that
should said Rudolph Jones desire to
be relived from the payment of in-
terest herein provided for he shall
have the right to pay the cost of the
laying of the main and the amount
which he will be required to pay
will be the difference between the
total cost and the cost of laying said
mains in proportion to the number
of linear feet of said lots which are
not the users of water.
Should this option be exercised, it
is further agreed that when any of
such lots become users of water
then there shall be returned to said
Rudolph Jones such an amount as
the total cost of the improvement
bears to the number of linear feet
of the lot which has become a user
of water, such cost being based up-
on the cost of laying said water
mains per linear foot.
It is further agreed that Rudolph
Jones shall be entitled to the inter-
est for dividends accumulating on
the bond herein provided for and
said bond shall be returned to him
when this contract has been fully
performed and all of its provisions
complied with.
This contract is executed by the
Mayor and Clerk of the City of Du-
buque under authority from the City
Council.

J. C. Maclnerny, Building Inspect-
or, explained that Mr. Hartig, owner
of the store at 756 Main Street, took
out the permit and that he under-
stood that Albert Ney, carpenter
contractor, had the contract and
that he was under the impression
that Watkins was working under
Mr. Ney who has a contractors bond
filed with the City.
Councilman Schrempf moved that
if Mr. Watkins is contracting and
engaging men to work under him, he
is considered a contractor and must
file a contractors bond with the City.

An Ordinance vacating McClain
Street in the City of Dubuque, Ia.
Whereas, McClain Street was
heretofore platted as a public street
in the City of Dubuque extending
from Grandview Avenue to South
Booth Street but, since the date of
platting, said street has never been
opened or used for public travel,
and, as now located the same is not
needed for use by the public.
Be it, therefor, ordained by the
City Council of the City of Dubuque:
Section 1. That McClain Street
extending from Grandview Avenue to
South Booth Street be and the same
is hereby vacated.
Section 2. That the City Clerk be
and he is hereby directed to cause
this ordinance to be duly filed with
the County Recorder of the County
of Dubuque, Iowa, after the same
has been fully and finally adopted
and approved by the Council.
Section 3. This ordinance shall
be in force and effect ten (10) days

Sousa's Concert Band addressed the
Council and invited them to come
and hear the concert which said

tickets.

To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: On January 17th, 1926,
Mrs. Wm. Aird sustained serious in-
juries by falling upon an icy side-
walk at the corner of West Fifth
Street and Paulina Street. The re-
sult of this fall was to prevent Mrs.
Aird from attending to her ordinary
housework duties, as well as contin-
uing in her employment and required
her to procure the services of physic-
ians to attend to her injuries. Mrs.
Aird will accept the sum of $300.00
in settlement of her claim which is
approximately the amount of her ex-
pense. In view of the injury and
the condition of the place where it
occurred I would respectfully recom-
mend that this settlement be made.
Some time ago Peter Kunnen ad-
dressed the Council with reference
to injuries sustained by his daugh-
ter, Dolores Kunnen at 29th and Pin -
nard Streets, on January 26th, 1926.
She broke her left arm above the
wrist. The facts in this case are
familiar to the Council and upon
your advice I have secured an agree-
ment from Mr. Kunnen to settle the
claim for $100.00. If these settle-
ments are satisfactory to your Hon -
orable Body, I recommend that the
Auditor be instructed to draw war-
rants in favor of Mrs. W. F. Aird in
the sum of $300.00, and Peter A.
Kunnen in the sum of $100.00.

Mayor Melchior stated that this
is the regular monthly meeting of
the City Council for the transaction
of such business as may regularly
come before the meeting, and that
this date is also set for the purpose
of levying special assessments and
the issuing of bonds to pay for the
improvement of the following
streets, to -wit:
Race Street, Heeb Street, Roland
Street„ and West 3rd Street, also
levying assessments for the con-
struction of a sidewalk in front of
Lot 210, Union Add., and the mak-
ing of gas connections on the im-
provement of McCormick Street.
Notice of publication, certified to
by the publisher, of the City Coun-
cil's intention to levy a special as-
sessment and authorize the issuance
of bonds to pay for the improvement
of Race Street from the North line
of West 11th Street to the South
property line of Rose Street.
There being no remonstrance,
